Compulsory Arbitration As Part Of A Broader Employment Dispute Resolution Process: The Anheuser-Busch Example, Richard A. Bales, Jason N.W. Plowman

Federal and state reporters are filled with examples of lopsided arbitration agreements drafted by employers with the apparent intent of discouraging employees from successfully bringing valid claims. The case reporters contain far fewer examples of employment dispute resolution programs that are carefully designed to ensure that employees receive a fundamentally fair forum for the resolution of their employment disputes, for the obvious reason that employees are less likely to challenge these programs. Aging-related neurodegenerative diseases (NDs) are the culmination of many different genetic and environmental influences. Prior studies have shown that RNAs are pathologically altered during the inexorable course of some NDs. Recent evidence suggests that microRNAs (miRNAs) may be a contributing factor in neurodegeneration. miRNAs are brain-enriched, small (~22 nucleotides) non-coding RNAs that participate in mRNA translational regulation. Although discovered in the framework of worm development, miRNAs are now appreciated to play a dynamic role in many mammalian brain-related biochemical pathways, including neuroplasticity and stress responses. This Article deals with Cox v. City of Dallas, Halprin v. Prairie Single Family Homes of Dearborn Park Ass’n, and the issue of whether the Federal Fair Housing Act (FHA) should be interpreted to outlaw discrimination in the provision of services by local governments. Part I describes the Cox litigation and its connection with Halprin. Part II surveys the pre-Cox cases that have dealt with discriminatory municipal services. On September 25, 2003, a fire broke out at the National Health Care (NHC) nursing home facility in Nashville, Tennessee, causing sixteen deaths and a number of injuries from smoke inhalation. Thirty-two victims subsequently filed suit against the nursing home, alleging that NHC was negligent for failing to install sprinklers in its facility. This claim was made notwithstanding the fact that applicable federal, state, and local safety regulations did not require the installation of sprinklers in this particular type of building, and notwithstanding that the NHC facility had been inspected by state fire inspectors just months before the fire and …

This Article explores Arlington Central School District Board of Education v. Murphy, a decision rendered by the first Roberts Court that may become a benchmark for Spending Clause jurisprudence. The majority in Arlington, led by Justice Alito, adopted the standard for constitutional conditions on spending that had been the dissenting view for years during the Rehnquist Court. More specifically, under the Pennhurst and Dole regime, the Court required Congress to provide "adequate" notice of conditions on spending, which seemed to be sufficient for the clear statement rule the Court (through Justice O'Connor) was seeking to institute. Serious reservations have been expressed in Maharashtra about the sexuality component of programs intended to build awareness of safe and healthy behaviors for school-going youth. This policy brief answers: Is there a need for sexuality education in school and out-of-school in Maharashtra? Are the concerns expressed supported by evidence? Evidence was obtained from the Youth in India: Situation and Needs study conducted in Maharashtra, which explored young people’s awareness of sexual and reproductive matters, sexual experiences of youth, parent–child communication on sexual and reproductive matters, and experience and acceptability of sexuality education programs. The goal of the Southern Nevada Health District Childhood Lead Poisoning Prevention Program (CLPPP) is to eliminate lead poisoning as a significant health risk for children living in the state of Nevada. Transforming growth factor beta-activated kinase 1 (TAK1), a member of the MAPKKK family, is a key mediator of proinflammatory and stress signals. Activation of TAK1 by proinflammatory cytokines and T and B cell receptors induces the nuclear localization of nuclear factor kappaB (NF-kappaB) and the activation of c-Jun N-terminal kinase (JNK)/AP1 and P38, which play important roles in mediating inflammation, immune responses, T and B cell activation, and epithelial cell survival. Here, we report that TAK1 is critical for the survival of both hematopoietic cells and hepatocytes. Deletion of TAK1 results in bone marrow (BM) and liver failure in mice …

The Khmer Rouge Tribunal is expected by many in the international community to bring a sense of reconciliation to a nation still grappling with the aftermath of more than thirty years of civil war. Yet the gap between national and local reconciliation initiatives tests post-conflict reconstruction efforts to meet the needs of Cambodian citizens who feel unconnected to the tribunal. This article inquires into the interrelationship between national reconciliation processes and grassroots peacebuilding in the form of conflict resolution trainings. Noting that retributive justice processes cannot take the place of restorative justice, genuine reconciliation in Cambodia will need to incorporate …

The present study examined whether cardiovascular habituation to stress is affected by a change in the physical context in which a stressor is encountered. Twenty-five undergraduate students at the University of Central Florida, Palm Bay Campus, were exposed to 4 trials of a stressor consisting of mental arithmetic while under evaluative observation. It was hypothesized that if participants experienced a change in the physical context in which stress was experienced on the final trial, they would demonstrate impaired habituation to stress as indicated by measures of heart rate and blood pressure. Exploring The Relationship Between Patients' Health Locus Of Control And Perception Of Physician's Support, Maria F. Ricci Twitchell

This study explored the relationship between patients' Health Locus of Control and their perceptions about the nature of their physician-patient relationship. The Locus of Control Scale and the Multidimensional Health Locus of Control Scale were implemented to measure the degree of personal control individuals attribute to their health. The Health Care Climate Questionnaire was used to measure the perceived physician support. The predicted result of the study was that patients who exhibit a higher degree of internal health locus of control would report better relationships with their physicians. Ecology And Life History Of An Amazon Floodplain Cichlid: The Discus Fish Symphysodon (Perciformes: Cichlidae), William G. R. Crampton

The discus fishes of the genus Symphysodon are popular ornamental cichlids that occur in floodplain lakes and flooded forests of the lowland Amazon Basin. These habitats are characterized by extreme seasonal fluctuations in the availability of food, shelter and dissolved oxygen, and also the densities of predators and parasites. Most aspects of discus biology are influenced by these fluctuating conditions. This paper reports an autoecological study of the western Amazonian discus S. haraldi (until recently classified as S. aequifasciatus). This species feeds predominantly on algal periphyton, fine organic detritus, plant matter, and small aquatic invertebrates. At high water it forages …

This article examines the joint effect of issue capability and gender on risk taking. Across three studies, the authors show that the effect of issue capability is moderated by gender, depending on the compatibility between the goal orientation of the decision maker and the nature of the decision task. For decisions that are mainly driven by achievement of gains (e.g., investment decisions), men's risk-taking propensity is more influenced by their levels of issue capability than women's because the nature of the decision task is consistent with men's agentic orientation focused on the self. Chelonid fibropapillomatosis-associated herpesvirus (CFPHV) is an alphaherpesvirus believed to cause marine turtle fibropapillomatosis (FP). A serodiagnostic assay was developed for monitoring sea turtle populations for CFPHV exposure. CFPHV glycoprotein H (gH) expressed in recombinant baculovirus was used in an enzyme-linked immunosorbent assay (ELISA) to detect virus-specific 7S turtle antibodies. Using captive-reared green turtles (Chelonia mydas) with no history of virus exposure as "known negatives" and others with experimentally induced FP as "known positives," the assay had 100% specificity but low sensitivity, as seroconversion was detected in only half of the turtles bearing experimentally induced tumors.
