Thoughts On Commercial Speech: A Roundtable Discussion, Ronald K.L. Collins, Steven H. Shiffrin, Erwin Chemerinsky, Kathleen M. Sullivan

Cornell Law Faculty Publications

Adam Liptak, the legal affairs writer for The New York Times, moderates a lively discussion about commercial speech between three esteemed constitutional scholars: Professor Erwin Chemerinsky of Duke University School of Law; Professor Kathleen Sullivan of Stanford Law School; and Professor Steve Shiffrin of Cornell Law School. These scholars debate the proper definition of defining commercial speech, how the corporate identity of a speaker and the content of the speech determines the level of First Amendment protection, whether it is possible to demarcate commercial speech from political speech, and the problems of paternalism and viewpoint discrimination in this complex and …

Justifying An Analysis Of The Ecclesiological Development Of Subsidiarity Via Civil And Common Law Jurisprudential Epistemology, William Pieratt Demond Oct 2007

Justifying An Analysis Of The Ecclesiological Development Of Subsidiarity Via Civil And Common Law Jurisprudential Epistemology, William Pieratt Demond

Seton Hall University Dissertations and Theses (ETDs)

This article seeks to justify an examination of subsidiarity's development within Catholicism. Due to the fact that the European Union ["EU"] codified subsidiarity via the Treaty of Maastricht, subsidiarity is now a part of EU law. Although seemingly intended to resolve questions concerning the proper allocation of powers, its codification has generated substantial debate concerning the proper meaning(s) (if any) and/or application(s) of subsidiarity within the EU. Due to the facts that 1) the EU's legal traditions are heavily influenced by both the civil and common law traditions, 2) both of these traditions advocate the use of established jurisprudential methodologies …

Financial Management: Social Agency, Social Enterprise And Social Economy, Roger A. Lohmann, Nancy Lohmann Oct 2007

Financial Management: Social Agency, Social Enterprise And Social Economy, Roger A. Lohmann, Nancy Lohmann

Faculty & Staff Scholarship

There has been a quiet revolution in financial management practice in social agencies in recent decades, symbolized by the transition from fund to enterprise accounting and increasing recognition of the ‘third sector’ of the social economy. The traditional voluntary agency model of donations has been joined by grants, performance contracts, ‘managed care’ and an array of other options, and traditional voluntary agency based and public agency practice now exist alongside corporate for profit service delivery and various forms of private practice. Social enterprise and entrepreneurship are a common theme in all this diversity, as social agencies must aggressively seek out …

Unproductive Bodies: A Materialist Critique Of The "Corporeal Turn", Paula Cerni Oct 2007

Unproductive Bodies: A Materialist Critique Of The "Corporeal Turn", Paula Cerni

Reconstruction: Studies in Contemporary Culture

[First paragraph]

Contemporary theory tends to neglect the human body's role in the production of material objects. This neglect is most glaring in constructionist approaches, whose post-structuralist view of the social as discursive practice necessarily downgrades the practical relations between humans and their physical environment. Arthur Frank, for example, formulates a typology - partly derived from Bryan Turner's theory of 'bodily order' - according to which the body acts in four ways: as a disciplined, dominating, mirroring and communicative body (Frank, 1991; Turner, 1984). None of these four modes of action involve the body acting practically on the wider material …

Prora near Sassnitz, is part of a small holiday resort, Ostseebad Binz on the Prora Wiek, one of the bays on the Island of Ruegen, north Germany. Only a few kilometres of sandy beach separate them. The one, practically uninhabited, is a ghost town that is nevertheless visited by 250,000 sightseers each year because of its historical importance; the other is a tourist paradise, swarming with people, mainly in summer.

Multicultural And Colorblind Ideology, Stereotypes, And Ethnocentrism Among Black And White Americans, Carey S. Ryan, Jennifer S, Hunt, Joshua A. Weible, Charles R. Peterson, Juan F. Casas

Psychology Faculty Publications

We examined Blacks’ and Whites’ perceptions of group variability and positivity as well as their beliefs about the extent to which multiculturalism and colorblindness would improve intergroup relations. In two studies, responses to questionnaires indicated that the tendency to endorse multiculturalism more than colorblindness was greater among Blacks than Whites; Blacks consistently endorsed multiculturalism more than colorblindness and Whites endorsed colorblindness more than did Blacks. Both studies also revealed evidence of out-group homogeneity and ethnocentrism. Stronger endorsement of multiculturalism relative to colorblindness predicted stronger stereotypes among Blacks, whereas stronger endorsement of colorblindness relative to multiculturalism predicted stronger stereotypes among Whites. …

Seven Perceptions Influencing Novice Teachers’ Efficacy And Cultural Competence, Nancy P. Gallavan Oct 2007

Seven Perceptions Influencing Novice Teachers’ Efficacy And Cultural Competence, Nancy P. Gallavan

Journal of Praxis in Multicultural Education

Novice teachers believe and behave according to perceptions about teaching, learning, and schooling they formed during childhood and adult experiences with families, classrooms, communities, media, and teacher education programs. Perceptions build funds of knowledge shaping teacher efficacy that influence their development of cultural competence–the processes of acquiring, accepting, and applying requisite knowledge, skills, and dispositions for ensuring educational equity and excellence for all learners. Through their words, actions, and interactions, novice teachers socially reproduce their interpretations of perceptions influencing their cultural competence visible through their generational perpetuation of practice. Survey research with novice teachers reveals the importance of their critical …
