The Amistad Case, Douglas O. Linder Jan 2007

The Amistad Case, Douglas O. Linder

Faculty Works

The improbable voyage of the schooner Amistad and the court proceedings and diplomatic maneuverings that resulted from that voyage form one of the most significant stories of the nineteenth century. When Steven Spielberg chose the Amistad case as the subject of his 1997 feature film, he finally brought it the attention the case had long deserved, but never received. The Amistad case energized the fledgling abolitionist movement and intensified conflict over slavery, prompted a former President to go before the Supreme Court and condemn the policies of a present Administration, soured diplomatic relations between the United States and Spain for …

Law And Heidegger’S Question Concerning Technology: Prolegomenon To Future Law Librarianship, Paul D. Callister Jan 2007

Law And Heidegger’S Question Concerning Technology: Prolegomenon To Future Law Librarianship, Paul D. Callister

Faculty Works

Following World War II, the German philosopher Martin Heidegger offered one of the most potent criticisms of technology and modern life. His nightmare is a world whose essence has been reduced to the functional equivalent of a giant gasoline station, an energy source for modern technology and industry. "This relation of man to the world [is] in principle a technical one . . . [It is] altogether alien to former ages and histories. For Heidegger, the problem is not technology itself, but the technical mode of thinking that has accompanied it." Such a viewpoint of the world is a useful …

Prospects For Democracy, Nick Stokes Jan 2007

Prospects For Democracy, Nick Stokes

Human Rights & Human Welfare

Upon the disintegration of the Soviet Union in 1991, the countries of Eastern Europe and Central Asia that had hitherto lived behind the Iron Curtain inherited new independence and uncertain political futures. Since then, the world has watched a political entity that once covered 8.6 million square miles shatter into 15 new nation-states, each with the potential to throw off the shackles of the past and forge new democracies. Fifteen years after the fall, we see elections at state and local levels, multi-party systems, and constitutions touting freedoms of press and religion. While these elements are vital to the survival …

How A Marriage Discrimination Amendment Would Disrespect Democracy In Minnesota, Anthony S. Winer Jan 2007

How A Marriage Discrimination Amendment Would Disrespect Democracy In Minnesota, Anthony S. Winer

Faculty Scholarship

The proposed marriage discrimination amendment to the Minnesota Constitution is profoundly anti-democratic. It is extremely wide-ranging in its scope, it obliterates the opportunity of the LGBT community to legislatively advance its interests in the area, it falsely assumes characteristics of the state judiciary that do not in fact exist, and it is drafted with language that is particularly hostile to LGBT concerns and democracy in general. It was a triumph for reason and democracy that this amendment was defeated in 2006. It should never be introduced again. In the unfortunate event that it is introduced again, it should be resoundingly …

Signing And Signifyin': Negotiating Deaf And African American Identities, Heather D. Clark Jan 2007

Signing And Signifyin': Negotiating Deaf And African American Identities, Heather D. Clark

Ethnic Studies Review

For individuals who are both African American and Deaf finding a place to belong is a process of navigating their many cultural identities. In this paper I explore the following questions: where do individuals who are African American and Deaf find and make community? To which communities do they perceive they belong? Is their primary identity African American, Deaf or something else? Does belonging to one community negate membership in another? Does the presence of African American Deaf individuals have an impact on either community or are they forced to create an entirely new one for themselves?

Plain Meaning Vs. Broad Interpretation: How The Risk Of Opportunism Defeats A Unitary Default Rule For Interpretation, Juliet P. Kostritsky Jan 2007

Plain Meaning Vs. Broad Interpretation: How The Risk Of Opportunism Defeats A Unitary Default Rule For Interpretation, Juliet P. Kostritsky

Faculty Publications

The problem of contract interpretation presents courts with significant questions about the nature and methodology of judicial intervention into privately arranged affairs. The court often assumes an active role in interpreting the words of a written contract in part because words have more than one meaning or because a contract is incomplete. When a court chooses amongst variable meanings, or interprets contracts to craft limitations on parties' behavior when express limits do not exist, its choice must be then justified using a framework explored in this essay.

Traditionally, commentators have advocated one of two general approaches to supply the methodology …

Educating Deaf Children In An Inclusive Setting In Kenya: Challenges And Considerations, Peter Oracha Adoyo Ph.D. Jan 2007

Educating Deaf Children In An Inclusive Setting In Kenya: Challenges And Considerations, Peter Oracha Adoyo Ph.D.

Electronic Journal for Inclusive Education

Educators of the deaf have been of the view that placement of deaf students in classrooms with their hearing peers often may not be conducive to their social and academic development. This is because the two groups often experience difficulties in communication with each other and that such difficulties often include loneliness, rejection and social isolation. These experiences as observed by the educators do not promote social and academic development. This paper discusses perspectives on inclusive education in general and the deaf in particular. Challenges encountered in placing the deaf child in an inclusive classroom are highlighted and possible solutions …

“The Problem Of Science” In Nietzsche And Heidegger, Babette Babich Jan 2007

“The Problem Of Science” In Nietzsche And Heidegger, Babette Babich

Research Resources

Nietzsche and Heidegger pose important philosophical questions to science and its technological projects. The resultant contributes to what may be called a continental philosophy of science and I argue that only such a rigorously critical approach to the question of science permits a genuinely philosophical reflection on science. The resultant contributes to what may be called a continental philosophy of science and I argue that only such a rigorously critical approach to the question of science permits a genuinely philosophical reflection on science. More than a thoughtful reflection on science, however, the heart of philosophy is also at stake in …

Bargaining With A Hugger: The Weaknesses And Limitations Of A Communitarian Conception Of Legal Dispute Bargaining, Or Why We Can't All Just Get Along, Robert J. Condlin Jan 2007

Bargaining With A Hugger: The Weaknesses And Limitations Of A Communitarian Conception Of Legal Dispute Bargaining, Or Why We Can't All Just Get Along, Robert J. Condlin

Cardozo Journal of Conflict Resolution

The communitarian conception of bargaining now popular with legal academics presupposes a world in which people are always at their best. Clients and lawyers share information about themselves and their situations candidly and fully, construct agreements from the perspective of their common interests and resolve differences according to objectively derived and jointly agreed upon substantive standards. They "connect" as persons and in the process convert what in lesser hands might be a form of stylized combat into a kind of joint venture, and sometimes even a lasting friendship. This, in turn, takes the hard edge off their disputing and makes …

An Adaptive Fuzzy Regression Model For The Prediction Of Dichotomous Response Variables, R.B. Zain, B. Abldin, R.M. Dom, S.A. Kareem

Research Publications (2006 to 2010)

This paper proposes an adaptive technique in the prediction of dichotomous response variable by combining fuzzy concept with statistical logistic regression. The model was tested on an oral cancer dataset in predicting oral cancer susceptibility. In this paper we will present the development, evaluation and validation of the proposed model based on the experiment carried out. Explanatory power of the adaptive model was calculated and compared with fuzzy neural network and statistical logistic regression models using calibration and discrimination techniques. Area under ROC values calculated indicates that the proposed model has compatible predictive ability to both fuzzy neural network and …

An Analysis Of Recreational Email Messages, Ai Nyet Chen, Rajeswary A. Sargunan

Research Publications (2006 to 2010)

This study focuses on one form of Computer-mediated Communication (CMC) that is, email. As email is a silent mode of communication, a wide range of communicative strategies (CSs) is employed by email users. Therefore, this study explores the various types of CSs employed by male and female teenagers when communicating with their friends in the website – www.friendster.com. The reasons for employing the various CSs and influence of gender on the use of CSs will also be discussed. A total of 123 email messages form the corpus for this study were contributed by 12 teenage students. Two instruments (interview questions …

Language And Ethnic Relations - A Case Study On Reverse Situations: Thais A Minority In Kedah, Malaysia And Malays A Minority In Pathumthani, Thailand, Umaiyah Haji Umar

Research Publications (2006 to 2010)

In undertaking my research on the classification of Thai-Kedah dialects, Umaiyah (2003) under a study leave grant from the University of Malaya, I came across Thai Buddhists who regard themselves as Malaysians, a minority group living in small communities in Kedah, Malaysia. These small communities are scattered in the state of Kedah, centred on Buddhist temples living peacefully with the predominantly majority Malay community. of interest in this paper is the community living in Naka, Kedah.

Language And Writing System Of Bangkok Melayu, Umaiyah Haji Umar

Research Publications (2006 to 2010)

Bangkok Melayu are descendants ofMalays who were taken prisoners and forcibly brought to Bangkok by the invading Thai forces during several raids into Pattani and Kedah between 1786 to 1838, Hall (1968) and Jitmoud (1988). They were settled in small communities and distributed to several parts of Bangkok and surrounding areas, Jitmoud (1988). Until 1930' s, with the wave of Thai nationalism followed with implementation on the policy of forced integration, Sanitwong Na Ayuthaya (1988), the rural Bangkok Malays lived apart from the mainstream Thai society practicing Malay culture.

English Language Learners And Library Research, Jessica Schomberg Jan 2007

English Language Learners And Library Research, Jessica Schomberg

All Graduate Theses, Dissertations, and Other Capstone Projects

The purpose of this project was to study problems English language learners (ELLs) face when doing research in U.S. academic libraries. A review of the literature indicates that ELLs face both linguistic and cultural barriers. Those barriers are related to learning expectations, library anxiety, and technology. Research on organizational culture and its influence on website design was consulted and used to compare the design of a library catalog’s interface with student responses to a library instruction session offered within Composition 101 for non-native speakers. Based on those results, it is argued that library catalogs are designed to match the cultural …

Communication, Liminality, And Hope: The September 11th Missing Person Posters, Kevin Jones, Kenneth S. Zagacki, Todd V. Lewis Jan 2007

Communication, Liminality, And Hope: The September 11th Missing Person Posters, Kevin Jones, Kenneth S. Zagacki, Todd V. Lewis

Faculty Publications - Department of Communication and Cinematic Arts

Immediately following the attacks on the World Trade Center on September 11, 2001, family and friends of victims missing in the towers began placing ‘‘Missing Person Posters’’ of their loved ones around New York City. In this paper, we argue that the posters represent a powerful response to a traumatic and in some ways unprecedented situation, a response that transformed the death of loved ones from a reality or future certainty into a probability made possible by the searchers’ desire, emotions, or imagination. We demonstrate how the posters, operating in the ‘‘subjunctive’’ voice, transformed the ‘‘ liminal’’ space between life …
