Good morning, welcome to you all. Many thanks to Sally Ganem and all of our Centennial Hosts, our congressional delegation, Mayor Fahey, Regent Schroeder and members of the Board of Regents, President Milliken, International guests and all of our colleagues from throughout the University of Nebraska system for joining us on this very special day.

One year ago tomorrow, during my installation ceremony, a quote from the Danish philosopher Soren Kirkegaard provided a context for my remarks when he wrote, "Life can only be understood backwards; but it must be lived forward."

Rural Superintendents: How Do Wyoming Rural Superintendents View And Respond To The Challenges Brought About By External Demands On Their Schools?, Jeanne L. Surface

Very little is known about how superintendents respond to and view the challenges brought about by increasing external performance demands on their schools. This important study uses a multi-case study format to create portraits of five rural superintendents, the challenges they face, and their responses to those challenges. The participant perceptions were organized into five themes: declining enrollment, isolation, board and community relations, celebrated accomplishments, and rural schools in contrast with urban or suburban schools. The superintendents were most proud of changes they had made to improve instruction in their districts. They spoke of challenges with bringing professional development to …

In this I start with 'engagement' and what that might mean in the context of a university-based research centre. There are, of course, many forms of engagement, but I wish to focus specifically on engagement as coproduction of knowledge. In this, our partner in the co-production of knowledge is the community, or rather civil society. I re-examine the nature of community, and the role of civil society in today's society. A concern over inequity and the existence of racial disparity of youth served by the juvenile justice system has long been a topic of considerable interest among scholars, policymakers, and court offi cials. Numerous empirical studies undertaken by academics and various public and private organizations have attempted to shed some light on this phenomenon. Research fi ndings on disproportionate minority contact have hardly been uniform, leaving much of this practice unexplained. This study uses data obtained at the detention decision point over a three-year period examining variance in juvenile case processing related to race. The purpose of the evaluation of the NDCS Serious and Violent Offender Reentry Program was to assess the success of the program in three areas. First, an evaluation of the process was conducted to determine if a reentry program had indeed been created by the NDCS. Second, a cost benefit analysis was conducted to determine the economic savings that a reentry program could promote for the state of Nebraska. Finally, an outcome evaluation was conducted to determine if the reentry program was successful in its goal of reducing recidivism among serious and violent offenders in the state. Below are the …

The goal of this paper is to demonstrate that possession of child pornography is not a victimless crime. It will illustrate the problem and explain the harm suffered by its victims. It will then trace factors that may have contributed to the perception that possession of child pornography is a victimless offense. The first factor is the dual nature of the child pornography laws that addresses both actual and future harm. When this duality is applied to possessors, their link to actual harm appears attenuated because the possessor is not involved in the acts of sexual abuse inherent in producing …

Fulfilling Lucy's Legacy: Recognizing Implicit Good-Faith Obligations Within Explicit Job Duties, Emily Gold Waldman

Wood v. Lucy, Lady Duff-Gordon is often cited for the principle that every contract contains an implied covenant of good faith and fair dealing. Yet the very source of that decision--the New York Court of Appeals--has been emphatically unwilling to recognize an implied good-faith covenant in the context of employment relationships, given the judicial presumption of employment at will. This essay criticizes the New York Court of Appeals' conclusion that the implied covenant of good faith and fair dealing must yield to the presumption of employment at will, and advocates a more balanced approach.

As an emerging world power, China has a crucial need for oil to meet its growing fuel consumption. It has invested heavily in Sudan, a country with extensive and productive oil reserves. However, this partnership has an ugly side. Sudanese militia groups, as well as government troops, have been committing gross human rights violations against residents of the Darfur region. Meanwhile, Chinese arms manufacturers have continued to export weapons and military equipment to Sudan, with the full knowledge of the Chinese government. This study set out to determine the effects that bullying in the workplace has on individual victims and the organizations where they work. The literature review presents the current research and determines where there are gaps. A qualitative study establishes the effects of bullying on individuals and organizations. Several participants provided details of bullying events and how these events impacted their performance. Conclusions were based both on the review of relevant literature as well as the experiences of the participants.

The relationship between hypertension and related biological, psychological, and social variables among patients diagnosed with hypertension was investigated utilizing the biopsychosocial model. Fifty-four participants from one outpatient private medical office were administered a demographic form, the Beck Anxiety Inventory (BAI), the Health Adherence Behavior Inventory (HABIT), the Inventory for Cognitive Distortions (ICD), and the Multidimensional Scale of Perceived Social Support (MSPSS). Results indicated that the participants' use of caffeine positively correlated with their high blood pressure readings. In addition, participants who reported having significant social support engaged in more health promoting behaviors. These findings were consistent with the hypotheses. Limitations …

A mathematical model of a cracked rotor and an asymmetric rotor with two disks representing a turbine and a generator is utilized to study the vibrations due to imbalance and side load. Nonlinearities typically related with a “breathing” crack are included using a Mayes steering function. Numerical simulations demonstrate how the variations of rotor parameters affect the vibration response and the effect of coupling between torsional and lateral modes. Bode, spectrum, and orbit plots are used to show the differences between the vibration signatures associated with cracked shafts versus asymmetric shafts. The Influence Of Biological Sex, Previous Experience, And Preparation Time On Classroom Public Speaking Grades, Judy C. Pearson, Jeffrey T. Child

Basic Communication Course Annual

How does biological sex affect public speaking grades? Students completed journal entries over the course of the semester. Hierarchical multiple regression incrementally examined competency measures (previous experience and overall preparation time) then biological sex on public speaking grade averages. Competency measures predicted higher speech grade averages, but women still earned higher speech grades even after the effects of competency had been removed. Among the explanations offered are that women may be more competent than men, a combination of competence and compliance explains women’s higher grades, or public speaking classrooms perpetuate a female competency bias.

In underground oil reservoirs, Hydrogen sulfide is usually found coexisting with the oil due to bacteria reduction over a long period of time. The amount of H2S in the oil varies from place to place around the globe. When the oil extraction process begins, the presence of Hydrogen sulfide becomes noticeable as drilling tools, piping and other equipment suffer from sulfide stress cracking, electrochemical corrosion and corrosion fatigue. Used tires have the potential for becoming popular in pollution control media used in stormwater applications including pervious pavement sub bases, green roof growth media, and upflow filters. Using tire crumb to decrease nutrients can minimize impacts on ecology while reducing the human footprint left by used tires. However, if tire crumb is not examined for toxicity, the ecological balance could unknowingly be disrupted. This research tested the acute toxicity of tire crumb in aquatic systems by finding the Lethal Concentration for 50% kill (LC50). Satellites typically communicate with locations on the ground to receive commands and send data back. Establishing reliable communications generally requires dedicated ground stations, which in turn require hardware and expertise. Developers of nano-satellites, however, may not have the expertise or resources necessary for establishing a dedicated ground station. Therefore, the use of an existing communication system, such as the Satellite Personal Communication Networks (S-PCNs), is attractive. Stormwater runoff is a known pollutant source capable of causing surface water degradation, especially in highly populated areas such as Central Florida. Wet detention ponds manage this stormwater, but most of the ponds do not remove enough nutrients, specifically nitrogen and phosphorus, to meet TMDL regulations. This research provides a possible addition to a detention pond in Seminole County, Florida using a Chamber Upflow Filter and Skimmer (CUFS), which can increase the removal of phosphorus and nitrogen by the system.
