Banking On Jarkesy, Jacob Cunningham, Todd Phillips
Banking On Jarkesy, Jacob Cunningham, Todd Phillips
Duke Law Journal Online
The 150-year-old bank regulatory system is under threat. Following the Supreme Court’s landmark decision in Jarkesy, bankers have filed numerous lawsuits challenging the ability of the federal bank regulatory agencies to adjudicate cases in non-Article III tribunals. But unlike the agencies tasked with enforcing the securities, antitrust, and consumer protection laws, the banking regulators lack statutory authority to file cases in federal court. A decision invalidating their in-house adjudicative authority strips of them of any forum in which to file enforcement actions.
This essay argues that these lawsuits should fail. Because the Seventh Amendment jury trial right exempts “public rights,” …
Minority Leaders’ Impact On Corporate Diversity And Organizational Change, Nana Kwasi Amponsah
Minority Leaders’ Impact On Corporate Diversity And Organizational Change, Nana Kwasi Amponsah
Walden Dissertations and Doctoral Studies
Workplace diversity continues to face criticism due to the limited representation of minority groups, with little progress made in the corporate sector. Despite corporations’ efforts to increase diversity and inclusion in the workplace, a notable lack of minority leadership persists in upper management roles. The purpose of this explanatory sequential mixed-method study was to explore the factors that affect the selection of minority leaders and how corporate executives utilize diversity, equity, and inclusion (DEI) initiatives to foster significant organizational change, even in the face of ongoing underrepresentation in upper management. Social dominance theory, anti-egalitarianism, and social construction theory grounded this …

Sex-Specific Evolutionary Programs Shape Recombination Rate Evolution In House Mice., Lydia K Wooldridge, Micah Pietraho, Peyton Disiena, Sam Littman, Benjamin Clauss, Beth L Dumont
Faculty Research 2026
Recombination rates vary across species, populations, and sexes. House mice (Mus musculus) present a particularly extreme example. Prior studies have established large differences in global recombination rates between M. musculus subspecies and inbred strains, with males exhibiting more extensive variation than females. The observation of sex-limited variation has prompted the hypothesis that male and female recombination rates may evolve by distinct evolutionary mechanisms in M. musculus. Here, we formally evaluate this hypothesis in a phylogenetic framework. We combine cytogenetic estimates of genomic crossover counts with published data to compile a large dataset of sex-specific crossover rate estimates totaling >6,000 single …

Halide perovskites are now being studied for a full range of optoelectronic devices due to their excellent electronic and optical properties. This work explores the impact of grain boundaries on low-temperature carrier transport in polycrystalline cesium tin iodide (CsSnI3) within the quantum diffusive transport regime, comparing a range of polycrystalline samples with varying grain sizes with epitaxial counterparts. Low-temperature magnetoresistance measurements reveal the presence of weak anti-localization (spin-orbit effects) with a shorter coherence length (Lϕ) than the epitaxial films. Surprisingly, Lϕ is not found to be impacted by grain size, despite being nearly an order …

Integrated Road Usage Fee Management Within Digital Navigation Systems, Paula Marques
Integrated Road Usage Fee Management Within Digital Navigation Systems, Paula Marques
Defensive Publications Series
Digital navigation systems may identify routes with fee-based road segments, such as tolls or vignettes, but may not provide an integrated method for payment. This can result in a fragmented and manual process for drivers with varied and unfamiliar payment systems. A system is described for integrating road usage fee management within a digital navigation service. The system can utilize a route analysis engine to identify fees, a client-side geofencing module on a computing device (e.g., a smartphone, smart watch, wearable device, in-vehicle infotainment system, augmented reality glasses, etc.) To detect a vehicle's entry into a fee-based zone, and a …

Reliably generating accurate structured query language (SQL) queries from natural language (NL) inputs is a difficult task due to challenges such as schema ambiguity, uncertainty regarding table relationships, complex business logic makes, etc. LLM-based solutions are often unable to operate reliably within complex, real-world enterprise environments with complex datasets. This disclosure describes the use of agentic artificial intelligence (AI) for NL-to-SQL query transformations. A semantic data layer leverages a three-tiered model - attributes, entities and cubes. Attributes define dimensions within a table, entities represent a logical view of data, and cubes act as business objects that abstract the complexity of …
Continuous Ambient Microphone Calibration Via Opportunistic Broadband Auditory Icons, Rajeev Nongpiur, Chris Breithaupt
Continuous Ambient Microphone Calibration Via Opportunistic Broadband Auditory Icons, Rajeev Nongpiur, Chris Breithaupt
Defensive Publications Series
Performance drift in microphone arrays is often caused by environmental factors such as dust, moisture, and grime accumulating over time. This spectral mismatch degrades the performance of spatial audio algorithms that rely on precise array calibration. To address this limitation, a continuous calibration method is disclosed wherein broadband earcons are opportunistically played through device speakers. Audio responses are recorded by on-device microphones during defined user scenarios. A background model is generated to filter out environmental noise and room reverberation from these recordings. Subsequently, the filtered in-field measurement is compared against a reference factory template to estimate spectral deviation. A calibration …

Global enterprise operations can experience inefficiencies and service delays from language-siloed support queues, while generic machine translation tools may lack the context to handle enterprise-specific terminology. A system and method can facilitate multilingual communication by integrating a generative artificial intelligence model within enterprise workflow platforms, such as customer relationship management systems. The framework can programmatically retrieve a curated, enterprise-specific glossary and inject it into a translation prompt sent to the model. This technique grounds the model, instructing it to prioritize an organization's specific lexicon for a given translation. The approach can produce translations that are both linguistically fluent and terminologically …

Enterprise service platforms can present operational challenges due to reactive support models and compliance risks associated with managing sensitive data, such as personally identifiable information (PII). A dual-function architecture may integrate a proactive intervention engine and an augmented data compliance framework. The intervention engine can analyze real-time data signals from various enterprise systems using an inference layer, such as a large language model, to predict potential user friction points and deliver preventative interventions. Concurrently, the compliance framework can provide a proactive component for detecting potential PII for human-in-the-loop review and an on-demand utility for creating non-destructive, anonymized versions of data …

A Policy Reversal As Structural Break: A Lesson From China’S Land Lease Financing For Infrastructure, Yilin Hou, Lin Li, Lei Shao
Center for Policy Research
Land-based revenues as a fiscal instrument to finance infrastructure tie public investment to real estate markets, where demand fluctuations cause fiscal consequences. This paper takes policy reversals as structural breaks and examines their impacts on infrastructure investment. We dissect China’s 2016 policy reversal that disallowed developers to finance land purchase with debt, causing sharp declines in local government land revenues, slashing their fiscal base for infrastructure investment. Using prefecture-level panel data and continuous difference-in-differences identification, we estimate the reversal reduced land-lease revenues by 55%. Two-stage least squares estimates suggest a 10% land-revenue decline translates into 6.6% investment reduction. Decomposing the …

Background: The development of relevant and robust large animal models of hepatocellular carcinoma is needed to test new therapeutic strategies for this disease. Transgenic approaches hold promise in addressing this complex problem. One such model, the Oncopig, has been reported to develop tumors of up to 4 cm in diameter within 7-14 days at sites of in situ vector inoculation. However, the resulting lesions reportedly contained an extensive inflammatory component that has not been evaluated in detail.
Methods: Herein, we describe our results from multiparametric characterization of the lesions generated using liver biopsy cores incubated in vector solution and replaced …

Spatially resolved transcriptomics (SRT) is a promising new technology that enables simultaneous analysis of gene expression and spatial information for biomedical research. However, the existing statistical and deep learning algorithms used for analyzing SRT data rely solely on two-dimensional (2D) spatial coordinates, which limits their ability to accurately identify spatial domains, spatially variable genes (SVGs), cell-to-cell communications, and developmental trajectories in a three-dimensional (3D) spatial manner. To address these limitations, we introduced Spa3D, which utilized the anti-leakage Fourier transform and graph convolutional neural network model to reconstruct 3D-based spatial structures from multiple 2D SRT slices. We demonstrate that Spa3D is …

Detecting internal physical changes in an electronic device (e.g., a smartphone, smart watch, wearable device) may be difficult with some conventional methods, and is often limited to chemical or electrical monitoring that fails to detect structural changes. A system can perform a mechanical resonant frequency analysis using existing hardware components, such as a haptic actuator and one or more sensors (e.g., an accelerometer, a microphone). The haptic actuator can be configured to generate a vibrational stimulus across a range of frequencies, while the sensors can measure the device's corresponding response. This measured response data can be processed to generate a …

Industrial and organizational (I-O) psychology recognizes dozens of different constructs, including several individual differences, environmental variables, job attitudes, and work-related behaviors. It is, of course, necessary to retain a variety of constructs in order to adequately capture the complexities, subtleties, and diversity of work-related phenomena. But do the many constructs recognized by I-O psychologists all serve a useful purpose? Or has our field been too eager to welcome redundant, unnecessary constructs into the fold? And if I-O psychology has embraced too many unnecessary constructs, then what—if anything—should we do about it? In the current focal article, we first discuss when …

ESR1 mutations are the leading cause of endocrine therapy resistance and progression in ER-positive metastatic breast cancer. ESR1 mutations are detected in ~50% of metastatic breast cancer patients, and identification of effective targeted therapeutics are critically needed. Here, we identified enrichment of dysregulated replication stress and DNA damage responses in multiple ESR1 mutant models. Targeting the replication stress response utilizing checkpoint inhibition in combination with PARP inhibition synergistically suppressed growth, induced cell cycle arrest, and attenuated DNA replication. PARP inhibition blocked metastatic dissemination in vivo and reduced both PARP1 and ER-regulated protein expression. PARP trapping by olaparib treatment with or …

We present a Physics-guided deep learning framework to address common limitations in Confocal Laser Scanning Microscopy (CLSM), including diffraction-limited resolution, noise, and under sampling due to low laser power conditions. The optical system’s point spread function and primary CLSM image degradation mechanisms, namely photon shot noise, dark current noise, motion blur, speckle noise, and under sampling are explicitly incorporated into the model as physics-based constraints. A convolutional autoencoder is trained with a custom loss function that integrates these optical degradation processes, ensuring that the reconstructed images adhere to physical image formation principles. The model is evaluated on simulated CLSM datasets …

Animals respond to changes in their environment and internal states via neuromodulation. Neuropeptides modulate neural circuits with flexibility because 1 gene can produce either multiple copies of the same neuropeptide or different neuropeptides. However, with this architectural complexity, the function of discrete and active neuropeptides is muddled. Here, we design a genetic tool that facilitates functional analysis of individual peptides. We engineered Escherichia coli bacteria to express active peptides, fed loss-of-function Caenorhabditis elegans, and rescued the activity of genes with varying lengths and functions: pdf-1, flp-3, ins-6, and ins-22. Some peptides were functionally redundant, while others exhibit unique and previously …
