Torture And Islamic Law, Sadiq Reza Jul 2007

Torture And Islamic Law, Sadiq Reza

Faculty Scholarship

This article considers the relationship between Islamic law and the absence or practice of investigative torture in the countries of today's Muslim world. Torture is forbidden in the constitutions, statutes, and treaties of most Muslim-majority countries, but a number of these countries are regularly named among those in which torture is practiced with apparent impunity. Among these countries are several that profess a commitment to Islamic law as a source of national law, including some that identify Islamic law as the principal source of law and some that go so far as to declare themselves "Islamic states." The status of …

Community Lawyering In The Juvenile Cellblock: Creative Uses Of Legal Problems Solving To Reconcile Competing Narratives On Prosecutorial Abuse, Juvenile Criminality, And Public Safety, David Dominguez Jul 2007

Community Lawyering In The Juvenile Cellblock: Creative Uses Of Legal Problems Solving To Reconcile Competing Narratives On Prosecutorial Abuse, Juvenile Criminality, And Public Safety, David Dominguez

Journal of Dispute Resolution

The power imbalance in juvenile legal proceedings is so lopsided that children and families are routinely overpowered and intimidated by administratively convenient processes and outcomes. I fully understand (and at times envy) the zealous legal advocate who champions his young client's cause and "makes the system pay." But I have found over my years of Community Lawyering that zealous advocacy can become so critical of institutional error that it bums problem solving relationships and destroys the chance to negotiate for mutual gain and structural reform. Zealous advocacy can win at the detention hearing and force the juvenile justice system to …

Returning To The Circle: The Reemergence Of Traditional Dispute Resolution In Native American Communities, Jessica Metoui Jul 2007

Returning To The Circle: The Reemergence Of Traditional Dispute Resolution In Native American Communities, Jessica Metoui

Journal of Dispute Resolution

An examination of Native American cultural definitions of justice illustrates the cultural relevance of traditional dispute resolution processes. Because these alternative processes focus largely on community inclusion and the importance of party healing after a crime, concepts central to Native American worldview, traditional dispute resolution is superior to the mainstream adversarial court system for handling many criminal matters in the Native American context. The successes of traditional dispute resolution processes in Native American communities are also evidence of the potential cross cultural applications of such processes within the mainstream criminal justice system

A Gene × Gene Interaction Between Drd2 And Drd4 Is Associated With Conduct Disorder And Antisocial Behavior In Males, Kevin M. Beaver, John Paul Wright, Matt Delisi, Anthony Walsh, Michael G. Vaughn, Danielle Boisvert, Jamie Vaske Jun 2007

A Gene × Gene Interaction Between Drd2 And Drd4 Is Associated With Conduct Disorder And Antisocial Behavior In Males, Kevin M. Beaver, John Paul Wright, Matt Delisi, Anthony Walsh, Michael G. Vaughn, Danielle Boisvert, Jamie Vaske

Criminal Justice Faculty Publications and Presentations

Background: Antisocial behaviors are complex polygenic phenotypes that are due to a multifactorial arrangement of genetic polymorphisms. Little empirical research, however, has been undertaken that examines gene × gene interactions in the etiology of conduct disorder and antisocial behavior. This study examined whether adolescent conduct disorder and adult antisocial behavior were related to the dopamine D2 receptor polymorphism (DRD2) and the dopamine D4 receptor polymorphism (DRD4).

Methods: A sample of 872 male participants from the National Longitudinal Study of Adolescent Health (Add Health) completed self-report questionnaires that tapped adolescent conduct disorder and adult antisocial behavior. DNA was genotyped for DRD2 …

Testimony On Law Enforcement In Indian Country Before The United States Senate Committee On Indian Affairs, 110th Congress, 1st Session, Kevin Washburn

Faculty Scholarship

Public safety and criminal justice on Indian reservations are better served when Indian tribes play a central role in these functions. Most of the successes of law enforcement in Indian country have involved careful cooperation and coordination between law enforcement agencies of different sovereigns. Even informal cooperation can be highly effective in improving public safety. Lack of cooperation undermines public safety.

Evaluating Court Processes For Determining Indigency, Elizabeth Neeley, Alan J. Tomkins Jun 2007

Evaluating Court Processes For Determining Indigency, Elizabeth Neeley, Alan J. Tomkins

Court Review: Journal of the American Judges Association

The Sixth Amendment to the Constitution guarantees all people accused of a crime the right to legal counsel. In the landmark 1963 decision Gideon v. Wainright, 1 the United States Supreme Court affirmed the right of indigent defendants to have counsel provided. But Gideon did not end the Supreme Court’s discussion of the circumstances in which the state is required to provide defendants with an attorney when they claim not to have the means to pay for one. 2 Nor did it end the states’ examination of the requirement of any legal assistance paid for by taxpayers. 3 Moreover, …

Grounding Frequent Filers: The Trend Of Revoking The Special Status Of Overly Litigious Pro Se Litigants, Michael G. Langan Jun 2007

Grounding Frequent Filers: The Trend Of Revoking The Special Status Of Overly Litigious Pro Se Litigants, Michael G. Langan

Court Review: Journal of the American Judges Association

Since the early 1990s, federal courts in the Second and Third Circuits have, with increasing frequency, revoked the special status of pro se civil litigants who have been overly litigious. This article discusses the reasons for this trend’s appearance in the Second and Third Circuits, the rationales for the trend, the fairness of the trend, and some practical advice for courts and practitioners wrestling with the issue of whether or not the special status of a particularly litigious pro se litigant should be revoked.

The Dark Side Of Humanity: An Empirical Investigation Into Global Slavery, Christine Balarezo Jun 2007

The Dark Side Of Humanity: An Empirical Investigation Into Global Slavery, Christine Balarezo

USF Tampa Graduate Theses and Dissertations

Global slavery includes human trafficking, debt bondage, forced labor, commercial sexual exploitation of children, and organ trafficking. Despite its official abolishment within the international community, global slavery continues to thrive in many parts of the world. The various types of slavery do not restrain themselves in a mutual exclusive manner; rather, they transcend and merge to create inter-connectedness within the illegal world of slavery. For instance, a person that is trafficked for the purpose of labor -- domestic or forced -- can also become sexually exploited and prostituted. This thesis discusses the nature and scope of the different faces of …
