Defamation, Anti-Slapp Legislation, And The Blogosphere: New Solutions For An Old Problem, Sean P. Trende
Duquesne Law Review
Because of the importance of the blogosphere as an emerging medium, this Article suggests that Congress should adopt a federal statute to protect speakers from "Strategic Lawsuits Against Public Participation," or SLAPPs. Federal anti-SLAPP legislation could serve as a powerful deterrent against groundless suits. In support of this thesis, the Article begins by exploring the growth of the internet and its recent transformation into a medium dominated by individuals. Part II analyzes the current legal framework, including a brief overview of defamation law, and contains an analysis of previous legal attempts to fit the internet into various defamation frameworks. Part …
Justice Michael A. Musmanno And Obscenity (1956-1967), Joel Fishman
Justice Michael A. Musmanno And Obscenity (1956-1967), Joel Fishman
Duquesne Law Review
From 1957 to 1973, the United States Supreme Court was in the process of articulating and refining the standard by which a literary or artistic work would be classified as "obscene." State supreme courts were likewise addressing this issue under their own constitutions and statutes. In Pennsylvania, Justice Michael A. Musmanno struggled against United States Supreme Court opinions that, in his opinion, opened the door to the spread of all types of obscene, lewd, and immoral materials throughout society. Justice Musmanno's opinions on this matter were consistent throughout this time of change, and they frequently reflected his views on American …

Incest And Empire In The Faerie Queene, Kent Lehnhof
Incest And Empire In The Faerie Queene, Kent Lehnhof
English Faculty Articles and Research
"When considered in the context of Elizabeth's effort to silence all discussion of incest, Edmund Spenser's courtly epic aiming to cultivate favor with the monarch looks like a disastrous miscalculation, for incest appears throughout The Faerie Queene. Indeed, incest sits at the center (both literally and figuratively) of the Book of Chastity, the very book wherein Spenser encourages Elizabeth 'in mirrours more then one her selfe to see.' In the present essay, I investigate the apparently illogical and impolitic prominence afforded to incest in book three of The Faerie Queene, ultimately arguing that the imperialist logic underpinning the epic is …

Intimate And Transparent Production Of Space, Thomas Fowler, Iv
Architecture
This paper illustrates the design work from an integrated third-year Architecture Design Studio and a Professional Practice (a.k.a., project constructability) Studio. There are two parts to this paper. The first part shows how students were involved in a collaborative interdisciplinary project with New Media Arts students in the Liberal Arts Department on campus. Students in collaborative teams designed and constructed a temporary pneumatic structure to house a virtually interactive technology called “Intimate Transactions”. Lessons learned from this design build collaboration in working with the inventor of this technology system, along with the reading of a range of essays on new …
"Infringed" Versus "Infringing": Different Interpretations Of The Word "Work" And The Effect On The Deterrence Goal Of Copyright Law, Sarah A. Zawada
"Infringed" Versus "Infringing": Different Interpretations Of The Word "Work" And The Effect On The Deterrence Goal Of Copyright Law, Sarah A. Zawada
Marquette Intellectual Property Law Review
One of the key elements that courts use to determine an appropriate statutory damage award in a copyright infringement case is the number of infringements of a copyright. How does a court determine the number of infringements when one infringing article has been printed six times in over one hundred copies of a magazine? Before the Copyright Act of 1976 went into effect, many courts adhered to the "multiplicity doctrine" and would have awarded statutory damages in the above scenarios for each of the six times that the infringing article was printed or the infringing song was played. Post-1976, however, …

The Male Dancer In The Middle East And Central Asia, Anthony Shay
The Male Dancer In The Middle East And Central Asia, Anthony Shay
Pomona Faculty Publications and Research
"That night ‘Abdi Jan’s troupe had been called so that the harem occupants could watch the show. Of course, you remember ‘Abdi well. Let me, nonetheless, give you a description of his looks. He was a lad of about twelve or thirteen, with large black eyes, languid and incredibly beautiful and attractive. His face was tanned and good-looking, his lips crimson, and his hair black and thick. Renowned throughout the town, the boy had a thousand adoring lovers. Being a dancer, however, he was unworthy of being anyone’s beloved." (Taj Al-Sultana 1993, 163) Within this quotation the reader may find …
