Pay-To-Stay In California Jails And The Value Of Systemic Self-Embarassment, Robert Weisberg
Pay-To-Stay In California Jails And The Value Of Systemic Self-Embarassment, Robert Weisberg
Michigan Law Review First Impressions
The website of the Santa Ana, California-version of Pay-to-Stay uses hotelier-type verbiage in describing features of its alternative jail program. It tells us that the jail “is pleased to host a full range of alternatives to traditional incarceration”; it reassures prospective “clients” seeking flexible work/jail schedules (“Work on Saturday or Sunday? No problem, your weekend days are our weekend days.”); it guarantees “24-hour on-site medical staff”; it accommodates inmates near and far (“We have helped clients with sentences from other counties as well as other states.”); and it generally brags that the jail “is the most modern and comfortable facility …

An Investigation Into The Predictors Of Adoption And Utilization Of Information-Sharing Networks By Local Law Enforcement In Three States, Joe Conrad Saviak
Electronic Theses and Dissertations
ABSTRACT A major change in longstanding police organizational behavior is increasingly evident in the recent emergence of computerized information-sharing networks in public safety. From both theoretical and empirical perspectives, a better understanding of the determinants that can explain and predict the rise and growth of this new and significant development in American policing is needed. A highly limited body of empirical studies has endeavored to validate effective predictors of adoption and utilization of electronic information-sharing networks by local law enforcement agencies. Utilizing an integrated theoretical framework largely built upon Rogers' diffusion of innovations theory, sixteen hypotheses were tested through logistic …

After Thirty Years, Is It Time To Change The Vehicle Inventory Search Doctrine?, Nicholas B. Stampfli
Seattle University Law Review
Part II of this Comment will describe the inventory search as it has developed in the Supreme Court's jurisprudence in order to provide background and understanding of the procedure as it stands today. Part III will address the difficulties in applying the Supreme Court's approach by comparing the differences in police department policies. Part IV will then closely examine Washington's somewhat laudable approach to inventory searches, the limits the state has placed on the scope of inventory searches, and the steps the state has taken to impose a consent requirement. Last, Part V will suggest much needed reforms for Washington …
Putting The "Public" Back Into Public-Private Partnerships For Economic Development, Audrey Mcfarlane
Putting The "Public" Back Into Public-Private Partnerships For Economic Development, Audrey Mcfarlane
All Faculty Scholarship
Public-Private Partnerships are viewed quite positively. In the context of working with local government for economic development, the interests and concerns of the private appear to dominate the development decision-making. This Essay explores eminent domain decisions and community benefits agreements for standards for measuring the efficacy of these partnerships. It suggests ways in which we can begin to think about public accountability and public benefits to be derived from these partnerships.

Court Review: Journal of the American Judges Association
In November 2007, a California Court of Appeal issued a decision in Garden Grove v. Superior Court that requires local police officers to return medical marijuana to a qualified patient, despite a lawful search and seizure subsequent to a moving motor vehicle violation. The effect of this ruling, in at least some instances, will be to place marijuana back into the hands of a person who is a risk to public safety while driving under the influence or is engaged in the “diversion” of medical marijuana through unlawful transporting.

Court Review: Volume 44, Issue 3 – When Should Judges Use Alcohol Monitoring As A Sentencing Option In Dwi Cases?, Victor E. Flango, Fred Cheesman
Court Review: Journal of the American Judges Association
Traditional sentencing sanctions have not been particularly effective against people caught driving while impaired (DWI) and less so against repeat offenders. Technology has provided judges with some new sentencing options, including various forms of electronic home monitoring. This article takes an initial step toward evaluating the effectiveness of alcohol monitoring as a sentencing option in DWI cases with the goal of eventually determining which types of offenders, if any, would benefit most from alcohol monitoring. The constant monitoring of alcohol consumption is thought to aid rehabilitation by providing a deterrent to drinking and a positive reinforcement to sobriety. It permits …
Court Review: Volume 44, Issue 1/2 – Adding Color To The White Paper: Time For A Robust Reciprocal Relationship Between Procedural Justice And Therapeutic Jurisprudence, David B. Wexler
Court Review: Journal of the American Judges Association
Judges Kevin Burke and Steve Leben, in Procedural Fairness: A Key Ingredient in Public Satisfaction, have produced a most impressive White Paper. It is handy, brief, crisp, readable, and immensely practical.
The document draws on, and makes most accessible, the research on procedural justice, demonstrating convincingly the importance of judges understanding and implementing in their courtrooms concepts such as “voice” and “respect.” Judges Burke and Leben claim procedural justice to be “the” critical element in public trust and confidence regarding the court system. They note, too, the role procedural fairness likely plays in increased compliance with court orders and even …

Is The U.S. Government’S Mining Of Commercial Data Contributing To An Erosion Of Public Trust In Government?, Carter H. Manny Jd
Faculty Publications
Following the terrorist attacks of September 11, 2001, the executive branch of the U.S. Government turned to data mining practices for the avowed purpose of protecting public security. Relying on a combination of legislative authorization and cooperation by the private sector, federal institutions have obtained access to information in commercial databases collected largely from routine business transactions by ordinary people posing no particular threat to public order. Much of the data mining has occurred without safeguards like prior court authorization and limitations in the Privacy Act of 1974. In the absence of these safeguards designed to protect individual liberty, data …

Common Law And Federalism In The Age Of The Regulatory State, Alexandra B. Klass
Common Law And Federalism In The Age Of The Regulatory State, Alexandra B. Klass
Articles
Over the past several decades, the growth of federal statutes and the rise of the regulatory state have weakened and displaced state common law even in the absence of express or implied preemption. However, there is a strong theoretical and judicial foundation on which to argue that the existence of statutes, regulations, and the data they generate should be used to inform and develop state common law rather than overshadow or displace it. Moreover, in this current age of the new federalism, such progressive common law development at the state level may be particularly timely and appropriate. This article uses …
