C-Loops: Extensions And Constructions, J.D. Phillips Jan 2007

C-Loops: Extensions And Constructions, J.D. Phillips

Journal Articles

C-loops are loops satisfying the identity x(y · yz) = (xy · y)z. We develop the theory of extensions of C-loops, and characterize all nuclear extensions provided the nucleus is an abelian group. C-loops with central squares have very transparent extensions; they can be built from small blocks arising from the underlying Steiner triple system. Using these extensions, we decide for which abelian groups K and Steiner loops Q there is a nonflexible C-loop C with center K such that C/K is isomorphic to Q. We discuss possible orders of associators in C-loops. Finally, we show that the loops of …

Habitat Use By Juvenile Gag, Mycteroperca Microlepis (Pisces: Serranidae), In Subtropical Charlotte Harbor, Florida (Usa), J. Patrick Casey, Gregg R. Poulakis, Philip W. Stevens

Gulf and Caribbean Research

Estuaries play a key role in the juvenile stage of gag (Myeteroperca microlepis). The use of estuarine habitats by juvenlle gag has been examined in temperate estuaries, which are at the northern limits of the range of this species, but the importance of subtropical estuaries during the early life history of this species has not been studied extensively. Gag were collected in subtropical Charlotte Harbor, Florida, during routine monthiy sampling from January 1996 to Decemher 2002. Juvenlle gag were collected using a 21.3-m seine, a 183-m haul seine, and a 183-m purse seine. A total of 738 individuals …

Genetic Analysis Of Blue Marlin (Makaira Nigricans) Stock Structure In The Atlantic Ocean, Jan R. Mcdowell, Jeanette E.L. Carlsson, John E. Graves Jan 2007

Genetic Analysis Of Blue Marlin (Makaira Nigricans) Stock Structure In The Atlantic Ocean, Jan R. Mcdowell, Jeanette E.L. Carlsson, John E. Graves

Gulf and Caribbean Research

The genetic basis of stock structure of blue marlin (Makaira nigricans Lacepède 1802) in the Atlantic ocean was inferred from analyses of mitochondrial control region sequences. Blue marlin were collected in 1998 from 4 major geographic locations: western North Atlantic, Caribbean Sea, western South Atlantic and eastern Atlantic. Haplotype diversity (h) ranged from 0.99-1.0 and nucleotide sequence diversity (π) ranged from 0.11-0.13 within samples indicating that the control region harbors a significant amount of genetic variation. However, no significant differences were found in the spatial partitioning of genetic variation among the 4 collections; all pairwise ϕST …

A Review Of Bankruptcy Prediction Studies: 1930-Present, Jodi L. Gissel, Don E. Giacomino, Michael D. Akers

Accounting Faculty Research and Publications

One of the most well-known bankruptcy prediction models was developed by Altman [1968] using multivariate discriminant analysis. Since Altman's model, a multitude of bankruptcy prediction models have flooded the literature. The primary goal of this paper is to summarize and analyze existing research on bankruptcy prediction studies in order to facilitate more productive future research in this area. This paper traces the literature on bankruptcy prediction from the 1930's, when studies focused on the use of simple ratio analysis to predict future bankruptcy, to present. The authors discuss how bankruptcy prediction studies have evolved, highlighting the different methods, number and …

The Braggart Soldier: An Archetypal Character Found In "Sunday In The Park With George", Paul Gebb Jan 2007

The Braggart Soldier: An Archetypal Character Found In "Sunday In The Park With George", Paul Gebb

Electronic Theses and Dissertations

In preparation for performance, an actor must develop an understanding for the character they portray. A character must be thoroughly researched to adequately enrich the performance of the actor. In preparation for the role of the "Soldier" in the production, Sunday in the Park with George, it is important to examine the evolution of the "Braggart Soldier" archetypal character throughout the historical literary canon. It is also of equal importance to study an author's canon of literature to acknowledge the reoccurring use of similar archetypal characters in order to successfully interpret the intentions of the author. This thesis paper will …

Reflections: A Theatrical Journey Into The Lives Of Adolescent Girls, Leah Page Jan 2007

Reflections: A Theatrical Journey Into The Lives Of Adolescent Girls, Leah Page

Electronic Theses and Dissertations

Adolescence is a difficult time for young women. Their bodies are changing and they are being asked to conform to a new set of feminine standards if they are to be accepted (Pipher 39). Studies have found that girls experience a decrease in self-esteem during this time. They are less likely to speak their minds openly and honestly, which can lead to depression and a feeling of falseness. As young women attempt to comprehend this turbulent time in their lives, they often find strength through positive relationships with others as well as from their own knowledge and self-awareness. Reflections is …

Food For Joyous Laughter: Contemporary Productions Of Gilbert & Sullivan's The Pirates Of Penzance, Julia Winstead Jan 2007

Food For Joyous Laughter: Contemporary Productions Of Gilbert & Sullivan's The Pirates Of Penzance, Julia Winstead

Electronic Theses and Dissertations

The operetta, The Pirates of Penzance, is a classic work by Gilbert and Sullivan, a work that continues to be produced frequently despite its Victorian setting and operatic style. For many years the standard performance style of all the operettas by Gilbert and Sullivan was upheld by the D'Oyly Carte Opera Company, who attempted to perform the operettas as they had originally been done. Though the D'Oyly Carte Opera Company helped stimulate interest in the works of Gilbert and Sullivan, nontraditional productions of G & S operettas produced outside of the company were able to reach larger audiences. When The …

Tree Calls Of Three Treefrogs (Hyla Femoralis, H. Gratiosa, And H. Squirella): Analysis Of Environmental, Behavioral, And Acoustic Characteristics, Kristine Schad Jan 2007

Tree Calls Of Three Treefrogs (Hyla Femoralis, H. Gratiosa, And H. Squirella): Analysis Of Environmental, Behavioral, And Acoustic Characteristics, Kristine Schad

Electronic Theses and Dissertations

Male frogs typically call near water at dusk to attract females for breeding. During the breeding season, male treefrogs also emit diurnal "tree calls" or "rain calls" from the tops of trees. Very little is known about tree calls, although many treefrogs use them. Tree calls may be used to attract females, deter males or be triggered by weather conditions favorable for breeding: high temperature and relative humidity, and a drop in barometric pressure. As dusk approaches, male treefrogs continue tree calls from lower in the trees, and if conditions are favorable, jump to the ground and travel to a …

Dynamics Of Cicrobial Communities Associated With Typha Angustifolia (Cattail) Litter In A Wetland Ecosystem: Effects Of Litter Manipulations On Microbial Decay Processes, Andrew John Foley Jan 2007

Dynamics Of Cicrobial Communities Associated With Typha Angustifolia (Cattail) Litter In A Wetland Ecosystem: Effects Of Litter Manipulations On Microbial Decay Processes, Andrew John Foley

Master's Theses and Doctoral Dissertations

Quantification of microbial processes involved in plant decomposition is important in understanding energy flow and nutrient recycling in wetlands. Prior studies examining emergent plant decomposition have often used litter that had been prematurely harvested (senescent) and/or manipulated (oven-dried). I examined the effects of litter manipulations on microbial decay dynamics associated with litter of the emergent macrophyte Typha angustifolia. Plant litter was harvested after senescence and after a period of standing-dead decay. This collected litter was either air-dried or oven-dried, placed into fine mesh (1 mm) litterbags, and submerged in the wetland. Litterbags were retrieved periodically and analyzed for microbial biomass, …

Two Essays On Institutional Investors, Hoang Nguyen Jan 2007

Two Essays On Institutional Investors, Hoang Nguyen

Electronic Theses and Dissertations

This dissertation consists of two essays investigating the trading by institutions and its impact on the stock market. In the first essay, I investigate why changes in institutional breadth predict return. I first show that changes in breadth are positively associated with abnormal returns over the following four quarters. I then demonstrate that this return predictability can be attributed to the information about the firms' future operating performance. When I examine different types of institutions independently, I find that the predictive power varies across the population of institutions. More specifically, institutions that follow active management style are better able to …

A Reason For Musicians To Fret: Copyright Infringement In Online Guitar Tablature, Laura E. Gary Jan 2007

A Reason For Musicians To Fret: Copyright Infringement In Online Guitar Tablature, Laura E. Gary

Vanderbilt Journal of Entertainment & Technology Law

Part I of this note will specifically address guitar tablature and how it differs from more traditional methods of copying musical works. Part I will also discuss derivative works and fair use in detail, setting out the statutory provisions and the relevant case law establishing and analyzing both these claims. Part II addresses the lack of legal precedent for copyright infringement in guitar tabs and devises a possible solution to the question of whether or not guitar tabs infringe copyrighted musical works. Specifically, this note concludes that the appropriate answer to that question is that guitar tabs are infringing derivative …

This note advances the case for an international organization to control Internet content. Part I describes the current state of affairs with respect to Internet regulation. First, this part describes briefly how the Internet works, to the extent that such a description is necessary to advance the argument presented in this note. Second, concentrating on Europe, the United States, and China, Part I describes the diverging preferences of countries regarding Internet regulation, the approaches they have taken, and the problems they have encountered due to the international nature of the Internet. Third, this part addresses the major attempt at international …

Truth, Accuracy And Neutral Reportage: Beheading The Media Jabberwock's Attempts To Circumvent New York Times V. Sullivan, David A. Elder Jan 2007

Truth, Accuracy And Neutral Reportage: Beheading The Media Jabberwock's Attempts To Circumvent New York Times V. Sullivan, David A. Elder

Vanderbilt Journal of Entertainment & Technology Law

In over four decades since the New York Times v. Sullivan decision, the United States Supreme Court has accorded the American media a level of freedom of expression that is unparalleled in the democratic world. Yet, the Supreme Court has also repeatedly affirmed its unwillingness to give the media a constitutional blank check, and has authorized redress where public persons can prove that the defendant published a "calculated falsehood." As any lawyer knows, the calculated falsehood standard is so difficult to satisfy that often none but the impulsive, the intrepid or the naive will contemplate suing for libel. However, Sullivan …

From Safe Harbor To Choppy Waters: Youtube, The Digital Millennium Copyright Act,And A Much Needed Change Of Course, Lauren B. Patten

Vanderbilt Journal of Entertainment & Technology Law

YouTube.com, named Time magazine's "Invention of the Year" for 2006 and widely recognized as the most-visited video site on the Internet, has changed the face of online entertainment. With the site's acquisition by Google in October 2006, the possibilities for YouTube's growth became truly endless. However, there is a darker side to the story of the Internet sensation, one that is grounded in its potential liability for copyright infringement. The issue is that many of the most-viewed and most-popular videos on the site are copyrighted. The copyright owners of those popular clips want their works back and are suing YouTube …

All In, But Left Out: How The Unlawful Internet Gambling Enforcement Act Seeks To Eradicate Online Gambling In The United States, Benjamin C. Wickert Jan 2007

All In, But Left Out: How The Unlawful Internet Gambling Enforcement Act Seeks To Eradicate Online Gambling In The United States, Benjamin C. Wickert

Vanderbilt Journal of Entertainment & Technology Law

In recent years, gambling on the Internet has evolved into a multi-billion dollar enterprise. The industry has been particularly entrenched in the United States, whose citizens at one time accounted for up to one-half of all Internet gambling revenues. However, the landscape of Internet gambling in the United States changed drastically in 2006, when President George W Bush signed into law the Unlawful Internet Gambling Enforcement Act (UIGEA). The crucial provision of the UIGEA is its prohibition of the acceptance of payments, made by United States banks and creditors, to purveyors of unlawful Internet gambling enterprises. By targeting United States …

The Driving Force Behind Gun Crimes: A Time Series Analysis Of The Impact Of Gun Type And Gun Density, Matthew Graham Ii Jan 2007

The Driving Force Behind Gun Crimes: A Time Series Analysis Of The Impact Of Gun Type And Gun Density, Matthew Graham Ii

Electronic Theses and Dissertations

Very few studies have explored the relationship between the availability of certain types of firearms and gun density on both gun aggravated assaults and gun homicides. Nonetheless, research by Koper (2001) discovered that the availability of more lethal types of firearms, not gun density, was directly related to an increase in gun homicide rates for Dallas. However, this study did not take into account certain social and economic variables that may strengthen or weaken the determined relationship. The current study uses data previously analyzed by Koper (2001) and includes social and economic variables that have been linked to lethal violence …

The Role Of Attention In Second Language Development, Amanda Marie Mcginnis Jan 2007

The Role Of Attention In Second Language Development, Amanda Marie Mcginnis

Graduate Student Theses, Dissertations, & Professional Papers

This pilot study investigated the role of attention in language learning. I began by examining the most current research into how attention functions in the brain; then I discussed how attention as a cognitive mechanism is believed to fit into models of data processing and language learning. Once the nature and role of attention in language development was understood, it became possible to discover the practical implications for language teachers and learners. The most recent means to a grammar pedagogy is the Focus on Form approach: a language teaching option which takes into account the research on the role of …

Secondhand Smoke Signals From Prison, Scott C. Wilcox Jan 2007

Secondhand Smoke Signals From Prison, Scott C. Wilcox

Michigan Law Review

This Note argues that courts should acknowledge current societal and medical perspectives on second hand smoke (SHS) and afford real protection to prisoners against SHS through injunctive relief. Part I examines evidence that conclusively demonstrates the serious risk of harm posed by SHS to the health of inmates. It reports that inmates' long-term exposure to SHS increases their risk of contracting lung cancer, heart disease, and other potentially life threatening conditions. Part II argues that, as required by the Helling standard, contemporary society does not tolerate involuntary, long-term exposure to SHS and that prison officials exhibit deliberate indifference by allowing …

Federal Rule Of Civil Procedure 52(A) As An Ideological Weapon?, Bryan Adamson Jan 2007

Federal Rule Of Civil Procedure 52(A) As An Ideological Weapon?, Bryan Adamson

Faculty Articles

In this article, the author explores Federal Rule of Civil Procedure 52(a) and standard of review choice to determine whether appellate judges can exploit its terms to pursue ideological goals. The author examines the operative terms of Rule 52(a), viz., findings of fact, clear error, and documentary evidence, and concludes that they are so malleable as to give appellate judges wide discretion in deciding whether clear error, de novo, or some other standard of review is to be applied. The article then goes on to identify fact typologies appellate courts invoke (historical, ultimate, constitutional, legislative, sociological, scientific, political, economic, jurisdictional), …

The Restricted Gift Lifecycle, Or, What Comes Around Goes Around, John K. Eason Jan 2007

The Restricted Gift Lifecycle, Or, What Comes Around Goes Around, John K. Eason

Faculty Articles

The conflict regarding enduring donor control over property gifted for charitable uses implicates issues of current relevance to donors and nonprofit charitable organizations, and to those who represent them. Not surprisingly, these issues, and the possible ways of both addressing and accounting for their resolution, vary by circumstance. In this Article, I frame the issues and explore the relevant circumstances by reference to the particular stage in the lifecycle of a donor's restricted gift at which conflict might arise. That lifecycle spans the time from initial negotiation of the gift to its potential modification or termination due to unanticipated circumstances. …

Intellectual Property From Below: Copyright And Capability For Education, Margaret Chon Jan 2007

Intellectual Property From Below: Copyright And Capability For Education, Margaret Chon

Faculty Articles

An approach to intellectual property from within a human development framework can contribute meaningfully to the WIPO Development Agenda, which was approved by the WIPO General Assembly in September 2007. Setting the proper regulatory balance between exclusive rights and access through exceptions and limitations to those rights is key to building national innovation capacity. A human development framework allows intellectual property norm-setters to prioritize the development of healthy and literate populations who are foundational to the functioning knowledge economies that intellectual property already assumes. Building upon an earlier piece in which Professor Chon posited that a substantive equality principle was …

The Next Generation Of Legal Citations: A Survey Of Internet Citations In The Opinions Of The Washington Supreme Court And Washington Appellate Courts, 1999-2005, Tina Ching

Faculty Articles

As more legal research is conducted online, it is reasonable to conclude that there will be a corresponding increase in citations to the Internet by judges in their opinions. With the widespread public use of the Internet to access information along with the constant changes and impermanence of websites, citing to the Internet should be an issue of increasing concern to the legal community across the country. This paper surveys the types of Internet sources the Washington state Supreme Court and Appellate Court justices are citing. It discusses the interrelated issues of link rot and the impermanence of web pages, …
