Resuscitating Hospital Enterprise Liability, Philip G. Peters Jr.

Missouri Law Review

Part I of this Article explains why existing malpractice law has failed to make patients safer. Part II then reviews the history of proposals for enterprise liability and the reasons those proposals were not adopted. Part III outlines my contention that hospital enterprise liability would revive the deterrent power of medical malpractice law. It also defends my claim that enterprise liability would align tort law with efforts of modem patient safety experts to reduce errors by focusing on system-wide improvement, rather than individual blame. Comparing Net And Eri Standardized Exam Scores Between Baccaulureate Graduates Who Pass Or Fail The Nclex-Rn, Mary D. Bondmass, Sheniz Moonie, Susan Kowalski

Environmental & Global Health Faculty Research

In the United States, nursing programs are commonly evaluated by their graduates success on the National Council Licensure Examination for Registered Nurses (NCLEX-RN). The purpose of this paper is to describe a change in NCLEX-RN success rates following the addition of standardized exams throughout our program's curriculum, and to compare these exam scores between graduates who pass NCLEX-RN and those who do not. Our results indicate an 8.5% change (p < 0.000) in the NCLEX-RN pass rate from our previous 5-year mean pass rate, and significant differences in standardized test scores for those who pass the NCLEX-RN compared to those who do not (p < 0.03). We conclude that our selected standardized exam scores are able to significantly identify graduates who are more likely to pass NCLEX-RN than not.

Quality end of life (EOL) care for the elderly continues to be a challenge, in part due to late referral for palliative and/or hospice services. The purpose of this study was to determine the accuracy of the MDS-CHESS scale (Hirdes, Frijters & Teare, 2003) in predicting 6-month mortality in a stable American nursing home (NH) population. A secondary aim was to determine any differences in mortality between the 2 sites. A sample of 191 residents of two NHs was analyzed in a retrospective, correlational cohort study, using data collected from the federal MDS database. No tort reform has more potential to improve the quality of medical care and to reduce the frequency of patient injuries than exclusive hospital enterprise liability. Hospital enterprise liability would make hospitals liable for all patient injuries occurring in the hospital that are the product of provider negligence, regardless of the independent contractor status of the providers. In its "exclusive" form, enterprise liability would also eliminate the personal liability of individual physicians and nurses. The Internet has significantly changed the ways in which information is provided, particularly in libraries. Libraries are buying increasing numbers of electronic reference (e-Reference) materials which are buried in the catalog or on web pages, not to be easily found by the user. Unlike print reference books, e-Reference books are not found on libraries’ reference shelves and, therefore, are underused. Libraries face the dilemma of how to make e-Reference books more accessible to patrons. Kansas State University Libraries are addressing this challenge by using the powerful metadata behind OPAC records to create browsable e-Reference lists. These lists are also published …

The main objective of the present study was to examine daily associations (intraindividual variability or IIV) between sleep and affect in older adults. Greater understanding of these associations is important, because both sleep and affect represent modifiable behaviors that can have a major influence on older adults’ health and well-being. We collected sleep diaries, actigraphy, and affect data concurrently for 14 days in 103 community-dwelling older adults. Multilevel modeling was used to assess the sleep–affect relationship at both the group (between-persons) and individual (within-person or IIV) levels. Tracing The History Of Medicare Home Health Care: The Impact Of Policy On Benefit Use, Joan K. Davitt, Sunha Choi

The Journal of Sociology & Social Welfare

We trace key policy changes that affected use of the Medicare home health benefit from the 1980s through the prospective payment system implemented in 2000, analyzing the impact on three measures of home care use: expenditures, users and visits. We demonstrate the impact of policies generated in the legislative, the judicial, and the executive branches of government and the gaming behavior of home health agencies in response to policy changes. Our analysis suggests that the policy itself and the implementation process are critical to understanding benefit use. Recent studies suggest the importance of examining cumulative risk or advantage as potential predictors of health over the life course. Researchers investigating the cumulative health effects of education, however, have mainly conceptualized education in years or degrees, often disregarding educational quality and access to educational opportunities that may place individuals on divergent academic trajectories. We investigate whether educational advantages in youth are associated with an individual's health trajectory. We develop a novel index of educational advantage and employ random-intercept modeling using data from the National Longitudinal Survey of Youth.
