"Fleeting Expletives" Are The Tip Of The Iceberg: Fallout From Exposing The Arbitrary And Capricious Nature Of Indecency Regulation, Dave E. Hutchinson

On November 4, 2008, the Supreme Court heard arguments in FCC v. Fox Television Stations, which centers on whether or the FCC's policy allowing fleeting expletives to be found actionably indecent is arbitrary and capricious. The Second Circuit found that the fleeting expletives policy is arbitrary and capricious as a matter of administrative law. The Supreme Court decision will provide much needed guidance for what constitutes a reasoned basis in the indecency regime's contextual approach. Motivational factors and experiences have the potential to influence students’ attitudes and anxiety levels towards English language learning. Recognizing the importance and multi-dimensional complexities of motivational attitudes and anxiety, this mini-research study attempts to investigate gender wise students’ attitudes, motivation and anxiety towards the learning of English as a second language in the multilingual context of Karachi, Pakistan. Exploring Patterns In Teachers’ Conceptions Of Citizenship And Political Participation: A Survey Of Secondary School Teachers In Karachi, Pakistan, Karim Panah

This paper examines patterns in teachers’ understanding of conceptual and practical aspects of citizenship by analyzing survey data obtained from 320 teachers of public and private sector secondary schools in Karachi, Pakistan. The survey was conducted using a five-point-Likert scale ranging from ‘strongly disagree through ‘neutral’ to ‘strongly-agree’ and openended questions on citizen participation in politics. The survey questionnaire included 28 items that reflected various aspects of citizen rights and responsibilities. Principal Component Analysis (PCA)) showed several patterns in teacher’s conceptions of citizenship with reference to democratization. In 2007, the Association of American Colleges and Universities recommended a set of Essential Learning Outcomes as objectives for twenty-first-century college learning. This study examined to what extent Essential Learning Outcomes are endorsed by faculty members with different teaching experience, across academic disciplines, Carnegie Classifications, institution types of controls, and accreditation regions.;Faculty Survey of Student Engagement (FSSE) 2004 data were used for this study with permission from the Indiana University Center for Postsecondary Research. This study explores how employees express uncertainty and enact uncertainty reduction techniques through electronic communication, specifically email, during temporary inter-organizational change. The context of the study is within the work environment of a nonprofit entity in the Southern region of the United States that employs just under 20 staff members and coordinates with approximately 135 partner staff affiliates on a daily basis. The Executive Director's medical leave of about three months requires that job responsibilities and organizational roles be temporarily restructured. This thesis compares the Wiccan faith with fantasy literature of the twentieth century in an effort to reveal the spread of radical feminist thought between 1963 and 1983 by examining how these groups represented the shared figure of the witch. By comparing these different representations it may be determined whether radical feminist thought was promoted through fantasy literature. If the figure of the witch did become radically feminist in this popular setting then this would indicate a broader acceptance of radical feminist thought in American culture. The goal of this research was to identify theories and describe characteristics of learning styles, assess characteristics of freshman students at Red River High School using data from the CAPSOL (Computerized Assessment and Prescription Styles of Learning) Style of Learning Assessment, MAP (Measures of Academic Progress) Scores, GPA (Grade Point Average), and North Dakota STARS (State Automated Reporting System), and justify a pedagogical and philosophical change in instruction to adapt instructional strategies to match and strengthen students' learning styles.

Hani is a language in the Loloish family, spoken primarily in Yunnan Province of southwest China. This thesis presents a description of constituent order and participant reference in written Hani narrative discourse. The primary data source for this thesis consists of three narratives, which are included in the appendices.

Constituent order in Hani is largely constrained by the principle of natural information flow. In order to conform to this principle, some constituents may appear in two or more different positions in the clause, depending on the information structure of the assertion being made. This thesis describes the tonal patterns and alternations present in the Mpyemo language (Bantu A.86c – ISO code mcx), with special attention to the verbal system. Rules and autosegmental representations are used to clarify and provide a formal analysis. A tone raising rule causes the underlying two-tone system to display three phonetic levels at the surface. This thesis explores nominalized verbs and verbs in the imperative. In addition, inflected verbs are described, although only a limited set of inflectional morphemes are treated. This thesis is based on a collection of narratives told by Gujar women in northern Pakistan. It majors on the structure of subordinate clauses, the discourse functions of relative clauses and conjunctive participial clauses, and the function of the most common connectives: tɛ, fir, bas and ǰī.

The position of the relative pronoun indicates whether a relative clause is referring to an activated or a new participant. Relative clauses that appear superfluous indicate that the referent has a significant role to play in the subsequent discourse.

The representation of North Americans in contemporary Mexican narrative texts is frequent, complex and worthy of study. The present dissertation makes no pretense of being a comprehensive catalogue of “gringos” in Mexican narrative; it can be better seen as a cross-section of Mexican literature concerning people from the United States published during the final two decades of the twentieth century. My intention is to explore how this Mexican narrative has characterized non-Mexican Americans and contextualize these visions in terms of their cultural and historical origins. When many collections are brought together in a federation or aggregation, the attributes of the original collections can become difficult to discern. Collection-level metadata has the potential to provide important context about the purpose and features of individual collections, but the qualitative aspects of collections are difficult to describe in a systematic way. This paper reports on a content analysis of collection records in the Digital Collections and Content (DCC) aggregation, conducted to analyze the kinds of substantive and purposeful information represented across 202 cultural heritage collections. On the island of Mota in the Banks Islands, children and adults frequently have their matrilineal and even matrimoiety affiliation, and consequently kin relations, altered and multiplied through various forms of adoption. Most of the 850 Motese count themselves as belonging to several kin groups. This creates personalized kin inventories for each individual. Consequently, an element of choice concerning which relation to emphasize is intrinsic to the Motese kinship system. In this paper, some of the reasons and motivations for these choices are outlined. Culture Clash - How Socio-Technical Factors Contribute To Enterprise Information Systems Interoperability, Alan Fisk

Despite increasing need for interoperable enterprise-level information systems, achieving interoperability is persistently problematical. Our work highlights social factors as a major contributor to good design, development, and operating practices. The research was conducted at a technologically sophisticated Fortune 50 company where design artifacts suggested by the literature were found to be in place yet good interoperability between systems was not consistently achieved. The data suggest boundary spanners can facilitate interoperability by promoting shared meanings and mindsets that advance acculturation among cross-functional groups. Findings contrast with enterprise systems interoperability literature, which has focused mainly on technological factors to ensure good design …

Introduction: This report examines demographic and socioeconomic factors concerning New York City based Latinos in Washington Heights and Inwood – particularly Dominicans.

Methods: Data on Latinos and other racial/ethnic groups were obtained from the U.S. Census Bureau American Community Survey, reorganized for public use by the Minnesota Population Center, University of Minnesota, IPUMSusa. Cases in the dataset were weighted and analyzed to produce population estimates.

Results: Since the 1980s the upper Manhattan neighborhood of Washington Heights/Inwood has been transformed by the immigration of a large Latino population of whom Dominicans have been the most prominent national group. Latinos made up …

Introduction: This study examines the linguistic patterns of New York City Latinos in comparison to other race/ethnic groups as of 2005.

Methods: Data on Latinos and other racial/ethnic groups were obtained from the U.S. Census Bureau American Community Survey, reorganized for public use by the Minnesota Population Center, University of Minnesota, IPUMSusa. Cases in the dataset were weighted and analyzed to produce population estimates.

Results: Among all four racial/ethnic groups the foreign-born population reported speaking English at home at lower rates than the domestic-born population, a finding which could have been anticipated. Yet, Latinos reported speaking English at home at …

[Excerpt] “Disclaimers are a common feature of public and commercial life. While this article will be concerned with disclaimers only in legal contexts, the range of such legal contexts is broad. This article will refer below to disclaimers by governmental and non-governmental actors in various circumstances. Disclaimers arise, for example, in Establishment Clause cases in general, and of late, in cases involving public school evolution text books. Disclaimers may also be thought of as a remedy for compelled speech, or as themselves an instance of compelled speech. Modern law often rests on the assumption that a uniform cost/benefit formula is the proper way to determine fault in ordinary contract disputes. This Article disputes that vision by defending the view that different standards of fault are appropriate in different contexts. The central distinction is one that holds parties in gratuitous transactions only to the standard of care that they bring to their own affairs, while insisting on the higher objective standard of ordinary care in commercial transactions. The Purpose of This Research is to Develop a Grounded Theory Model to Explain the Factors Influencing Collaborative Learning in Higher Education, the Role of Technology in Facilitating Collaboration, and the Outcome of Collaboration. We Assigned 28 Participants to Small Groups to Work on Course-Related Questions; Half of the Groups Were Face-To-Face Groups and the Other Half Groups Were Collaborating in a Simulated Virtual Environment with the Aid of Information Technology.
