The Book Of Daniel In Light Of The Ancient Near Eastern Literary And Material Finds: An Archaeological Perspective, Patrick Mazani Jan 2008

The Book Of Daniel In Light Of The Ancient Near Eastern Literary And Material Finds: An Archaeological Perspective, Patrick Mazani

Dissertations

This dissertation examines the text of the book of Daniel in light of some ancient Near Eastern archaeological discoveries. While chapter 1 of this research is introductory, chapter 2 begins by investigating personal and place names mentioned in Daniel and making a comparative analysis between the claims of Daniel's text and related archaeological discoveries. Archaeological evidence shows that the place names mentioned in the book of Daniel were real geographical locations where historical events are claimed to have taken place. Archeological materials not only help clarify some words, phrases, and locations of places, but seem to show that at least …

The Upside Of Overbreadth, Samuel W. Buell Jan 2008

The Upside Of Overbreadth, Samuel W. Buell

Faculty Scholarship

Overbreadth in criminal liability rules, especially in federal law, is abundant and much lamented. Overbreadth is avoidable if it results from normative mistakes about how much conduct to criminalize or from insufficient care to limit open texture in statutes. Social planners cannot so easily avoid overbreadth if they cannot reach behaviors for which criminalization is well justified without also reaching behaviors for which it is not. This mismatch problem is acute if persons engaging in properly criminalized behaviors deliberately alter their conduct to avoid punishment and have resources to devote to avoidance efforts. In response to such efforts, legal actors …

After Inclusion, Mitu Gulati, Devon W. Carbado, Catherine Fisk Jan 2008

After Inclusion, Mitu Gulati, Devon W. Carbado, Catherine Fisk

Faculty Scholarship

What forms of discrimination are likely to be salient in the coming decade? This review flags a cluster of problems that roughly fall under the rubric of inclusive exclusions or discrimination by inclusion. Much contemporary discrimination theory and empirical work is concerned not simply with mapping the forces that keep people out of the labor market but also with identifying the forces that push them into hierarchical structures within workplaces and labor markets. Underwriting this effort is the notion that, although determining what happens before and during the moment in which a prospective employee is excluded from an employment opportunity …

Disability, Communication Disorders, Articulation Disorders And Their Social Implications : A Review Of Research, Katherine Smith Jan 2008

Disability, Communication Disorders, Articulation Disorders And Their Social Implications : A Review Of Research, Katherine Smith

Honors Capstones

A critical review of current research on disabilities has shown that individuals with disabilities are subjective to a stigma. This stigma has devastating affects on the social life of the individual. Often times, this is established in childhood and continues through adulthood. It has been shown that this stigma affects and individuals social competence, the ability to form peer relationships, and results in social anxiety. Communicative disorders, as a type of disability, are subjective to the same results. Communicative disorders have also been shown to have correlation to behavioral and academic problems as well as social implications. Articulation disorders also …

Treatment Of Aphasia : Maximizing Outcomes, Julia R. White Jan 2008

Treatment Of Aphasia : Maximizing Outcomes, Julia R. White

Honors Capstones

It is the intention of this study to investigate several therapeutic tools which address the nonlinguistic cognitive functions in order to determine the most effective method of treatment for individuals with aphasia. The theory being investigated here is that a lesion affecting speech and language areas of the brain most likely also affects surrounding areas, and therapy which targets these affected functions could positively increase the treatment outcomes. In addition to my initiation of a new research study with Dr. Jamie Mayer and Lilli Bishop for treating nonlinguistic cognitive functions in aphasia, this project also involves careful review and education …

Technology Mediated Dispute Resolution Can Improve The Registry Of Interpreters For The Deaf Ethical Practices System: The Deaf Community Is Well Prepared And Can Lead By Example, David Allen Larson, Paula Gajewski Mickelson Jan 2008

Technology Mediated Dispute Resolution Can Improve The Registry Of Interpreters For The Deaf Ethical Practices System: The Deaf Community Is Well Prepared And Can Lead By Example, David Allen Larson, Paula Gajewski Mickelson

Faculty Scholarship

The work of American Sign Language (ASL)/English interpreters is filled with complex interpersonal, linguistic and cultural challenges. The decisions and ethical dilemmas interpreters face on a daily basis are countless and the potential for disagreement regarding those decisions is great. Technology Mediated Dispute Resolution (TMDR) processes can be particularly helpful when misunderstandings and conflicts arise. Technology Mediated Dispute Resolution is a more inclusive phrase than Online Dispute Resolution (ODR) and includes cellular telephones, radio frequency devices, and satellite communication systems. The Deaf Community has learned to adapt and rely upon a variety of technologies and, because many Deaf individuals already …

Securing The Rule Of Law Through Interpretive Pluralism: An Argument From Comparative Law, Richard Stith Jan 2008

Securing The Rule Of Law Through Interpretive Pluralism: An Argument From Comparative Law, Richard Stith

UC Law Constitutional Quarterly

As the distinction between interpretation and politics diminishes, the need for pluralism in interpretation increases. The Article argues, first, that the rule of law requires that no one tribunal possess the power to subordinate a whole legal system to its politicized rule.

The Article then uses comparative legal study to analyze two tested alternatives to concentrating interpretive authority in a single court. Under the "separation of powers" approach, some or many jurisdictionally distinct institutions are granted powers to interpret and apply the constitution and the laws. A multiplicity of interpreters helps to prevent domination by any one legal ideology and …

Direct Democracy And Article Ii: Additional Thoughts On Initiatives And Presidential Elections, Vikram David Amar Jan 2008

Direct Democracy And Article Ii: Additional Thoughts On Initiatives And Presidential Elections, Vikram David Amar

UC Law Constitutional Quarterly

This Article focuses on the first of the two questions in Professor Richard Hasen's aricle on whether "initiated changes to rules for choosing Presidential electors violate Article II." The article looks closely at places other than Article II where the Constitution uses the phrase "legislature of the States" and carefully examines Supreme Court cases on the topic. Given that initiative proponents are not necessarily foreclosed by the text of the Constitution, or Supreme Court case law, and given that initiative backers have some nineteenth and twentieth century history on their side, courts should be hesitant to invalidate all initiated changes …

The Bologna Process And Its Impact In Europe: It's So Much More Than Degree Changes, Laurel Terry Jan 2008

The Bologna Process And Its Impact In Europe: It's So Much More Than Degree Changes, Laurel Terry

Faculty Scholarly Works

The Bologna Process is a massive, multi-year project designed to create the "European Higher Education Area" by the year 2010. it began ten eyars ago, when four European Union (EU) countries signed a relatively vague declaration. It has grown to include forty-six countries, including all of the EU Member States and nineteen non-EU countries. The Bologna Process countries have agreed on ten "action lines" for restructuring European higher education. These action lines are nothing short of revolutionary - they address everything from a three-cycle degree system (e.g., bachelor-master's-doctorate degrees), European-wide quality assurance efforts, mobility of higher education students and staff, …

Alien Invaders! On-Site Programming (Grade 6), Discover Mojave: Forever Earth

Curriculum materials (FE)

In the “Alien Invaders!” program, students investigate how quagga mussels might affect Lake Mead. Students collect water quality data such as clarity, pH, and temperature to determine current habitat conditions that have allowed quagga mussels to thrive in Lake Mead. Students learn about the consequences that quagga mussels could have on the lake and its living and non-living resources. Using the knowledge they’ve gained, students create their own management plans to prevent the spread of quagga mussels to other waterways.

A Comparison Of Social Skills Training Approaches On Preschool Teacher And Child Behaviors, Keith J Hyatt Jan 2008

A Comparison Of Social Skills Training Approaches On Preschool Teacher And Child Behaviors, Keith J Hyatt

UNLV Retrospective Theses & Dissertations

The first purpose of this study was to determine whether instruction to teachers resulted in differences in their performance. The second purpose of this study was to compare the effectiveness of two social skill training methods, a proactive approach and a reactive approach, on increasing the "positive initiations" and/or "positive responses" of preschool children toward their peers during small group art activities. The proactive approach consisted of the teacher providing children with 5 minutes of instruction in specific social skills prior to the art activities, while the reactive approach consisted of the teacher providing verbal praise for "positive initiations" and …

When News Breaks, "The Daily Show" Fixes It: Exposing Social Values Through Satire, Daniel Brandon Mccue Jan 2008

When News Breaks, "The Daily Show" Fixes It: Exposing Social Values Through Satire, Daniel Brandon Mccue

UNLV Retrospective Theses & Dissertations

This thesis asserts that news satires (The Daily Show, The Onion, Saturday Night Live, and others) expose the mythological function of news by revealing violations of social values expressed implicitly in news stories. By employing irony, a rhetorical trope, these news satires provide a social critique of people and institutional power. Using a combination of critical analysis, content analysis, and historiography, this thesis defines news, irony, satire, and parody, and explores news satires that have found a mass audience in the United States in the decades following the birth of television. A synthesis of these definitions and explorations will support …

Opinionated Software, Meiring De Villiers Jan 2008

Opinionated Software, Meiring De Villiers

Vanderbilt Journal of Entertainment & Technology Law

Information security is an important and urgent priority in the computer systems of corporations, governments, and private users. Malevolent software, such as computer viruses and worms, constantly threatens the confidentiality, integrity, and availability of digital information. Virus detection software announces the presence of a virus in a program by issuing a virus alert. A virus alert presents two conflicting legal issues. A virus alert, as a statement on an issue of great public concern, merits protection under the First Amendment. The reputational interest of a plaintiff disparaged by a virus alert, on the other hand, merits protection under the law …

Evolutionism And Historical Particularism At The St. Petersburg Museum Of Anthropology And Ethnography, Sergei Kan Jan 2008

Evolutionism And Historical Particularism At The St. Petersburg Museum Of Anthropology And Ethnography, Sergei Kan

Dartmouth Scholarship

The paper describes the early 20th century debates between several leading Russian anthropologists, including Lev Shternberg, on the best way of displaying artifacts in the newly refurbished Museum of Anthropology and Ethnology in St. Petersburg. These debates revealed major tensions and contradictions between evolutionism and historical particularism, as well as universalism and nationalism within Russian anthropology of that era.

Information Policy For The Library Of Babel, James Grimmelmann Jan 2008

Information Policy For The Library Of Babel, James Grimmelmann

Cornell Law Faculty Publications

The image of Borges's Library of Babel, which contains all possible books, is haunting and suggestive. This essay asks what we would do if we were advising a Federal Library Commission on how to deal with the Library's vast holdings and overwhelming disorganization. This thought exercise provides a set of sensible principles for information policy in an age of extreme informational abundance.

Judicial Policy - Making And The Peculiar Function Of Law, Richard Kay Jan 2008

Judicial Policy - Making And The Peculiar Function Of Law, Richard Kay

Faculty Articles and Papers

While the nature of legal systems is a perpetually contested question, it is fairly uncontroversial that each must contain certain essential characteristics. First, each must suppose some picture of the appropriate way for human beings subject to it to live together in society. Second, to secure that proper arrangement, each must employ, to a greater or lesser degree, the device of general rules of conduct. Finally, in all but the simplest systems, the effectiveness of those rules must be guaranteed by some process of adjudication. The relationships among these three factors - social values, legal rules and judging - comprise …

Misconceptions About Silence And Passivity: How American Students Perceive Asian International Students' Use Of Passivity Within The Classroom, Audra Nuru Jan 2008

Misconceptions About Silence And Passivity: How American Students Perceive Asian International Students' Use Of Passivity Within The Classroom, Audra Nuru

Electronic Theses and Dissertations

Asian international students (AIS) are becoming increasingly more populous in American universities each year. While AIS are enrolled in the same required classes as American students, it has been observed that frequent interaction between AIS and American students is rather uncommon. Due to obvious social hesitation between the two groups of students during classroom discussion, the study presented was initiated in order to unveil possible reasons for this social integration dilemma. Social Attractiveness, Perceived Homophily and Attributional Confidence scales were selected in order to determine possible factors contributing to this dilemma. In order to pursue explanations for the dormant socialization …

Creating Marginality And Reconstructing Narrative: Reconfiguring Karen Social And Geo-Political Alignment, Barbara Verchot Jan 2008

Creating Marginality And Reconstructing Narrative: Reconfiguring Karen Social And Geo-Political Alignment, Barbara Verchot

Electronic Theses and Dissertations

Pre-modern conceptualization of shifting borderlands and territories rather than fixed boundaries often allowed for the dynamic flow of peoples between polities. Until the late 1800s and the colonization of Burma in 1886 by the British Empire, this permeability of the borders of its territory was how Siam (currently Thailand) viewed its geo-political sphere (Thomson 1995:272). Britain extended the boundaries of its empire beyond India to guarantee the economic interests of the British Empire. With this push eastward, Siam abutted a polity that rejected the idea of shifting borderlands. The British ascribed to the modern concept of non-permeability of borders. This …

"Blackfeet Belong To The Mountains": Blackfeet Relationships With The Glacier National Park Landscape And Institution, David R. Craig Jan 2008

"Blackfeet Belong To The Mountains": Blackfeet Relationships With The Glacier National Park Landscape And Institution, David R. Craig

Graduate Student Theses, Dissertations, & Professional Papers

National Parks are home to many landscapes of great significance to Native American peoples. The eastern half of Glacier National Park is considered a homeland by the Blackfeet people, and has historically been very important to their material, cultural, and spiritual well-being. This relationship, like those of many other Native peoples, has been severely disrupted by the establishment and presence of the national park, resulting in prolonged conflict between tribes and parks. Blackfeet relationships with this cultural landscape require interaction and engagement in order to realize the full extent of its benefits. Often, these practices serve distinct material needs, however, …

Securing The Rule Of Law Through Interpretive Pluralism: An Argument From Comparative Law, Richard Stith Jan 2008

Securing The Rule Of Law Through Interpretive Pluralism: An Argument From Comparative Law, Richard Stith

Law Faculty Publications

Can law rule? For law to rule, it must be enforced. But when law is enforced, not it but its enforcers may rule. To bind those enforcers firmly to the law, they, too, would have to be subjected not only to law but also to a still stronger force—which itself may then be lawless. The very effort to secure the rule of law appears to lead instead to ever more powerful human rulers.

Put another way: If we abolish the police and the courts, in order to leave people truly “not under man but under God and the law,”1 we …

Melody Recognition At Fast And Slow Tempos: Effects Of Age, Experience, And Familiarity, W. Jay Dowling, James C. Bartlett, Andrea R. Halpern, Melinda W. Andrews

Faculty Journal Articles

Eighty-one listeners defined by three age ranges (18–30, 31–59, and over 60 years) and three levels of musical experience performed an immediate recognition task requiring the detection of alterations in melodies. On each trial, a brief melody was presented, followed 5 sec later by a test stimulus that either was identical to the target or had two pitches changed, for a same–different judgment. Each melody pair was presented at 0.6 note/sec, 3.0 notes/sec, or 6.0 notes/sec. Performance was better with familiar melodies than with unfamiliar melodies. Overall performance declined slightly with age and improved substantially with increasing experience, in agreement …

New Classes Of Codes For Cryptologists And Computer Scientists, Florentin Smarandache, W.B. Vasantha Kandasamy

Branch Mathematics and Statistics Faculty and Staff Publications

Historically a code refers to a cryptosystem that deals with linguistic units: words, phrases etc. We do not discuss such codes in this book. Here codes are message carriers or information storages or information transmitters which in time of need should not be decoded or read by an enemy or an intruder. When we use very abstract mathematics in using a specific code, it is difficult for non-mathematicians to make use of it. At the same time, one cannot compromise with the capacity of the codes. So the authors in this book have introduced several classes of codes which are …
