Design Patents: An Alternative When The Low Standards Of Copyright Are Too High?, Ryan G. Vacca
Akron Law Faculty Publications
The standard for copyright protection is notoriously low the work must be independently created by the author and possess a minimal degree of creativity. Even with this low standard, blank forms, and other forms which do not convey information, are categorically denied copyright protection. In contrast, the standard for design patent protection is much more burdensome. Design patents protect news, original, ornamental, and non-obvious designs. Even though there is a higher standard, the Patent and Trademark Office has issued design patents for blank forms.
This article explores the blank forms doctrine in copyright law, articulated in Baker v. Selden. Later …

Frameworks For Patient Safety In The Nursing Curriculum, Theresa Maria Chenot
Frameworks For Patient Safety In The Nursing Curriculum, Theresa Maria Chenot
UNF Graduate Theses and Dissertations
Patient safety (i.e., the degree to which patients are free from accidental injury) has received a great deal of media coverage during the past few years. Professional and regulatory agencies have indicated that patient safety education should be provided to healthcare workers to improve health outcomes. The primary purpose of this exploratory study was to gain a better understanding of the current status of patient safety awareness among pre-licensure nursing students. To this end, six research questions guided the study:
1. Will interpretable item constructs be identified when responses to the Healthcare Professional Patient Safety Assessment Curriculum Survey (HPPSACS) are …

Push-Pull Curicullum For For Farmer Field Schools, International Centre Of Insect Physiology And Ecology (Icipe)
icipe Manuals
Foreword
This push-pull curriculum for farmer field schools (FSS) is a major step towards getting the push-pull technology into the national extension systems in eastern and southern Africa. The FFS approach aims at supporting farmers by improving the quality of disseminating technology to ensure that majority of the farmers benefit from innovative technologies.
While research institutions have developed a range of technologies to solve local production problems in most smallholder farming systems, agricultural productivity has continued to decline. Many of the technologies have not been effectively disseminated to majority of the farmers and hence remain largely unknown except in few …

Integrating Semantic Templates With Decision Tree For Image Semantic Learning, Ying Liu, Dengsheng Zhang, Guojun Lu, Ah-Hwee Tan
Research Collection School Of Computing and Information Systems
Decision tree (DT) has great potential in image semantic learning due to its simplicity in implementation and its robustness to incomplete and noisy data. Decision tree learning naturally requires the input attributes to be nominal (discrete). However, proper discretization of continuous-valued image features is a difficult task. In this paper, we present a decision tree based image semantic learning method, which avoids the difficult image feature discretization problem by making use of semantic template (ST) defined for each concept in our database. A ST is the representative feature of a concept, generated from the low-level features of a collection of …

Forecasting Consumer Adoption Of Technological Innovation: Choosing The Appropriate Diffusion Models For New Products And Services Before Launch, Roger Calantone, Lance Gentry
Forecasting Consumer Adoption Of Technological Innovation: Choosing The Appropriate Diffusion Models For New Products And Services Before Launch, Roger Calantone, Lance Gentry
Business and Information Technology Faculty Research & Creative Works
There are many good articles on various forecasting models. There is consensus that no single diffusion model is best for every situation. Experts in the field have asked for studies to provide empirical-based guidelines for recommending when various models should be used. This research investigates multiple diffusion models and provides recommendations for which diffusion models are appropriate for radical and really new products and services before the launch of the innovation.
Seismic Reflection And Gravity Constraints On The Bedrock Configuration In The Greater East Missoula Area, Frank Janiszewski
Seismic Reflection And Gravity Constraints On The Bedrock Configuration In The Greater East Missoula Area, Frank Janiszewski
Graduate Student Theses, Dissertations, & Professional Papers
The greater East Missoula, MT area is the site of numerous studies to track possible groundwater contamination from the EPA Superfund Site at the Milltown Dam. The accuracy of these groundwater models depends on many factors, one of which is the accuracy to which the bedrock topography is mapped. Currently, a map based heavily on a gravity survey provides the most detailed map of the bedrock. The accuracy of this map may be improved through the use of seismic reflection techniques, better estimates of the density contrast used in the gravity modeling, and by extending the gravity survey to include …
The Dynamics Of Daily Retail Gasoline Prices, Michael C. Davis
The Dynamics Of Daily Retail Gasoline Prices, Michael C. Davis
Economics Faculty Research & Creative Works
Previous research has analyzed the behavior of retail gasoline stations in how they adjust their prices. In this paper we analyze the daily movements in prices of four retail gasoline stations located in Newburgh, New York. We find some evidence to support the notion that the behavior is explained by menu costs. There is substantial evidence that the firms adjust their prices asymmetrically, being more inclined to increase than to decrease prices. We conclude that the pricing behavior is being determined by a combination of search costs for the consumers and menu costs for the producers. Copyright © 2007 John …
Nonlinear Optimization Approach For Upfc Power Flow Control And Voltage Security: Sufficient System Constraints For Optimality, Radha P. Kalyani
Nonlinear Optimization Approach For Upfc Power Flow Control And Voltage Security: Sufficient System Constraints For Optimality, Radha P. Kalyani
Doctoral Dissertations
"This dissertation provides a nonlinear optimization algorithm for the long term control of Unified Power Flow Controller (UPFC) to remove overloads and voltage violations by optimized control of power flows and voltages in the power network. It provides a control strategy for finding the long term control settings of one or more UPFCs by considering all the possible settings and all the (N-1) topologies of a power network. Also, a simple evolutionary algorithm (EA) has been proposed for the placement of more than one UPFC in large power systems"--Abstract, page iv.

A Mössbauer Spectral Study Of The Gdco₄₋ₓfeₓb Compounds, Fernande Grandjean, Raphäel P. Hermann, Eustachy S. Popiel, Gary J. Long
Chemistry Faculty Research & Creative Works
The iron-57 Mössbauer spectra of the GdCo4-xFexB compounds, where x is 0.10, 0.15, 0.20, 0.25, 1, 2, 2.5, and 2.6, have been measured at room temperature and reveal relatively small iron hyperfine fields of approximately 12-18 T, relatively large quadrupole interactions of approximately +0.9 and -1 mm/s, and three very different types of spectra for x=0.10 and 0.15, x=0.25, 1, and 2, and x=2.5 and 2.6. The differences result from both the different easy magnetization directions in these compounds and the different cobalt and/or iron occupancies of the crystallographic 2c and 6i sites. The spectra have …
Verb Contraction In The West Saxon Dialect Of Old English: An Optimality Theory Account, Melinda Mix
Verb Contraction In The West Saxon Dialect Of Old English: An Optimality Theory Account, Melinda Mix
Graduate Student Theses, Dissertations, & Professional Papers
The phenomena of verb contraction in the West Saxon dialect of Old English has been described in many grammars of the language. However, most of these use a traditional rule-based analysis of the sound changes which occur. This thesis re-analyzes the data in terms of Optimality Theory (OT), which uses a system of constraint ranking to account for sound changes. The advantage of using OT is that it offers a single ranking to explain sound changes that would require separate rules and ordering in a more traditional analysis. Section 1 introduces the motivation for approaching this data from OT. Section …
Modeling The Cumulative Effects Of Forest Fire On Watershed Hydrology: A Post-Fire Application Of The Distributed Hydrology-Soil-Vegetation Model (Dhsvm), Crystal S. Stonesifer
Modeling The Cumulative Effects Of Forest Fire On Watershed Hydrology: A Post-Fire Application Of The Distributed Hydrology-Soil-Vegetation Model (Dhsvm), Crystal S. Stonesifer
Graduate Student Theses, Dissertations, & Professional Papers
The Distributed Hydrology-Soil-Vegetation Model (DHSVM) was applied to the Eightmile Creek watershed in western Montana. The purpose of this research was primarily to assess the applicability of the model as a cumulative effects assessment tool in the post-fire landscape of a forested watershed in this region. The model was first calibrated to the pre-fire watershed conditions using six years of historic streamflow data. DHSVM was able to accurately simulate the general shape of the measured hydrograph for each of the six simulated water years, and the normalized median absolute error statistics were below the target threshold of 50% for each …

Altered Parvalbumin-Positive Neuron Distribution In Basal Ganglia Of Individuals With Tourette Syndrome, Paul S.A. Kalanithi
Yale Medicine Thesis Digital Library
The neuropathology of Tourette Syndrome (TS) is poorly characterized. This thesis provides the first quantitative stereologic immunohistochemical study of the basal ganglia in TS. TS is a childhood neuropsychiatric disorder characterized by motor and vocal tics. Previous imaging studies found alterations in caudate (Cd) and putamen (Pt) volumes. To investigate possible alterations in cell populations, postmortem basal ganglia tissue from individuals with TS and normal controls (NC) was analyzed using unbiased stereological techniques. A markedly higher (>160% of control) total neuron number and density was found in the internal segment of the globus pallidus (GPi) of TS (p220% of …

The "Order-Of-Battle" In Constitutional Litigation, Michael Wells
Scholarly Works
This article examines and defends a procedural rule that figures prominently in constitutional tort litigation, has drawn sharp criticism from the federal judiciary, and seems to have lost the support of at least four sitting Supreme Court Justices. In order to recover damages, plaintiffs must not only prove a constitutional violation but also fend off assertions of official immunity. In ruling on motions to dismiss the complaint and motions for summary judgment, a preliminary question is the sequence in which the two issues should be addressed-a problem the Justices call the "order-of-battle." Morse v. Frederick, the "Bong Hits Jesus" case, …

Unjust Enrichment Within A Valid Contract: A Close Look At Roxborough V. Rothmans Of Pall Mall Australia Ltd, Hang Wu Tang
Research Collection Yong Pung How School Of Law
This paper examines the decision of the High Court of Australia, Roxborough v Rothmans of Pall Mall Australia Ltd. In particular, this paper interrogates the suggestion by some English commentators that the principle of unjust enrichment ought to apply in this case. This suggestion is controversial because this case is a situation where there was a valid contract between [*2] the parties. In this paper, the central argument advanced is a negative thesis: the unjust enrichment principle is inappropriate as a framework of analysis in the Roxborough context. In a situation like Roxborough, there are two hurdles before the unjust …
