From Prison To The Community : The Role Of Citizen Participation In Female Prisoner Reentry, Dana Roderick Torrey
From Prison To The Community : The Role Of Citizen Participation In Female Prisoner Reentry, Dana Roderick Torrey
Dissertations and Theses
Growing attention is being given to the design of programs for female prisoners to assist their successful reentry into the community upon the completion of their incarceration. However, current programs have been largely designed and implemented with the goal of seeking parolee compliance through mandatory rules and practices. Little emphasis is placed on preparing inmates to assume their duties as citizens and active participants in the lives of their community. In short, existing programs pay little attention to the importance of creating what I call for purposes of this study, “citizen participation”.
This study tests the importance of developing a …

Session 10 - Risk Education: Teaching (And Learning) About Technology And Uncertainty In Society, Julian Kilker
Session 10 - Risk Education: Teaching (And Learning) About Technology And Uncertainty In Society, Julian Kilker
International Symposium on Technology and Society
Recently heightened concerns about governmental and corporate surveillance, coupled with long-term social and psychological research on privacy, present both an opportunity and a challenge for discussions about risks and risk assessments related to national security and civil liberties, as well as discussions about the social implications of technology in general. These issues include ethics, assessing uncertainty, balancing risks, and negotiating multidisciplinary expertise. This paper contextualizes the planning, implementing, and responses to several iterations of the Honors course “Who’s watching? Media, privacy, and surveillance,” within the larger topic of pedagogical practices appropriate for examining important, but controversial, topics related to technology …

The Lessons Of Capturing The Friedmans: Moral Panic, Institutional Denial And Due Process, Susan Bandes
The Lessons Of Capturing The Friedmans: Moral Panic, Institutional Denial And Due Process, Susan Bandes
College of Law Faculty
In the 1980's hundreds of childcare workers were accused of sexually abusing children in horrific ways. Arnold and Jesse Friedman, whose prosecutions are chronicled in the film Capturing the Friedmans, were among those convicted and sent to prison during this period. Sociologists have called this series of prosecutions a classic moral panic: a widespread, hostile, volatile overreaction to a perceived societal threat. This paper examines the concept of moral panic in the context of the day care sexual abuse prosecutions in general, and the Friedman prosecutions in particular. It begins by exploring the role of the legal system in …

Cruelty To The Mentally Ill: An Eighth Amendment Challenge To The Abolition Of The Insanity Defense, Stephen M. Leblanc
Cruelty To The Mentally Ill: An Eighth Amendment Challenge To The Abolition Of The Insanity Defense, Stephen M. Leblanc
American University Law Review
This Comment addresses the present gap in insanity-defense laws
created by the defense’s abolition and offers an Eighth Amendment
based remedy. Part I reviews the history and evolution of the insanity
defense in Anglo-American law. It then describes how four states
have statutorily abolished the defense. It concludes with a discussion
of Clark v. Arizona, the Court’s most recent decision on the
constitutionality of the insanity defense. Part II turns to the Eighth
Amendment, examining its historical understanding and the
contemporary evolving-standards-of-decency analysis, through which
the Court assesses the constitutionality of modern-day punishments.
Part II concludes with a discussion of …
Transitional Justice In Korea: Legally Coping With Past Wrongs After Democratization, Kuk Cho
Transitional Justice In Korea: Legally Coping With Past Wrongs After Democratization, Kuk Cho
Washington International Law Journal
For more than a decade, Korean society has taken various legal steps to rectify past wrongs perpetrated by the old authoritarian-military regime. In 1995, the “Special Act Concerning the May 18 Democratization Movement” was passed in the National Assembly. Under this new legal circumstance, the two former presidents were imprisoned on charges of leading the 1979 military coup and brutally oppressing the May 18 Uprising of 1980. However, because such a transition from the authoritarian-military rule was established through a political compromise, Korean society had to experience a limited transitional justice. As another step to rectify past wrongs, the “Act …

China's Network Justice, Benjamin Liebman, Tim Wu
Chicago Journal of International Law
The broader goal of this Article is to better understand the relationship between how a legal system functions and how judges communicate, both with each other and with other parties, including the media, the public, and political actors. Information transmission is an important but poorly understood part of any legal system. A precedent system, amid briefs, and the rules on ex parte contacts all serve to regulate how parties in a system communicate and what kind of information "counts." Media and political pressure cannot help but affect a legal system. In the words of Ethan Katsh, "Law is an organism …
