Anthropometric Variation In California: A Study Of Native American Populations, Catherine R. Mahoney Jan 2008

Anthropometric Variation In California: A Study Of Native American Populations, Catherine R. Mahoney

Graduate Student Theses, Dissertations, & Professional Papers

Physical anthropologists study the patterns of human morphology to observe the influence of genetics and environment on cranial form. The following study compares cephalic and nasal index means from four Native American populations using modern statistical methods, including one-way ANOVA tests and Games-Howell comparison tests. The individuals used were of only Native American ancestry, over the age of seventeen when the data was collected, and were divided into male and female samples. The climatic conditions of each of the regions are compared to examine the relationship between the mean cranial and nasal indices and the environments in which the populations …

Fire In My Backyard: Place Meanings And Landowner Views On Fire And Fuels Management On The Kootenai National Forest, Mt, Michael Anthony Cacciapaglia Jan 2008

Fire In My Backyard: Place Meanings And Landowner Views On Fire And Fuels Management On The Kootenai National Forest, Mt, Michael Anthony Cacciapaglia

Graduate Student Theses, Dissertations, & Professional Papers

Federal land management agencies are currently striving to become more democratic and open to citizen participation in decision-making. Recently, the build-up of hazardous forest fuels and ensuing increase in high-intensity wildland fire events across the western U.S. has led to growing interest in integrating local communities and their views and interests into the planning process for fuel reductions projects. One way to investigate local perspectives and make them available to local fire management officers is through qualitative research into relationship to place and preferences for proposed management actions using in-depth interviews with landowners residing in the wildland-urban interface. This study …

Tracing Shakespeare’S Sea-Change: From The Tempest To The New York Times, Joshua L. Comer Jan 2008

Tracing Shakespeare’S Sea-Change: From The Tempest To The New York Times, Joshua L. Comer

Quidditas

An historical approach to the changing use of a Shakespearean phase, like “sea- change,” offers a case study in the long-standing power and evolving meaning of Shakespeare’s language. While all sea-changes today are not so major as those of which Ariel sang in The Tempest, the rich language of Ariel’s song has acquired a significant place in the history of American journalism.

Negotiating Reality With Anekdoty: Soviet Vs. Post-Soviet Humor Lore, Daniela S. Hristova Jan 2008

Negotiating Reality With Anekdoty: Soviet Vs. Post-Soviet Humor Lore, Daniela S. Hristova

Russian Language Journal

As a genre, anekdoty have been among the most popular oral narratives in the Soviet as well as post-Soviet era.2 Similar to other folkloric and literary genres, the post-Soviet social and linguistic liberalization has had an impact on Russian humor lore, but to a much lesser degree than it might seem on the surface. Since effective humor narratives impart laughter by way of reacting to significant sociopolitical phenomena, the changed economic and ideological reality in post- Soviet Russia fostered paradigmatic classes of anekdoty that feature new protagonists. The question, however, is whether what made a Soviet anekdot funny differs from …

Introduction To Volume 58 Jan 2008

Introduction To Volume 58

Russian Language Journal

It was the Russian linguist, Grigorii Vinokur, who first introduced the term “kul’tura iazyka” or “language culture” to Russian in his writings on the changes taking place in the Russian language in the aftermath of the Bolshevik Revolution (Kul’tura iazyka [Moscow 1929]). Loosely defined as language production at all ranges of the discursive spectrum, the term provided Vinokur with a useful heuristic for writing about language in flux in a manner that took into account not just the high-end linguistic production of belles-lettres, but also the everyday language use (and abuse) of more mundane, but equally influential sources – including …

Assessing Clinical Trial Eligibility With Logic Expression Queries, Deryle W. Lonsdale, C. Tutison, Craig G. Parker, David W. Embley

Faculty Publications

This paper introduces a system that processes clinical trials using a combination of natural language processing and database techniques. We process web-based clinical trial recruitment pages to extract semantic information reflecting eligibility criteria for potential participants. From this information we then formulate a query that can match criteria against medical data in patient records. The resulting system reflects a tight coupling of web-based information extraction, natural language processing, medical informatic approaches to clinical knowledge representation, and large-scale database technologies. We present an evaluation of the system and future directions for further system development.

Interpretive Sovereignty: A Research Agenda, Kristen A. Carpenter Jan 2008

Interpretive Sovereignty: A Research Agenda, Kristen A. Carpenter

In federal Indian law, the treaty operates as our foundational legal text. Reflecting centuries-old historical political arrangements between Indian nations and the United States, treaties remain vital legal instruments that decide dozens of legal cases each year. Yet, these treaties--originally drafted in English by the federal government, following negotiations with tribal representatives who usually spoke their own languages--present a number of ambiguities for contemporary courts. The dominant model of treaty interpretation is one in which judges interpret treaties in a manner they they believe to reflect Indians' understanding of treaty terms and, more generally, to promote the interests of Indian …

Garbage Pails And Puppy Dog Tails: Is That What Katz Is Made Of?, Aya Gruber Jan 2008

Garbage Pails And Puppy Dog Tails: Is That What Katz Is Made Of?, Aya Gruber

Publications

This Article takes the opportunity of the fortieth anniversary of Katz v. U.S. to assess whether the revolutionary case's potential to provide broad and flexible privacy protection to individuals has been realized. Answering this question in a circumspect way, the Article pinpoints the language in Katz that was its eventual undoing and demonstrates how the Katz test has been plagued by two principle problems that have often rendered it more harmful to than protective of privacy. The manipulation problem describes the tendency of conservative courts to define reasonable expectations of privacy as lower than the expectations society actually entertains. The …

The Measure Of Government Speech: Identifying Expression's Source, Helen Norton Jan 2008

The Measure Of Government Speech: Identifying Expression's Source, Helen Norton

Publications

States and other governmental bodies increasingly invoke the government speech defense to First Amendment challenges by private parties who seek to alter or join what the government contends is its own expression. These disputes involve competing claims to the same speech: a private party maintains that a certain means of expression reflects (or should be allowed to reflect) her own views, while a public entity claims that same speech as its own, along with the ability to control its content.

In suggesting a framework for approaching these problems, this Article starts by examining the theoretical and practical justifications for insulating …

Hearts, Minds, Hands: A Dream Team For Mental Health, Julianne Gold Brunson, Judy Molner, Miriam Nathan Lerner Jan 2008

Hearts, Minds, Hands: A Dream Team For Mental Health, Julianne Gold Brunson, Judy Molner, Miriam Nathan Lerner

Articles

Interpreting in a mental health setting with hearing staff members and deaf clientele, the ethical situations fly fast and furious, providing the interpreter with a wealth of war stories with which to regale neophyte students of this dynamic profession. Much has been written to improve the many and varied mental health services being extended to deaf populations. The most commonly described dyads are that of hearing therapist and deaf patient. However, consider the case of a deaf psychologist treating hearing clients. In this instance, the interpreter becomes the liaison between the deaf professional and the hearing patient. When an interpreter …

Jagannath's Saligram: On Bruno Latour And Literary Critique After Postcoloniality, Amit Ray, Evan Selinger Jan 2008

Jagannath's Saligram: On Bruno Latour And Literary Critique After Postcoloniality, Amit Ray, Evan Selinger

Articles

Bruno Latour has turned to Indian vernacular fiction to illustrate the limits of ideology critique. In examining the method of literary analysis that underlies his appropriation of postcolonial history and culture, we appeal to Edward Said's notion of "traveling theory" in order to discuss critically the aesthetic as well as political stakes of using the technology of the modern novel for the allegorical purposes that Latour has in mind. We argue that Latourian analysis fails to uphold its own rigorous aspirations when it reduces complex literary and cultural representation to universal allegory.

Reviewing The Author-Function In The Age Of Wikipedia, Amit Ray, Erhardt Graeff Jan 2008

Reviewing The Author-Function In The Age Of Wikipedia, Amit Ray, Erhardt Graeff

Articles

In "Reviewing the Author-Function in the Age of Wikipedia," Amit Ray and Erhardt Graeff examine how wiki technology challenges traditional concepts of authorship and authority in knowledge production. The authors build on poststructuralist theory, particularly Roland Barthes's "Death of the Author" and Michel Foucault's concept of the "author-function," to analyze how wikis destabilize individual authorship in favor of collaborative, community-driven content creation.

The essay argues that wikis represent a fundamental shift from the Romantic notion of the solitary author-genius to what they term the "wiki writing process"—a dynamic system where traditional roles of reader, writer, and editor blur into a …

A Qualitatively Grounded Curriculum For Western International Student Orientation To Chinese Higher Education, Lin Yi Jan 2008

A Qualitatively Grounded Curriculum For Western International Student Orientation To Chinese Higher Education, Lin Yi

Masters Theses

More and more U.S. students are seeking university study abroad in China. Information about how to prepare for overseas study in China, and what challenges need to be overcome, is limited. To develop the proposed orientation curriculum, Chinese professors teaching international students, international student affairs professionals serving international students, English-speaking international students studying in Chinese universities, and U.S. citizens visiting and working in China contributed their insights and experiences of culture shock, culture surprises, and cultural differences. The themes emerging from the interviews were organized into the content of the proposed orientation curriculum. When U.S. international students experience this Chinese …

Missionary Views Of Hinduism, Catherine Cornille Jan 2008

Missionary Views Of Hinduism, Catherine Cornille

Journal of Hindu-Christian Studies

Since the beginning of the modern missionary movement, Christian missionary views of Hinduism have changed significantly, partly as a result of linguistic developments (to which some missionaries contributed in important ways) and partly as a result of theological shifts (themselves also at times inspired by missionary insights and experiences). The views of an eighteenth century Christian missionary thus differ radically from those of missionaries able to profit from the translation efforts of nineteenth and twentieth century scholarship, and the views of a contemporary Roman Catholic missionary may bear little resemblance to that of an Evangelical Protestant.

The Dark Side Of The Tune: A Study Of Villains, Michael Biggs Jan 2008

The Dark Side Of The Tune: A Study Of Villains, Michael Biggs

Electronic Theses and Dissertations

On championing the villain, there is a naive quality that must be maintained even though the actor has rehearsed his tragic ending several times. There is a subtle difference between to charm and to seduce. The need for fame, glory, power, money, or other objects of affection drives antagonists so blindly that they ve no hope of regaining a consciousness about their actions. If and when they do become aware, they infrequently feel remorse. I captured the essence of the villain by exposing these lightless characters to the sun. On Monday, April 9th and Tuesday, April 17th, 2007, on the …

User-Generated Content And The Future Of Copyright: Part One--Investiture Of Ownership, Steven Hetcher Jan 2008

User-Generated Content And The Future Of Copyright: Part One--Investiture Of Ownership, Steven Hetcher

Vanderbilt Journal of Entertainment & Technology Law

While user-generated content (UGC) has been around for quite some time, the digital age has led to an explosion of new forms of UGC. Current UGC mega-sites, such as YouTube, Facebook, and MySpace, have given UGC a new level of significance, due to their ability to bring together large numbers of users to interact in new ways. The "user" in UGC generally refers to amateurs, but also includes professionals and amateurs aspiring to become professionals. "Generated" is synonymous with created, reflecting the inclusion of some minimal amount of creativity in the user's work. Finally, "content" refers to digital content, or …

What Makes Them Click? Applying The Rational Choice Perspective To The Hacking Underground, Michael Bachmann Jan 2008

What Makes Them Click? Applying The Rational Choice Perspective To The Hacking Underground, Michael Bachmann

Electronic Theses and Dissertations

The increasing dependence of modern societies, industries, and individuals on information technology and computer networks renders them ever more vulnerable to attacks on critical IT infrastructures. While the societal threat posed by hackers and other types of cyber-criminals has been growing significantly in the last decade, main-stream criminology has only recently begun to realize the significance of this threat. Cyber-criminology is slowly emerging as a subfield of criminological study and has yet to overcome many of the problems other areas of criminological research have already mastered. Aside from substantial methodological and theoretical problems, cyber-criminology currently also suffers from the scarcity …

Half-Truths, Mistakes, And Embarrassments: The United States Goes To The Fifth Meeting Of The Special Session To Review The Operation Of The Hague Convention On The Civil Aspects Of International Child Abduction, Merle H. Weiner Jan 2008

Half-Truths, Mistakes, And Embarrassments: The United States Goes To The Fifth Meeting Of The Special Session To Review The Operation Of The Hague Convention On The Civil Aspects Of International Child Abduction, Merle H. Weiner

Utah Law Review

The United States was not an admirable leader at the Fifth Meeting. When invited by the pre-meeting questionnaire to “make proposals concerning recommendations to be made by the Special Commission,” the United States was silent.493 The United States, however, was vocal in its indifference, or perhaps hostility, to the plight of domestic violence victims. While its position was condemnable, the transparency with which the United States presented it allows concerned individuals to address the merits of the U.S. position. In contrast, the U.S. position on a number of other issues was obscured with nationalistic legal language. The use of this …

On Communication, John Greenman Jan 2008

On Communication, John Greenman

Michigan Law Review

Everybody knows that communication is important, but nobody knows how to define it. The best scholars refer to it. Free-speech law protects it. But no one-no scholar or judge-has successfully captured it. Few have even tried. This is the first article to define communication under the law. In it, I explain why some activities-music, abstract painting, and parading-are considered communicative under the First Amendment, while others-sex, drugs, and subliminal advertising-are not. I argue that the existing theories of communication, which hold that communicative behaviors are expressive or convey ideas, fail to explain what is going on in free-speech cases. Instead, …
