Finding International Law: Rethinking The Doctrine Of Sources, Harlan G. Cohen Nov 2007

Finding International Law: Rethinking The Doctrine Of Sources, Harlan G. Cohen

Scholarly Works

The doctrine of sources has served international law well over the past century, providing structure and coherence during a time when international law was expanding rapidly and dramatically. But the doctrine's explanatory power is increasingly being challenged. Current doctrine tells us that treaties are international law; empirical evidence, however, suggest that treaties are poor predictors of state practice. The expansion of the international community, the rise of human rights, developments in international legal theory, and the international system's need to adapt to changing circumstances, have all also put pressure on the reified role of "treaty" in identifying rules of international …

The Value-Congruence Model Of Memory For Emotional Experiences: An Explanation For Cultural Differences In Emotional Self-Reports, Shigehiro Oishi, Ulrich Schimmack, Ed Diener, Chu Kim-Prieto, Christie N. Scollon, Dong-Won Choi

Research Collection School of Social Sciences

In 3 studies, the authors found support for the value-congruence model that accounts for cultural variations in memory for emotional experiences. In Study 1, the authors found that in the made-in-the-U.S. scenario condition, European Americans were more accurate than were Asian Americans in their retrospective frequency judgments of emotions. However, in the made-in-Japan scenario condition, European Americans were less accurate than were Asian Americans. In Study 2, the authors demonstrated that value orientation mediates the Culture X Type of Event congruence effect. In Study 3 (a daily event sampling study), the authors showed that the congruence effect was explained by …

The Promise Of A Managerial Values Approach To Corporate Philanthropy, Jaepil Choi, Heli Wang Nov 2007

The Promise Of A Managerial Values Approach To Corporate Philanthropy, Jaepil Choi, Heli Wang

Research Collection Lee Kong Chian School Of Business

This article presents an alternative rationale for corporate philanthropy based on managerial values of benevolence and integrity. On the one hand, top managers with benevolence and integrity values are more likely to spread their intrinsic concern for others into the wider society in the form of corporate philanthropy. On the other hand, top managers high in benevolence and integrity are likely to contribute to improved managerial credibility and trusting firm-stakeholder relationships, thereby improving corporate financial performance. Therefore, the article makes the argument that both corporate philanthropy and corporate financial performance can better be interpreted as resulting from managers’ benevolence and …

What Is Extreme Cruelty? Judicial Review Of Deportation Cancellation Decisions For Victims Of Domestic Abuse, Anna Byrne Nov 2007

What Is Extreme Cruelty? Judicial Review Of Deportation Cancellation Decisions For Victims Of Domestic Abuse, Anna Byrne

Vanderbilt Law Review

In the 1990s, Congress began to devote increased attention to the problem of domestic violence, a rampant national problem with social and economic costs. At the same time, concerns about immigrants draining the social welfare service system and taking jobs away from U.S. citizens gave rise to an interest in more stringently monitoring and eradicating the illegal alien population in the United States. As part of the 1994 Violence Against Women Act ("VAWA"), Congress passed the battered spouse provision, attempting to reconcile its desires to address domestic violence and tighten immigration laws. Illegal immigrants are subject to removal procedures. However, …

Barring Too Much: An Argument In Favor Of Interpreting The Immigration And Nationality Act Section 101(A)(42) To Include A Duress Exception, Nicole Lerescu Nov 2007

Barring Too Much: An Argument In Favor Of Interpreting The Immigration And Nationality Act Section 101(A)(42) To Include A Duress Exception, Nicole Lerescu

Vanderbilt Law Review

The asylum system is in disarray. The United States is unable to guarantee that every asylum seeker will receive a fair and impartial hearing. Although media attention recently has focused on the asylum system's procedural flaws, unjust statutory interpretations also work against those seeking refuge in the United States. This Note focuses on one particular example within this commonly criticized area of the law: the prevailing interpretation of section 101(a)(42) of the Immigration and Nationality Act to bar those who have persecuted others under duress from attaining refugee status.

It is intuitively appealing that a system of laws should hold …

Integrating Investment Treaty Conflict And Dispute Systems Design, Susan Franck Nov 2007

Integrating Investment Treaty Conflict And Dispute Systems Design, Susan Franck

Scholarly Articles in Law Reviews & Journals

With the debate on the renewal of the Trade Promotion Authority Act, the proper terms of investment treaties - including dispute resolution provisions - have become an issue of public scrutiny. In a so-called litigation explosion, investors resolve disputes against host governments through international arbitration mechanisms in investment treaties; and there is little evidence of reliance on other processes like mediation. This escalation has lead to a teething period where parties and non-parties have expressed divergent views as to the efficacy, efficiency and fairness of the dispute resolution process. With billions of dollars and sovereignty at stake, the dispute resolution …

The Purpose Of Our Efforts, Donelson R. Forsyth Nov 2007

The Purpose Of Our Efforts, Donelson R. Forsyth

Jepson School of Leadership Studies articles, book chapters and other publications

This year’s APA Convention in San Francisco was something of a homecoming for the division, for it was in that same city, some 18 years ago, that group psychology and group psychotherapy first took the stage as a newly founded division within APA. Only a few months earlier this fledgling coalition of dedicated supporters of group approaches had successfully petitioned APA for official divisional recognition. As that petition explained, it was time for psychologists to focus on groups and group-based approaches to adjustment, arguing that there “are two basic psychological approaches to human life and to mental health; one through …

Citing The Elite: The Burden Of Authorial Anxiety, Shane Tintle Nov 2007

Citing The Elite: The Burden Of Authorial Anxiety, Shane Tintle

Duke Law Journal

Academic legal writing is known for extensive citation. Generally, scholars who study citation practices are increasingly likely to link citation with authors' attempts to manage their impression. This Note offers an explanation of why authors of law review articles use citation as a means of managing impression. It combines a historical analysis that shows why excessive citation became conventional with a literary analysis that shows why excessive citation was unique in its ability to aid academics in substantively contributing to the bench and bar. It further shows how, because of the historic and literary significance of citation, a norm compelling …

A Voice Operated Musical Instrument., Travis R. Gault Nov 2007

A Voice Operated Musical Instrument., Travis R. Gault

Electronic Theses and Dissertations

Many mathematical formulas and algorithms exist to identify pitches formed by human voices, and this has continued to be popular in the fields of music and signal pro-cessing. Other systems and research perform real time pitch identification implemented by using PCs with system clocks faster than 400MHz. This thesis explores developing an embedded RPTI system using the average magnitude difference function (AMDF), which will also use MIDI commands to control a synthesizer to track the pitch in near real time. The AMDF algorithm was simulated and its performance analyzed in MATLAB with pre-recorded sound files from a PC. Errors inherent …

Forgotten Racial Equality: Implicit Bias, Decisionmaking, And Misremembering, Justin D. Levinson Nov 2007

Forgotten Racial Equality: Implicit Bias, Decisionmaking, And Misremembering, Justin D. Levinson

Duke Law Journal

In this Article, I claim that judges and jurors unknowingly misremember case facts in racially biased ways. Drawing upon studies from implicit social cognition, human memory research, and legal decisionmaking, I argue that implicit racial biases affect the way judges and jurors encode, store, and recall relevant case facts. I then explain how this phenomenon perpetuates racial bias in case outcomes. To test the hypothesis that judges and jurors misremember case facts in racially biased ways, I conducted an empirical study in which participants were asked to recall facts of stories they had read only minutes earlier. Results of the …

An information system is typically developed by a team of information systems (IS) professionals. Research shows that teams staffed with the right people are more likely to be effective and efficient. There is a paucity of study that examines the important traits of IS professionals in team contexts. The objective of this research is to identify and understand the important characteristics of good team members in software development projects. We applied an established psychological technique (Repertory Grid) to guide our interviews with 21 experienced IS professionals, who have had extensive experience in software development teams.
