Managing Preservation Obligations After The 2006 Federal E-Discovery Amendments, Thomas Y. Allman

The 2006 E-Discovery Amendments to the Federal Rules of Civil Procedure (2006 Amendments or the Amendments) do not directly address the onset or scope of preservation obligations. As noted in the September 2005 Report of the Standing Committee of the Judicial Conference recommending adoption of the 2006 Amendments, preservation obligations “arise from independent sources of law” and are dependent upon “the substantive law of each jurisdiction.” However, the Amendments have a major impact on how parties must analyze and execute preservation obligations involving electronically stored information (“ESI”).

Self-Monitoring Differences In Best Friendship Maintenance: Exit, Voice, Loyalty, And Neglect, Sarah Danielle Sommerfeld

The relationship between self-monitoring and maintenance strategies for best friendships was examined in this investigation. The 25-item Self-Monitoring Scale was used to assess participants’ self-monitoring type. Rusbult’s exit-voice-loyalty-neglect measure was used to assess participants’ maintenance strategies. It was predicted that high self-monitors more than low self-monitors would engage in destructive maintenance strategies, and low self-monitors more than high self-monitors would engage in constructive maintenance strategies. High self-monitors did use neglect, a destructive and passive strategy, more than did low self-monitors. The fight to save Appalachia from absolute devastation by mining companies has, thus far, been a losing battle. As the photographs recently published in Vanity Fair and Audubon so vividly proclaim, Appalachia—the great hidden forest of the United States—is still being laid to waste, mile by mile, despite the work of valiant activists. Although there have been numerous obstacles, the primary reason for failure is wrapped up in the image of Appalachia in the public consciousness. This single hurdle—the image of Appalachia—stands behind, buttressing numerous obstacles to ending mountain top removal mining.

In 2005, an article in the highly influential journal Science reported that roughly 20% of human genes are patented. This figure has been widely cited and at times over-interpreted. For example, a popular science fiction author warns the public that their bodies are "owned" by someone else. A bill was introduced in Congress in 2007 that would essentially seek to ban the patenting of DNA. The arrest, trial, and execution of John Brown in the fall of 1859 came at a critical moment in United State history. According to historian David S. While Mencken's description is doubtless an exaggeration, measured by the public interest it generated, the Hauptmann trial stands with the O. J. Simpson and Scopes trials as among the most famous trials of the twentieth century. From June through September of 1692, nineteen men and women, all having been convicted of witchcraft, were carted to Gallows Hill, a barren slope near Salem Village, for hanging. Another man of over eighty years was pressed to death under heavy stones for refusing to submit to a trial on witchcraft charges. Hundreds of others faced accusations of witchcraft. Two processes are incorporated into a new model for transmissible prion diseases. These are general incidence for the lengthening process of infectious polymers attaching to and converting noninfectious monomers, and the joining of two polymers to form one longer polymer. The model gives rise to a system of three ordinary differential equations, which is shown to exhibit threshold behavior dependent on the value of the parameter combination giving the basic reproduction number R0. Avian influenza virus stocks (A/chicken/Iran/259/1998/(H9N2)) were propagated in the allantoic cavities of 10-day-old embryonated chicken eggs. The harvested suspension was concentrated by polyethylene glycol 6000. Concentrated samples were layered onto sucrose gradient (30%-60%). Both hemagglutinin and neuraminidase were solubilized from purified viruses with Triton X-100 across 30% sucrose gradient. NA was isolated from HA and other viral proteins by affinity chromatography on N-(p-aminophenyl)oxamic acid. Fractions that had high NA activity and did not show HA activity were pooled and analyzed by neuraminidase inhibition and SDS-PAGE. In this study, 130 Escherichia coli strains isolated from 306 cattle and sheep fecal samples were studied for their resistance to 10 antibiotics, verotoxin production, and hemolyzation. The antibiotic resistance rates of the E. coli strains were as follows: tetracycline, 51.6%; streptomycin, 24.2%; ampicillin, 13.1%; amoxicillin/clavulanic acid, 5.2%; gentamycin, 4.6%; ciprofloxacin, 4.6%; trimethoprim-sulfamethoxazole, 4.3%; cefotaxime, 0.7%. None of the strains were resistant to cefepime or ceftazidime. Of all the antibiotics tested, only resistance to streptomycin was higher in the strains isolated from cattle than in the sheep strains (P = 0.043). Differences in the protein and plasmid content of 2 Lactococcus lactis strains, L. lactis subsp. lactis LL52 and L. lactis subsp. cremoris LC79, under the stresses of high and low temperature, osmotic shock, and low pH were determined. We identified 3 new proteins with molecular masses of 16.0, 29.4, and 45.0 kDa as high temperature stress response specific in strain LL52. High temperature stress did not cause any changes in the protein content of strain LC79. The objectives of this study were to isolate and identify Mycoplasma gallisepticum in quails with clinical and pathological signs of chronic respiratory disease (CRD), and to compare the sensitivity and specificity of commonly used serological tests that are used for the detection of M. gallisepticum antibodies. The study included 20 Japanese quails 10-weeks old with respiratory distress, nasal discharge, mortality and swollen infraorbital sinuses. There was no bacteriological agent isolated. The Seroprevalence Of Listeria Monocytogenes In Sport Horses Bred In Ankara Province, H. Zeynep Güçlü, K. Zafer Karaer, Cahi̇t Babür, Selçuk Kiliç

The aim of this study was to determine the seroprevalence of Listeria monocytogenes in horses bred for sport in the province of Ankara. Sera collected from 100 clinically healthy horses were tested for the presence of L. monocytogenes antibodies using the Osebold absorption test. Agglutination titers >= 1:100 were accepted as positive results and a seropositivity rate was determined. Of the 100 serum samples, 62 were seropositive for L. monocytogenes antibodies detected at dilutions of 1:100 (n = 29, 46.7%), 1:200 (n = 31, 50%), and 1:400 (n = 2, 3.2%).

Microscopic and macroscopic structures of accessory adrenal nodules in Caspian miniature horses (5 males and 5 females) were studied. The accessory adrenal nodules were round or oval and yellow to red. Their maximum diameters varied from 0.1 to 0.5 cm. These nodules were found near the kidneys and adrenal glands, but they were in close contact with the adrenal gland. The accessory adrenal nodules were similar to the adrenal cortex microscopically, and from the outer layer to the inner layer they contained glomerulosa, intermedia, and fasciculata. Effect Of Feeding Supplemental Tallow On The Performance Of Lactating Nili-Ravi Buffaloes, Haq Nawaz, Muhammad Yaqoob, Muhammad Abdullah

In order to determine the feeding value of tallow for lactating Nili-Ravi buffaloes, 4 buffaloes were fed 0%, 2%, 4%, or 6% tallow in a 4 X 4 Latin square experiment. The intakes of dry matter (DM), organic matter (OM), crude protein (CP), acid detergent fiber (ADF), and neutral detergent fiber (NDF) decreased (P < 0.01), but the intakes of ether extract (EE) (P < 0.01) and digestible energy (DE) (P < 0.05) increased with increasing levels of tallow in the diets. Intake of net energy for lactation (NE_L) did not differ (P < 0.01) with varying levels of supplemental tallow. Daily milk yield increased (P < 0.01) from 11.00 to 13.2 kg/day. Production of 4% fat corrected milk (FCM), solid corrected milk (SCM), and energy corrected milk (ECM) increased quadratically (P < 0.05) with the increasing level of tallow in the diets. Milk fat content and total milk fat increased linearly (P < 0.01) and quadratically (P < 0.05), respectively, as the level of tallow in the diet increased. There was no difference in protein and lactose content due to feeding tallow. Total solid content increased quadratically (P < 0.05) from 16.45% to 17.67% but solid not fat (SNF) percentages did not vary with varying levels of tallow. The gross energy (GE) of the milk increased from 1096 to 1160 Kcal/kg (P < 0.01) with increasing levels of tallow in the diets. Energetic efficiency of milk production improved in a quadratic (P < 0.05) manner with 2%, 4%, and 6% tallow, with the highest being 47.6% with 4% supplemental tallow. The proportion of C_{8:0} to C_{16:1} fatty acids (FA) decreased from 53.66% to 35.52%, whereas the concentration of C_{18:0} to C_{20:0} increased (44.93% to 62.84%) in the milk fat of buffaloes fed diets containing different levels of tallow. Gains in body weight (BW) were higher (P < 0.05) in buffaloes fed diets containing supplemental tallow as compared to those fed the control diet. This study suggests that tallow up to 6% of diet DM is a suitable fat supplement as an economical energy source for lactating buffaloes.

A polymerase chain reaction - restriction fragment length polymorphism test was performed on DNA samples extracted from blood samples of 256 Holstein Friesian crossbred and 112 from Jersey crossbred bulls/bull calves to detect allelic frequency of the bovine kappa-casein and beta-lactoglobulin gene responsible for milk production traits. A 350 bp fragment of kappa-casein and a 247 bp fragment of beta-lactoglobulin were amplified and digested with Hinf I and Hae III restriction enzymes, respectively. An 18-month-old native goat with 25 kg bodyweight submitted to the Department of Anatomy from a farm for use in student practicals was diagnosed with cryptorchidism. In macroscopical examination, the cryptorchid testis was near the left kidney. The cryptorchid testis was small, firm, and 31 x 30 mm in size and weighed 11 g, while the right testis, located in the scrotum, was 53 x 29 mm in size and weighed 37 g. Microscopically there was tubular hypoplasia and the capsule of the testis (tunica albuginea) was thicker in the left cryptorchid testis. Cryptorchidism is seen more often in horses, …

In a 12-week feeding trial, the effect of 2 algae meals (Ulva rigida or Cystoseira barbata) on feed intake, growth, and nutrient utilization of juvenile Nile tilapia, Oreochromis niloticus, was investigated. This was the first attempt to utilize Cystoseira barbata as a feed supplement for Nile tilapia. The fish were fed to apparent satiation with formulated diets supplemented with various levels of Ulva meal (5%, 10%, or 15%) or Cystoseira meal (5%, 10%, or 15%).
