Combating Corruption Through International Law In Africa: A Comparative Analysis, Won Kidane, Tom Snider Jan 2007

Combating Corruption Through International Law In Africa: A Comparative Analysis, Won Kidane, Tom Snider

Faculty Articles

"Little did we suspect," remarked Nelson Mandela, "that our own people, when they get that chance, would be as corrupt as the apartheid regime. That is one of the things that has really hurt us." Africa is the only continent that has grown poorer over the last three decades. The causes of Africa's existing predicaments are complete; however, there is no argument that deep-rooted corruption is one of the most serious contemporary developmental challenges facing the continent. Mr. Adama Dieng, who the Secretary General of the Organization of African Unity (OAU), the precursor of the African Union (AU), entrusted with …

The Contract Thesis Of The Federal Spending Power, David Engdahl Jan 2007

The Contract Thesis Of The Federal Spending Power, David Engdahl

Faculty Articles

This article focuses on the inherent similarities between spending power and contract law, and elaborates on Congress’s ability to “contract” with the States, to have States consent to laws beyond Congress’s enumerated powers with federal funding as consideration. A majority of the federal budget is currently spent on social security, social and economic assistance, education, and other aid and development programs. This “contract” thesis permits our system to maintain the virtues of enumerated federal powers. This analogy might suggest a limited role for private parties in enforcing their terms. The article is offered as an illustration for how legal scholarship …

Textual Strategies To Resist Disappearance And The Mothers Of Plaza De Mayo, Alicia Partnoy Jan 2007

Textual Strategies To Resist Disappearance And The Mothers Of Plaza De Mayo, Alicia Partnoy

Modern Languages and Literatures Faculty Works

In her paper "Textual Strategies to Resist Disappearance and the Mothers of Plaza de Mayo" Alicia Partnoy draws attention to the ways the Mothers of the Plaza de Mayo use literature as both a form of protest and as a way to build solidarity. Focusing on four texts written by the Mothers, Partnoy attempts to correct the lack of attention that this literary work has drawn. Partnoy suggests that in addition to the forms of public protest engaged by the Mothers, their literary activities also play a central role in their efforts. In fact, their use of the literary form …

Distance From Family, Years Of Life On Reservation/Village, Level Of Acculturation, Gender, And Acculturation Stress Of American Indian/Alaska Native Students At The University Of Montana, Michael Brian Trahan

Graduate Student Theses, Dissertations, & Professional Papers

Acculturation is a construct that supposes that two or more cultures interact and are in conflict with one another, and an individual can determine which qualities to adhere to from each culture. Acculturation stress is a product of the acculturation process, in which an individual experiences stress as a result of the interaction of the multiple cultures upon the individual. This study examined the effects of acculturation stress on 41 (14 male and 27 female) American Indian/Alaska Native (AI/AN) university students in an effort to determine whether this stress is related to level of acculturation, years lived on an Indian …

Absolute Quantitative Real-Time Polymerase Chain Reaction For The Measurement Of Human Papillomavirus E7 Mrna In Cervical Cytobrush Specimens, Michael E. Scheurer, Laura M. Dillon, Zhuo Chen, Michele Follen, Karen Adler-Storthz

Faculty, Staff and Student Publications

BACKGROUND: Few reports of the utilization of an accurate, cost-effective means for measuring HPV oncogene transcripts have been published. Several papers have reported the use of relative quantitation or more expensive Taqman methods. Here, we report a method of absolute quantitative real-time PCR utilizing SYBR-green fluorescence for the measurement of HPV E7 expression in cervical cytobrush specimens. RESULTS: The construction of a standard curve based on the serial dilution of an E7-containing plasmid was the key for being able to accurately compare measurements between cervical samples. The assay was highly reproducible with an overall coefficient of variation of 10.4%. CONCLUSION: …

The Sox-Rfid Connection, Porcher L. Taylor Iii, Nezih Altay Jan 2007

The Sox-Rfid Connection, Porcher L. Taylor Iii, Nezih Altay

School of Professional and Continuing Studies Faculty Publications

Companies expect to gain many benefits from implementing Radio Frequency Identification (RFID) technology. Perhaps the one cited most often is lower supply chain costs, which result from the improved inventory visibility that the technology affords. But there's another often overlooked advantage that supply chain managers should know about: RFlD technology can help them fulfill the requirements of the Sarbanes-Oxley Act (SOX) if implemented and integrated properly. Conversely, RFID can complicate the already complex and costly internal mandates of SOX if the implementation is not approached the right way.

Terminator Detection By Support Vector Machine Utilizing A Stochastic Context-Free Grammar, Patricia Francis-Lyon, Nello Cristianini, Stephen Holbrook Jan 2007

Terminator Detection By Support Vector Machine Utilizing A Stochastic Context-Free Grammar, Patricia Francis-Lyon, Nello Cristianini, Stephen Holbrook

Nursing and Health Professions Faculty Research and Publications

A 2-stage detector was designed to find rho-independent transcription terminators in the Escherichia coli genome. The detector includes a stochastic context free grammar (SCFG) component and a support vector machine (SVM) component. To find terminators, the SCFG searches the intergenic regions of nucleotide sequence for local matches to a terminator grammar that was designed and trained utilizing examples of known terminators. The grammar selects sequences that are the best candidates for terminators and assigns them a prefix, stem-loop, suffix structure using the Cocke-Younger-Kasaami (CYK) algorithm, modified to incorporate energy effects of base pairing. The parameters from this inferred structure are …

Taxing Emotional Distress Recoveries: Does Murphy Show The Way?, Kaushal P. Mahaseth Jan 2007

Taxing Emotional Distress Recoveries: Does Murphy Show The Way?, Kaushal P. Mahaseth

LLM Theses and Essays

The taxability of recoveries of damages on account of emotional distress remains a complicated issue under the American federal income tax law. Recent developments due to a controversial decision by the D.C. Circuit Court of Appeals have further added fuel to this debate. Even if one were to argue the justifications of exempting such recoveries from income taxation, courts do not appear to be the very appropriate kind of forum. Congress can, and in fact does tax such recoveries and the constitutional basis of such power can hardly be doubted. As a result, appropriate changes in the statute only can …

Judicial Review Of International Commercial Arbitral Awards By National Courts In The United States And India, Aparna D. Jujjavarapu Jan 2007

Judicial Review Of International Commercial Arbitral Awards By National Courts In The United States And India, Aparna D. Jujjavarapu

LLM Theses and Essays

Article V of the New York convention lays down the provisions under which the recognition and enforcement of an arbitral award may be refused. The United States and India are signatories to the Convention. Section 10(a) of the Federal Arbitration Act in the United States limits the scope of judicial review of the arbitral awards to a clear list of grounds of vacatur. The national courts of the United States have recognized several non-statutory grounds of which "manifest disregard of the law" as a standard of review is the focus in this thesis. In fact, the state of Georgia has …

The Land Of The Free: Human Rights Violations At Immigration Detention Facilities In America, Caitlin J. Mitchel Jan 2007

The Land Of The Free: Human Rights Violations At Immigration Detention Facilities In America, Caitlin J. Mitchel

LLM Theses and Essays

In America today, aliens who commit even minor visa violations can be detained in one of many immigration detention facilities throughout the U.S. These detainees may be transferred to a facility far away from their homes, families, and attorneys. While imprisoned in these detention facilities, some detainees are treated as and housed with criminals. Their substantive and procedural rights are limited and their human rights are violated. The U.S. laws that should protect them are the very laws that strip them of their rights to court proceedings, challenges of decisions regarding detention, and judicial review. By issuing substantial reservations, declarations, …

Applicable Law Provisions In International Uniform Commercial Law Conventions, Paolo E. Conci Jan 2007

Applicable Law Provisions In International Uniform Commercial Law Conventions, Paolo E. Conci

LLM Theses and Essays

The development of international trade requires predictability and uniformity of the applicable legal framework. Such requirements can be satisfied by means of international uniform commercial law conventions, which try to set forth coherent and uniform bodies of substantial rules. A key role is also played by private international law, an instrument operating at a different level but often included in the uniform conventions themselves. This paper analyzes the relationship between international uniform commercial law conventions and private international law to investigate how it has developed over the last seventy years, and suggests a new approach to international commercial transactions in …

Imports Or Made-In-China: Comparison Of Two Constitutional Cases In China And The United States, Xiao Li Jan 2007

Imports Or Made-In-China: Comparison Of Two Constitutional Cases In China And The United States, Xiao Li

LLM Theses and Essays

When its economic increase attracts the global attention, China is also looking for a break-through in its judicial reform. The Qi v. Chen case (2001) was considered to be the Chinese version of Marbury v. Madison and gave rise to a heated discussion of the judicial review power in China. This article will analyze the doubts on the Qi case and the prospects of judicial review it indicates through comparison with Marbury v. Madison. Although Qi v. Chen opened the door for constitutional litigation, its dramatic facts and strained application of the Constitution threw it into question. Nevertheless, its effect …

Discovering Software Reliability Patterns Based On Multiple Software Projects, Yi Liu, Gerald Adkins, Jeng-Foung Yao, Gita Williams Jan 2007

Discovering Software Reliability Patterns Based On Multiple Software Projects, Yi Liu, Gerald Adkins, Jeng-Foung Yao, Gita Williams

Journal of International Technology and Information Management

Discovering patterns that indicate software reliability provides valuable information to software project managers. Software Quality Classification (SQC) modeling is a methodology that can be used to discover reliability patterns of large software projects. However, the patterns found by SQC modeling may not be accurate and robust owing to insufficient information used in the training process. This study compares two genetic programming-based SQC models using different volumes of data. These data were extracted from seven different NASA software projects. The results demonstrate that combining data from different projects can produce more accurate and reliable patterns.

Soviet Language Policy In Uzbekistan: How The Role Of Russian Has Changed Through Soviet Times And Independence, Mary Catherine Boehmer Jan 2007

Soviet Language Policy In Uzbekistan: How The Role Of Russian Has Changed Through Soviet Times And Independence, Mary Catherine Boehmer

Honors Theses

This thesis examines the progression of Soviet language policy in Uzbekistan and its effects. It also examines how the perception of Russian has changed in post-Soviet Uzbekistan and Uzbeks now view their own language as a direct result of language policy. I based my research on the research of others and the interview of a former Peace Corps volunteer who lived in both Tashkent and Andijon for a total period of two years. Through my investigation, I discovered how the Central Asian languages were formed on the basis of language, how Soviet leaders used both Russian and ethnic languages to …

Dynamics Of Transcriptional Repression By Λ Cro Repressor In Vivo, Dustin Land Markle Jan 2007

Dynamics Of Transcriptional Repression By Λ Cro Repressor In Vivo, Dustin Land Markle

Honors Theses

Cro is a regulatory protein that participates in the life cycle switch of bacteriophage lambda (X). While wild-type Cro is produced as a single domain polypeptide monomer, two monomers must assemble to form a dimer before Cro can act as a functional transcriptional repressor. We suspect that dimerization of Cro monomers determines, in part, the dynamics of the activity of the protein in vivo. Rate and equilibrium constants for dimerization of several Cro variants have already been determined in vitro,, and dimerization of Cro monomers is slow relative to other similar proteins. This study is concerned with exploring the in …

Securitizing Audit Failure Risk: An Alternative To Caps On Damages, Lawrence A. Cunningham Jan 2007

Securitizing Audit Failure Risk: An Alternative To Caps On Damages, Lawrence A. Cunningham

GW Law Faculty Publications & Other Works

For several decades, policy analysts have debated whether to establish ex ante caps on damages that audit firms face for violating state or federal law in their audits of public companies. A common argument supporting caps is a claimed inability of audit firms to obtain requisite external liability insurance and need to resort to self-insurance programs. This Article evaluates this claim by assessing existing insurance resources and inquiring into potential additional insurance devices. The assessment suggests that, for auditors, self-insurance is better than external insurance so that the claim does not necessarily support damages caps. Even if the claim were …

Civil Society Engagement In Free Trade Negotiations: Cafta Opposition Movements In El Salvador, Rose J. Spalding Jan 2007

Civil Society Engagement In Free Trade Negotiations: Cafta Opposition Movements In El Salvador, Rose J. Spalding

College of Liberal Arts and Social Sciences Faculty and Staff Works

This article analyzes civil society participation in the free trade debate by focusing on networks that opposed the Central American Free Trade Agreement (CAFTA) in El Salvador. Drawing on documents, observations, and semi-structured interviews with civil society leaders, two kinds of opposition coalitions are identified. “Critic negotiators,” emphasizing active engagement and policy research, used the limited participation space opened by authorities to push for reform. “Transgressive resisters,” repudiating the formal consultation process, deployed confrontational tactics and posed more fundamental challenges. This work uses social movement theory to explore coalition resource mobilization, the role of movement entrepreneurs, strategic decision-making, mechanisms linking …
