Optimal Bail And The Value Of Freedom: Evidence From The Philadelphia Bail Experiment, David Abrams, Chris Rohlfs Jun 2007

Optimal Bail And The Value Of Freedom: Evidence From The Philadelphia Bail Experiment, David Abrams, Chris Rohlfs

Coase-Sandor Institute for Law & Economics Research Paper Series

This paper performs a cost-benefit analysis to determine socially optimal bail levels that balance the costs to defendants against the costs to other members of society. We consider jailing costs, the cost of lost freedom to incarcerated defendants, and the social costs of flight and new crimes committed by released defendants. We estimate the effects of bail amounts on the fraction of defendants posting bail, fleeing, and committing crimes during pre-trial release, using data from a randomized experiment. We also use defendants' bail posting decisions to measure their subjective values of freedom. We find that the typical defendant in our …

The Internship: Bridge Between Marketplace And Liberal Arts Education In The Catholic Tradition, Eric Grabowsky, Janie M. Harden Fritz

Journal of Catholic Education

Internships can be distinctive pedagogical opportunities within a Catholic liberal arts education. The applied marketplace experience provided by an internship, properly understood, is consistent with the Catholic understanding of education. The value of internships for Catholic higher education can be illustrated by focusing on communication and rhetorical studies. This essay consists of a selected review of literature situating internships within liberal arts education, followed by the articulation of a Thomistic framework for rhetorical education.

A Specialized Domestic Violence Court In South Carolina: An Example Of Procedural Justice For Victims And Defendants, Angela R. Gover, Eve M. Brank, John M. Macdonald

Department of Psychology: Faculty Publications

The current research details interviews with 50 victims and 50 defendants who participated in a specialized criminal domestic violence court in Lexington County, South Carolina. These victims and defendants indicated satisfaction with their court experiences, thought the process allowed them to voice their views, felt they were treated with respect, and were generally satisfied with the outcome of their cases. Court observations and interviews with court personnel confirmed that this court has successfully incorporated victims and defendants into the decision-making process while also providing a fair system to address the issue of violence against women.

Privacy And Law Enforcement In The European Union: The Data Retention Directive, Francesca Bignami Jun 2007

Privacy And Law Enforcement In The European Union: The Data Retention Directive, Francesca Bignami

Chicago Journal of International Law

This Article examines a recent twist in European Union ("EU") data protection law. In the 1990s, the European Union was a market-creating organization and the law of data protection was designed to prevent rights abuses by market actors. Since the terrorist attacks in New York, Madrid, and London, however, cooperation in law enforcement has accelerated. Now the challenge for the European Union is to protect privacy in its emerging system of criminal justice. This Article analyzes the first EU law to address data privacy in law enforcement-the Data Retention Directive (or "Directive"). Based on a detailed examination of the Directive's …

Evolving Approaches To Jihad: From Self-Defense To Revolutionary And Regime-Change Polticial Violence, M. Cherif Bassiouni Jun 2007

Evolving Approaches To Jihad: From Self-Defense To Revolutionary And Regime-Change Polticial Violence, M. Cherif Bassiouni

Chicago Journal of International Law

There is a debate among Western academics as to whether violence is endemic to Islam or whether Islam is a peaceful religion. Proponents of these views are largely influenced by their own political persuasions, but mostly by their perceptions as outside observers of the Muslim world. The most plausible conclusions are advanced by those who simply see Muslim societies as any other society wrestling with social, economic, cultural, and political issues, and where at different times ideology is resorted to as a way of justifying political transformation. In some cases, Islamic doctrine is used as a legitimizing basis for political …

Grassroots Plea Bargaining, Josh Bowers Jun 2007

Grassroots Plea Bargaining, Josh Bowers

Public Law and Legal Theory Working Papers

In the 1990s, New York City implemented a particularly vigorous brand of localized order-maintenance policing. Such targeted enforcement of “borderline” offenses led to a skyrocketing rate of non-felony arrests in affected (predominantly poor and minority) communities and, consequently, created a crisis of systemic legitimacy within these communities. Notably, however, enforcement was increasingly heavy-handed only on the policing end. By contrast, when it came to plea bargaining, prosecutors were providing more and more lenient no-time or short-time pleas to reduced (often non-criminal) charges. In this essay, I offer a novel (and at least partial) explanation for this leniency trend. My explanation …

Globalization, Immigration And The Welfare State: A Cross-National Comparison, Qingwen Xu Jun 2007

Globalization, Immigration And The Welfare State: A Cross-National Comparison, Qingwen Xu

The Journal of Sociology & Social Welfare

Over the past decades, the forces of globalization have helped created a huge wave of immigration. The relationship between globalization and immigration has been intensely examined in the last decade with a focus not only on whether and how much globalization has caused international immigration but also how to promote and sustain a just global system for the growing number of immigrants. This study selects three developed countries with different welfare state philosophies and traditions-Australia, Sweden and the United States-and compares how they cope with the growing number of immigrants and their various needs. This paper reflects thinking about states' …

Community Policing: Broken Windows, Community Building, And Satisfaction With The Police, Robert M. Lombardo, Todd Lough

Criminal Justice & Criminology: Faculty Publications & Other Works

The concept of community policing dominates the law enforcement profession today. One would be hard pressed to find an advertisement for a police chief’s position that does not require a thorough understanding of this method of policing. Like the Kansas City preventive patrol experiment and the Rand report on the criminal investigation process, the call for community policing has led to dramatic changes in the way that police carry out their responsibilities. In spite of its popularity, there have been a number of challenges to community policing from social scientists who are particularly concerned about the ‘broken windows’ model of …

Misunderstanding Corruption And Community: Comparative Politics Of Corruption Regulation In The Pacific, Mark Findlay Jun 2007

Misunderstanding Corruption And Community: Comparative Politics Of Corruption Regulation In The Pacific, Mark Findlay

Research Collection Yong Pung How School Of Law

This paper will take as its empirical foundation the author’s experience of corruption and regulation in small Pacific island states. The argument is that notions of corruption and strategies for its regulation suitable for modernized societies, which lack cultural specificity and community engagement, may in fact stimulate corruption relationships in transitional cultures. The other consequence of the imposition of inappropriate definitions and regulation strategies is a profound misunderstanding of communities of dependence. In fact, corruption control can misconstrue and exacerbate economic and political dependence environments, fostering the conditions for corruption which accompany socio-economic development. Two remedies are suggested. First, corruption …

Zhong Hui (Chung Hui, 225–264 C.E.) In Internet Encyclopedia Of Philosophy, Alan Kam Leung Chan Jun 2007

Zhong Hui (Chung Hui, 225–264 C.E.) In Internet Encyclopedia Of Philosophy, Alan Kam Leung Chan

Research Collection College of Integrative Studies

Zhong Hui (Chung Hui) was a major philosophical figure during China’s early medieval period (220-589 CE). An accomplished interpreter of the Laozi and the Yijing, Zhong Hui contributed significantly to the early development of xuanxue—literally “learning” (xue) of the “dark” or “mysterious” (xuan) Dao (“Way”), but sometimes translated as “Neo-Daoism“. He also was a major political figure whose ambition eventually led to his untimely demise. Virtually all of Zhong Hui’s writings have been lost, which perhaps explains why he has been given scant attention by students of Chinese philosophy. Had he not failed in his attempt to overthrow the regime …

Google 'Til They Goggle: Trawling Electronic Databases To Build Your Collection And Better Serve Your Client Base, Carol Ottolenghi

Library Philosophy and Practice (e-journal)

Too often, organizations and the public consider properly trained Library staff as “overhead,” or even "dead weight." Budget crunches and the “I’ll just Google it” attitude prevalent today can mean a shrinking – or completely eliminated – library. This paper discusses how the Library staff at the Ohio Attorney General’s Office paired the power of traditional librarian skills with Google, electronic data bases, and a variety of online “alert” systems for greatly increased outreach, effectiveness, and visibility within their organization.
