Crimes That Count Twice: A Reexamination Of Rico's Nexus Requirements Under 18 U.S.C. §§ 1962(C) And 1964(C), Randy D. Gordon

The complicated structure of the Racketeering Influenced and Corrupt Organizations Act makes it difficult to determine when “ordinary” crimes spill over into RICO violations. This Article examines and synthesizes various “nexus” requirements that courts have devised to separate non-RICO crimes from full-blown RICO violations. The Article concludes with a discussion of the United States Supreme Court’s recent holding in Anza v. Ideal Steel Supply Corporation, 126 S. Ct. 1991 (2006), which sharply limits certain types of civil RICO claims.

At heart, this introductory essay aspires to encourage scholars who write in widely divergent areas, yet share a focus on the changing nature of jurisdiction, to engage one another more closely. From Jackson's study of "convergence, resistance, and engagement" among courts, Kingsbury's study of "global administrative law," and Bermann's analysis of "transatlantic regulatory cooperation," to Resnik's evaluation of "trans-local networks," Weiser's account of "cooperative federalism" in telecommunications law, and Thompson's concept of "collaborative corporate governance," a related set of questions is ultimately at stake: How ought we understand the reach of any given decision-maker's jurisdiction? Biomedical interventions promise achievement of health-related Millennium Development Goals provided social-, capacity- and knowledge-based constraints to scaling up and reaching marginalized people at risk, are addressed, and balance between prevention and treatment is struck. We argue for a new approach: multi-stakeholder capacity building and learning for empowerment: MuSCLE. MuSCLE is used as a way to frame three systemic weaknesses in traditional health science and policy approaches: (1) a lack of engagement with people at risk to build a collective understanding of the contexts of health problems, including social drivers; (2) a lack of multi-criteria evaluation of alternative interventions; (3) a …

Most of the recent intellectual property literature concerns the enclosure of the public domain or the one-way ratchet of intellectual property protection. While these concerns are significant and rightly placed, a different, and perhaps more important, enclosure movement is currently taking place at the international level. Instead of the public domain, this concurrent movement encloses the policy space of individual countries and requires them to adopt one-size-fits-all legal standards that ignore their local needs, national interests, technological capabilities, institutional capacities, and public health conditions. The paper examines issues relating to establishing breeders rights in developing nations by taking India as an example. At the outset, the paper examines the international obligations relating to protecting plant breeder’s rights by examining the requirements under Article 27.3 of the TRIPS agreement. In doing so, the paper examines analyzes what amounts to an effective sui generis system as required under TRIPS.

Cataracts are a cloudiness of the lens within the eye which obstructs vision. They are found in many species including rats, dogs, and humans. Vision is hindered where this "cloudiness", made of water build up and broken crystalline, proteins take form. Oculvet is an eye medication, used by veterinarians, containing carnosine as its active ingredient. Topical application of carnosine is reported to be an effective treatment for the prevention and removal of pre-existing cataracts. For this experiment, Sprague- Dawley rats were anesthetized and exposed to ultraviolet radiation, UVB and UVC. They were divided into four groups (n = 32), three …

Existing hydrological monitoring systems suffer from short- comings in accuracy, resolution, and scalability. Their fragility, high power consumption, and lack of autonomy necessitate frequent site visits. Cabling requirements and large size limit their scalability and make them prohibitively expensive. The research described in this paper proposes to alleviate these problems by pairing high-resolution in situ measure- ment with remote data collection and software maintenance. A hybrid sensor network composed of wired and wireless connections autonomously measures various attributes of the soil, including moisture, temperature, and resistivity. Acculturation, Gender, And Alcohol Use Among Mexican American College Students, Marcela Raffaelli, Rosalie A. Torres Stone, Maria I. Iturbide, Meredith Mcginley, Gustavo Carlo, Lisa J. Crockett

Prior research with non-college samples of Mexican Americans has demonstrated that gender moderates the association between acculturation and alcohol use. We replicated this finding in a college student sample and attempted to account for the differential impact of acculturation on Mexican American men and women by examining the mediating effects of social context, family conflict and psychological functioning. Participants were 148 Mexican Americans (67% female; M age 23 years) from three state universities in California and Texas who completed self-report surveys. In multivariate analyses controlling for age, maternal education, living situation, and site, linguistic acculturation was associated with increased alcohol …

How can a large scale, multi-state, collaborative workforce development project be evaluated? This article describes the evaluation process of the Midwest Center for Information Technology (MCIT). The project uses “impact threads” to connect the outcomes of the project to strategic evaluation questions. The MCIT project, involving 10 public two-year colleges located in Nebraska, Iowa, South Dakota, and North Dakota, strives to assist partner colleges in enhancing information technology training and related degree programs. Agribusiness

The invention of agriculture that occurred around 10,000 years ago heralded a shift from nomadic hunting and gathering to more managed forms of food, feed and fibre production. The domestication of crops initially involved the saving of seed from one season for planting in subsequent years. Later, farmers purposefully selected crop varieties and so in practice began matching and, by repeated selection over many years, adapting crop genetics to the environment in which the crop was grown. From its inception, enhancing G x E (i.e., gene by environment) interactions was an intrinsic, if not defining, feature of agriculture.

Bollywood cinema is a proverbial machine, cranking out upwards of 800 new films each year. Recently, however, Indian directors have begun looking toward Hollywood for an abundance of storylines to reform for Bollywood consumers. In most cases the original Hollywood plotline is indiscernible amidst the Bollywood panacea of singing and dancing and Indian religious references are often inserted to validate and legitimate characterizations, situations and bring an Indian cultural atmosphere that Bollywood audiences require. Psychology Faculty Research and Publications

Religion and spirituality have been topics of interest to psychologists since the inception of the field, and this special issue devoted to spirituality and psychotherapy reflects the maturation of decades of research. Psychotherapy clients would like to discuss religious or spiritual issues with therapists, but therapists feel poorly prepared to do so. This special issue hopefully represents a step towards bridging the needs of clients and the expertise of providers. The seven articles in this issue reflect the progress psychologists have made toward understanding religion and spirituality, and they represent state‐of‐the‐art attempts at integrating these dimensions into treatment.

Many endangered or threatened ecosystems depend on ground water for their survival. Nebraska’s saline wetlands, home to a number of endangered species, are ecosystems whose development, sustenance, and survival depend on saline ground water discharge at the surface. This study demonstrates that the saline conditions present within the eastern Nebraska saline wetlands result from the upwelling of saline ground water from within the underlying Dakota Aquifer and deeper underlying formations of Pennsylvanian age. Over thousands to tens of thousands of years, saline ground water has migrated over regional scale flowpaths from recharge zones in the west to the present-day discharge …

We Are Not Tijuana: The Valley Protests Washington's Crackdown On Gambling, Robin Robinson

During Prohibition, the US Treasury Department limited the number of hours that international bridges spanning the Rio Grande River were open in an attempt to control such illegal activities as gambling. Brownsville, Texas, typically received an exemption for the bridge between Brownsville and Matamoros, Mexico, by arguing that Matamoros lacked the vice problems that had prompted the border restrictions elsewhere. The article discusses actions taken when, in August 1931, Brownsville was not exempted.

Since soybean (Glycine max [L.] Merr.) is low in saturated fat and active in reducing blood cholesterol, it is gaining interest as a healthy snack food. Direct consumption of vegetable soybeans is very popular in the Orient. However, the cultivars used in Asia are not adapted to U.S. production systems. The objectives of this study were to determine the efficiency of mechanical harvest and to identify vegetable soybean cultivars adapted for a mechanical harvest system.
