Outsiders Looking In: The American Legal Discourse Of Exclusion, Luis E. Chiesa Oct 2007

Outsiders Looking In: The American Legal Discourse Of Exclusion, Luis E. Chiesa

Elisabeth Haub School of Law Faculty Publications

In the first part of the article it is pointed out that during the last two hundred years our government has frequently enacted measures that unfairly burden certain social groups during times of crisis. The historical analysis set forth in Part II of this article reveals that adoption of such measures is usually justified by an appeal to national security. Thus, we have been told that we need to exclude some groups from the full protection of our laws in order to guarantee the safety of the rest of the populace. The rest of the article is dedicated to explaining …

Can You Have Your Cake And Eat It Too? Achieving Capital Gain Treatment While Keeping The Property, Ronald H. Jensen Oct 2007

Can You Have Your Cake And Eat It Too? Achieving Capital Gain Treatment While Keeping The Property, Ronald H. Jensen

Elisabeth Haub School of Law Faculty Publications

I will attempt to show in this article that the cases and rulings dispensing with the need for a sale or exchange are unjustified under the statutory scheme and prevailing capital gain jurisprudence, and further that such holdings constitute bad policy. Part II will set forth a number of examples, based largely on decided cases, where it has been held or contended that recoveries in excess of basis qualify for capital gain treatment even though the taxpayer did not sell or exchange the property. These cases will illustrate the contexts in which this issue arises and will provide a basis …

A Hidden Spatial-Temporal Markov Random Field Model For Network-Based Analysis Of Time Course Gene Expression Data, Zhi Wei, Hongzhe Li Oct 2007

A Hidden Spatial-Temporal Markov Random Field Model For Network-Based Analysis Of Time Course Gene Expression Data, Zhi Wei, Hongzhe Li

UPenn Biostatistics Working Papers

Microarray time course (MTC) gene expression data are commonly collected to study the dynamic nature of biological processes. One important problem is to identify genes that show different expression profiles over time and pathways that are perturbed during a given biological process. While methods are available to identify the genes with differential expression levels over time, there is a lack of methods that can incorporate the pathway information in identifying the pathways being modified/activated during a biological process. In this paper, we develop a hidden spatial-temporal Markov random field (hstMRF)-based method for identifying genes and subnetworks that are related to …

Clinical Skills Day: Preparing Third Year Medical Students For The Rural Rotation, Gwen Wagstrom Halaas, Therese M. Zink, Kathleen D. Brooks, J. Miller

Family Medicine Faculty Publications

Introduction: In order to prepare third year medical students in the Rural Physician Associate Program for a nine-month community-based continuity care experience in rural Minnesota, USA, a clinical skills day that featured human patient simulators and standardized patients was developed. Patients presenting with common urgent and routine primary-care problems were developed and presented using the objective structured clinical examination for teaching. The goals of the day were to: (1) distinguish urgent from non-urgent clinical presentation; (2) use clinical guidelines for making decisions; (3) communicate effectively in stressful situations; and (4) uncover a significant clinical issue with a different presenting complaint. …

Age Determination From Biological Stains Using Messenger Rns Profiling Analysis, John Ballantyne Oct 2007

Age Determination From Biological Stains Using Messenger Rns Profiling Analysis, John Ballantyne

UCF Patents

In the present work, we report the development of two reverse transcription-quantitative polymerase chain reacton (RT-qPCR) assays for the definitve identification of newborn individuals. The methodology is based upon gene expresiion profiling analysis in which specific age groups are identified by detecting the relative quantity of expression of appropriate mRNA species. RNA is isolated from dried bloodstains is analyzed using the two duplex real-time PCR reactions for two variant novel forms of newborn specific gamma hemoglobin.

Auroral Ion Outflow: Low Altitude Energization, Kristina A. Lynch, J. L. Semeter, M. Zettergren, P. Kintner, R. Arnoldy, E. Klatt, J. Labelle, R. G. Michell Oct 2007

Auroral Ion Outflow: Low Altitude Energization, Kristina A. Lynch, J. L. Semeter, M. Zettergren, P. Kintner, R. Arnoldy, E. Klatt, J. Labelle, R. G. Michell

Dartmouth Scholarship

The SIERRA nightside auroral sounding rocket made observations of the origins of ion upflow, at topside F-region altitudes (below 700 km), comparatively large topside plasma densities (above 20 000/cc), and low energies (10 eV). Upflowing ions with bulk velocities up to 2 km/s are seen in conjunction with the poleward edge of a nightside substorm arc. The upflow is limited within the poleward edge to a region (a) of northward convection, (b) where Alfvenic ´ and Pedersen conductivities are well-matched, leading to good ionospheric transmission of Alfvenic power, and (c) of ´ soft electron precipitation (below 100 eV). Models of …
