Language is like the cane in the hand of the blind person. The better one becomes at getting around with the cane, the more he or she is apt to forget the cane but through the cane perceive the objects scraped and tapped by the other end. A defective cane may distort the world perceived by the blind person. So too, defective use of language threatens to muddy our understanding of the things we talk about. Foreign critics sometimes accuse Americans of taking a hypocritical stance on international law. They say we preach an ethical international law to others, but practice a selfishly utilitarian international law ourselves. Postcolonial theory aims at a critical interrogation of legitimizing knowledge claims put forward by proponents of the resurgent Empire. This article undertakes such an interrogation at the intersection of geography and international law. It aims to demonstrate that both modern geography and modern international law were constituted in, by, and through imperatives of Empire and unavoidably bear traces of their formative origin. The aim is to theorize the spatiality of global relations of domination and resistance under the shadow of international law. Nest Reuse By Eastern Kingbirds: Adaptive Behavior Or Ecological Constraint?, Lucas J. Redmond, Michael T. Murphy, Amy C. Dolan

The reuse of old nests by open-cup nesting passerines is a seemingly rare but potentially adaptive behavior if, as a consequence, females begin to breed earlier, lay larger clutches, or fledge more young. We report an unusually high rate of nest reuse (~10% of 341 nests) for Eastern Kingbirds (Tyrannus tyrannus) breeding at Malheur National Wildlife Refuge, Oregon. We found no difference in availability of nesting habitat or food abundance in territories in which nests were and were not reused. We also found no support for the hypotheses that kingbirds benefited from nest reuse by breeding earlier, laying …

A Database Of Persons Convicted Of Felonies In Washtenaw County, Michigan, 1990-2007, Donald E. Shelton

Master's Theses and Doctoral Dissertations

This study is a database of information from Washtenaw County, Michigan, court records of approximately one-fourth of its convicted felons from 1990 to 2007. It includes 3,123 sentencing appearances for 3,992 crimes committed by 2,495 defendants. It includes 1126 probation violation resentencings for a total of 5,118 sentences. It contains demographics of defendants and the dynamics of their crimes and the sentencing process. Several official court reports in each case were examined.

Preliminary descriptive and frequency analyses are reported to describe the database in detail and lay the groundwork for future sophisticated regression and other analyses. Special attention is given …

Correction Factors For Body Mass In Military Physical Fitness Tests, Paul M. Vanderburgh

Recent research findings combined with the theoretical laws of biological similarity make the compelling case that all physical fitness test items for the Army, Air Force, and Navy impose a 15-20% physiologic bias against heavier, not fatter, men and women. Using the published findings that actual scores of muscle and aerobic endurance scale by body mass raised to the 1/3 power, correction factor tables were developed. This correction factor can be multiplied by one’s actual score (e.g., push-ups, sit-ups, abdominal crunches, or curl-ups repetitions or distance run time) to yield adjusted scores that are free of body mass bias. The prevalence of obesity is problematic in the United States. The objectives of the present study were to determine the extent of obesity in students studying at Eastern Michigan University and to evaluate their diet quality. Body Mass Index (BMI) of students (19-30 years, n=100) was measured from self-reported heights and weights as a benchmark of their weight category. Intakes of total energy (kilocalories), macronutrients and key micronutrients were assessed from three-day food diaries maintained by participants and compared with the Dietary Reference Intake Standards. The intent of this study was to determine if high school female basketball players participating in a physical training intervention (including a warm-up and plyometric, jump, flexibility, and strength training) would decrease valgus motion at the knee joint upon impact of a jump landing task. In addition, another aim of the investigation was to determine if the training routine would enhance physical performance factors associated with specific basketball skills (e.g., vertical jump and agility).

Factor Structure And Clinical Implications Of Child Behavior Checklist/1.5-5 Ratings In A Sample Of Girls Adopted From China, Tony Xing Tan, Robert F. Dedrick, Kofi Marfo

Objective: This study assessed psychometric properties of the Child Behavior Checklist (CBCL/1.5-5) and explored clinical insights from its use in a sample of adopted Chinese girls.

Methods: Parental ratings were obtained on 707 adopted Chinese girls, ages 1.50-5.92 years (M = 3.24, SD = 1.26). Confirmatory factor analysis (CFA), employing robust weighted least squares estimation, was used to evaluate the instrument's seven-factor correlated structure. Profiles of scores were analyzed descriptively for clinical insights.

The Supreme Court has narrowed the doorway into the protected class for the Americans with Disabilities Act of 1990 (ADA) in virtually every employment case. Taking their cue from the Supreme Court, the lower courts have been concerned principally with who is "disabled" and thus protected by the ADA. The answer today is not many people. The courts generally have been so hostile to ADA plaintiffs that it is difficult now to find a case in which the plaintiff was able to prove that he was disabled. Congress contemplated that some impairments would always be disabling. The Supreme Court, however, …
