Rodrigo's Corrido: Race, Postcolonial Theory, And U.S. Civil Rights, Richard Delgado Nov 2007

Rodrigo's Corrido: Race, Postcolonial Theory, And U.S. Civil Rights, Richard Delgado

Vanderbilt Law Review

Richard Delgado enlists his alter ego, Rodrigo, to analyze Latino legal history and civil rights. Encountering "the Professor" after testifying at a hearing on an immigration bill, Rodrigo excitedly tells his old friend and mentor about a new body of writing he has come across. Postcolonial theory, which deals with issues such as cultural survival, resistance, and collaboration, can help move American civil rights scholarship beyond its current impasse. Over dinner, Rodrigo demonstrates how insights from these writers can enrich U.S. civil rights theory and practice. He also posits a new theory of Latinos' sociolegal construction, based on a triple …

Special Project: Current Issues In Immigration, Anna Byrne

Vanderbilt Law Review

These words, so famously engraved upon a plaque inside the Statue of Liberty, have become an anachronism in modern American politics. In recent years our society has witnessed a maelstrom arise concerning immigration law and enforcement, with vocal factions spouting angry vitriol about the need to tighten borders and crack down on illegal immigration. Intense debate was sparked 2006 after the House of Representatives passed a restrictive bill that called for a wall to be built along 700 miles of the U.S.-Mexican border, criminalized the aiding or encouraging of illegal immigrants to remain in the country, and imposed new penalties …

The Origins Of Shared Intuitions Of Justice, Owen D. Jones, Paul H. Robinson, Robert Kurzban Nov 2007

The Origins Of Shared Intuitions Of Justice, Owen D. Jones, Paul H. Robinson, Robert Kurzban

Vanderbilt Law Review

The role of justice in assigning criminal liability and punishment has been a matter of long-standing debate. A standard argument against a desert distributive principle-that is, against distributing punishment according to an offender's blameworthiness- has been that such a concept of "desert" is simply too vague and the subject of too much disagreement to operationalize. There may be some truth to these complaints when applied to a philosophical notion of desert, which has been the traditional basis of the desert school.

But more recently, a utilitarian-based theory of desert has urged reliance on an empirical notion of desert, drawn from …

Measuring Diversity Management Skill: Development And Validation Of A Situational Judgment Test, Andrew Biga Nov 2007

Measuring Diversity Management Skill: Development And Validation Of A Situational Judgment Test, Andrew Biga

USF Tampa Graduate Theses and Dissertations

As a result of both demographic and social changes in the U.S., organizations have become much more diverse. Diversity presents unique challenges for management as it is linked to both positive and negative organizational performance outcomes (Mannix & Neale, 2005). Diversity, by itself, may not be sufficient to achieve competitive advantage. Effective diversity management becomes an important issue for organizations to consider. The current research uses Situational Judgment Test (SJT) methodology to develop an assessment measuring Diversity Management Skill. The development of a SJT involves a three-step process: Creation of critical incidents, generation of response options, and use of SME …

The Acquisition Of Two Phonetic Cues To Word Boundaries, Melissa A. Redford, Christina E. Gildersleeve-Neumann Nov 2007

The Acquisition Of Two Phonetic Cues To Word Boundaries, Melissa A. Redford, Christina E. Gildersleeve-Neumann

Speech and Hearing Sciences Faculty Publications and Presentations

The study evaluated whether durational and allophonic cues to word boundaries are intrinsic to syllable production, and so acquired with syllable structure, or whether they are suprasyllabic, and so acquired in phrasal contexts. Twenty preschool children (aged 3 ; 6 and 4 ; 6) produced: (1) single words with simple and complex onsets (e.g. "nail" vs. "snail"); and (2) two-word phrases with intervocalic consonant sequences and varying boundary locations (e.g. "this nail" vs. "bitty snail"). Comparisons between child and adult control productions showed that the durational juncture cue was emergent in the four-year-olds' productions of two-word phrases, but absent elsewhere. …

Suburbs As Exit, Suburbs As Entrance, Nicole Stelle Garnett Nov 2007

Suburbs As Exit, Suburbs As Entrance, Nicole Stelle Garnett

Michigan Law Review

Most academics assume that suburbanites are "exiters " who have abandoned central cities. The exit story is a foundational one in the fields of land-use and local-government law: exiters' historical, social, and economic connections with "their" center cities are frequently used to justify both growth controls and regional government. The exit story, however no longer captures the American suburban experience. For a majority of Americans, suburbs have become points of entrance to, not exit from, urban life. Most suburbanites are "enterers "-people who were born in, or migrated directly to, suburbs and who have not spent time living in any …

The Preemployment Ethical Role Of Lawyers: Are Lawyers Really Fiduciaries?, Fred C. Zacharias Nov 2007

The Preemployment Ethical Role Of Lawyers: Are Lawyers Really Fiduciaries?, Fred C. Zacharias

William & Mary Law Review

This Article considers the nature and extent of lawyers' obligations to prospective clients. Most jurisdictions have rules forbidding certain kinds of representation, requiring that particular information be given clients in writing, and regulating fees. Professional code drafters, courts, and commentators, however, have never addressed the broader issue of the lawyer's role at the retainer stage of representation, including whether lawyers have responsibility for providing prospective clients with candid advice regarding the course they should pursue.

The issue is important to clients. A lawyer's action may determine whether a client obtains any representation, competent representation, or a lawyer well suited to …

An Alternative Strategy For Building Sales Of Computers: Generic Advertising, Min Lu, Steven M. Thompson, Yanbin Tu Nov 2007

An Alternative Strategy For Building Sales Of Computers: Generic Advertising, Min Lu, Steven M. Thompson, Yanbin Tu

Management Faculty Publications

Frequent upgrading and aggressive price-cutting have become standard practice in the computer sector. While necessitated in part by declining production costs and a highly competitive market, these strategies have also served to make computers more affordable, growing the size of the overall market. Recently downturns in the sales of computers motivate us to examine the impact of these strategies on overall sales growth. We find evidence to suggest that excessive upgrading and overly aggressive price-cutting can be detrimental to overall sales growth. We also find that the computer sector exhibits characteristics that suggest that generic advertising would be an effective …

Template Use And The Effectiveness Of Knowledge Transfer, Robert J. Jensen, Gabriel Szulanski Nov 2007

Template Use And The Effectiveness Of Knowledge Transfer, Robert J. Jensen, Gabriel Szulanski

Faculty Publications

This paper is a direct empirical examination of the fundamental claim that use of templates enhances the effectiveness of knowledge transfer. We explore the effect of template use through an eight-year, in-depth field investigation of Rank Xerox (now Xerox Europe). The field investigation covers three sequential transfer efforts in 15 western European countries. The investigation reveals a naturally occurring, repeated-treatment quasi experiment that allows us to test the hypothesis that the use of templates enhances the effectiveness of knowledge transfer. "Observation" in this experiment measure the extent of adoption and performance of the practice at the recipient units. The "treatment" …

Blinking On The Bench: How Judges Decide Cases, Chris Guthrie, Jeffrey J. Rachlinski Nov 2007

Blinking On The Bench: How Judges Decide Cases, Chris Guthrie, Jeffrey J. Rachlinski

Vanderbilt Law School Faculty Publications

How do judges judge? Do they apply law to facts in a mechanical and deliberative way, as the formalists suggest they do, or do they rely on hunches and gut feelings, as the realists maintain? Debate has raged for decades, but researchers have offered little hard evidence in support of either model. Relying on empirical studies of judicial reasoning and decision making, we propose an entirely new model of judging that provides a more accurate explanation of judicial behavior. Our model accounts for the tendency of the human brain to make automatic, snap judgments, which are surprisingly accurate, but which …

The Origins Of Shared Intuitions Of Justice, Owen D. Jones, Paul H. Robinson, Robert Kurzban Nov 2007

The Origins Of Shared Intuitions Of Justice, Owen D. Jones, Paul H. Robinson, Robert Kurzban

Vanderbilt Law School Faculty Publications

Contrary to the common wisdom among criminal law scholars, empirical evidence reveals that people's intuitions of justice are often specific, nuanced, and widely shared. Indeed, with regard to the core harms and evils to which criminal law addresses itself-physical aggression, takings without consent, and deception in transactions-the shared intuitions are stunningly consistent across cultures as well as demographics. It is puzzling that judgments of moral blameworthiness, which seem so complex and subjective, reflect such a remarkable consensus. What could explain this striking result?

The authors theorize that one explanation may be an evolved predisposition toward these shared intuitions of justice, …

The Approach Of The Black Death In Switzerland And The Persecution Of Jews, 1348-1349, Albert Winkler Nov 2007

The Approach Of The Black Death In Switzerland And The Persecution Of Jews, 1348-1349, Albert Winkler

Swiss American Historical Society Review

When the Black Death first arrived in Europe in 1347, it struck along the Mediterranean coast of Italy and southern France. In the following year, the plague swept into central Europe following major trade routes deep into the interior of the continent. The pestilence was one of the most virulent diseases ever to strike the human community, and its impact was devastating, because perhaps a third of the population of Europe died in the next several years. People were dying at an unprecedented rate, and no one knew precisely what the contagion was or how to stop it. 1 A …

Decency, Dignity, And Desert: Restoring Ideals Of Humane Punishment To Constitutional Discourse, Eva Nilsen Nov 2007

Decency, Dignity, And Desert: Restoring Ideals Of Humane Punishment To Constitutional Discourse, Eva Nilsen

Faculty Scholarship

American punishment today is degrading, indecent, and harsher than deserved despite a Constitution designed to protect people from cruel and unusual punishment. Unfortunately, the U.S. Supreme Court’s response to the increasing inhumanity of contemporary punishment has been to reduce its Eighth Amendment jurisprudence to tidy categories, legal fictions, and hollow phrases. Absent from the discourse is any acknowledgement of the actual day-to-day experience facing the convicted person, or any suggestion that, although punishments can be degrading, they need not be. The case for treating a convicted person with respect for his human dignity, and for constitutional scrutiny of punishment as …

Factors Associated With Teenage Pregnancy In The European Union Countries: A Systematic Review, Mari Imamura, Janet Tucker, Phil Hannaford, Miguel Oliveira Da Silva, Margaret Astin, Laura Wyness, Kitty Wm Bloemenkamp, Albrecht Jahn, Helle Karro, Jørn Olsen, Marleen Temmerman Nov 2007

Factors Associated With Teenage Pregnancy In The European Union Countries: A Systematic Review, Mari Imamura, Janet Tucker, Phil Hannaford, Miguel Oliveira Da Silva, Margaret Astin, Laura Wyness, Kitty Wm Bloemenkamp, Albrecht Jahn, Helle Karro, Jørn Olsen, Marleen Temmerman

Obstetrics and Gynaecology, East Africa

Background: As part of the REPROSTAT2 project, this systematic review aimed to identify factors associated with teenage pregnancy in 25 European Union countries.

Methods: The search strategy included electronic bibliographic databases (1995 to May 2005), bibliographies of selected articles and requests to all country representatives of the research team for relevant reports and publications. Primary outcome measure was conception. Inclusion criteria were quantitative studies of individual-level factors associated with teenage (13–19 years) pregnancy in EU countries.

Results: Of 4444 studies identified and screened, 20 met the inclusion criteria. Most of the included studies took place in UK and Nordic countries. …
