Beyond Westphalia: Competitive Legalization In Emerging Transnational Regulatory Systems, Errol E. Meidinger Jan 2007

Beyond Westphalia: Competitive Legalization In Emerging Transnational Regulatory Systems, Errol E. Meidinger

Contributions to Books

Published as Chapter 7 in Law and Legalization in Transnational Relations, Christian Brütsch & Dirk Lehmkuhl, eds.

This paper analyzes several emerging transnational regulatory systems that engage, but are not centered on state legal systems. Driven primarily by civil society organizations, the new regulatory systems use conventional technical standard setting and certification techniques to establish market-leveraged, social and environmental regulatory programs. These programs resemble state regulatory programs in many important respects, and are increasingly legalized. Individual sectors generally have multiple regulatory programs that compete with, but also mimic and reinforce each other. While forestry is the most developed example, similar …

Crash Data Analysis: Collective Vs. Individual Crash Level Approach, Mohamed Abdel-Aty, Anurag Pande Jan 2007

Crash Data Analysis: Collective Vs. Individual Crash Level Approach, Mohamed Abdel-Aty, Anurag Pande

Civil and Environmental Engineering

Introduction

Traffic safety literature has traditionally focused on identification of location profiles where “more crashes are likely to occur” over a period of time. The analysis involves estimation of crash frequency and/or rate (i.e., frequency normalized based on some measure of exposure) with geometric design features (e.g., number of lanes) and traffic characteristics (e.g., Average Annual Daily Traffic [AADT]) of the roadway location. In the recent past, a new category of traffic safety studies has emerged, which attempts to identify locations where a “crash is more likely to occur.” The distinction between the two groups of studies is that the …

Organizational Adoption Of Web-Enabled Services For Information Dissemination, Pamila Dembla, Prashant Palvia, Lloyd Brooks Jan 2007

Organizational Adoption Of Web-Enabled Services For Information Dissemination, Pamila Dembla, Prashant Palvia, Lloyd Brooks

Faculty Articles

Although communication, collaboration, and transaction processing are some of the important business functions facilitated by the web, timely dissemination of information is critical for ultimate customer satisfaction and potential profitability. The purpose of this study is to determine the affect that contextual factors such as IS maturity, organizational attributes, and environmental characteristics have on perceived usefulness and adoption of web-enabled services for information dissemination in organizations. The key focus of this article is "organizational adoption" as opposed to individual acceptance for which there have been numerous studies. A research model and eight hypotheses were developed based on past literature. Data …

Coalition Formation And Teamwork In Embodied Agents, Majid Ali Khan Jan 2007

Coalition Formation And Teamwork In Embodied Agents, Majid Ali Khan

Electronic Theses and Dissertations

Embodied agents are agents acting in the physical world, such as persons, robots, unmanned air or ground vehicles and so on. These types of agents are subject to spatio-temporal constraints, which do not exist for agents acting in a virtual environment. The movement of embodied agents is limited by obstacles and maximum velocity, while their communication is limited by the transmission range of their wireless devices. This dissertation presents contributions to the techniques of coalition formation and teamwork coordination for embodied agents. We considered embodied agents in three different settings, each of them representative of a class of practical applications. …

Cost-Benefit Analysis Without Analyzing Costs Or Benefits: Reasonable Accommodation, Balancing, And Stigmatic Harms, Cass R. Sunstein Jan 2007

Cost-Benefit Analysis Without Analyzing Costs Or Benefits: Reasonable Accommodation, Balancing, And Stigmatic Harms, Cass R. Sunstein

Public Law and Legal Theory Working Papers

Is an accommodation “reasonable,” under the Americans with Disabilities Act, if and only if the benefits are roughly proportional to the costs? How should benefits and costs be assessed? Should courts asks about how much disabled employees are willing to pay to obtain the accommodation, or instead how much they would have to be paid not to have the accommodation? How should stigmatic or expressive harms be valued? This essay, written for a symposium on the work of Judge Richard A. Posner, engages these questions in a discussion of an important opinion in which Judge Posner denied accommodations involving the …

The Emerging Importance Of Law Review Rankings For Law School Rankings, 2003-200 7, Alfred L. Brophy Jan 2007

The Emerging Importance Of Law Review Rankings For Law School Rankings, 2003-200 7, Alfred L. Brophy

University of Colorado Law Review

The release of the 2007 U.S. News rankings of law schools has set off another round of speculation on the meanings of the rankings and what, ifanything, schools can do to improve the quality of the education they provide, as well as their rankings. Drawing upon earlier evidence that there is a close connection between the citation rankings of law reviews and the ranking of their law schools, this paper looks to changes in both the U.S. News rankings and law journal rankings over the past few years. This paper tests and finds some support for a hypothesis that as …

Post A Message And Go To Jail: Criminalizing Internet Libel In Japan And The United States, Salil K. Mehra Jan 2007

Post A Message And Go To Jail: Criminalizing Internet Libel In Japan And The United States, Salil K. Mehra

University of Colorado Law Review

In the United States, criminal libel is all but dead. American law professors only write about it to denounce the continued existence of rarely enforced criminal libel statutes. In Japan, however, criminal libel laws have become vital tools in policing injurious speech on the Internet. Defamatory posts lead to police intervention and even arrest. Because the United States is considering regulation of online speech, potentially including criminal penalties, we can learn from the experience of Japan. From a positive perspective, this Article explains why Japan applies such laws to the Internet. From a normative perspective, the Article addresses why broadly …

The Minister Is Lay: Social Organization In New Paradigm Christianity, Jayeel Cornelio Jan 2007

The Minister Is Lay: Social Organization In New Paradigm Christianity, Jayeel Cornelio

Development Studies Faculty Publications

Love seems to be in the air for many of the red-shirted members of Hope Filipino. On this particular Sunday afternoon, the church-owned Nexus Auditorium, located in a shopping center in Singapore’s prominent Orchard Road, conveys the vibrancy of Valentine’s season. Instead of a familiar Christian song, setting the mood for the inflowing audience is one of Kenny G’s romantic hits, a tangible indication that this is not ordinary church. The Sunday service, redesigned for evangelistic purposes, expects a greater number of non-Christian visitors as a result of the pre-Valentine Matthew Care Group. With friends meeting and ushers greeting at …

Is Romanian Mothers' Employment Status During A Child's First Year Of Life Correlated With School-Age Children's Behavior Problems?, Codruta A. Ruset Jan 2007

Is Romanian Mothers' Employment Status During A Child's First Year Of Life Correlated With School-Age Children's Behavior Problems?, Codruta A. Ruset

Master's Theses and Capstones

Although research studies are more likely now than in the past to include children and families of varied racial and ethnic backgrounds, no attempts have been made to examine the relationship between early maternal employment among Romanian mothers and their children's behavioral problems. Therefore, based on a sample drawn from a Romanian population, this thesis investigates whether maternal employment during the first year of the child's life is related to Romanian school-age children's behavioral problems, considering control variables like period of maternal employment, employment type, child care type, family income; child's age, maternal educational level, and family type. Findings illustrate …

Race Salience In Defense Attorney Opening And Closing Statements: The Effects Of Ambiguity And Juror Attitudes, Donald Bucolo Jan 2007

Race Salience In Defense Attorney Opening And Closing Statements: The Effects Of Ambiguity And Juror Attitudes, Donald Bucolo

Master's Theses and Capstones

Two studies were conducted to evaluate if making a defendant's race salient in defense attorneys' opening and closing statements would reduce White juror racial bias towards a Black defendant when evidence against the defendant was strong (Study 1) or weak (Study 2). In Study 1, making race salient did reduce guilty verdicts against the Black defendant. In addition, more racist jurors were more likely to find the Black defendant guilty only when race was not made salient. In Study 2, making a defendant's race salient did not affect White jurors verdicts. Further, in Study 2 participants with more positive views …

An Examination Of The Nursing Home Industry, Craig Labore Jan 2007

An Examination Of The Nursing Home Industry, Craig Labore

Master's Theses and Capstones

Quality of care remains an issue plaguing the nursing home industry. Over the next twenty years, nursing homes will become inundated with members of the "baby boomer" generation. The goal of this research project was to examine approaches to improving the quality of care in nursing homes in The United States. Three reforms were identified. First, there needs to be improved communication between CMS, regional offices and state agencies. Second, create a training program which trains surveyors and nursing home administrators in a nursing home setting. Finally; there must be collaboration between CMS and nursing home industry leaders in policy-making …

The Family In Tocqueville's "Democracy In America": Understanding Difference In The Age Of Equality, Nicholas R. Noloboff Jan 2007

The Family In Tocqueville's "Democracy In America": Understanding Difference In The Age Of Equality, Nicholas R. Noloboff

Master's Theses and Capstones

The American family in Tocqueville's Democracy in America presents a novel association to humankind; at its heart are natural bonds between generations, spouses and siblings that offer, through public recognition, new opportunities for both individual and civic improvement. Through an exposition of Democracy's American family, this paper addresses how the association helps remediate the greatest dangers of the age of equality: a tyrannical majority, materialism, individualism and ultimately, democratic despotism. It finds that the chief virtue of the American family comes from the natural, complementary gender differences that define marriage in American public opinion; in particular, the social recognition that …

Transcending The Body: The Role Of Divine Mind In The Practice Of Christian Science Healing, Sarah L. Gibb Jan 2007

Transcending The Body: The Role Of Divine Mind In The Practice Of Christian Science Healing, Sarah L. Gibb

Master's Theses and Capstones

Christian Science has been largely ignored in sociological inquiries of modern religious institutions. This research project aims to uncover how Christian Science practitioners understand their world in terms of the origins of illness, the gender division of labor, and their role as healers within the Christian Science community and the world. I distributed questionnaires to practitioners in California and the New England region, analyzing the responses using both quantitative and qualitative methods. The practitioners in this sample (N = 33) are overwhelmingly white, middle-aged to older women with higher-than-average levels of educational attainment and income. Thematic analyses reveal that in …

The Effects Of Market Transition On The Distribution Of Health Care In China: 1991--2000, Rachel Marks Jan 2007

The Effects Of Market Transition On The Distribution Of Health Care In China: 1991--2000, Rachel Marks

Master's Theses and Capstones

This research aims to examine the changes in the availability and accessibility of health care available to Chinese citizens over a nine year period. I use market transition theory as a framework for examining these changes. Market transition theory posits that as a government moves from a socialist system to a market-based economy, a new stratification order will emerge. Changes in the Chinese health care system are examined using 1991 and 2000 data from the China Health and Nutrition Survey. Using ordinary least-squares and logistic regression, I analyze differences in access and availability of health care between ethnic groups, rural …

The Disneyization Of Service Work In Financial Organizations, Karen Schreiner Jan 2007

The Disneyization Of Service Work In Financial Organizations, Karen Schreiner

Master's Theses and Capstones

In recent years, financial companies have adopted "the Disney Way" in their approaches to customer service. Along with other organizations, financial companies place emphasis on the service they provide and are training associates to stage a "show" for their customers. Financial organizations increasingly look toward Disney as a model for customer "delight", and use Disney's methods of training to mold associates who are constantly smiling and friendly, use a company-written script, and "perform" as part of their job duties.

My study investigates the nature of performance-based customer service through a content analysis of bank teller employment advertisements and banking advertisements …

Yale CEAS Occasional Publication Series - Volume 1

Sports in Japan have long been embedded in community life, the educational system, the mass media, the corporate structures, and the nationalist sentiments of modern Japan. For over a century, they have been a crucial intersection of school pedagogy, corporate aims, media constructions, gender relations, and patriotic feelings. The chapters in this book highlight a wide range of sports, and together, they offer a significant window on to the ways that the sporting life animates the institutions of modern Japan.

Ghosts Of The Past And Hopes For The Future: Article 466 And Societal Expectations, Elizabeth Carter Jan 2007

Ghosts Of The Past And Hopes For The Future: Article 466 And Societal Expectations, Elizabeth Carter

Journal Articles

This paper traces the history of the law governing component parts Louisiana Civil Code article 466 and its predecessor articles. It notes that civilian methods of interpretation do little to solve the ambiguity inherent in component parts and that stare decisis and jurisprudence constante only confuse the situation. The societal expectations test has been designed to account for these problems and has successfully resolved the ambiguities when it is correctly applied.

Afterword: The Race Question In Latcrit Theory And Asian American Jurisprudence, Robert S. Chang, Neil Gotanda Jan 2007

Afterword: The Race Question In Latcrit Theory And Asian American Jurisprudence, Robert S. Chang, Neil Gotanda

Faculty Articles

In the tradition of LatCrit Afterwords, Professors Chang and Gotanda take the liberty of raising questions that extend beyond the particular themes of this LatCrit Conference and the papers published in this Symposium. They return to two questions - ethnicity versus race and black exceptionalism - that were raised in early LatCrit Conferences but which have since been moved to the background. They ask what LatCrit Theory and Asian American Jurisprudence might teach us about minority on minority conflict and other ethno-racial fault lines. They present an analytic model to help understand commentaries on racial conflict and coalition. This model …

The Importance Of Individual And Population Variation To Human Stature Estimation, Kelly Jean Shields Jan 2007

The Importance Of Individual And Population Variation To Human Stature Estimation, Kelly Jean Shields

Graduate Student Theses, Dissertations, & Professional Papers

Human stature estimation is a central part of forensic anthropological investigation. It is one of several factors used to identify unknown individuals. The statistical relationship between body length and body segment length allows for long bone lengths from an unidentified individual to be used in a linear regression equation to estimate living stature. These linear regression equations are often formulated from a data set of an entirely different population. This research explores the necessity for the unknown individual to be similar on a number of points to the known population that makes up the equation. Populations are highly variable, and …

The Influence Of Neighborhood, Family, School, And Student Dimensions Of Social Capital On Academic Achievement: An Integrated Theoretical Framework, Floy O. Scott Jan 2007

The Influence Of Neighborhood, Family, School, And Student Dimensions Of Social Capital On Academic Achievement: An Integrated Theoretical Framework, Floy O. Scott

Graduate Student Theses, Dissertations, & Professional Papers

Current federal education law places the responsibility of the academic achievement of students with schools while ignoring other social factors that might influence the educational outcomes of students. Students are part of a complex social system that both enable and constrain their development and behavior. If we are to look at ways to improve academic programs, it is imperative we examine the different social systems to which students are exposed, including neighborhood, family, peer groups, and educational systems, in order to understand their role in assessing school accountability efforts. This study uses an integrated framework of social disorganization theory and …
