The right of publicity gives people the right to control the use of their name and likeness for commercial purposes. For years, courts have struggled to make sense of two dimensions of this right - what it means to use a name or likeness commercially, and what aspect of a person's likeness are protected against appropriation. In the absence of any clear theoretical foundation for the right of publicity, the meanings of these terms have steadily swelled, to the point at which virtually any use that brings financial benefit to someone by referencing an individual qualifies as a violation of …

Evaluation Of Montana's Hiv Prevention Social Marketing Campaign: A Descriptive Study, Helen Catherine Burnside

The purpose of this descriptive study was to evaluate Montana’s 2006 HIV Prevention Social Marketing Campaign in two intervention communities: Flathead and Silver-Bow Counties and one comparison community: Lewis and Clark County. The intervention began in March 2006, and data was collected in the intervention communities for the first four months of the campaign and included four areas. First, HIV testing data was evaluated throughout the campaign to assess the number of individual’s receiving HIV counseling and testing in the intervention communities. Second, a survey quantitatively evaluated the campaign among individuals receiving an HIV test at the Flathead and Silver …

The purpose of this study is to record and explain choices made in the direction of Ghosts by Henrik Ibsen. This creative thesis describes the director's process and includes a production journal, research and analysis, production goals and schedules, and a visual video recording of the production in performance. The goal of this process documentation is to provide the choices made through collaboration and authenticate those choices up to performances.
Ghosts was performed in the Bertha Martin Theatre located within the StrayerWood building as part of Theatre UNI's 2003-2004 season. Henrik Ibsen, the playwright, penned a domestic tale about a …

Development Lending And The Community Reinvestment Act, Keith N. Hylton

In a series of articles on community-development lending published in the late 1990s, I criticized the Community Reinvestment Act (CRA).4 Criticizing the CRA, however, was not the sole focus of these articles. I offered a theoretical framework for analyzing the statute that I hoped would be useful to scholars who attempted either to justify or to condemn the statute. I also offered alternatives to the current approach, pointing especially toward the subsidization of economic-development efforts.
Looking back, it appears that I underestimated the degree to which the political controversy surrounding the CRA would color the treatment some later scholars …

Bible Beater/Bra Burner: Liminal Experiences of Christian & Feminist identity explores the relationship between Christian and feminist identity. Through ethnography and ethnodrama, this project examines the ways fifteen women in eastern Iowa negotiate the relationship between Christianity and feminism in their daily lives, the ways language functions for and against these performances of self, and the ways staged performance can be used to approach these specific issues of women's identity. The ethnodrama written from interview and autoethnographic data, Bible Beater/Bra Burner, was performed in the University of Northern Iowa Interpreters Theatre on April 20-22, 2006. For over thirty years, repeat players on the defense side of tort litigation have undertaken to "reform" tort doctrine in their favor. Initially, these efforts consisted of ad hoc efforts to address a series of "crises," primarily in terms of the cost and availability of liability insurance. In the 1980s, the tort reform movement began to develop a more permanent institutionalized approach to the push for "reform." Not surprisingly, there has been considerable debate about the goals of this movement, the fairness or efficiency of the specific doctrinal reforms it seeks, and the methods it uses. Copyright, Commodification, And Culture: Locating The Public Domain, Julie E. Cohen
Georgetown Law Faculty Publications and Other Works
The relationship between increased commodification and the public domain in copyright law is the subject of considerable controversy, both political and theoretical. The paper argues that beliefs about what legal definition the public domain requires depend crucially on implicit preconceptions about what a public domain is. When considered in broader historical context, the term public domain has a specific set of denotative and connotative meanings that constitute the artistic, intellectual, and informational public domain as a geographically separate place, portions of which are presumptively eligible for privatization. This idea meshes well with the current push toward commodification in copyright. The …

This dissertation examines the use of silence in Henry James's novel The Ambassadors. James uses silence rich in meaning to portray the protagonist Lewis Lambert Strether's unfolding consciousness. James creates different types of silences that reflect a shift from the spoken or written word to alternate symbol systems. James's novel perches on the threshold of modernity, as his work reflects the ideas of a line of thinkers extending back from James and his brother, William, to Ralph Waldo Emerson, Sampson Reed, and Emanuel Swedenborg. At the same time, the novel draws on the contemporary ideas of Charles Darwin, prefigures …

The purpose of this quantitative descriptive research study was to investigate Enrolled Nurses' attitudes, intentions and behaviour in relation to independent medication administration (IMA). This research was necessary as a significant number of Enrolled Nurses (ENs) are now able to administer medications up to Schedule Four level, without supervision when they have completed a medication administration programme (MAP). This change in the scope of practice for the EN will eventually be introduced nationally as recommended by the National Review of Nursing Education (2002). Urinary catheterisation remains a common procedure conducted by nurses often as a result of autonomous decision making. This research aimed to identify and describe the lived experience of nurses' decision making processes regarding the insertion and removal of urinary catheters. The research was believed to be important as there is a myriad of literature on what is best practice but very little on what is actually taking place in nursing practice. A qualitative phenomenological study design was chosen, where nurse participants were interviewed using open-ended questions.
