Using Human Rights Treaties To Resolve Ambiguity: The Advent Of A Rights-Conscious Charming Betsy Canon, Melissa A. Waters Jan 2007

Using Human Rights Treaties To Resolve Ambiguity: The Advent Of A Rights-Conscious Charming Betsy Canon, Melissa A. Waters

Scholarship@WashULaw

This article considers the role of international human rights law in the domestic context, and examines in particular the use of what the author calls a "rights-conscious Charming Betsy canon", whereby judges in New Zealand, Canada, the United States and Australia have interpreted statutory provisions (focusing on the case study of immigration law) so as to be consistent with international human rights norms. The author also considers the more radical use of the canon, proposed in particular by the High Court of Australia's Justice Kirby, which proposes that even constitutional texts may be interpreted to be consistent with international law, …

Normativity In The "New" Schools: Assessing The Legitimacy Of International Legal Norms Created By Domestic Courts, Melissa A. Waters Jan 2007

Normativity In The "New" Schools: Assessing The Legitimacy Of International Legal Norms Created By Domestic Courts, Melissa A. Waters

Scholarship@WashULaw

One of the great legacies of the New Haven School was its early recognition of the tremendous dynamism and complexity of the international lawmaking process. Its proponents wisely rejected both Austinian positivism and the traditional conception of "law" as a dichotomy of "national" and "international" legal rules. Instead, the policy-oriented jurisprudence of the New Haven School recognized and embraced the interactivity of a multiplicity of decisionmakers in shaping the international legal regime. Moreover, in defining law as an iterative process of authoritative decisionmaking, the New Haven School recognized that authoritative decisions need not necessarily come from official bodies such as …

Treaty Dialogue In Sanchez-Llamas: Is Chief Justice Roberts A Transnationalist, After All?, Melissa A. Waters Jan 2007

Treaty Dialogue In Sanchez-Llamas: Is Chief Justice Roberts A Transnationalist, After All?, Melissa A. Waters

Scholarship@WashULaw

Chief Justice John Roberts is generally considered to be a “nationalist” with respect to transnational judicial dialogue: for example, he has expressed skepticism as to the value of foreign authority in constitutional interpretation. In his majority opinion in Sanchez-Llamas v. Oregon, however, Roberts eagerly engages in treaty dialogue, by considering foreign and international sources in interpreting U.S. treaty obligations. This Essay examines Roberts’ use of both “direct” and “indirect” treaty dialogue in interpreting the Vienna Convention on Consular Relations. By engaging in dialogue with both treaty partners and the International Court of Justice, Roberts allows foreign precedent and practice to …

Social Impact: Perspectives With Luis H. Zayas: A Closer Look At Immigration, Betsy Rogers Jan 2007

Social Impact: Perspectives With Luis H. Zayas: A Closer Look At Immigration, Betsy Rogers

Social Impact Publication

Immigration reform took center stage last spring as hundreds of thousands of immigrants from Latin America and elsewhere filled American streets to protest proposed legislation widely seen as harsh and punitive. The immigrants' numbers and fervor took many by surprise, but Luis Zayas, the Shanti K. Khinduka Distinguished Professor of Social Work and professor of psychiatry at the School of Medicine, finds nothing historically unusual in today's migrations.

Turning Away, Jacob D. Rawlins Jan 2007

Turning Away, Jacob D. Rawlins

Faculty Publications

From the time of Joseph Smith’s first vision, the concepts of general apostasy and divine restoration have been central to the Latter-day Saint movement. In the Prophet’s account of his vision, he records that after he asked which church he should join, “I was answered that I must join none of them, for they were all wrong; and the Personage who addressed me said that all their creeds were an abomination in his sight; that those professors were all corrupt; that: ‘they draw near to me with their lips, but their hearts are far from me, they teach for doctrines …

An Examination Of Social Justice And U.S Politics Among Mexican Americans: The Role Of Education In Political Participation, Mark S. Teachout Ph.D, Andrea E. Berndt Ph.D., Andrew C. Hernandez Jan 2007

An Examination Of Social Justice And U.S Politics Among Mexican Americans: The Role Of Education In Political Participation, Mark S. Teachout Ph.D, Andrea E. Berndt Ph.D., Andrew C. Hernandez

Verbum Incarnatum: An Academic Journal of Social Justice

The purpose of this study was to examine the perceptions and behaviors of Mexican Americans toward social justice issues in a political context, as a function of educational attainment. Based on the premise set forth by Boakari (2006), we expected those with a higher level of educational attainment would reflect both perceptions and behaviors that represent a more socially aware and participative citizen within a political context. Results were significant for all analyses, indicating that participants with a higher level of educational attainment had perceptions and self-reported behaviors more congruent with social justice issues in a political context, compared to …

Religion And The Electability Of Presidential Candidates, Dr. Philip E. Lampe Ph.D. Jan 2007

Religion And The Electability Of Presidential Candidates, Dr. Philip E. Lampe Ph.D.

Verbum Incarnatum: An Academic Journal of Social Justice

Denominationalism appears to be an important factor in American politics, particularly in presidential elections. Evidence indicates there are, and has always been, favored and disfavored denominations. One such disfavored denomination is Catholicism. Although it is the largest denomination in the United States, there has been only one Catholic president. Until the 2004 election, whenever a Catholic was in the presidential race, anti-Catholic rhetoric was commonly employed against him. Fears of papal control and sinister machinations were expressed. The result was religious discrimination which, like all forms of discrimination, eliminates or greatly reduces the right of participation. This is a violation …

Factors Associated With Employment Among Latinos Living With Hiv/Aids, Shaun Michael Burns, Lydia R. L. Young, Suzanne Maniss Jan 2007

Factors Associated With Employment Among Latinos Living With Hiv/Aids, Shaun Michael Burns, Lydia R. L. Young, Suzanne Maniss

Counseling Faculty Publications

This investigation explored the utility of various demographic, health-related, and psychological variables in predicting employment among Latinos living with HIV/AIDS. Results of an analysis of variance indicated that employed participants were younger, evinced significantly greater CD4 counts, physical and mental health functioning, and internal locus of control beliefs than those who were unable to work due to disabilities. A backward binary logistic regression demonstrated that age, CD4 count, internal locus of control, and mental health functioning contributed to the explanatory power of the final model. This model correctly classified group membership 72% of the time, 78% of participants who were …

Roger Scruton: The West And The Rest Study Guide, Steven Alan Samson Jan 2007

Roger Scruton: The West And The Rest Study Guide, Steven Alan Samson

Faculty Publications and Presentations

In The West and the Rest, Scruton examines the clash between two civilizations: Islam and the West. He contrasts the dynamic, highly institutionalized, but increasingly decadent secular legal tradition of the West, which promotes such ideas as citizenship, corporate personality, and territorial jurisdiction, with the backward-looking but unified vision of a universal community associated with the Koran. One thing that troubles the relationship of these two civilizations today is a crisis of confidence in the West, which has produced a nihilistic, self-condemning “culture of repudiation.” This countercultural solvent has been infiltrating the flood of cultural byproducts of the West that …

In Slow Motions : The Democratic Process In Critical-Liberatory Pedagogy, Michaelia Morgan Jan 2007

In Slow Motions : The Democratic Process In Critical-Liberatory Pedagogy, Michaelia Morgan

Capstone Projects and Master's Theses

Prior to conducting a required graduate-level proseminar utilizing democratic methods, the instructors perceived that they possessed a quantity of ideas as to how to proceed; during the course of teaching the class, they recognized that they also maintained some arresting lacunae. Thus, I have attempted to convey what Dr. Whang and I encountered, discerned and learned as we left authoritarian measures at the door and unflinchingly attempted to bring democracy into our classroom. It is my hope that educators will endeavor to produce more democracy by placing democratic principles at the helm of their deliberations. It is conceivable that everyone …

I Want To Speak English Like You : One Woman's Experience Teaching English To Adults In Senegal, Jenny F. Webster Jan 2007

I Want To Speak English Like You : One Woman's Experience Teaching English To Adults In Senegal, Jenny F. Webster

Capstone Projects and Master's Theses

I went to Senegal, West Africa, in December 2004 because I wanted to teach English there. This was my second trip to Senegal. On my first trip one year earlier I went to practice African dance, and at that time several people asked me to teach them English. In response to their requests and my own sense of adventure, I created an English as a Foreign Language curriculum specifically designed for semi-literate Senegalese adults working in the tourist business. I spent one month in the village of Abene teaching adults and children, but specifically for this study I conducted interviews …

The Cost And Effectiveness Of Small-Scale Control Methods On Fennel, Foeniculum Vulgare, In Natividad Creek Park, Salinas, Ca, Abigail Gwinn Jan 2007

The Cost And Effectiveness Of Small-Scale Control Methods On Fennel, Foeniculum Vulgare, In Natividad Creek Park, Salinas, Ca, Abigail Gwinn

Capstone Projects and Master's Theses

Invasive species in the United States cost the federal and state governments billions of dollars per year and are spreading through wildlife habitat at a rate of about 700,000 acres per year. Information on effective methods of controlling various invasive species is crucial to land managers and others who seek to remove invasive, exotic species and restore their lands to a more natural state. This study examines which of three methods will work most effectively at controlling fennel (Foeniculum vulgare) in a small-scale infestation in two sites in Salinas, while costing the least. The methods are: digging out individual plants …
