Rain May Be Heavy At Times: A Collection Of Personal Essays, Natalie Mercer Worrell Jan 2008

Rain May Be Heavy At Times: A Collection Of Personal Essays, Natalie Mercer Worrell

Theses

Rain May Be Heavy at Times: A Collection of Personal Essays by Natalie Mercer Worrell is a candid, witty, and emotionally resonant exploration of modern womanhood, family life, and personal growth. Through a series of sharply observed and deeply personal essays, Worrell shares her experiences as a young mother, divorcee, student, and writer, balancing everyday chaos with moments of insight and humor. The collection opens with reflections on the challenges of rekindling a long-dormant writing practice, interrupted by illness, early motherhood, and financial hardship. Worrell charts a path from self-doubt to rediscovery, fueled by a return to education and a …

Pressures Toward Mediocrity In The Representation Of Children, Barbara Glesner Fines Jan 2008

Pressures Toward Mediocrity In The Representation Of Children, Barbara Glesner Fines

Faculty Works

When children are the subject of dependency, adoption or guardianship proceedings, protecting those children requires attention to a variety of interests. Children need a voice: an advisor and an advocate whose judgment is unclouded by conflicting interests. Courts need information that the adult parties to the proceedings may not easily discover or willingly provide. The families and social services agencies need monitors and mediators. The attorney guardian ad litem (GAL) is, in many situations, called upon to meet all these needs. During the past decade, major academic conferences and professional organizations have devoted thousands of hours to developing standards of …

Recent Developments Affecting The Enforcement, Procurement, And Licensing Of Research Tool Patents, Joshua D. Sarnoff, Christopher M. Holman

Faculty Works

A vigorous discussion exists regarding the need to provide exclusive patent rights as incentives to invent and to disclose so-called "research tools," whether such exclusive rights should apply to all uses and users of patented research tools, and whether exclusive rights to prohibit all uses of research tools would unduly discourage sequential invention. This article summarizes recent developments under U.S. patent laws of particular relevance to the debate over the patenting of research tools, and provides some insights into the practices of various academic sciences, industries, and government agencies regarding the treatment of these important inventions. The article provides a …

Incrementalism, Comprehensive Rationality, And The Future Of Gun Control, Allen K. Rostron Jan 2008

Incrementalism, Comprehensive Rationality, And The Future Of Gun Control, Allen K. Rostron

Faculty Works

This article examines the issue of gun control through the lens of the 'comprehensive rationality' and 'incrementalism' models of policymaking and argues that incremental policymaking has been one of the major impediments to progress toward more effective regulation of guns. Gun laws are often an incoherent patch-work of provisions as new restrictions are piled atop old ones in response to particular tragedies or narrow concerns, instead of crafting bills to achieve an optimal approach to the entire problem. Political science and other social sciences literature has closely examined the 'incrementalism' and 'comprehensive rationality' models of policymaking over the past several …

Falwell V. Flynt Trial, 1984, Douglas O. Linder Jan 2008

Falwell V. Flynt Trial, 1984, Douglas O. Linder

Faculty Works

Asked about his first sexual experience by an interviewer, Reverend Jerry Falwell said, "I never really expected to make it with Mom, but then after she showed all the other guys in town such a good time, I thought 'What the hell!'" Falwell went on to describe a a Campari-fueled sexual encounter with his mother in an outhouse near Lynchburg, Virginia. Neither the incestuous sex nor the interview ever happened, of course. They sprang from the imagination of a parody writer for Hustler Magazine. When the Campari parody ad appeared in the November 1983 issue of Hustler, the founder of …

The Antitrust Legacy Of Justice William O. Douglas, C. Paul Rogers Iii Jan 2008

The Antitrust Legacy Of Justice William O. Douglas, C. Paul Rogers Iii

Cleveland State Law Review

One cannot study the history of antitrust law without running headlong into the opinions of Associate Justice William 0. Douglas. In his thirty-six years on the Supreme Court, he authored thirty-five majority opinions and nearly as many dissenting or concurring opinions in cases involving antitrust questions or issues. It is quite probable that Justice Douglas authored more antitrust opinions, both for the majority and in dissent, than any Supreme Court justice in history. This Article will attempt to further define and refine Justice Douglas' antitrust philosophy by examining his written opinions and writings. It will then attempt to measure that …

Holding Nature Responsible: The Natural Conditions Exception To Water Quality Standards Of The Clean Water, Shimshon Balanson Jan 2008

Holding Nature Responsible: The Natural Conditions Exception To Water Quality Standards Of The Clean Water, Shimshon Balanson

Cleveland State Law Review

Part I provides a background to the Clean Water Act (“CWA”), including a brief review of its history, structure, and the development of water quality standards. The analysis in Part II.A explores the states' responsibilities in compiling a list of impaired water under CWA § 303(d), while Part II.B reviews the evolution of the “natural conditions” exception in case law, state regulation, and EPA policy and guidance. Part II.C evaluates the validity of the “natural conditions” exception from three frameworks—scientific, public policy, and legal—and raises serious questions as to whether deviatory water quality standards cohere with the principles and purposes …

Enmasking Beckett: The Use Of The Commedia Dell'arte In Waiting For Godot, Shaun Sheley Jan 2008

Enmasking Beckett: The Use Of The Commedia Dell'arte In Waiting For Godot, Shaun Sheley

Theses

In Enmasking Beckett: The Use of the Commedia dell'Arte in Waiting for Godot, Shaun Sheley explores how the traditional Italian theatrical form of Commedia dell'Arte can inform and enhance character development and physical expression in Samuel Beckett’s seminal play Waiting for Godot. Drawing on his experience directing a 2007 university production, Sheley demonstrates how the fixed archetypes and physical vocabulary of Commedia dell'Arte can be applied to Beckett’s characters—Vladimir, Estragon, Pozzo, and Lucky—to support their stylized, non-naturalistic portrayal and Beckett’s own directive for the play to be performed "balletically."

The thesis contextualizes Waiting for Godot within Beckett’s broader …

Beyond Analogy: Perez V. Sharp, Antimiscegenation Law, And The Fight For Same-Sex Marriage, Robin A. Lenhardt Jan 2008

Beyond Analogy: Perez V. Sharp, Antimiscegenation Law, And The Fight For Same-Sex Marriage, Robin A. Lenhardt

Faculty Scholarship

Conversations about the constitutionality of prohibitions on marriage for same-sex couples invariably reduce to the question of whether a meaningful analogy can be drawn between restrictions on same-sex marriage and antimiscegenation laws. In an effort to refocus this debate, this article considers the California Supreme Court's 1948 decision in Perez v. Sharp and its use by advocates in recent litigation to secure marriage rights for gay and lesbian couples. Opponents of marriage rights for members of the LGBT *840 community frequently assert that dispatching Perez in these cases distorts the meaning of that decision and other similar precedents by drawing …

Pragmatic Truths: When Ritual Meets The Reality Of Community Engagement, Joyce Hendricks, Vicki Cope, Maureen Harris Jan 2008

Pragmatic Truths: When Ritual Meets The Reality Of Community Engagement, Joyce Hendricks, Vicki Cope, Maureen Harris

EDU-COM International Conference

Community engagement is the touchstone of all universities and is critical to the credibility and overall standing of academic institutions. The cardinal features of engagement include ‗Capability, Commitment, Contribution, Continuity, Collaboration and Conscience‘. However these abstract concepts are often idealized and simplistic. On the other hand, when community engagement is managed well, participatory planning can produce better substantive ideas, useful relationships and stronger agreements across stakeholder groups. However, if engagement is more ritual than reality, it can lead to technically deficient ideas, frustrated expectations, power grabs in which parochial interests dominate conflicts and mistrust. This case study describes the realignment …

Expanding The Ecological Consciousness Of Social Work Students: Education For Sustainable Practice, Peter Jones Jan 2008

Expanding The Ecological Consciousness Of Social Work Students: Education For Sustainable Practice, Peter Jones

EDU-COM International Conference

Social work has a long tradition of being explicitly concerned with the ‗person-in-environment‘, recognising the need to take account of context when working to address disadvantage and maximise wellbeing. This concern with environment, and indeed with the concept of sustainability has, however, been focused primarily on the social rather than the ecological (Coates 2003; Besthorne & McMillen 2002). At a time when increasing attention is being paid to the importance of promoting education about, and for, sustainability in higher education (Sipos, Battisti & Grimm 2008; Wright 2002; Thomas 2004), the social work profession also needs to begin engaging in a …

Spondyloepiphyseal Dysplasia Tarda With Progressive Arthropathy With Delayed Diagnosis, Esra Tuğ, Efsun Şenocak

Turkish Journal of Medical Sciences

Spondyloepiphyseal dysplasia tarda with progressive arthropathy (SEDT-PA) is a rare autosomal recessive hereditary skeletal disease, and mutations in WISP3 are responsible for its onset. WISP3 is essential for maintaining cartilage integrity mainly by regulating the expression of collagen II, and mutations of WISP3 linked to SEDT-PA can compromise this function and lead to cartilage loss, which is frequently misdiagnosed as juvenile idiopathic arthritis. It is characterized by arthralgia, joint contractures, bony swelling of metacarpophalangeal and interphalangeal joints and platyspondyly. Clinical and laboratory signs of joint inflammation such as synovitis, a high erythrocyte sedimentation rate and an elevated C-reactive protein level …
