Workers' Compensation, H. Michael Bagley, Daniel C. Kniffen, Katherine D. Dixon
Workers' Compensation, H. Michael Bagley, Daniel C. Kniffen, Katherine D. Dixon
Mercer Law Review
The year 2007 was relatively quiet for workers' compensation legislation in the Georgia General Assembly. However, there were several statutory modifications of note.
The Georgia Workers' Compensation Act has long excluded "farm laborers" from its coverage. The scope of that exclusion was clarified by including within the term farm laborer "any person employed by an employer in connection with the raising and feeding of and caring for wildlife, as such term is defined in paragraph (77) of [Official Code of Georgia Annotated ("O.C.G.A.")] Section 27-1-2." The Code section referenced defines wildlife as "any vertebrate or invertebrate animal life indigenous to …
Real Property, Linda S. Finley
Real Property, Linda S. Finley
Mercer Law Review
Each year, as the number of cases involving real property reported by Georgia's appellate courts continues to increase, it becomes more and more difficult to determine which cases to include in this survey Article. Nevertheless, this Article discusses case law and legislative developments in Georgia real property law from June 1, 2006 through May 31, 2007, selected either for their significance to real property law, to update attorneys who either regularly or from time to time practice or render opinions regarding real property, or to survey trends. However, as the reader may see, at times the cases surveyed were selected …

To understand the relevance and importance of internal branding, five respected and admired North American organizations were paralleled to see where the …
Using Creativity Tools To Improve The Product Development Process, Rachel Wiatrowski
Using Creativity Tools To Improve The Product Development Process, Rachel Wiatrowski
Creativity and Change Leadership Graduate Student Master's Projects
Throughout the product development process, problems arise that challenge the success and inventiveness of a product. Creativity tools and techniques enable the multi-disciplinary teams that develop these products to react to problems and thereby, develop superior products. However, when each member of a product development team does not have the same foundation of creativity training, it can be difficult to use these tools effectively. The purpose of this project is to assist product development in using creativity tools and techniques both in and outside of creative problem solving group sessions, and to improve the quality and originality of products overall. …

Fueling The Passion: Creating A Department Vision, Understanding And Improving A Workplace Creative Climate., Penelope J. Standen
Creativity and Change Leadership Graduate Student Master's Projects
This project was about leading the process of developing a department vision, understanding the current climate within a department and facilitating creative problem solving to work on action plans to improve that climate. The project commenced with the development of a department vision for the marketing team within my organization. This was completed with the help of a core vision team, who volunteered to be part of this process. The second major component of this project was about understanding the current creative climate within my department. It involved reviewing KEYs survey (Amabile, Conti, Coon, Lazenby & Herron, 1996), results, as …

Dicliny In Bouteloua (Poaceae: Chloridoideae): Implications For The Evolution Of Dioecy, Michael S. Kinney, J. Travis Columbus, Elizabeth A. Friar
Aliso: A Journal of Systematic and Floristic Botany
The New World grass genus Bouteloua (Chloridoideae: Cynodonteae) comprises 57 species, 13 of which produce unisexual spikelets and hence are diclinous. Andromonoecy, gynodioecy, monoecy, trimonoecy, and dioecy all occur in the genus, and ten species are known to express more than one of these breeding systems. Employing a phylogenetic estimate based on parsimony analysis of DNA sequences from the ITS (nrDNA) and trnL–F (cpDNA) regions representing 35 species of Bouteloua, including ten of 13 diclinous species, we used parsimony character state reconstructions to investigate the evolution of unisexual spikelets and breeding systems. Our specific goals were to estimate …

Emergency Federalism: Calling On The States In Perilous Times, Adam M. Giuliano
Emergency Federalism: Calling On The States In Perilous Times, Adam M. Giuliano
University of Michigan Journal of Law Reform
The attacks of September 11 prompted a historic debate concerning terrorism and domestic emergency response. This ongoing dialogue has driven policy decisions touching upon both liberty and security concerns. Yet despite the enormous effort that has gone into the national response, the role of the sovereign states, and with it federalism, has received comparatively little attention. This Article explores the relevance of federalism within the context of the "War on Terror" and in the aftermath of Hurricane Katrina. Acknowledging that theories of federalism developed elsewhere are insufficient, he outlines a doctrine of 'emergency federalism.' The author argues that the Framers …

Against Expediency: The Ethics Of Education, Gerard Mannion
Journal of Catholic Education
This article suggests that church-linked universities and colleges can and should show that there is an alternative to the expediency and pseudo-utilitarian thinking which currently dominates higher education. Such institutions can and should serve as beacons of a virtuous approach to education which can show others a more positive way forward. Theology and ethics”both disciplines mutually informing the other”hold the key to fostering and promoting a true culture of ministry both in the day-to-day existence of universities and colleges and in nurturing young minds to take that culture of ministry out into the wider community.

Integrating Strategic Quality Management In The Context Of Corporate Strategy – Initial Lessons: A Case Study Of Universiti Brunei Darussalam, Fairul Rizal Haji Rashid
Research Publications (2006 to 2010)
Managing quality is basically the same with other aspects of management; it requires strategies formulation, goal settings, development of action plans, implementation plans and provision of control and feedback mechanism for corrective actions to be taken. It is thus imperative not to see quality management as solely a controlling device; rather it must be seen as a management function that must be institutionalized in different levels of organizations. In fact, many excellent organizations have demonstrated that quality has an important strategic value in today’s competitive world. Furthermore, in today’s complex and changing environments, organizations are also forced to formulate strategy …

Extremism And Social Learning, Cass R. Sunstein, Edward L. Glaeser
Extremism And Social Learning, Cass R. Sunstein, Edward L. Glaeser
Coase-Sandor Institute for Law & Economics Research Paper Series
When members of deliberating groups speak with one another, their predeliberation tendencies often become exacerbated as their views become more extreme. The resulting phenomenon—group polarization—has been observed in many settings, and it bears on the actions of juries, administrative tribunals, corporate boards, and other institutions. Polarization can result from rational Bayesian updating by group members, but in many contexts, this rational interpretation of polarization seems implausible. We argue that people are better seen as Credulous Bayesians, who insufficiently adjust for idiosyncratic features of particular environments and put excessive weight on the statements of others where there are 1) common sources …

Self, Other, And Jump Rope Community: The Triumphs Of African American Women, Wynnetta Ann Scott-Simmons
College of Graduate Studies: Theses & Dissertations
Using Critical Race Theory, Critical Literacy, Black Feminist Thought as a theoretical framework and Oral History as research methodology, the lives of four young African American women are explored as they leave their culturally insular surroundings, Jump Rope Communities, to seek access to the codes of power and registers of language in all-White, all-girl, elite private schools during the late 1960s and early 1970s. In capturing the memories, perceptions, and lived experiences of these women over thirty years later, the journey into a world of divergences was explored--divergent language codes, divergent social, cultural, and economic stratifications, and divergent linguistic expectations, …

Rideability Issues For Asphalt And Concrete Specification Modifications, Brad Rister, Clark Graves
Kentucky Transportation Center Research Report
Concerns have been raised regarding the differences between the incentive/disincentive determination procedures as well as the pay adjustments for rideability between asphalt and concrete projects. This report will attempt to do the following:
- Address the differences between concrete and asphalt rideability specifications by looking at Kentucky’s historical rideability specifications and the specifications of peer states.
- Review the necessity to revise current specifications based on historical rideability data, peer states rideability specifications, technological advancements in placement of roadway materials, and technological advancements in measuring rideability after construction.
- Evaluate the monetary impact of a revised rideability specification on the latest year’s data. …
