Urinary catheterisation remains a common procedure conducted by nurses often as a result of autonomous decision making. This research aimed to identify and describe the lived experience of nurses' decision making processes regarding the insertion and removal of urinary catheters. The research was believed to be important as there is a myriad of literature on what is best practice but very little on what is actually taking place in nursing practice. A qualitative phenomenological study design was chosen, where nurse participants were interviewed using open-ended questions. Modern aesthetics regards sight and hearing as the only senses which were able to produce art. Touch, smell and taste might offer pleasant stimuli, but can never achieve the status of art objects. What are the arguments for this rejection, and are they still sustainable? Disinterestedness, a comparatively recent concept in aesthetics, is commonly held to be one of the characteristics of an appropriate response to art, but can be understood in a number of senses. Three varieties are distinguished: a strong form which confines attention exclusively to the internal relations of the work of art; a moderate variety which links internal and external features of the work but solely within the cognitive domain; and a weak form which permits the appreciator to draw on a wide range of external referents but proscribes purely idiosyncratic responses. This note argues that the structure of existing FCC and FTC regulatory regimes is not effective in addressing challenges posed by certain types of product placement. Thus, a specific disclosure requirement targeting non-visual product placement is needed. Part I presents an overview of the existing federal regulatory structure governing product placement, and the current arguments for and against affirmative disclosure requirements. Parts II and III identify the various categories of product placement and argue that non-visual placement presents unique challenges that are absent in other categories of product placement. Uncertainty over conduct which results in disqualification can be costly and the laws relating to disqualification may be widely known but their application is difficult. Rigid application of irrebuttable presumptions and imputation of knowledge may result in disqualification of a client’s chosen counsel. Even if an attorney succeeds in opposing a motion to disqualify, the resulting costs and delay may damage the attorney-client relationship more than if the attorney had simply declined the representation. Motions to disqualify usually arise from conflicts of interest involving former clients. The law of disqualification, in this instance, is well developed and largely based on …

It is well established that, absent some very special circumstances, agreements on price or certain other terms of trade by otherwise competing entities (i.e., "horizontal agreements") are unlawful per se under the Sherman Act. In practical effect, once the fact of the horizontal agreement has been established, an adverse impact on competition is presumed, and therefore that the plaintiff is spared the burden of proving such an impact. The principal task for plaintiffs in such cases, therefore, is establishing the existence of an agreement.

This symposium piece explores the current state of our cities with a particular emphasis on political power, education and housing, and examines whether our move away from integration and towards diversity has been a trade worth making. Despite the transformation of most of the largest cities to majority-minority status, the latest data indicate that our housing remains deeply segregated, and urban schools deeply troubled, and in many instances, whites have been able to retain political power. The increased emphasis on diversity has not translated into the expected multicultural renaissance. The essay also explores the emerging issues relating to the ascendancy …

Upon inspection of the standard collegiate and professional bassoon repertoire in the United States, one observes that most of the solo and chamber works for the instrument are of European or North American origin. While works of Latin American origin have gained a small foothold in the bassoon repertory, it is clear that there is a wealth of new music for bassoon that is largely neglected by North American performers. The article examines the use of Peoples' Tribunals in seeking access to justice where none has been possible through more formal methods. It uses as illustration the Women's International War Crimes Tribunal that sought justice for the so-called comfort women, the primarily Asian women who were subjected to sexual slavery by the Japanese military before and during World War Two. The article briefly recounts the fate of the comfort women and then considers the legal and practical obstacles they faced in accessing justice at the end of the War. Critical review of the existing literature on African women writers clearly shows that nowhere is the question of writing as a cultural negotiation posed, discussed or much less addressed. This is a lacuna that this dissertation addresses for the first time by proposing a re-reading of the selected works of Ama Ata Aidoo, Mariama Bâ and Marie NDiaye through the new prism of writing as part of cultural negotiation. The aim of this study is to illustrate the purpose and potential of theatre that promotes a proto-environmental agenda, or Green Theatre, in re-orienting Western behavior and mores in a direction that creates positive socio-environmental change. In correlation, this dissertation will examine the objectives and performance modes of several educational and professional theatre entities that house a distinctly unique Green agenda. The primary performances featured will include Peter Schumann’s Bread and Puppet Theatre, Blue Man Group’s Tubes, performances by Koko the signing lowland gorilla, and Playmakers of Baton Rouge’s production of Habitat Cats.

Bright Sheng was born in Shanghai, China, in 1955, and became one of America’s leading composers in the twentieth-century. Bright Sheng’s orchestral music, opera and chamber music is frequently performed throughout the world. His musical language combines Chinese folk music and Western techniques--the meeting of East and West. This essay will discuss Bright Sheng’s The Stream Flows for solo violin (1990), Three Fantasies for Violin and Piano (2006), String Quartet No.3 (1993), and String Quartet No.4 Silent Tempo (2000). This study addresses a gap in scholarship on leadership styles in the Deaf community. There is an invisible style of leadership differing from the mainstream culture not previously addressed in the literature at any depth. My study is composed of three interlocking parts; the practice of anthropology: fieldwork, analysis, and presentation. The foundation for my fieldwork, is an "archeology of the structure of the perceived world" (Merleau-Ponty), using the holding environment of the rehearsal process and the structural process of an acting technique called Del-Sign. On June 27, 2005, the US Supreme Court announced its much-awaited decision in MGM Studios, Inc. v. Grokster Ltd. A few months after this, the Federal Court of Australia handed down its decision at first instance in relation to parallel litigation in that country concerning the KaZaa file sharing system. Both decisions repay careful consideration of the way in which the respective courts have addressed the relationship between the protection of authors' rights and the advent of new technologies, particularly in relation to peer-to-peer networks.
