Taking Things Into Account: Learning As Kinaesthetically-Mediated Collaboration, Jayson O. Seaman Jan 2007

Taking Things Into Account: Learning As Kinaesthetically-Mediated Collaboration, Jayson O. Seaman

Kinesiology

This paper presents research on participant learning processes in challenge course workshops using the framework known as Cultural-Historical Activity Theory (CHAT). CHAT views learning as a shared, social process rather than as an individual event. Participants' experiencing and learning was mediated by the physical and social conditions of the experience and by the contributions of other participants. The concept of mediation suggests that the meaning participants make of experience is not an individual event, but instead is enacted as a creative, collaborative process using cultural and institutional tools. The recognition that people's physical, social and reflective learning processes are mediated, …

The Myth Of Inherent And Inevitable Industry Differences: Diversity As Artifact In The Quest For Patent Reforms, Robert A. Armitage

Michigan Telecommunications & Technology Law Review

The University of Michigan Law School hosted a two-day conference entitled "Patents and Diversity in Innovation." The morning of the first day featured a panel devoted to "industry differences." This panel took up the task of dealing with the following questions: How has diversification of innovation and the expansion of patentable subject matter affected patent practice? How do markets for technology vary from sector to sector? And how do they reflect or influence patent practice? To what extent are business practices and competitive markets shaped by the nature of the technology, product, or service?[...] A conference titled "Patents and Diversity" …

Compensation For Porperty Under The European Convention On Human Rights, Tom Allen Jan 2007

Compensation For Porperty Under The European Convention On Human Rights, Tom Allen

Michigan Journal of International Law

This Article asks whether the right to property, as a human right, serves the same general purpose as other human rights. The Article does so by examining the standards relating to compensation for deprivations of property under the European human rights system. If the system protects property for similar reasons as other fundamental rights, the interpretation of the right to property should draw upon the principles developed in relation to the interpretation of other rights. However, if the right to property is distinct from other human rights, then perhaps guidance on its interpretation should come from comparative law, specifically in …

Critical Autonomy: Investigating Social Class And Education, Peter-John Giampietro Jan 2007

Critical Autonomy: Investigating Social Class And Education, Peter-John Giampietro

Doctoral Dissertations

This dissertation develops the concept of critical autonomy as a theoretical framework to guide responses to social class oppression in schooling. The project is grounded on Cheryl Misak and C. S. Peirce's arguments about inquiry and their implications for holding knowledge claims, especially claims to self-knowledge. As a result, critical autonomy presupposes the need for engagement in a community of inquiry. Unlike other theories of autonomy that may acknowledge that autonomy is nurtured socially but is realized in isolation, I argue that critical autonomy is enhanced through the constant process of inquiry with other inquirers. Thus it is always a …

Beyond "English Language Learner": Second Language Writers, Academic Literacy, And Issues Of Identity In The United States High School, Christina M. Ortmeier-Hooper Jan 2007

Beyond "English Language Learner": Second Language Writers, Academic Literacy, And Issues Of Identity In The United States High School, Christina M. Ortmeier-Hooper

Doctoral Dissertations

This study examines the writing experiences of U.S. adolescent second language writers and considers how students' identities as ""English Language Learners (ELL)" contributes to their learning, their sense of self, and their academic writing. Within the perspective that writing is a socially-embedded activity, I conducted five case studies documenting the academic writing experiences of immigrant students from various countries (Nigeria, Taiwan, Dominican Republic and El Salvador) during their first year of high school.

During the year-long study, I collected data from sources, including: student interviews, classroom observations, students' writing samples, students' social influence maps, and community/school artifacts. Using a theoretical …

Can Deterrence Be Tailored?, M. Elaine Bunn Jan 2007

Can Deterrence Be Tailored?, M. Elaine Bunn

Strategic Forums

Deterrence, the hallmark of Cold War–era security, needs to be adapted to fit the more volatile security environment of the 21st century. The Bush administration has outlined a concept for tailored deterrence to address the distinctive challenges posed by advanced military competitors, regional powers armed with weapons of mass destruction (WMD), and nonstate terrorist networks—while assuring allies and dissuading potential competitors.

Why "Managing" Biodiversity Will Fail: An Alternative Approach To Sustainable Exploitation For International Law, Kyle Ash Jan 2007

Why "Managing" Biodiversity Will Fail: An Alternative Approach To Sustainable Exploitation For International Law, Kyle Ash

Animal Law Review

The role of humans in mass extinctions necessitates an assessment of the collective human psychology responsible for the degradation of Earth’s life support systems. In this paper, the Author will cite instruments and discourse relevant to international environmental law to illustrate how an antiquated conception of biological hierarchies is condoned whenever other species are mentioned. As reflected in the law, humans do not just believe we are existentially unconnected with the rest of life, but that we have more right to live on the planet. This, ironically, allows us to rationalize activities that destroy the planet, even for ourselves. Nature …

Awakening The 'Mere Pulsation Of Desire' In Silas Marner, Melissa Raines Jan 2007

Awakening The 'Mere Pulsation Of Desire' In Silas Marner, Melissa Raines

The George Eliot Review Online, ISSN: 2831-5375

In George Eliot's Middlemarch, the narrator reflects on those crucial events which shape pathways in our lives. For Tertius Lydgate, this occurs with the chance opening of a book to a particular page:

[T]he first passage that drew his eyes was on the valves of the heart. He was not much acquainted with valves of any sort, but he knew that valvae were folding doors, and through this crevice came a sudden light startling him with his first vivid notion of finely adjusted mechanism in the human frame.'

For Lydgate, this seminal instant is the one which inspires him to …

Review Of The Organ Pipe Cactus By David Yetman, Geoff Kelley Jan 2007

Review Of The Organ Pipe Cactus By David Yetman, Geoff Kelley

Ecological and Environmental Anthropology (University of Georgia)

The Organ Pipe Cactus combines historical, interview, and field observation data to plea for greater awareness, appreciation, and conservation of the organ pipe cactus (Stenocereus thurberi) – pitaya as it is commonly known in the Sonoran Desert, Mexico. This short book (70 pages including excellent illustrations, glossary, references, and index) seeks to emphasize how (mostly impoverished) human communities have utilized and maintained the plant for centuries.
Yetman’s coverage of pitaya ecology is thorough and recognizes the roles humans have played in the plant’s distribution. Adaptations from cellular to landscape levels are explained with great clarity. Micro and macro …

Review Of Fort Randall On The Missouri, 1856-1892 By Jerome A. Greene & Fort Concho: A History And A Guide By James T. Matthews, Barton Barbour Jan 2007

Review Of Fort Randall On The Missouri, 1856-1892 By Jerome A. Greene & Fort Concho: A History And A Guide By James T. Matthews, Barton Barbour

Great Plains Quarterly (through 2013)

National Park Service historian Jerome A. Greene, a leading figure in western military historiography, here offers a comprehensive study of Fort Randall, which served as a bastion of U.S. Army presence in the Great Plains for thirty-eight years. Built in 1856, Fort Randall's garrison was expected to keep peace among Native Plains nations, prevent Indian-white conflicts, and monitor the burgeoning traffic on overland trails and the Missouri River. Located just above the Nebraska-South Dakota border, Fort Randall lay within two hundred miles of the Ponca, Santee, Yankton, Rosebud, and Pine Ridge reservations. Despite its proximity to these sometimes troubled reservations, …

Review Of Hidden In Plain Sight: Contributions Of Aboriginal Peoples To Canadian Identity And Culture, Volume L Edited By David R. Newhouse, Cora J. Voyageur, And Dan Beavon, Robin Brownlie Jan 2007

Review Of Hidden In Plain Sight: Contributions Of Aboriginal Peoples To Canadian Identity And Culture, Volume L Edited By David R. Newhouse, Cora J. Voyageur, And Dan Beavon, Robin Brownlie

Great Plains Quarterly (through 2013)

Hidden in Plain Sight is a book with an unusual agenda: to discuss and publicize the many constructive, meaningful contributions that Aboriginal peoples have made to Canadian society. Aimed primarily at the general public, students, and Aboriginal people themselves, the book contains essays from treaty researchers, civil servants, lawyers, teachers, curators, artists, writers, undergraduate students, and academics. The book's impetus arose from its editors' frustration over the constant equation of Aboriginal people with pain, problems, and struggle. Widely absent from public discourse and academic writing, they felt, was attention to the strengths and capacity of Aboriginal peoples, their achievements in …

Review Of North American Icelandic: The Life Of A Language, Kirsten Wolf Jan 2007

Review Of North American Icelandic: The Life Of A Language, Kirsten Wolf

Great Plains Research: A Journal of Natural and Social Sciences (through 2013)

A curious phonological feature of North American Icelandic is flámceli ("skewed speech"). The term refers to the apparent mergers of two sets of front vowels: on the one hand (1) and (E), and on the other hand (Y) and (ö). Flámceli was widespread in certainly one of the areas of Iceland that witnessed considerable emigration to North America in the last quarter of the nineteenth century and was brought to the New World in the speech of the immigrants. It was found in three regional dialects of Icelandic up until the last few decades when, through official efforts, it was …

Structuring Complex Cooperative Learning Activities In 50–Minute Classes, Barbara J. Millis Jan 2007

Structuring Complex Cooperative Learning Activities In 50–Minute Classes, Barbara J. Millis

To Improve the Academy: A Journal of Educational Development

Given the power of learning-centered teaching, faculty can be coached to structure cooperative activities wisely and well, even within 50-minute class periods where there is a perception that complex group work is difficult. In addition to giving some basic advice on team formation and classroom management, this chapter provides examples of five complex cooperative learning structures—Jigsaw, Send-a-Problem, Cooperative Debates, Guided Reciprocal Peer Questioning, and Bingo—that can be conducted within 50-minute classes. The specific literature-based examples are complemented by examples in a variety of other disciplines, making them seem doable to more faculty.

Cued Speech: Not Just For The Deaf Anymore, Shana Baber Jan 2007

Cued Speech: Not Just For The Deaf Anymore, Shana Baber

Senior Honors Theses and Projects

Originally, Dr. Cornett designed Cued Speech for the Deaf to serve as a supplement to lipreading in order to allow the Deaf access to spoken English in a purely visual form. However, because of its integration of multiple senses and brain areas—sound, sight, kinesthesia, and motor movement—Cued Speech is particularly well suited to help many students with special needs regardless of their hearing status. This article will provide an overview of what Cued Speech is and how it can be used by speech-language pathologists and other professionals to aid a variety of students with special needs who may or may …

The Racialization Of Jimi Hendrix, Marcus K. Adams Jan 2007

The Racialization Of Jimi Hendrix, Marcus K. Adams

Senior Honors Theses and Projects

The period of history immediately following World War Two was a time of intense social change. The end of colonialism, the internal struggles of newly emerging independent nations in Africa, social and political changes across Europe, armed conflict in Southeast Asia, and the civil rights movement in America were just a few. Although many of the above conflicts have been in the making for quite some time, they seemed to unite to form a socio-political cultural revolution known as the 60s, the effects of which continues to this day.

The 1960s was a particularly intense time for race relations in …

Black Aesthetics In Children's Literature, Tammy Shonta Smith Jan 2007

Black Aesthetics In Children's Literature, Tammy Shonta Smith

Master's Theses and Doctoral Dissertations

The purpose of my research is to show that although many African American children’s books have been used as “race texts” to give children insight into race relations of the past, many are important in that they preserve the Black dialect and encourage child activism and social change. Black aesthetics are most beneficial in that they educate children about not just race but about the African American oral tradition of Black dialect. They also provide children with a strong foundation in Black aesthetics, which prepares them for the higher forms of Black aesthetics found in African American adult literature. Not …

Scholarly Editing As A Dissertation Topic: Philological Perspectives On Documentary Editing In Theory And Practice, Harry Lonnroth

Documentary Editing: Journal of the Association for Documentary Editing (1979–2011)

The doctoral dissertation for the Degree of Doctor of Philosophy in Scandinavian Languages that I duly defended in public at the University of Tampere, Finland, was a so-called philological edition3 for the period of 1678-1695 of the judgment book of the town of Ekenas,4 a Swedish-speaking town in southern Finland:" The scholarly edition includes philological commentary and indices for persons, places, subjects and cases. It constitutes a legal-historical document, which, I hope, will prove to have a long lasting philological and historical source value in both the Finnish and the Scandinavian perspective. (; Before I go on to discuss in …
