Analysis Of Determinants In Neighborhood Satisfaction Between Defended And Defensible Communities Within The General And Urban Housing Environments, David William Chapman

School of Public Service Theses & Dissertations

The purpose of this study is to provide a detailed examination and analysis of neighborhood satisfaction determinants among residents living within defended and defensible gated communities in the United States. The study considers whether there are significant differences in the determinants at national or regional levels and whether there are significant differences within the components of individual household characteristics, neighborhood quality characteristics, or both.

The theoretical framework and model for neighborhood satisfaction used with this study is based on a modified model of Lu's work on neighborhood satisfaction (1999, pp. 78-79) and residential mobility (1996) that were based on Speare's …

Fatigue's Influence On Workload, Situation Awareness, And Performance In A Military Simulation Of Combat, Carlotta M. Boone Jan 2007

Fatigue's Influence On Workload, Situation Awareness, And Performance In A Military Simulation Of Combat, Carlotta M. Boone

Psychology Theses & Dissertations

Military operations routinely require military personnel to consistently perform their duties over several hours or days. Tasks that require prolonged work can lead to mental fatigue and decreased performance. The transactional model proposes that individuals cope with changes in the environment and maintain performance. This ability to cope is determined by factors of the environment and the individual's personality. One environmental factor that can influence coping is extended task performance. This study examined the effect of extended task performance and its interaction with task difficulty. Participants interacted with the military simulation game Command and Conquer: Generals™ for three hours. They …

Generational Differences Among Community College Students In Their Evaluation Of Academic Cheating, Kathleen E. Wotring Jan 2007

Generational Differences Among Community College Students In Their Evaluation Of Academic Cheating, Kathleen E. Wotring

Educational Leadership & Workforce Development Theses & Dissertations

Values development is an important part of the mission of community colleges, and upholding academic integrity is one way in which colleges advance this mission. Community colleges serve a multigenerational student body, more diverse than most four-year institutions of higher education, and different generational cohort groups hold different values and attitudes. The purpose of this study was to determine whether community college students varied by generation in their evaluation of academic activities as cheating, and to further determine whether such variation interacted with demographic variables and the extent to which personal morality is grounded in a religious belief system. Based …

The Social Security Administration's New Disability Adjudication Rules: A Significant And Promising Reform, Frank S. Bloch, Jeffrey S. Lubbers, Paul R. Verkuil

Articles

The article evaluates the Social Security Administration's (SSA) new Disability Service Improvement (DSI) process, introduced in 2006, which aims to address inefficiencies and inconsistencies in disability adjudication. The reforms include key innovations such as Quick Disability Determinations (QDDs), the Medical and Vocational Expert System (MVES), and the replacement of the Appeals Council with the Decision Review Board (DRB). While the reforms represent a significant and promising step toward improving the disability determination process, the article identifies remaining concerns, particularly regarding the role of the Federal Reviewing Official (FRO) and rules for submitting evidence at administrative hearings.

Using Comparative Torts Materials To Teach First-Year Torts, Anthony J. Sebok Jan 2007

Using Comparative Torts Materials To Teach First-Year Torts, Anthony J. Sebok

Articles

The article argues that incorporating comparative torts materials, particularly from European jurisdictions such as Germany and Italy, can effectively enhance the teaching of tort damages in first-year law courses. This approach is not about adopting a comparative curriculum but using these materials to provide deeper insights into American tort law.

The Potential For Ch4-Enriched Biogas As A Transport Fuel In Ireland, Niamh Power Jan 2007

Ireland needs a biofuel industry- to aid compliance with the Kyoto Protocol, the Biofuels Directive and to secure its energ>' supply. The overall aim of this work is to assess the potential of CH4-enriched biogas as a transport fuel in Ireland. Biogas is produced during the anaerobic digestion of biomass. This work investigates biogas production from two different feedstocks; biodegradable municipal waste and agricultural crops. To assess the potential for biogas as a transport fuel the alternatives to biogas are investigated and compared. Thus digestion and composting of biodegradable municipal waste, and biogas and ethanol production from agricultural crops …

Anaerobic Digestion: Decision Support Software, Marco Poliafico Jan 2007

Anaerobic Digestion: Decision Support Software, Marco Poliafico

Theses

Ireland has significant quantities of livestock; meat exportation is a vibrant sector of the economy. Environmental management of animal wastes has therefore become an important concern. On the other hand in the last decade, national and EU policy debate has highlighted the need to investigate alternative energy: in particular energy for transport.

This study investigates the quantities of animal wastes produced in Ireland and their potential treatment using Anaerobic Digestion technologies. In 2005 Ireland had over 8 millions animals (cattle and pigs) and the annual slaughter accounted for over 4.2 million of these creatures. These animals have been responsible for …

Development Of An Immunoturbidimetric Particle Enhanced Assay For Detection Of C-Reactive Protein, Maria Nicholas Jan 2007

Development Of An Immunoturbidimetric Particle Enhanced Assay For Detection Of C-Reactive Protein, Maria Nicholas

Theses

Background: C-reactive protein (CRP) is a well-known marker for inflammation. Recent studies have demonstrated that increases in CRP concentrations are associated with future coronary events in apparently healthy men and women. The requirement for assays, capable of testing CRP concentrations within the range 1-lOmg/l, is therefore great.

Methods: Two CRP assays were developed. The Sensitive assay is capable of measuring CRP concentrations as low as lmg/l for use as a potential cardiac marker test. The Normal assay can measure concentrations from 5-400mg/l for establishing levels of inflammation. Both assays developed are latex particle enhanced immunoturbidimetric assays designed for use on …

Evaluation Of Four Novel Broad-Host-Range Antimicrobial Agents., Jiahui Guo Jan 2007

Evaluation Of Four Novel Broad-Host-Range Antimicrobial Agents., Jiahui Guo

Theses

The overall objective of this thesis was to evaluate the antimicrobial effects of four novel broad-host-range antimicrobial agents. The first was a milk-derived lipoprotein developed by Westgate Biologicals with the support of Enterprise Ireland. This lipoprotein which was designated LactiSAL, was evaluated against a wide range of bacterial species associated with humans. Essentially, the LactiSAL was incorporated at a variety of concentrations into agar media, which were appropriate for cultivation of the different genera. Agars were examined for colony formation, after which it was possible to quantify the minimal inhibitory concentration for each genus. Subsequently, LactiSAL was incorporated at levels …

The Religion Clauses And The “Really New” Federalism, Martin H. Belsky Jan 2007

The Religion Clauses And The “Really New” Federalism, Martin H. Belsky

Akron Law Faculty Publications

It had been a principle of contemporary constitutional law that once a provision of the Bill of Rights was “fully” incorporated, such as with the First Amendment, it established a constitutional minimum. A state could provide, either by constitutional or statutory provision, additional protections to its citizens, so long as this did not create a conflict with other federal law. Another principle, until recently, was that the federal government had the ability by legislation to provide additional or enhanced rights to Americans, and that these rights applied uniformly to residents of all states.

The application of these two principles?at least …

Online courses have many components and dimensions. Both the form (structure) and the content (expression) are situated in an overall environment. The sum of these elements results in student outcomes and learning. In order to facilitate construction and evaluate the quality of an online course, a four-part rubric was designed to reflect:

Structure (Context, Organization, and Environment)

Content (Presentation of Information)

Processes (Relationships and Interactions)

Outcomes (Mastery of Content and Course Evaluation)

This rubric was designed to provide quantitative and qualitative standardized evaluation for faculty self-evaluation, peer evaluation, and administrator evaluation. The rubric was piloted at two universities and shown …

School Choice And States' Duty To Support Public Schools , Aaron J. Saiger Jan 2007

School Choice And States' Duty To Support Public Schools , Aaron J. Saiger

Faculty Scholarship

The education clauses of state constitutions require states to support schools that not only educate children adequately and equitably, but that are "public" or "common." This Article argues that state-supported school choice can be consistent with these latter requirements. Individual choices, about where to live and whether to educate children privately, have long shaped traditional "public" schooling arrangements. The more direct role choice plays in school voucher and charter programs is also consistent with the requirement that schools be "public." Such programs must ensure, however, that parents' choices among schools are "genuine and independent." This criterion, developed by the U.S. …

Resisting The Corporatization Of Nonprofit Governance: Transforming Obedience Into Fidelity Symposium: Nonprofit Law, Economic Challenges, And The Future Of Charities: Panel Iv: The Increasing Resemblance Of Nonprofit And Business Organizations Law, Linda Sugin Jan 2007

Resisting The Corporatization Of Nonprofit Governance: Transforming Obedience Into Fidelity Symposium: Nonprofit Law, Economic Challenges, And The Future Of Charities: Panel Iv: The Increasing Resemblance Of Nonprofit And Business Organizations Law, Linda Sugin

Faculty Scholarship

It is my privilege, as organizer of this conference, to reflect on the excellent papers published in this issue and the wonderful discussions that they inspired. The presentations left me with the impression that the law of nonprofit governance is moving toward a more corporate model of accountability-a model that emphasizes audits and other formal financial controls, and that focuses enforcement on financial wrongdoing and misuse of charitable funds by directors and managers. Along with these developments, it appears that the legal role of donors in nonprofit governance is growing, increasing donors' ability to impose their vision on the organizations …

Implied World Views In Pictures: Reflections From A Cognitive Psychological And Anthropological Point Of View, Michael Ranta Jan 2007

Implied World Views In Pictures: Reflections From A Cognitive Psychological And Anthropological Point Of View, Michael Ranta

Contemporary Aesthetics (Journal Archive)

In traditional art history, iconological attempts to analyze visual works of art by treating their formal and semantic features as symptoms of more general, implied world views or cultures have occurred rather frequently. Still, such attempts have been criticized for permitting subjective and non-verifiable interpretations. In this paper, however, I will argue that (i) pictorial works of art indeed imply wider world views or schemata, and (ii) that our comprehension of these schemata can be explained by taking into account recent research within cognitive psychology. More specifically, I will argue that intelligence partly consists of the storage and retrieval of …

American Moral Rights And Fixing The Dastar Gap, Justin Hughes Jan 2007

American Moral Rights And Fixing The Dastar Gap, Justin Hughes

Articles

When the United States acceded to the Berne Convention in 1988, Congress concluded that a compendium of causes of action under American law, including Lanham Act claims, provided the moral rights protections mandated by Berne Article 6bis. This claim of patchwork protection of moral rights has always been widely criticized, but became more dubious in the wake of the Supreme Court's 2003 decision in Dastar v. Twentieth Century Fox. In Dastar, the Court held that vis-a-vis works in the public domain there is no Lanham section 43(a) obligation to credit the original creator or copyright owner as the origin of …

Regional Human Rights Courts And Internal Armed Conflicts, Michele D'Avolio Jan 2007

Regional Human Rights Courts And Internal Armed Conflicts, Michele D'Avolio

Intercultural Human Rights Law Review

This article explores the role of regional human rights courts in internal armed conflicts and asks the question: How have regional human rights courts contributed to the development of and interplay between, international humanitarian and international human rights law in internal armed conflicts? In order to address this question, I have first set forth a brief discussion of the laws of war ("LOW") as they pertain to internal armed conflict. This discussion will establish the framework for a discussion of the interplay between International Humanitarian Law ("IHL") and International Human Rights ("IHR") and, more specifically, why issues of convergence arise …

Reemployment And Earnings Recovery Among Older Unemployment Insurance Claimants, Christopher J. O'Leary, Randall W. Eberts Jan 2007

Reemployment And Earnings Recovery Among Older Unemployment Insurance Claimants, Christopher J. O'Leary, Randall W. Eberts

Upjohn Institute Working Papers

The rate of involuntary job loss among older workers has increased in recent years. Previous research has found that after job separation older workers take longer to get back in jobs, and experience bigger earnings declines than younger prime age workers. These studies were based on surveys targeted at older and dislocated workers, which rely on retrospective interviews of strategic samples from the general labor force. Previous studies have not explicitly accounted for the availability of unemployment insurance (UI) benefits between jobs. This paper compares the adjustment to involuntary unemployment of older and younger prime age UI claimants, using a …
