Slavery In New Hampshire: Profitable Godliness To Racial Consciousness, Jody R. Fernald Jan 2007

Slavery In New Hampshire: Profitable Godliness To Racial Consciousness, Jody R. Fernald

Master's Theses and Capstones

The goal of this thesis is to restore complexity, normalcy, and the later development of racism to the history and culture of slavery in New Hampshire. In addition to its role as a normal aspect of life in a hierarchical Atlantic world, slavery in New Hampshire gave birth to both racism and racial consciousness after its gradual demise in the state. The roots of slavery, the acculturation of different populations, changing interpretations of the state's history of slavery, and contemporary examples of its influence are presented here in an effort to correct the perception that slavery was inconsequential in the …

The Impact Of The User Board Majority Requirement On The Governance Of Community Health Centers, Nancy J. Bracken Jan 2007

The Impact Of The User Board Majority Requirement On The Governance Of Community Health Centers, Nancy J. Bracken

MUSC Theses and Dissertations

The federal requirement that 51 percent of the governing boards of federally funded community health centers must be users of the health center was originally intended to insure that the community served had a voice in the services provided. This qualitative study attempted to determine the perceptions of key stakeholders of the impact of the requirement on the effectiveness of governing boards, as well as how boards develop and measure effectiveness. Open-ended, semi-structured interviews with five CEOs and five Board Chairs revealed few concerns about the challenges of complying with the requirement. Board training in South Carolina appears to be …

Visual Culture Archaeology: A Criti/Politi/Cal Methodology Of Image And Identity, James Haywood Rolling Jan 2007

Visual Culture Archaeology: A Criti/Politi/Cal Methodology Of Image And Identity, James Haywood Rolling

Teaching and Leadership - All Scholarship

This study argues the efficacy of the phenomenological cultural work of a visual culture archaeology that liberates a political and critical identity, resistant to domination, authoring social change and its own agency through multiple and incommensurable positions. Built upon Foucauldian premises, visual culture archaeology is developed as a methodology for discursive un-naming and re-naming, and emerges from the inherence and attenuation of inscripted meanings in the reinterpretation of identity during a postmodern confluence of ideas and images. The hybridized representation of the African American in Western visual culture has been unique in the effort by some to define us over …

Guiding Patrons To Online Health Information: Can Librarians Be Found Liable?, Elaine Gibson Jan 2007

Guiding Patrons To Online Health Information: Can Librarians Be Found Liable?, Elaine Gibson

Articles, Book Chapters, & Popular Press

The amount of health information available on the Internet is growing rapidly and information intermediaries are increasingly being asked to help information seekers find and make sense of this information. This activity is for the most part benign from a legal perspective. However, there is a small possibility that, should the intermediary steer an information seeker to information that proves harmful to the seeker, the intermediary may be found liable for injuries incurred. In this paper, we examine the theoretical underpinnings of the relevant laws, clarify the risks, and recommend ways to minimize risk.

Transphobia And The Relational Production Of Gender, Elaine Craig Jan 2007

Transphobia And The Relational Production Of Gender, Elaine Craig

Articles, Book Chapters, & Popular Press

Knowing one's place in the social order, whether that place is one of relative privilege or not, serves two psychologically ameliorative functions. It relieves one from the “anxiety of [gender] identity interrogation” and it helps to inform one as to the socially agreed upon, acceptable conduct for interpersonal exchanges--the episteme of social interaction. This Paper will demonstrate that gender identity is produced through relational, contextually influenced, interpretative processes. Because gender is constructed in societies which strongly embrace static, binary conceptions of gender, and in which social, familial, occupational, and sexual *139 interactions are heavily influenced by gendered social scripts, gender …

Respecting Adolescents' Confidentiality And Reproductive And Sexual Choices, Rebecca J. Cook, Joanna Erdman, Bernard M. Dickens Jan 2007

Respecting Adolescents' Confidentiality And Reproductive And Sexual Choices, Rebecca J. Cook, Joanna Erdman, Bernard M. Dickens

Articles, Book Chapters, & Popular Press

Adolescents, defined as between 10 and 19 years old, present a growing challenge to reproductive health. Adolescent sexual intercourse contributes to worldwide burdens of unplanned pregnancy, abortion, spread of sexually transmitted infections (STIs), including HIV, and maternal mortality and morbidity. A barrier to contraceptive care and termination of adolescent pregnancy is the belief that in law minors intellectually mature enough to give consent also require consent of, or at least prior information to, their parental guardians. Adolescents may avoid parental disclosure by forgoing desirable reproductive health care. Recent judicial decisions, however, give effect to internationally established human rights to confidentiality, …

In The Back Alleys Of Health Care: Abortion, Equality And Community In Canada, Joanna Erdman Jan 2007

In The Back Alleys Of Health Care: Abortion, Equality And Community In Canada, Joanna Erdman

Articles, Book Chapters, & Popular Press

The decriminalization of abortion in Canada ensured neither its availability nor accessibility as an integrated and publicly funded health service. While Canadian women are increasingly referred to or seek abortion services from single-purpose clinics, their exclusion from public health insurance often render these services inaccessible. This article considers denied funding for clinic abortion services from the perspective of the Canadian constitutional guarantee of sex equality. The article focuses on the 2004 Court of Queen's Bench's judgment in Jane Doe I v. Manitoba, which framed denied public funding for clinic abortion services as a violation of women's equality rights under the …

A Comprehensive Analysis Of Mri Research Risks: In Support Of Full Disclosure, Jennifer Marshall, Toby Martin, Jocelyn Downie, Krisztina Malisza

Articles, Book Chapters, & Popular Press

Magnetic resonance imaging (MRI) procedures have been used for over 20 years. This modality is considered relatively safe and holds great promise. Yet, MRI has a number of risks. In order for MRI research to meet the Canadian standard of disclosure, the investigator must communicate and make note of all risks in their research protocols and consent forms. Those creating and reviewing research protocols and consent forms must take notice of the different circumstances under which MRI poses a risk. First, this paper will describe the current standard of disclosure in Canada for research participants. Second, the paper will provide …

A Tale Of Two Greenways: A Comparative Study Of Greenway Projects, Gabrielle Markeson Jan 2007

A Tale Of Two Greenways: A Comparative Study Of Greenway Projects, Gabrielle Markeson

Fordham Urban Law Journal

This Comment discusses the recent trend in urban planning which places an emphasis on creating smart growth communities, which encourage mixed land use, alternative modes of transportation, and incorporating green space in development to combat urban sprawl. Smart growth communities often offer greenways, which encompass a broad range of green space including open space along rivers and streams, natural or landscaped courses for pedestrian or bicycle passage, open space connectors for parks, and linear parks designated as parkways, among others. The Comment discusses the environmental, economic, and health benefits of greenways. While greenways have become desirable, many communities aren't successful …

Payton, Practical Wisdom, And The Pragmatist Judge: Is Payton's Goal To Prevent Unreasonable Entries Or To Effectuate Home Arrests?, Christos Papapetrou Jan 2007

Payton, Practical Wisdom, And The Pragmatist Judge: Is Payton's Goal To Prevent Unreasonable Entries Or To Effectuate Home Arrests?, Christos Papapetrou

Fordham Urban Law Journal

This Comment analyzes the conflicting "objective" and "subjective" tests that courts use to determine if a law enforcement officer's entry into a suspect's home is valid following the Supreme Court's holding in Payton v. New York that an arrest warrant implicitly carries with it a right to enter a suspect's home when there is "reason to believe" it is the suspect's residence and that the suspect is inside. The Comment questions how courts should interpret the "reason to believe" standard and analyzes an approach put forth by Professor Matthew A. Edwards in his article, Posner's Pragmatism and Payton Home Arrests. …

Help Wanted: Is There A Better Way To Select Judges?, Luke Bierman Jan 2007

Help Wanted: Is There A Better Way To Select Judges?, Luke Bierman

Fordham Urban Law Journal

This article gives an anecdotal account of the authors attempt to apply for a position as a State Court Judge that he saw posted in the newspaper. The article uses the job posting concept as a starting point to argue that the system of judicial appointment in New York needs to be reworked and there needs to be new and creative solutions brought into the discussion.

Appointing Judges The European Way, Mary L. Volcansek Jan 2007

Appointing Judges The European Way, Mary L. Volcansek

Fordham Urban Law Journal

This Article looks at methods of judicial selection in Europe as a way to contrast and perhaps better understand and improve the systems of judicial selection used in the United States. The article argues that in Europe, judicial independence is prized above and beyond any other possible positive trait. The democratic legitimacy of European judges derives from the intimate connection between democracy and the rule of law. Legitimacy does not attach, in the public eye, to a single political institution, but rather to the system as a whole.

Undermining Individual And Collective Citizenship: The Impact Of The Exclusion Laws On The African-American Community, S. David Mitchell Jan 2007

Undermining Individual And Collective Citizenship: The Impact Of The Exclusion Laws On The African-American Community, S. David Mitchell

Fordham Urban Law Journal

The purpose of this Article is to demonstrate that felon exclusion laws are not race neutral and that the application of the laws has a racially discriminatory effect, and to call for their abolition. The laws contribute to the erosion of citizenship rights for the individual African-American ex-felon, and the undermining of the collective citizenship rights of the larger African-American community. Part II discusses the conceptualization of citizenship that underscores the premise of the Article. Part III discusses the exclusions that ex-felons encounter and the resulting impact on the individual and the community. Using Alabama as a case study, Part …

A Home Of Its Own: The Role Of Poverty Law In Furthering Law Schools' Mission, Marie A. Fallinger Jan 2007

A Home Of Its Own: The Role Of Poverty Law In Furthering Law Schools' Mission, Marie A. Fallinger

Fordham Urban Law Journal

This essay argues that poverty law can and should be a part of the law school curriculum. If the law school believes it mission to be creating "1) lawyers as public citizens and leaders; 2) lawyers as skilled technicians of the law; 3) lawyers as skilled counselors; 4) lawyers as advocates on behalf of a cause in legal institutions; and 5) lawyers as transformational partners with the poor" then poverty law instruction is vital.

Race And Wealth Disparity: The Role Of Law And The Legal System, Beverly Moran, Stephanie M. Wildman Jan 2007

Race And Wealth Disparity: The Role Of Law And The Legal System, Beverly Moran, Stephanie M. Wildman

Fordham Urban Law Journal

This Article attempts to demonstrate that legal and racial disparities are taken into account in legal decisions and throughout the legal system, despite people's belief and hope that the law is color and wealth blind. Furthermore, this Article demonstrates that race has always affected U.S. law and the legal system. Finally, prominent examples of race-and-class-neutral law are not neutral at all, but include some inherent biases.

Musical Chairs And Tall Buildings: Teaching Poverty Law In The 21st Century, Amy L. Wax Jan 2007

Musical Chairs And Tall Buildings: Teaching Poverty Law In The 21st Century, Amy L. Wax

Fordham Urban Law Journal

This Essay examines the evolution, demise and focus of welfare law courses in law school. It examines the content of these courses in an attempt to understand why these courses are not as popular as they once had been. Finally, it looks at the goals of welfare policy and what welfare law courses should teach.
