Security Design That Addresses Agency Conflicts And Information Asymmetry, Manish Tewari
Security Design That Addresses Agency Conflicts And Information Asymmetry, Manish Tewari
Electronic Theses and Dissertations
This study focuses on the role of structured derivative securities to meet diverse corporate financing objectives in the light of agency theory and asymmetric information. The focus is on the nonconvertible callable-puttable fixed-coupon bonds. The primary objective is to discern the marginal role of the put and put-deferred features in addressing the agency issues and asymmetric information. A sample of (159) securities issued over the period (1977-2005) are examined using Merton's (1974) structural contingent claims valuation model. The put option as well as the deferred put option incorporated in these securities is found to mitigate the asset substitution issue. It …
Examining The Effect Of Organizational Policy Changeon Taser Utilizations, Michael Miller
Examining The Effect Of Organizational Policy Changeon Taser Utilizations, Michael Miller
Electronic Theses and Dissertations
The purpose of this study is to examine the effect of organizational policy changes within the Use-of-Force Continuum on taser usage and officer's perceptions of taser effectiveness. Tasers have been used by police since the 1970s and their use is increasing as the technology has improved. Data reveals that tasers are beneficial for controlling non-compliant suspects while preventing serious injuries and rarely has their use resulted in death. Much of the public controversy surrounding tasers centers on when and how often officers deploy them. Use of force data from 890 police citizen encounters during a two-year period was analyzed to …
Take The Training Wheels Off The League: Major League Soccer's Dysfunctional Relationship With The International Soccer Transfer System, Omar H. Ayad
Vanderbilt Journal of Entertainment & Technology Law
Currently in its eleventh season, Major League Soccer (MLS) is struggling to establish its identity and niche in the international soccer community. In particular, issues of player control and transfer regulations continue to distinguish and alienate the league from the elite soccer associations of Europe, as well as the overall global soccer community. Since Fraser v. Major League Soccer, the league has been defined as a single entity and, thus, is free to wield substantial control over player contracting and placement, while avoiding charges of monopolistic behavior. MLS has taken advantage of this freedom when executing international transfers of MLS …
A Prototype For Narrative-Based Interactivity In Theme Parks, Kirsten Kischuk
A Prototype For Narrative-Based Interactivity In Theme Parks, Kirsten Kischuk
Electronic Theses and Dissertations
The purpose of this thesis is to look at the potential for interactive devices to enhance the story of future theme park attractions. The most common interactive theme park rides are about game-based interaction, competition, and scoring, rather than about story, character, and plot. Research into cognitive science, interactivity, narrative, immersion, user interface, theming and other fields of study illuminated some potentially useful guidelines for creating compelling experiences for park guests. In order to test some of these ideas, an interactive device was constructed and tested with study subjects. Each study subject watched a video recording of an existing theme …
The Attic Door: A Feature Length Motion Picture, Daniel Daneau
The Attic Door: A Feature Length Motion Picture, Daniel Daneau
Electronic Theses and Dissertations
THE ATTIC DOOR is the feature-length film co-written and directed by Danny Daneau while pursuing a Master of Fine Arts at the University of Central Florida. Many challenges had to be met to produce a feature-length motion picture utilizing digital technology on an ultra-low budget as part of a graduate education. Beyond gaining a profound understanding of the physical, financial, and emotional strength it takes to complete a feature-length motion picture, Daneau experienced the creative challenges that all filmmakers must meet when applying the principles of filmmaking theory to an actual work of self-expression. The production process for an original …

Hope For A Thorn: The Making Of A Microbudget Digital Feature Film, Leslie Kitzinger
Electronic Theses and Dissertations
This paper provides a look at the making of a microbudget feature film. It seeks to explain my growth as a filmmaker and an artist, through the challenges, both narrative and practical, that I encountered, as well as provide documentation following the process. Hope for a Thorn: The Making of a Microbudget Digital Feature Film includes elements from each phase of filmmaking, from script and preproduction to the marketing plan. This document shows the tremendous amount of preparation and planning that goes into the making of a microbudget digital feature film.
Gutter King, Keith Morris
Gutter King, Keith Morris
Electronic Theses and Dissertations
Gutter King had a threefold purpose: to create a feature film using limited resources, to make the film bridge the gap between a defined artistic aesthetic and its broader distribution goals, and to make the film entertaining to its target market of 14-24 year old males. The methods used: exploiting new digital technology, using a limited workforce (crew), and implementing a planned improvisational structure.
Marijuana Legalization: Americans' Attitudes Over Four Decades, Anthony Saieva
Marijuana Legalization: Americans' Attitudes Over Four Decades, Anthony Saieva
Electronic Theses and Dissertations
Americans have long held a variety of opinions when it comes to the legalization of marijuana. While previous research has mostly focused on use rates and behavior, the purpose of this examination is to specifically analyze people's attitudes towards marijuana legalization. Of particular importance was (1) the extent to which attitudes towards marijuana legalization have changed over the past four decades and (2) how the social factors often associated with marijuana legalization attitudes have changed over the same period. Results indicate that over one-third of Americans now believe marijuana should be made legal. These pro-legalization attitudes are at their highest …
What Makes Them Click? Applying The Rational Choice Perspective To The Hacking Underground, Michael Bachmann
What Makes Them Click? Applying The Rational Choice Perspective To The Hacking Underground, Michael Bachmann
Electronic Theses and Dissertations
The increasing dependence of modern societies, industries, and individuals on information technology and computer networks renders them ever more vulnerable to attacks on critical IT infrastructures. While the societal threat posed by hackers and other types of cyber-criminals has been growing significantly in the last decade, main-stream criminology has only recently begun to realize the significance of this threat. Cyber-criminology is slowly emerging as a subfield of criminological study and has yet to overcome many of the problems other areas of criminological research have already mastered. Aside from substantial methodological and theoretical problems, cyber-criminology currently also suffers from the scarcity …
Media, Civil Society And Political Culture In West Africa, Mohamed Saliou Camara
Media, Civil Society And Political Culture In West Africa, Mohamed Saliou Camara
Humanities & Communication - Daytona Beach
From the premise that a free and democratic society is impossible without free and responsible media and an active civil society and that freedom and democracy must evolve from within a particular society in order to mature into a way of life for the society and its media, the present study examines the symbiotic role of the media and civil society in West Africa’s struggle for democratic governance. It addresses the question of the independence and accountability of West Africa’s media vis-à-vis foreign donors, local business and political forces along with the effects on local audiences of giant Western/global media …
Mental Health Care In India: Prescribing The Right Policy, Kimberly Meltzer
Mental Health Care In India: Prescribing The Right Policy, Kimberly Meltzer
Pepperdine Policy Review
India’s perspectives on mental health and standards of care have been complicated by developmental factors, resulting in recognition not upheld in practice. India is a country of particular interest due to this disparity between its rhetoric and reality, and looking at the history of mental health and the impact of these factors will help shape recommendations for improving mental health care. Mental health policy efforts and traditions of care continue to fall short of the country’s mental health care needs. Policy recommendations proposed in this paper center on community mental health care, which should and can be expanded by maximizing …

Half-Truths, Mistakes, And Embarrassments: The United States Goes To The Fifth Meeting Of The Special Session To Review The Operation Of The Hague Convention On The Civil Aspects Of International Child Abduction, Merle H. Weiner
Utah Law Review
The United States was not an admirable leader at the Fifth Meeting. When invited by the pre-meeting questionnaire to “make proposals concerning recommendations to be made by the Special Commission,” the United States was silent.493 The United States, however, was vocal in its indifference, or perhaps hostility, to the plight of domestic violence victims. While its position was condemnable, the transparency with which the United States presented it allows concerned individuals to address the merits of the U.S. position. In contrast, the U.S. position on a number of other issues was obscured with nationalistic legal language. The use of this …
The Poetry Of Law, Sidney Delong
The Poetry Of Law, Sidney Delong
Faculty Articles
This article examines the literature of statutory drafting. This underappreciated genre is perhaps the last place one would expect to find a sensitive soul struggling to escape the prison house of language. Yet the economic realities facing today's graduate students mean that many former lit majors will find their way onto legislative drafting committees, whence they peek out at us from under the sub-sections of their lives. It is time that this genre was formally recognized. Of course, its artists struggle against the challenge of the form and their achievements must be measured in millimeters rather than miles. This article …
The Parent Trap: Differential Familial Power In Same-Sex Families, Deirdre Bowen
The Parent Trap: Differential Familial Power In Same-Sex Families, Deirdre Bowen
Faculty Articles
Do intact same-sex couples where one member of the couple became pregnant with assisted reproduction or was the primary adopter, and the other member became a parent through second parent adoption, understand the legal protections afforded them? In short the answer is no. An interesting family dynamic arises around those who can claim the true status as parent based on their legal understandings of parenthood and their interactions with the dominant culture. The result of research conducted on this issue indicated that second parent adopters had much less emotional power in the family, but often had more economic power. Even …

Remedial Approaches To Human Rights Violations: The Inter-American Court Of Human Rights And Beyond, Thomas Antkowiak
Remedial Approaches To Human Rights Violations: The Inter-American Court Of Human Rights And Beyond, Thomas Antkowiak
Faculty Articles
A sustained reflection upon remedial obligations and possibilities is particularly necessary at this juncture in the development of international law, where important mechanisms with reparative functions have recently sprung up around the world: the International Criminal Court, the African Court of Human Rights, and several national schemes, as a result of proliferating transitional justice initiatives. This article argues for a remedial model that emphasizes the restorative measures of satisfaction and rehabilitation, as well as general assurances of non-repetition. The work first examines the case law of the Inter-American Court of Human Rights, the only international human rights body with binding …
Unlocking The Secrets Of Highly Successful Legal Writing Students, Anne Enquist
Unlocking The Secrets Of Highly Successful Legal Writing Students, Anne Enquist
Faculty Articles
Why are some law students successful in their legal writing classes and others are not? To identify the secrets to success, Professor Enquist did a case study of six second-year law students as they wrote a motion brief and an appellate brief for their 2L legal writing course. Based on their 1L legal writing course, two of these students were predicted to be highly successful, two were predicted to be moderately successfully, and two were predicted to be only marginally successful. Through daily records of all their activities related to writing the briefs, interviews with the study subjects, drafts of …
The Enforceability Of Default Interest In Real Estate Mortgages, Steven W. Bender
The Enforceability Of Default Interest In Real Estate Mortgages, Steven W. Bender
Faculty Articles
This article examines the use of default interest rate provisions in real estate mortgage loan transactions and the varying ways courts assess the enforceability of such provisions. The authors argue that these provisions are important to lenders, ensuring that they are able to recover the transaction costs and risks associated with defaulting borrowers. The article asserts that, due to the importance of these provisions to lenders' financial stability, courts should apply the unconscionability standard with a deference to freedom of contract principles before refusing to enforce default interest rate provisions. The authors also outline guidelines lenders should follow in both …
The Challenges Of Representing Detained Non-Citizens In Expedited Removal Proceedings From The Perspective Of The Dickinson School Of Law Immigration Clinic, Won Kidane
Faculty Articles
Persons deprived of their liberties as a result of administrative detention for immigration reasons face a multitude of serious challenges. There is currently no recognized right to the government-appointed representation in immigration proceedings. As a result, on a very small percentage of immigrants obtain pro bono or any other kind of legal representation. This problem is compounded by the fact that most immigration detainees are detained in remote rural areas where the private bar is virtually unavailable. Those who are fortunate to obtain pro bono or other types of legal representation also face some serious challenges at the different stages …

Differential Dynamic Properties Of Scleroderma Fibroblasts In Response To Perturbation Of Environmental Stimuli, Momiao Xiong, Frank C. Arnett, Xinjian Guo, Hao Xiong, Xiaodong Zhou
Faculty, Staff and Student Publications
Diseases are believed to arise from dysregulation of biological systems (pathways) perturbed by environmental triggers. Biological systems as a whole are not just the sum of their components, rather ever-changing, complex and dynamic systems over time in response to internal and external perturbation. In the past, biologists have mainly focused on studying either functions of isolated genes or steady-states of small biological pathways. However, it is systems dynamics that play an essential role in giving rise to cellular function/dysfunction which cause diseases, such as growth, differentiation, division and apoptosis. Biological phenomena of the entire organism are not only determined by …

Debating Identity: Urban Indians In The Healthcare System, Erin J. Klahn
Debating Identity: Urban Indians In The Healthcare System, Erin J. Klahn
Graduate Student Theses, Dissertations, & Professional Papers
In recent years, the public health sector has recommended that healthcare practitioners become culturally competent in order to reduce health disparities in minority groups. It was reported later in the Surgeon General's Report (1999) on mental health, that culture shapes the healthcare experience for minority groups and in turn may influence the treatment course. Cultural competence models have been proposed in conjunction with the development of ethnic-specific mental health clinics, where practitioners and patients are ethnically similar, and programs are designed with the groups’ unique cultural needs in mind. This poses a particularly unique dilemma for urban Indians as their …

The Ilo Convention On Freedom Of Association And Its Future In The United States, Steve Charnovitz
GW Law Faculty Publications & Other Works
This paper addresses the status of the international law convention on freedom of association in the United States. Although the United States supported the adoption of the Convention on Freedom of Association (#87) in the International Labour Organization in 1948, the U.S. government has not ratified that Convention. Instead, the Convention has sat on the shelf in the United States Senate since 1949, the longest unratified convention on the treaty calendar of the Senate Foreign Relations Committee. The paper analyzes the disadvantages for the United States in failing to become a party to this important treaty. The paper notes that …
Harmless Constitutional Error And The Institutional Significance Of The Jury, Roger A. Fairfax Jr.
Harmless Constitutional Error And The Institutional Significance Of The Jury, Roger A. Fairfax Jr.
GW Law Faculty Publications & Other Works
Appellate harmless error review, an early twentieth-century innovation prompted by concerns of efficiency and finality, had been confined to non-constitutional trial errors until forty years ago, when the Supreme Court extended the harmless error rule to trial errors of constitutional proportion. Even as criminal procedural protections were expanded in the latter half of the twentieth century, the harmless error rule operated to dilute the effect of many of these constitutional guarantees - the right to jury trial being no exception. However, while a tradeoff between important process values and the Constitution's protection of individual rights is inherent in the harmless …

An examination of the eschatological problem, defined as an over-emphasis on the individual nature of the end-times, asserting that the problem may be reconciled through an application of theological aesthetics, and a practical example of this application in the art of theSaint John’sBible.
