A Poverty Of Representation: The Attorney’S Role To Advocate For The Powerless, Spencer Rand Mar 2007

A Poverty Of Representation: The Attorney’S Role To Advocate For The Powerless, Spencer Rand

Texas Wesleyan Law Review

In this paper, I look at the work that attorneys are doing to right the wrongs of the underrepresented. This article argues that as a profession, we talk about providing assistance to those that cannot afford representation but that this is more talk than action. This article also examines modes of representing the poor, including legal services and other non-profit legal agencies and laws that allow attorneys to collect fees from third-party payors. Furthermore, this article argues that while the existing methods of representation are good and should be supported, these avenues are limited and, as such, are unlikely to …

Somerset’S Case At The Bar: Securing The “Pure Air” Of English Jurisdiction Within The British Empire, Daniel J. Hulsebosch Mar 2007

Somerset’S Case At The Bar: Securing The “Pure Air” Of English Jurisdiction Within The British Empire, Daniel J. Hulsebosch

Texas Wesleyan Law Review

This essay explores what this environmental conceit meant as a legal fact to the legal professionals involved in the case in 1772. It was important to them. Many of us are also legal professionals, and the case remains important to us. But the case meant something different for them, who could not see the future, than it does today for us, who see their future as our history. It is a mistake, then, to attribute too much weight to this one legal decision-to read into Mansfield's opinion the whole history of liberation.

Codifying Humanity: The Legal Line Between Slave And Servant, Veronica Hendrick Mar 2007

Codifying Humanity: The Legal Line Between Slave And Servant, Veronica Hendrick

Texas Wesleyan Law Review

Beloved, Toni Morrison's Pulitzer Prize-winning novel, portrays the ramifications of U.S. legal policies that codified people as either human, therefore entitled to rights, or animal, thereby allotted to the category of slave. It is this categorization that sets the action of the novel into gear. Sethe, the main character, runs from the Sweet Home farm to freedom in Ohio, where her three small children await her. After only 28 days of freedom, her owner and the local sheriff arrive to apprehend her. In response, Sethe attempts to kill her children and herself rather than return to the slave system.

MUSC Faculty Journal Articles

Variables influencing the risk of dissemination and outcome of Cryptococcus neoformans infection were assessed in 111 organ transplant recipients with cryptococcosis in a prospective, multicenter, international study. Sixty-one percent (68/111) of the patients had disseminated infection. The risk of disseminated cryptococcosis was significantly higher for liver transplant recipients (adjusted hazard ratio [HR], 6.65; P= .048). The overall mortality rate at 90 days was 14% (16/111). The mortality rate was higher in patients with abnormal mental status (P = .023), renal failure at baseline (P = .028), fungemia (P = .006), and disseminated infection (P = .035) and was lower in …

Environmental And Genetic Influences On Mating Strategies Along A Replicated Food Availability Gradient In Guppies (Poecilia Reticulata), Gita R. Kolluru, Gregory F. Grether, Heidy Contreras Mar 2007

Environmental And Genetic Influences On Mating Strategies Along A Replicated Food Availability Gradient In Guppies (Poecilia Reticulata), Gita R. Kolluru, Gregory F. Grether, Heidy Contreras

Biological Sciences

Food availability is expected to influence the relative cost of different mating tactics, but little attention has been paid to this potential source of adaptive geographic variation in behavior. Associations between the frequency of different mating tactics and resource availability could arise because tactic use responds directly to food intake (phenotypic plasticity), because populations exposed to different average levels of food availability have diverged genetically in tactic use, or both. Different populations of guppies (Poecilia reticulata) in Trinidad experience different average levels of food availability. We combined field observations with laboratory “common garden” and diet experiments to examine how this …

Contaminant Plumes Of The Lawrence Berkeley National Laboratory And Their Interrelation To Faults, Landslides, And Streams In Strawberry Canyon, Berkeley And Oakland, California, Committee To Minimize Toxic Waste, Laurel Collins

Committee to Minimize Toxic Waste

The Lawrence Berkeley National Laboratory (LBNL), initially called the UC Radiation Laboratory, was originally located on the University of California Berkeley (UCB) central campus in Alameda County during 1932. By 1940, it was relocated to its present site in the steep hills of Strawberry Canyon east of the Hayward Fault and the central UCB campus. The first major facility, the 184-inch synchrocyclotron was built with funds from both private and university sources, and was used in the Manhattan Project in the development of the world’s first nuclear bomb. Beginning in 1948 the U.S. Atomic Energy Commission and then its successor …

Performance Characteristics Of A Therapeutic Ultrasound Wire Waveguide, Graham Gavin, Garrett Mcguinness, Finbar Dolan, M.S. Hashmi Mar 2007

Performance Characteristics Of A Therapeutic Ultrasound Wire Waveguide, Graham Gavin, Garrett Mcguinness, Finbar Dolan, M.S. Hashmi

Articles

Therapeutic ultrasound angioplasty has been investigated, clinically, by a number of researchers and represents a potentially promising therapy for the treatment of atherosclerotic lesions. To date, there has been no detailed analysis of the effect of mechanical design parameters, such as wire geometry or damping characteristics, on wire waveguide performance. An apparatus capable of delivering therapeutic ultrasound down small diameter nickel–titanium (NiTi) wire waveguides is described. The output peak-to-peak (p–p) displacements at the distal tip of a 1.0mm diameter waveguide were measured experimentally, by means of an optical microscope and image analysis software. The output was measured for a range …

Individual Acoustic Variation In Fallow Deer (Dama Dama) Common And Harsh Groans: A Source-Filter Theory Perspective, Elisabetta Vannoni, Alan G. Mcelligott Mar 2007

Individual Acoustic Variation In Fallow Deer (Dama Dama) Common And Harsh Groans: A Source-Filter Theory Perspective, Elisabetta Vannoni, Alan G. Mcelligott

Veterinary Science and Medicine Collection

Mammals are able to distinguish conspecifics based on vocal cues, and the acoustic structure of mammal vocalizations is directly affected by the anatomy and action of the vocal apparatus. However, most studies investigating individual patterns in acoustic signals do not consider a vocal production-based perspective. In this study, we used the source-filter model of vocal production as a basis for investigating the acoustic variability of fallow deer groans. Using this approach, we quantified the potential of each acoustic component to carry information about individual identity. We also investigated if cues to individual identity carry over among the two groan types …

Carcass Composition And Meat Quality Of Three Different Iberian × Duroc Genotype Pigs, Rosario Ramírez, Ramon Cava Mar 2007

Carcass Composition And Meat Quality Of Three Different Iberian × Duroc Genotype Pigs, Rosario Ramírez, Ramon Cava

Slaughter and Slaughtering Practices Collection

Carcass composition and meat quality of Longissimus dorsi (LD) and Biceps femoris (BF) muscles from three different Iberian × Duroc genotype pigs were studied: GEN1: ♂ Iberian × ♀ Duroc1; GEN2: ♂ Duroc1 × ♀ Iberian; GEN3: ♂ Duroc2 × ♀ Iberian. Duroc1 (DU1) were selected for the manufacture of dry-cured meat products while Duroc2 (DU2) were pigs selected for meat production, with high percentages of meat cuts and low carcass fat. Genotype had a significant effect on the differences found while sex had not. GEN2 showed the highest weights at days 180 and 238 of weaning and the highest …

Influence Of Swimming Speed On Metabolic Rates Of Juvenile Pacific Bluefin Tuna And Yellowfin Tuna, Jason M. Blank, Charles J. Farwell, Jeffery M. Morrissette, Robert J. Schallert, Barbara A. Block Mar 2007

Influence Of Swimming Speed On Metabolic Rates Of Juvenile Pacific Bluefin Tuna And Yellowfin Tuna, Jason M. Blank, Charles J. Farwell, Jeffery M. Morrissette, Robert J. Schallert, Barbara A. Block

Biological Sciences

Bluefin tuna are endothermic and have higher temperatures, heart rates, and cardiac outputs than tropical tuna. We hypothesized that the increased cardiovascular capacity to deliver oxygen in bluefin may be associated with the evolution of higher metabolic rates. This study measured the oxygen consumption of juvenile Pacific bluefin Thunnus orientalis and yellowfin tuna Thunnus albacares swimming in a swim-tunnel respirometer at 20°C. Oxygen consumption ( Mo2) of bluefin (7.1–9.4 kg) ranged from 235 ± 38 mg kg-1 h-1 at 0.85 body length (BL) s-1 to 498 ± 55 mg kg-1 h-1 at 1.80 …

A Novel Lux Operon In The Cryptically Bioluminescent Fish Pathogen Vibrio Salmonicida Is Associated With Virulence, Eric J. Nelson, Hege S. Tunsjø, Pat M. Fidopiastis, Henning Sørum, Edward G. Ruby Mar 2007

A Novel Lux Operon In The Cryptically Bioluminescent Fish Pathogen Vibrio Salmonicida Is Associated With Virulence, Eric J. Nelson, Hege S. Tunsjø, Pat M. Fidopiastis, Henning Sørum, Edward G. Ruby

Biological Sciences

The cold-water-fish pathogen Vibrio salmonicida expresses a functional bacterial luciferase but produces insufficient levels of its aliphatic-aldehyde substrate to be detectably luminous in culture. Our goals were to (i) better explain this cryptic bioluminescence phenotype through molecular characterization of the lux operon and (ii) test whether the bioluminescence gene cluster is associated with virulence. Cloning and sequencing of the V. salmonicida lux operon revealed that homologs of all of the genes required for luminescence are present: luxAB (luciferase) and luxCDE (aliphatic-aldehyde synthesis). The arrangement and sequence of these structural lux genes are conserved compared to those in related species of …

Genome Size Evolution In Relation To Leaf Strategy And Metabolic Rates Revisited, Jeremy M. Beaulieu, Ilia J. Leitch, Charles A. Knight Mar 2007

Genome Size Evolution In Relation To Leaf Strategy And Metabolic Rates Revisited, Jeremy M. Beaulieu, Ilia J. Leitch, Charles A. Knight

Biological Sciences

• Background and AimsIt has been proposed that having too much DNA may carry physiological consequences for plants. The strong correlation between DNA content, cell size and cell division rate could lead to predictable morphological variation in plants, including a negative relationship with leaf mass per unit area (LMA). In addition, the possible increased demand for resources in species with high DNA content may have downstream effects on maximal metabolic efficiency, including decreased metabolic rates.

• MethodsTests were made for genome size-dependent variation in LMA and metabolic rates (mass-based photosynthetic rate and dark respiration rate) using our own …
