Examining American Indians' Recall Of Cultural Inclusion In School, Scott Freng, Adrienne Freng, Helen A. Moore

This research examined American Indians' recall of cultural inclusion from their elementary through high school education. Sixteen American Indians described their experiences of schools to peer interviewers. Analysis of interviews revealed three themes: the nature of cultural inclusion, factors influencing cultural inclusion, and recommendations for ideal cultural inclusion. Most participants recalled very little cultural inclusion. However, when cultural inclusion was experienced, it could be categorized into five types ("Indian pride," mismatched specific tribal information, negative/ stereotypical, student initiative, and inclusion due to parental, familial, and/or community involvement). Participants' experiences most closely resembled Charleston's (1994) pseudo or quasi Native education. However, …

Allowing Not-Knowing In A Dialogic Discussion, José Alfonso Feito

International Journal for the Scholarship of Teaching & Learning

Inspired by Bakhtin’s and Vygotsky’s theories of learning, this project explores how “allowing not-knowing” is enacted within collaborative student-led seminar discussions. Earlier research on student reflections (Feito, 2002) suggested that in successful seminars, participants regularly acknowledge their lack of understanding, offer partial understandings, and collectively develop new meanings. This project tracks these phenomena within actual classroom discourse. A detailed discourse analysis of a small “Great Books” seminar session (N=16) describes how students construct a learning environment conducive to not-knowing and the open-ended construction of meaning. International Journal for the Scholarship of Teaching & Learning

This investigation sought to determine if supplementing lectures using Microsoft PowerPoint slides with handouts of the slides enhanced test-taking performance in an undergraduate Human Development course. In the first study, one section of the course (N=50) was given handouts for one exam and a final; the other (N=50) received handouts only for the final. No significant differences in test performance occurred across sections. The second study, conducted the following semester for two sections of the same course, assessed whether the receipt of PowerPoint handouts was moderated by learning styles. Learning styles were not predictive of improved test performance as a …

The pedagogical efficacy of traditional approaches to teaching that involve direct instruction in a subject-centered approach is being questioned constantly in higher education. Thus, this paper examines the shifting discourse in college teaching that emphasizes student learning and excellence in teaching, including implications resulting from this shift. The Scholarship of Teaching and Learning (SoTL) is one of the models engendering this discursive shift. The Problem Of Official Discretion In Anti-Terrorism Law: Comment On Khawajah, W. Wesley Pue, Robert Russo

This paper assesses the first judicial ruling on key provisions of the Anti Terrorism Act. Rutherford J.'s ruling struck down provisions creating a motive requirement in the definition of terrorist activity while upholding the overall structure of the act against challenges on the basis of overbreadth and vagueness. A fault-line divides the two sides of the ruling. On one side the court looked to the lived-experience of legal rules, concluding that including motive requirements would mislead officials in the direction of improper and unconstitutional racial or religious profiling. Achievement gaps, the focus of this research, result from unequal achievement and the variance in achievement existing between different segments of the student population, for example, the difference in achievement between minority students and non-minority students. The No Child Left Behind Act of 2001 and AYP (Adequate Yearly Progress) focus on achievement gaps despite contradictory expressions about the efficacy of the act. The No Child Left Behind Act has created discussion and awareness of race, SES (economically advantaged and disadvantaged) and academic achievement.

The most prominent solutions to this tragedy have focused on building and maintaining stable institutions. This Article reexamines this foundational literature by exploring the costs of stability. In many cases, far more than is generally recognized, the way we value the commons changes. "Conflict resolution is one of the most challenging tasks in collaborative engineering design. In the previous research, a web-based intelligent collaborative system was developed to address this challenge based on intelligent computational argumentation. However, two important issues were not resolved in that system: priority of participants and self-conflicting arguments. In this thesis, two methods are developed for incorporating priorities of participants into the computational argumentation network: 1) weighted summation and 2) re-assessment of strengths of arguments based on priority of owners of the argument using fuzzy logic inference. From the Spanish arrival in Florida in 1565 to present-day America, immigration has been a continuous factor in the history of the United States, and it has repeatedly challenged notions of what it means to be American. A Default-Logic Paradigm For Legal Fact-Finding, Vern R. Walker

This paper presents a visual framework for modelling complex legal reasoning — reasoning that integrates legal rules and policies with expert and non-expert evidence. The framework is based on a many-valued, predicate, default logic. The paper first visualizes the two sides of the rule-evidence interface: rule-based deductions and evidence evaluation. It then explores ways to visualize several dynamics around that interface, including dynamics concerning evidentiary relevance, findings of fact, process decision making about motions, policy-based reasoning about rules and relevant-factor reasoning. The number of English Language Learners (ELLs) in the United States continues to increase (U.S. Census Bureau, 2002); therefore, schools and educators are affected by the growing differences in students' language skills, prior experiences, and progress. This research addresses the need for understanding ELLs and how ELLs benefit from adults effectively reading aloud to them. Further research is needed on effective reading instruction for ELLs for several reasons. First, teachers are becoming ELL teachers by default and feel overwhelmed because of the responsibility to teach both language and content (Gersten, 2002).
