A Presuppositional Critique Of Constructivism, Paul R. Rickert Oct 2007

A Presuppositional Critique Of Constructivism, Paul R. Rickert

Faculty Publications and Presentations

Educational theories have roots. They have roots in broader philosophies, conceptions of the nature of reality, and the theories utilized in classrooms to teach have implications for broader society. Specifically, this paper discusses the problems of constructivist theory in the classroom. The author takes a presuppostitional view and shows that all systems have most basic beliefs which are un-provable. So at the heart of any form of interpretive schema is faith in that schema. The author discusses ontological and epistemological options and how shifts in philosophy change the order of the most basic beliefs, but not the fact that they …

Policing The Police: Democracy And Effective Methods Of Accountability In Post-Apartheid South Africa, Alaina Varvaloucas Oct 2007

Policing The Police: Democracy And Effective Methods Of Accountability In Post-Apartheid South Africa, Alaina Varvaloucas

Independent Study Project (ISP) Collection

This study seeks to explore the extent and effectiveness of systems of criminal accountability of the police force in South Africa. More specifically, it explores the pros and cons of existing organizations mandated to deter police from acting criminally and punish them when they do, and the need to strengthen them. The study first takes a look at such organizations as the Independent Complaints Directorate (ICD)—which is an independent civilian oversight body—and the South African Police Service’s (SAPS) internal disciplinary system and assesses their strengths and limitations in providing a culture of accountability. The study then focuses on police culture …

Instructional Costs And Tuition Revenues, David Yamoah Oct 2007

Instructional Costs And Tuition Revenues, David Yamoah

Academic Leadership: The Online Journal (2003-2012)

A variety of tax reform initiatives have impacted on the ability of New Jersey and some states in the United States to fund public higher education. Public Higher Education faces competition for limited state resources from a variety of state mandatory spending measures including health, criminal justice and elementary and secondary education. In addition, concern about the cost of higher education has resulted in demand for accountability in the use of public funds, which has lead to the need to establish relationship between funding and cost of providing higher education.

Insider Trading Rules Can Affect Attractiveness Of Country's Stock Markets, Laura N. Beny Oct 2007

Insider Trading Rules Can Affect Attractiveness Of Country's Stock Markets, Laura N. Beny

Law Quadrangle (formerly Law Quad Notes)

The following essay is based on testimony the author delivered to the U.S. Senate Judiciary Committee on September 26, 2006.

The academic debate about the desirability of prohibiting insider trading is longstanding and as yet resolved. The legal academic literature on insider trading suffers from a few significant shortcomings. In brief, legal scholars who believe that insider trading is efficient and thus ought not to be prohibited maintain that insider trading increases managers' (and other insiders') incentives to behave in the interest of stockholders; makes stock prices more informationally efficient (that is, more accurate); and/or does not decrease the liquidity …

Growth = Bucks(?), Gregory Lanier Oct 2007

Growth = Bucks(?), Gregory Lanier

Journal of the National Collegiate Honors Council Online Archive

Many of us in honors education will readily agree that, if the equation above is ever true at all, it is a very sharp double-edged sword. I suspect that most of us who direct honors programs or colleges at public institutions have been sliced or diced more than once by an institution’s growth imperatives. Although upper-level administrators often point to their honors programs with pride and tout the accomplishments of their honors students to alumni and benefactors, only a few honors programs and colleges actually report a funding baseline that adequately addresses all the needs of the program and its …

No Law: Deadwood And The State, Mark L. Berrettini Oct 2007

No Law: Deadwood And The State, Mark L. Berrettini

Great Plains Quarterly (through 2013)

Deadwood's final episode of season 3 opens with a monologue from theater operator Jack Langrishe (Brian Cox), a relative newcomer to the camp of Deadwood. Shown in a wide shot that spotlights him on the dark stage of his nascent theater, Langrishe ostensibly speaks to one of his companions, the actress Claudia (Cynthia Ettinger), shown in one medium reverse-shot. Yet Langrishe also speaks and performs beyond the theater to the residents of Deadwood and to the program's viewers extradiagetically as he sums up the tense state of affairs within the camp:

This camp is in mortal danger. The man …

"I'Ll Try Anything Once": Using The Conceptual Framework Of Children's Human Rights Norms In The United States, Bernardine Dohrn Oct 2007

"I'Ll Try Anything Once": Using The Conceptual Framework Of Children's Human Rights Norms In The United States, Bernardine Dohrn

University of Michigan Journal of Law Reform

International human rights law provides norms, concepts, and standards of immediate and practical value to attorneys for court-involved children in the United States. The conceptual framework of the comprehensive rights of the child is broadly congruent with, or closely related to, the strongest aspects of US. constitutional law and practice. The expansive language of children's human rights offers an historic opportunity: new tools and a more comprehensive context in which to change how we think about young people in conflict with the law, children in state custody, and children in related legal settings. The challenge is to use these fresh …

Troubled Children And Children In Trouble: Redefining The Role Of The Juvenile Court In The Lives Of Children, Ann Reyes Robbins Oct 2007

Troubled Children And Children In Trouble: Redefining The Role Of The Juvenile Court In The Lives Of Children, Ann Reyes Robbins

University of Michigan Journal of Law Reform

This Essay considers the emerging research in the area of dual-jurisdiction children, often referred to as "crossover kids "-those currently or previously involved in maltreatment proceedings who have also committed delinquent acts. Part I describes the development of the juvenile courts in the early twentieth century. Part II of this Essay questions the need to "track" children along one legal path or another and points to the pitfalls of providing services to some children through a criminal justice paradigm instead of treating all children through a social work paradigm. Finally, Part III advocates a redesign of the juvenile court- a …

Regulating "Rent-A-Cops" Post-9/11: Why The Private Security Officer Employment Authorization Act Fails To Address Homeland Security Concerns, Ian Patrick Mcginley Oct 2007

Regulating "Rent-A-Cops" Post-9/11: Why The Private Security Officer Employment Authorization Act Fails To Address Homeland Security Concerns, Ian Patrick Mcginley

Cardozo Public Law, Policy & Ethics Journal

The article critiques the Private Security Officer Employment Authorization Act (PSOEAA) for its limited scope in addressing homeland security concerns related to private security officers. While the Act introduces a background check system, it fails to adequately address terrorist infiltration, training, and cooperation with public law enforcement. The analysis argues that federal regulation, led by the Department of Homeland Security (DHS), is necessary to enhance the private security industry's role in homeland security. A grant-based regulatory scheme is proposed to incentivize training, cooperation, and improved screening processes for private security officers, particularly those guarding critical infrastructure.
