In this essay, I review the fourth edition of Gary Born's International Litigation in United States Courts (ICL), now co-authored by Peter Rutledge. This is a well-established case book/treatise that has influenced the thinking of many lawyers, both in the United States and abroad. In reviewing ICL, I explore some of the recent changes in cross-border litigation in the United States reflected in the fourth edition. Those changes demonstrate that transnational litigation has become a separate field of law in the sense that its independent study has acquired considerable practical importance. But there is more. Catholic Philanthropy And Civil Society: The Lay Volunteers Of Saint Vincent De Paul In Nineteenth-Century Mexico, Silvia Marina Arrom Ph.D.

The history of the Society of Saint Vincent de Paul and the Association of the Ladies of Charity of Saint Vincent de Paul in nineteenth-century Mexico counters the argument that “civil society and philanthropy are new to Latin America.” Both organizations operated in cities nationwide, with tens of thousands of members helping hundreds of thousands of persons who were poor. Their activities, which are described in detail, encompassed traditional forms of charity and efforts to address the causes of poverty. From Mothers' Allowance To Mothers Need Not Apply: Canadian Welfare Law As Liberal And Neo-Liberal Reforms, Shelley A. M. Gavigan, Dorothy E. Chunn

Osgoode Hall Law Journal

In this paper we examine changes in the form and content of Canadian welfare law through a historical, feminist lens using the exemplar of mother-headed families. Our analysis of how the state dealt with sole support mothers in several provinces throughout the twentieth century reveals important continuities, as well as discontinuities, between the past and the present that have shaped and reshaped the lives and experiences of poor women and their children. In doing so, it helps to illuminate how they have been rendered "undeserving" or "never deserving" with the neo-liberal (re)formation of the Keynesian state in Canada.

The Bit Generation's Emergence As A Collective Action Problem: Prisoner's Dilemma Or Network Effects?, Santiago Montt

The Latin American and Caribbean Journal of Legal Studies

This paper presents a new theory that explains why developing countries have been entering into Bilateral Investment Treaties (BITs) in the last 50 years. It disputes Andrew Guzman’s account which depicts the BIT generation as a result of a prisoner’s dilemma among developing countries. As explained here, the BIT “game” differs from a prisoner’s dilemma in two key ways. First, the BIT game has a sequential/evolutionary nature, stemming from the fact that developing countries have been joining (and rejecting) the network at various times since 1959. How did an unaccredited law school, admitting its first students in 1976, become renowned as a national and international leader in environmental education in less than three decades? What did Pace have to attract some of America’s brightest and best college graduates to pursue their careers in environmental law in White Plains?
