An Investigation Of Meromixis In Cave Pools, Lechuguilla Cave, New Mexico, David B. Levy Jan 2008

An Investigation Of Meromixis In Cave Pools, Lechuguilla Cave, New Mexico, David B. Levy

International Journal of Speleology

Chemical characteristics of permanent stratification in cave pools (meromixis) may provide insight into the geochemical origin and evolution of cave pool waters. The objective of this study was to test the hypothesis that some pools in Lechuguilla Cave may be subject to ectogenic meromixis, where permanent chemical stratification is induced by input of relatively saline or fresh water from an external source. However, because organic C concentrations in Lechuguilla waters are low (typically < 1 mg L-1), biogenic meromixis resulting in O2(g)-depleted subsurface waters is not expected. Four pools at various depths below ground surface (0 m) were studied: (1) …

Allen, Paul M. Secunda, Julie C. Suk, Tristin K. Green, Brad Seligman, Elaine W. Shoben

Articles

The article examines the effectiveness of legal frameworks and corporate practices in addressing employment discrimination, contrasting the French criminal approach with the U.S. reliance on civil remedies and diversity initiatives. It argues that while criminal investigations in France have successfully uncovered and punished discriminatory hiring practices, U.S. corporations often evade meaningful change through ineffective diversity training and lack robust accountability mechanisms. The analysis underscores the need for structural reforms in the U.S., emphasizing the importance of accountability and flexibility in consent decrees to drive lasting progress in diversity and inclusion.

Analysis Of Adenovirus And Bovine Coronavirus., Kevin Lane Jan 2008

Analysis Of Adenovirus And Bovine Coronavirus., Kevin Lane

Theses

This investigation involved the analysis of selected gastroenteritis viruses, adenovirus and bovine coronavirus, obtained from faecal samples, collected from hospital and diagnostic laboratories respectively in Cork city, Ireland. The viruses isolated from these samples were subjected to analysis using cell culture and nucleic acid extraction. In addition adenovirus was analysed using PCR and PCR followed by restriction endonuclease digest. Many samples contained more than one gastroenteritis virus, the virus of interest and a natural co-infection with rotavirus species. Rotavirus infections in Ireland have been extensively studied and we were interested in studying singly and doubly infect samples.

Bovine enteric coronavirus …

Gender Bias Of Cardiovascular Risk In Caucasian Type Ii Diabetics: A Haemostatic Explanation?, William Quirke Jan 2008

Gender Bias Of Cardiovascular Risk In Caucasian Type Ii Diabetics: A Haemostatic Explanation?, William Quirke

Theses

People with type II diabetes are disproportionately affected by cardiovascular disease compared to those without diabetes. The relative risk of cardiovascular disease caused by type II diabetes is higher in females than in males. This risk has not been fully explained by traditional risk factors and attention has turned to the possible role of haemostatic abnormalities in explaining the excess cardiovascular morbidity and mortality among diabetic females. We examined specific parameters of the coagulation (factor VII, factor VIII, von Willebrand factor, fibrinogen) and fibrinolytic (plasminogen activator inhibitor- 1, thrombin-activatable fibrinolysis inhibitor) system in 113 Irish Caucasian type II diabetics to …

Mesh Mac Enabling Mesh Networking Over Ieee 802.15.4 Mac Layer, Panneer Selvan Muthukumaran

Theses

Wireless sensor network is a network of sensor nodes that function in a cooperative manner to monitor the changes in the physical environment. Wireless sensor networks are used in environment and habitat monitoring, healthcare applications, building automation, and traffic control to name a few. Typically, wireless sensor node is a low power embedded device which consists of a microcontroller, sensors, wireless transceiver and a battery. These devices are usually distributed in a physical environment which makes it difficult to maintain the network manually.

The IEEE 802.15.4 and Zigbee are considered as standard protocols for wireless sensor networks. The IEEE 802.15.4 …

The Relationship Of Fear And Fatalism With Breast Cancer Screening Among A Selected Target Population Of African American Middle Class Women, Patricia Yvonne Talbert Jan 2008

The Relationship Of Fear And Fatalism With Breast Cancer Screening Among A Selected Target Population Of African American Middle Class Women, Patricia Yvonne Talbert

Journal of Social, Behavioral, and Health Sciences

The purpose of this quantitative study was to explore whether fear and fatalism influence compliance with breast cancer screening among members of a selected target population of African American middle-class (AAMC) women. Using a cross-sectional analysis, a sample of 120 AAMC women, ages 35 and older, residing in Minnesota, was surveyed with an abridged version of the Champion Health Belief Model Scale (Champion, 1999), the Champion Breast Cancer Fear Scale (Champion et al, 2004), and an adapted version of the Powe Fatalism Model (Powe, 1995). Results indicated that fear and fatalism belief scores were statistically related to breast cancer compliance …

Smoking Attitudes Among Adolescents: Effect Of Messages Varying On Argument Quality And Source’S Expertise, Evdoxia Kosmidou, Yannis Theodorakis, Stiliani (Ani) Chroni

Journal of Social, Behavioral, and Health Sciences

The present study examined the effectiveness of an anti-smoking message on processing and persuasion in young adolescents. Data were collected from 112 Greek adolescents 13 to 16 years of age, who were randomly assigned into a control and four experimental groups. All participants in experimental groups read a written anti-smoking message varying on the source’s expertise (expert or non expert) and on the quality of the arguments (12 weak/12 strong arguments). Before and after the experimental manipulation, participants completed questionnaires assessing attitudes towards smoking, intention to smoke, perceived behavioral control, subjective norms, knowledge, and smoking behavior. Repeated measures analyses showed …

Continence Care: The Need For Creativity And Innovation, Karen A. Karlowicz Jan 2008

Continence Care: The Need For Creativity And Innovation, Karen A. Karlowicz

Ellmer School of Nursing Faculty Publications

(First paragraph) In April 2007, I attended a conference quite different from anything I had previously experienced. The conference, Innovating for Continence: The Engineering Challenge, was hosted by the Simon Foundation for Continence. As the title implies, this was not your usual conference about the diagnosis, treatment, and management of urinary incontinence. Rather, it was a conference dedicated to exploring technological advances in continence care. The central question throughout this two-and-a-half day event was, "What can be done to simulate continence technology to ensure the most effective management for persons who suffer with this problem?"

Friends As Fiduciaries, Ethan J. Leib Jan 2008

Friends As Fiduciaries, Ethan J. Leib

Faculty Scholarship

This Article argues that the law of fiduciary duties provides a good framework for friends to understand their duties to one another better, gives courts a useful set of rhetorical and analytical tools to employ when they are forced to entertain disputes that arise between close friends, and, finally, can help direct courts to furnish betrayed friends certain kinds of remedies that are most appropriate for achieving justice within that dispute context. This is not the first Article to make an effort to expand the reach of the fiduciary concept into new sorts of relationships that are not always considered …

Liberal Justices' Reliance On Legislative History, James J. Brudney, Corey Distlear Jan 2008

Liberal Justices' Reliance On Legislative History, James J. Brudney, Corey Distlear

Faculty Scholarship

This Article presents a strong case against the conventional wisdom that legislative history is a "politicized'" resource, invoked opportunistically by federal judges. The premise that judges regularly rely on legislative history to promote their preferred policy positions-if true-should find ample support in the majority opinions of liberal Supreme Court Justices construing liberal (pro-employee) labor and civil rights statutes. By analyzing all 320-plus majority opinions in workplace law authored by eight liberal Justices from 1969-2006, the authors establish that legislative history reliance is actually associated with a constraining set of results. When the eight liberal Justices use legislative history as part …

Can We Get Inside The Aesthetic Sensibility Of The Archaic Past?, Frederic Will Jan 2008

Can We Get Inside The Aesthetic Sensibility Of The Archaic Past?, Frederic Will

Contemporary Aesthetics (Journal Archive)

This essay is about getting inside the sensibility of the archaic past.[1] Can we get into the creative mind of the painter of The Sorcerer? Can we reconstruct the sensibility of prehistoric humans? Can we recover the humor of the prehistoric artist? Can we do it? After all, sense equipment is the same in men and women of all ages, and though each age inflects its sense usages uniquely, there should remain an underlying continuity among sensibilities. Shouldn't we be able to return into earlier forms of those usages? Can we tell whether we have been successful in accomplishing …

The Aesthetics Of Trademarks, Peter H. Karlen Jan 2008

The Aesthetics Of Trademarks, Peter H. Karlen

Contemporary Aesthetics (Journal Archive)

Trademarks are not just property, they are aesthetic creations that pervade everyday experience. One estimate is that the average person encounters more than 1,000 trademarks per day, many of which influence purchases and product use.

As pervasive aesthetic creations having literary, pictorial, graphic, sculptural, and musical content, trademarks deserve aesthetic analysis. The article discusses the origins, strength, appeal, and effectiveness of trademarks within the context of aesthetic considerations such as meaning, intention, authorship, and mode of creation. Also reviewed are morphemic and phonemic analysis of trademarks, semantic positioning, the dichotomy between creation and discovery of trademarks, and the differences between …

"The People Are Missing", Maryvonne Saison Jan 2008

"The People Are Missing", Maryvonne Saison

Contemporary Aesthetics (Journal Archive)

It is through the ideal of a sensus communis that Aesthetics has offered to Philosophy an articulation to Politics. I will question the idea of an "aesthetic sociability" through the concept of "régime esthétique" (aesthetic regime) proposed by Jacques Rancière to define the 18th century fundamental change carried by Aesthetics in order to think art and sensibility together.

One question will be the central core of my essay, which is how to understand nowadays Deleuze’s assertion that art should be "contributing to the invention of a people."

Consensus and dissensus are two reefs between which art and philosophy navigate at …

Ebay's Practical Effect: Two Differing Visions, Jay Dratler Jan 2008

Ebay's Practical Effect: Two Differing Visions, Jay Dratler

Akron Law Faculty Publications

This short paper examines the likely effect of the Court's three opinions on the actual practice of intellectual property cases in their remedial phase. The first part briefly discusses the unanimous opinion and its likely economic effect in increasing the already daunting complexity-and therefore the already considerable cost-of intellectual property litigation. The second part examines the first concurring opinion and the effect of its implicit suggestion that nothing much has really changed. The third part examines the possible practical effect of the second concurring opinion. The conclusion then offers a few general observations on where remedial practice in patent cases …

The New Face Of Women's Legal History: An Introduction To The Symposium, Tracy A. Thomas

Akron Law Faculty Publications

Women’s legal history is developing as a new and exciting field that provides alternative perspectives on legal issues both past and present. Feminist legal history seeks to examine the ways in which law historically has informed women’s rights and how feminist discourse has shaped the law. This short essay quickly traces the development of women's legal history as a field, and then introduces the papers from a symposium at the University of Akron School of Law. The Akron Constitutional Law Center oranized a conference in October 2007 entitled “The New Face of Women’s Legal History” to showcase many of the …

Procedural Path Dependence: Discrimination And The Civil-Criminal Divide, Julie C. Suk Jan 2008

Procedural Path Dependence: Discrimination And The Civil-Criminal Divide, Julie C. Suk

Articles

Procedural path dependence occurs when the particular features of the procedural system that is charged with enforcing a given legal norm determine the substantive path of that norm. This Article shows how the limits of employment discrimination law in two different national contexts can be explained by procedural dynamics. In France, as in several European countries, employment discrimination law is enforced predominantly in criminal proceedings. French criminal procedure enables the discovery of information necessary to prove the facts of discrimination, whereas the limits of French civil procedure make it impossible for such information to be revealed. As a result, the …

U.S. Patent Reform And International Public Health: Issues Of Law And Policy, Kevin Mcgarry Jan 2008

U.S. Patent Reform And International Public Health: Issues Of Law And Policy, Kevin Mcgarry

Intercultural Human Rights Law Review

While technology continues to advance in many countries, the developing countries of the world are still playing catch-up. Technological progress is a key element of economic development, but only when adapted properly and affordably to meet the needs of the recipient country and population. However, development plans involving technology transfers to developing countries often encounter difficulties in the form of conflicting private sector patent' interests, inter-governmental bureaucratic inertia and misplaced or minimal technological investment. Of primary concern is the lack of access to affordable pharmaceuticals and medical treatments created by a mixture of expensive medical/pharmaceutical research, overreaching profit-seeking, and diminishing …

Is There A Role For Public Support Of Incumbent Worker On-The-Job Training?, Kevin Hollenbeck Jan 2008

Is There A Role For Public Support Of Incumbent Worker On-The-Job Training?, Kevin Hollenbeck

Upjohn Institute Working Papers

States have begun to use training subsidies as a policy tool for employment retention and business competitiveness. This paper summarizes a survey of states concerning their investments in incumbent worker training. Altogether, states are investing about $550 to $800 million, which is perhaps one percent or less of total private sector training costs. The paper further discusses a study conducted for one state in which we found significant fiscal returns implying that underinvestment of public funds for incumbent worker training may be occurring. In this state, primary sector jobs were created or retained at a public cost of less than …
