Book Review - Should It Have Been Called Republic.Com 1.5? : Reviewing Cass Sunstein's 'Republic.Com 2.0' (2007), Peter Jenkins

Comparative Research in Law & Political Economy

Sunstein's argument in the original 2001 Republic.com and in this new 2007 version is that democracy requires a range of common experiences (social glue) and unanticipated exposure to diverse points of view, but that the Internet fails society on both counts. Sunstein believes that the Internet tends to create social fragmentation by encouraging individuals to sort themselves into deliberative enclaves of like-minded people and assisting them to filter out unwanted, opposing opinions. Republic.com 2.0 is much less than it could have been had the author cited opposing points of view more frequently, not been so US-centric, and considered recent uses …

The Province Of Jurisprudence (Really) Redetermined, Allan Hutchinson Jan 2008

The Province Of Jurisprudence (Really) Redetermined, Allan Hutchinson

Comparative Research in Law & Political Economy

When Julius Stone published his famous essay, The Province of Jurisprudence Redetermined, in 1944, he had reasonable cause for genuine optimism. English jurisprudence had been in the doldrums since the initial flurry of activity and excitement following Austin's launch of the modern project of analytical jurisprudence in 1832 with his The Province of Jurisprudence Determined. Most of the subsequent scholarship had simply refined and riffed unimaginatively on the basic Austinian themes. Yet, as the Second World War came to a close, there were signs that the time was ripe for a different and more vibrant approach to jurisprudential study. Julius …

International Institutions And Transnational Advocacy: The Case Of The North American Agreement On Labour Cooperation, Ruth Buchanan, Rusby Mariela Chaparro Jan 2008

International Institutions And Transnational Advocacy: The Case Of The North American Agreement On Labour Cooperation, Ruth Buchanan, Rusby Mariela Chaparro

Comparative Research in Law & Political Economy

The North American Agreement on Labor Cooperation is studied as both a new type of arena for labor advocacy in North America, as well as a site that has fostered the emergence of new transnational networks of advocates. We locate our discussion in the context both of debates on the emergence and efficacy of 'soft law' in a diverse array of transnational contexts, a nascent literature on the globalization of public interest lawyering (PIL), as well as more long standing debates on transnational advocacy networks (TANS). The article provides an overview of the uses made of the NAALC complaints process …

Exploring Interdisciplinary Prayer Research In A Health Context, E. James Baesler Jan 2008

Exploring Interdisciplinary Prayer Research In A Health Context, E. James Baesler

Communication & Theatre Arts Faculty Publications

Communication, Psychology, and Sociology are three leading academic disciplines engaged in the social scientific study of prayer, the spiritual communication between a believer(s) and God, but rarely do these disciplines collaborate in interdisciplinary prayer scholarship. Possibilities for interdisciplinary prayer research in a health context are explored through a review of the literature and academic interviews. Interdisciplinary linkages in the prayer-health context are organized in an integral "all-quadrant" theoretical model, and an assessment of the viability of interdisciplinary prayer-health research is considered.

Final Report Of The Experts Committee For Human Research Participant Protection In Canada, Jocelyn Downie

Reports & Public Policy Documents

The Experts Committee for Human Research Participant Protection in Canada presents herewith its final report and recommendations concerning the development of a new comprehensive system in Canada. The final report is the product of some twenty months work. Beginning in September, 2006 and ending February, 2007 the Committee held monthly face-to-face meetings which it supplemented by conference calls and the circulation of draft texts by various members. During the course of its work, the Committee assessed the concerns that had been raised about the existing Canadian governance arrangements and then examined alternative models that might serve to deal effectively with …

An Object-Oriented Natural Language Expert System, Kenneth Staffan, Henry Etlinger Jan 2008

An Object-Oriented Natural Language Expert System, Kenneth Staffan, Henry Etlinger

Articles

This paper highlights the design and implementation of a prototype object-oriented Intelligent Tutoring System (ITS). There were two main goals for the prototype. One was to create a small tutoring system which fit into the niche of current commercially available systems, while exhibiting some of the more intelligent features found in larger custom systems. The other was to experiment with an object-oriented model, design approach, and implementation for such a system. A masking technique for pattern matching is one of the key paradigms driving the intelligent diagnosis. The prototype provides a means for practicing sentence construction, by checking a student's …

Qualitative Analysis Of The Implementation Of An Autism Program Within A Public School District, Lucila F. Hernandez

PCOM Psychology Dissertations

The study analyzed the development, implementation and success of an educational program for children with Autism Spectrum Disorder (ASD) diagnosis within a public school structure. Records reviewed for a two year time period identified four phases to program development and implementation, as well as identifying themes and barriers for specific roles, administration, staff and parents. The success of the program is evidenced by growth in the children and by reported satisfaction of parents and staff. A program blue print offers an outline to program development and implementation. Necessary ASD program components, based on literature reviewed are summarized. This study highlights …

Pragmatic Language And Social Skills Functioning In Children Diagnosed With Asperger's Disorder, Donna Lee Toro Jan 2008

Pragmatic Language And Social Skills Functioning In Children Diagnosed With Asperger's Disorder, Donna Lee Toro

PCOM Psychology Dissertations

Sixteen children with a diagnosis of Asperger's Disorder, as defined by the DSM-IV-TR (2000), were assessed using the following standardized measures: KBIT-2 (Kaufman & Kaufman, 2003), CASL (Carrow-Woolfolk, 1999), and SSRS (Gresham & Elliot, 1990). The purpose of the study was to determine whether the measurement of pragmatic language functioning is reliably associated with social skill performance in children with Asperger's disorder. Results indicated that the group mean composite index score of the CASL was in the average range for children with a standard score of 85 or higher on the KBIT -2. Group average scores for formal language functioning …

“A Painful Process Of Waiting”: The New York, Washington, New Jersey, And Maryland Dissenting Justices Understand That “Same-Sex Marriage” Is Not What Same-Sex Couples Are Seeking, Barbara Cox Jan 2008

“A Painful Process Of Waiting”: The New York, Washington, New Jersey, And Maryland Dissenting Justices Understand That “Same-Sex Marriage” Is Not What Same-Sex Couples Are Seeking, Barbara Cox

Faculty Scholarship

This essay focuses on the recent decisions by the highest courts of four states rejecting the claims of individuals in same-sex relationships that they must be permitted to marry the partner of their choice. In the cases of Hernandez v. Robles, Andersen v. King County, Lewis v. Harris, and Conaway v. Deane, a majority or plurality of each court determined that the bans preventing individuals in same-sex couples from marrying were constitutional. Understanding these cases is particularly important as additional state supreme courts address the cases of similar plaintiffs pending before them.

Mistakes, Changed Circumstances And Intent, Nancy Kim Jan 2008

Mistakes, Changed Circumstances And Intent, Nancy Kim

Faculty Scholarship

The most common contract defenses are duress, unconscionability, incapacity, fraud, and the basic assumption. defenses4 of mutual mistake, unilateral mistake, impossibility, frustration of purpose and commercial impracticability. In this Article, I limit my discussion to basic assumption defenses. Several prevailing rationales explain why a party should be allowed to escape contractual liability despite the sufficiency of consideration where there has been a failure of a basic assumption material to the transaction. No single rationale or principle, however, unifies all basic assumption defenses. Several commentators have noted that similar fact patterns applying a given doctrine often yield inconsistent results. Parties’ employment …

Theories which have been used in the study of language choice have anchored primarily on sociolinguistic approaches. These approaches are linked to Fishman’s (1972) concepts of who speaks what language to whom and when. Another group of theories draw upon the psychological factors to explain language choice. From the literature in this field of study, each approach has shown limitations in its use. The stand taken in this study is that sociolinguistic and psychological approaches can be combined into a single category of approaches that can theorize language choice. This study examines language choice through this combined interpretative framework to …

Nonlinear Identification And Control: A Practical Solution And Its Application, Xiaodong Na Jan 2008

Nonlinear Identification And Control: A Practical Solution And Its Application, Xiaodong Na

University of Kentucky Doctoral Dissertations

It is well known that typical welding processes such as laser welding are nonlinear although mostly they are treated as linear system. For the purpose of automatic control, Identification of nonlinear system, especially welding processes is a necessary and fundamental problem. The purpose of this research is to develop a simple and practical identification and control for welding processes. Many investigations have shown the possibility to represent physical processes by nonlinear models, such as Hammerstein structure, consisting of a nonlinearity and linear dynamics in series with each other. Motivated by the fact that typical welding processes do not have non-zeroes, …
