Making The Party Presentation Principle Safe For Originalism, Randy E. Barnett, Lawrence B. Solum

The Supreme Court sometimes adheres to what it calls the “party presentation principle”—terminology that dates back to 2008. Although judicial articulations of the principle have been inconsistent and imprecise, the gist is the familiar notion that courts should resolve cases on the basis of the issues and reasons presented by the parties to the dispute. Conversely, questions not properly raised by the parties should be avoided by the Court. Thus, the Court has on several occasions declined to address arguments outside the scope of the questions raised by the parties in their petition for certiorari.

Long an open, yet misinterpreted political artist, Bruce Springsteen has never shied away from calling out injustices through his songs. Over the course of his long career, he has used his platform to lyrically speak out against war, the brutality of American capitalism, and the struggles of marginalized people of all backgrounds. This study explores to what extent Japanese as a Target Language (JTL, henceforth) learners use mixed-speech styles. "Mixed-speech styles" refers to the phenomenon that occurs when speakers shift speech styles during the course of an interaction. The three primary speech styles are (1) the desu/masu forms, which are generally considered formal speech-level markers, (2) the non-desu/masu forms, considered informal speech-level markers, and (3) the Chūto shūryō-gata, which I translate to unfinished utterances that do not contain a clear style-marker.

On January 21, 2025, the U.S. Supreme Court recognized in Andrew v. White that the State’s introduction of sexualizing evidence in a woman’s capital trial may violate due process. In Brenda Andrew’s case, prosecutors presented evidence about her sexual relationships, clothing, and style of underwear as proof that she was guilty of capital murder. Our research, supported by a grant from the National Science Foundation, reveals for the first time that the prosecution’s tactics in Brenda Andrew’s case were far from unique. Teaching in English Medium Instruction (EMI) programs can significantly reshape educators’ professional identities particularly when English is not their first language. This article summarizes a previously published phenomenological study with three Italian EMI educators in educational linguistics. Drawing on creative fortune lines to trace their experiences, the study showed that participants’ disciplinary field played a central role in their lived identity, intersecting with issues of language teaching and native-speakerist ideologies. The findings also revealed a heightened awareness of multilingual competence across English and other languages, which contributed to identity formation, alongside a pronounced tension between their professional selves expressed in …

During the acculturation process to their new life in the United States, international students can face challenges in building meaningful connections with their campus community due to difficulties in social integration. There has been limited research on finding effective ways to help international students overcome these challenges, despite numerous studies exploring the factors contributing to international students' disengagement, such as cultural and linguistic barriers and financial difficulties. This study explores how dialogic teaching can enhance metacognition and self-efficacy among middle school multilingual learners (MLs) who face challenges with the academic language demands of literacy tasks. Using a design-based research (DBR) methodology, specifically formative experiment, the Metacognitive Dialogic Teaching Protocol (MDTP) was implemented over seven iterative cycles. The research questions were as follows: How do dialogic interactions impact metacognition in middle-grade MLs? How does Metacognitive Dialogic Teaching affect comprehension development in these students? And how does it influence their self-efficacy? This dissertation explores the impact of culturally responsive professional development on K–12 educators’ perceptions and understanding of Black English, also known as African American Vernacular English (AAVE). The study responds to the longstanding marginalization of Black English in educational environments and its implications for academic equity, cultural identity, and student performance—particularly among African American learners. The central intervention, titled “Do You Understand Me? Linguistic and Cultural Competence Black English Professional Development,” was designed to increase teachers’ linguistic awareness, dismantle deficit perspectives, and promote inclusive instructional practices that validate students’ home language.

The curriculum was designed in alignment with the Cognitive Theory of Multimedia Learning (CTML), Empowerment Theory (ET), and Social Cognitive Theory (SCT) frameworks. These frameworks were used to determine the selection and sequencing of learning activities. As reflected in CTML principles, the use of texts, images, infographics, and videos enhances knowledge retention and information comprehension and helps prevent cognitive overload. Through activities, homework, and family engagement, the principles of ET were incorporated into the curriculum to facilitate participants’ perceived control over food-related decisions. Background. Safety supports psychological wellbeing and potentially shapes brain aging yet existing scales overlook cumulative lifespan safety experiences.
Methods. To address this gap, we developed and validated the Lifetime Sense of Safety (LSS) scale in Kenyan adults. The LSS uses visual analog scaling with a red-to-green color gradient to retrospectively rate felt safety across life stages and settings. We evaluated scale psychometrics and associations with social determinants of health and indicators of brain health.
Results. The LSS shows adequate internal consistency and test-retest reliability, with two distinct but correlated factors representing childhood and adulthood safety. Women and …

In online learning spaces, students may feel disconnected not only because of limited interaction but also when they notice differences in their backgrounds or beliefs. This survey study examined students’ perceived differences and their implicit and explicit experiences of othering based on their backgrounds and beliefs. Descriptive results showed that political orientation, culture, and socioeconomic status were common areas where students felt different, while race/ethnicity, culture, and religion stood out as stronger points of distinction. Thematic analysis of open-ended responses showed that many students described subtle forms of othering, such as discomfort and self-doubt, while others encountered more direct negative …

Hispanic workers make up a large and growing portion of the construction workforce in the United States; particularly in California, the percentage of construction workers who are Hispanic is estimated to be about 55% as of 2021 (Elkins). Low-income and ethnic minority youth experience high psychiatric need but persistently low participation in traditional mental health care. General pediatricians are often the first and only healthcare providers with whom many families engage around their child’s emotional and behavioral development. Using both quantitative analysis of retrospective secondary data and Interpretative Phenomenological Analysis (IPA) of in-depth interviews with diverse caregivers, this project explored influencers of child mental health and family utilization of pediatric primary-care-based mental health services in the context of a uniquely multicultural clinic serving a predominantly Medicaid population. This study examined the critical role of human resource (HR) managers in promoting workforce integration and addressing the persistent barriers faced by people with disabilities (PWDs) in Côte d'Ivoire. Focusing on the perspectives, challenges, and lived experiences of HR managers, the research explored how inclusive workplace practices were developed and implemented within the Ivorian context. Executive leadership development programs are often treated as race-neutral pathways to advancement, yet they frequently reflect dominant cultural norms that require leaders from marginalized communities to assimilate in order to succeed. This study examined the question: How can executive leadership development be restructured to affirm Black identity, cultural intelligence, and leadership persistence rather than require assimilation into exclusionary models? This study employs a convergent mixed-methods design, including interviews with 9 Black executive leaders and a document analysis of leadership development programs using the Assimilation Pressure Index. Artificial intelligence and machine learning systems are deeply embedded in modern information ecosystems, yet the bias they exhibit is not a single phenomenon. This dissertation identifies three distinct stages of the AI pipeline at which bias surfaces, each demanding a di!erent conceptual treatment: measurement bias in preprocessing, addressed through identification fairness; content bias at the corpus level, addressed through representation equity; and systemic bias in retrieval, addressed through distributional justice. This qualitative multi-case study examines how elementary teachers in English as a New Language (ENL) and Dual Language Bilingual Education (DLBE) settings conceptualize, implement, and reflect upon translanguaging pedagogies, with particular attention to translanguaging rings as tools for language differentiation. Grounded in a rearticulation of language as a dynamic, socially, politically, and historically constructed subject and object, this study challenges monoglossic ideologies that position named languages as bounded systems at the center of language education. In Mergers & Acquisitions (M&A), a deal is completed when it has been announced, a fully executed agreement is in place, and the target's ownership is consolidated with the acquirer. The completion of an M&A deal is vital because it is a labor-intensive process that requires a tremendous number of resources from the firm. Yet even though 39,494 deals were announced in 2025, few studies have examined the variables that influence deal completion. The aims of this project are twofold: (a) to develop a method of theoretical analysis and (b) to put this method into pointed use. In service of (a), I propose a method of choreographic analysis. This method operates relationally, highlighting the production of movement and stillness among and between bodies, objects, and encounters. Choreographic analysis draws from methods typically sequestered to dance studies. Towards aim (b), this project demonstrates the relevance and breadth of choreographic analysis by connecting it to ecocriticism.
