Separation, Risk, And The Necessity Of Privacy To Well-Being: A Comment On Adam Moore's Toward Informational Privacy Rights, Kenneth Einar Himma Nov 2007

Separation, Risk, And The Necessity Of Privacy To Well-Being: A Comment On Adam Moore's Toward Informational Privacy Rights, Kenneth Einar Himma

San Diego Law Review

In this Article, I want to raise doubts about certain of Moore's premises in his argument defending information privacy rights. As always and I say this as a continuing admirer of his skill as a philosopher, information theorist, and legal theorist his argument is well thought out and persuasively written. But, as we will see, there are serious problems with each major plank of his schema for justifying privacy rights.

Privacy Versus Security: Why Privacy Is Not An Absolute Value Or Right, Kenneth Einar Himma Nov 2007

Privacy Versus Security: Why Privacy Is Not An Absolute Value Or Right, Kenneth Einar Himma

San Diego Law Review

In this Article, I consider the scope of this right to informational privacy relative to our interests in security and argue, in particular, that the right to privacy must yield to these interests in the case of a direct conflict. I offer arguments from a number of different perspectives. I will, for example, begin with a case directly rooted in what I take to be ordinary case intuitions and then continue with an argument grounded in the distinction between intrinsic and instrumental value, which is thought to serve as a rough mark between what is important from a moral point …

How To Understand Legislatures: A Comment On Boudreau, Lupia, Mccubbins, And Rodriguez, Larry Alexander Nov 2007

How To Understand Legislatures: A Comment On Boudreau, Lupia, Mccubbins, And Rodriguez, Larry Alexander

San Diego Law Review

Much has been written about legal interpretation, and I have serious disagreements with most of it. So it is quite refreshing to read an article on the topic that, from my perspective, gets the topic right from start to finish. As an added bonus, two of the authors are my former colleagues. My enthusiasm for the approach taken by Boudreau, Lupia, McCubbins, and Rodriguez (hereinafter BLMR) has not proven fatal to my task of commenting on the article. I am not reduced to saying "Right on" and then signing off. There are issues to be flagged. Nonetheless, so much of …

The Origins Of Shared Intuitions Of Justice, Owen D. Jones, Paul H. Robinson, Robert Kurzban Nov 2007

The Origins Of Shared Intuitions Of Justice, Owen D. Jones, Paul H. Robinson, Robert Kurzban

Vanderbilt Law Review

The role of justice in assigning criminal liability and punishment has been a matter of long-standing debate. A standard argument against a desert distributive principle-that is, against distributing punishment according to an offender's blameworthiness- has been that such a concept of "desert" is simply too vague and the subject of too much disagreement to operationalize. There may be some truth to these complaints when applied to a philosophical notion of desert, which has been the traditional basis of the desert school.

But more recently, a utilitarian-based theory of desert has urged reliance on an empirical notion of desert, drawn from …

The Acquisition Of Two Phonetic Cues To Word Boundaries, Melissa A. Redford, Christina E. Gildersleeve-Neumann Nov 2007

The Acquisition Of Two Phonetic Cues To Word Boundaries, Melissa A. Redford, Christina E. Gildersleeve-Neumann

Speech and Hearing Sciences Faculty Publications and Presentations

The study evaluated whether durational and allophonic cues to word boundaries are intrinsic to syllable production, and so acquired with syllable structure, or whether they are suprasyllabic, and so acquired in phrasal contexts. Twenty preschool children (aged 3 ; 6 and 4 ; 6) produced: (1) single words with simple and complex onsets (e.g. "nail" vs. "snail"); and (2) two-word phrases with intervocalic consonant sequences and varying boundary locations (e.g. "this nail" vs. "bitty snail"). Comparisons between child and adult control productions showed that the durational juncture cue was emergent in the four-year-olds' productions of two-word phrases, but absent elsewhere. …

Culture Research In The Recent Work Of Itamar Even-Zohar, Harry Aveling

Wacana, Journal of the Humanities of Indonesia

Kekhasan Pengajaran Bahasa Mandarin Di Indonesia, Hermina Sutami Oct 2007

Kekhasan Pengajaran Bahasa Mandarin Di Indonesia, Hermina Sutami

Wacana, Journal of the Humanities of Indonesia

1998 was the year of Mandarin teaching resurrection in Indonesia after 30 years prohibited. Since then, many schools begin to teach Mandarin as an extracurricular subject. In the last two years it becomes an intracurricular subject. Since there was no Chinese school for almost 30 years, consequently there was no publication on Mandarin student's book, no Mandarin teachers. Nowadays, suddenly Mandarin teachers, student's book was highly needed. Many schools use Singapore/Taiwan's book. This rises problems, because Singapore/Taiwan's students language circumstance is different from Indonesian students. The result is far from what we expected. This article proposed some aids based on …

Locating Authority In Law, And Avoiding The Authoritarianism Of 'Textualism', Patrick Mckinley Brennan Oct 2007

Locating Authority In Law, And Avoiding The Authoritarianism Of 'Textualism', Patrick Mckinley Brennan

Working Paper Series

Much modern jurisprudence attempts to move the locus of authority away from people with authority in order to locate it instead, for example, in rules or texts. This article argues that authority, wherever it exists, is a quality of the actions of persons. The article mounts this argument by showing how Justice Scalia's textualism is the legal analogue of a largely discredited form of "Christian positivism," one that leads to a form of authoritarianism. The article goes on to argue that authorianism can be avoided only by individuals' and their communities' becoming authoritative, including in the making and enforcement of …

A Study Of The Relationship Between Semiotic Content In Commercial Email Subject Lines And The Decision By The Recipient To Open The Message, Stephen J. Johnson Oct 2007

A Study Of The Relationship Between Semiotic Content In Commercial Email Subject Lines And The Decision By The Recipient To Open The Message, Stephen J. Johnson

Masters Theses

The writings of Saussure, Peirce, Barthes, Eco and others express theories that symbols, signs, and signals are integral elements in the assignation of meaning within general human communication. Email marketing specialists such as Stephanie Miller, Andy Goldman, and Jeannieay Mullen opine that it is the email recipient’s inferences regarding the words in the address or subject lines that are the primary determinants in the decision whether or not to first open and subsequently respond to a commercial email. It would then seem that email marketers would be well served by understanding what forms these inferences in the minds of the …

Field Assessment Of A Model Tuberculosis Outbreak Response Plan For Low-Incidence Areas, Laura Freimanis Hance, Karen R. Steingart, Christine G. Hahn, Lisa Pascopella, Charles M. Nolan Oct 2007

Field Assessment Of A Model Tuberculosis Outbreak Response Plan For Low-Incidence Areas, Laura Freimanis Hance, Karen R. Steingart, Christine G. Hahn, Lisa Pascopella, Charles M. Nolan

Public and Community Health Sciences Faculty Publications

Background: For a regional project in four low-incidence states, we designed a customizable tuberculosis outbreak response plan. Prior to dissemination of the plan, a tuberculosis outbreak occurred, presenting an opportunity to perform a field assessment of the plan. The purpose of the assessment was to ensure that the plan included essential elements to help public health professionals recognize and respond to outbreaks.

Methods: We designed a semi-structured questionnaire and interviewed all key stakeholders involved in the response. We used common themes to assess validity of and identify gaps in the plan. A subset of participants provided structured feedback on the …

Reading Fluency Through Alternative Text: Rereading With An Interactive Sing-To-Read Program Embedded Within A Middle School Music Classroom, Marie Biggs Oct 2007

Reading Fluency Through Alternative Text: Rereading With An Interactive Sing-To-Read Program Embedded Within A Middle School Music Classroom, Marie Biggs

USF Tampa Graduate Theses and Dissertations

Singing exaggerates the language of reading. The students find their voices in the rhythm and bounce of language by using music as an alternative text. A concurrent mixed methods study was conducted to investigate the use of an interactive sing-to-read program Tune Into Reading (Electronic Learning Products, 2006) as an alternative text, embedded within a heterogeneous music classroom. Measured by the Qualitative Reading Inventory-4 (QRI-4) (Leslie & Caldwell, 2006), the fluency, word recognition, comprehension, and instructional reading level of the treatment students were compared to their counterparts who sang as part of the regular music program. Concurrently, this investigation also …

Phonological Facilitation Through Translation In A Bilingual Picture-Naming Task, Paul Amrhein, Aimee Knupsky Oct 2007

Phonological Facilitation Through Translation In A Bilingual Picture-Naming Task, Paul Amrhein, Aimee Knupsky

Department of Psychology Faculty Scholarship and Creative Works

We present a critical examination of phonological effects in a picture-word interference task. Using a methodology minimizing stimulus repetition, English/Spanish and Spanish/English bilinguals named pictures in either L1 or L2 (blocked contexts) or in both (mixed contexts) while ignoring word distractors in L1 or L2. Distractors were either phonologically related to the picture name (direct; FISH–fist), or related through translation to the picture name (TT; LEG–milk–leche), or they were unrelated (bear–peach). Results demonstrate robust activation of phonological representations by translation equivalents of word distractors. Although both direct and TT distractors facilitated naming, TT facilitation was more consistent in L2 naming …

Jurisprudence And Judicial Ethics, W. Bradley Wendel Oct 2007

Jurisprudence And Judicial Ethics, W. Bradley Wendel

Cornell Law Faculty Publications

The fundamental value in judicial ethics is impartiality. This means that a judge is duty-bound to decide cases on their merits, be open to persuasion, and not influenced by improper considerations. The paradigm case of unethical behavior by a judge is taking a bribe to decide a case in favor of one of the parties. This kind of corruption, which is fortunately rare in many developed countries, is also relatively uninteresting from an intellectual point of view. A more difficult case of failure of impartiality, conceptually speaking, involves a judge who relies on extra-legal factors as the basis for a …

A Benchmark Study Of Protein Embeddings In Sequence-Based Classification, Humasak Tommy Argo Simanjuntak, Lamsihar Siahaan, Patricia Dian Margaretha, Ruth Christine Manurung, Susi Purba, Rosni Lumbantoruan, Arlinta Barus, Helen Grace B. Gonzales

Elinvo (Electronics, Informatics, and Vocational Education)

Proteins play a vital role in various tissue and organ activities and play a key role in cell structure and function. Humans can produce thousands of proteins, each consisting of tens or hundreds of interconnected amino acids. The sequence of amino acids determines the protein's 3D structure and conformational dynamics, which in turn affects its biological function. Understanding protein function is very important, especially for biological processes at the molecular level. However, extracting or studying features from protein sequences that can predict protein function is still challenging: it takes a long time, is an expensive process, and has yet to …
