Enhancing Decision Analysis Models With Web Agents, Jeffrey M. Keisler, Wei Zhang Nov 2006

Enhancing Decision Analysis Models With Web Agents, Jeffrey M. Keisler, Wei Zhang

Management Science and Information Systems Faculty Publication Series

Decision analysis (DA) can be enhanced by taking advantage of vast, real-time data available from the World Wide Web (the Web). Human intensive DA models such as influence diagrams may be linked with electronic agents that actively utilize the Web to generate data. At the time of modeling, results of agent actions are treated as stochastic events. Probability distributions are assessed conditioned on the range of outcomes for these events. When the DA model is evaluated the agent performs actions defined by the model in terms of the state of nature. Structuring links for these models presents technical challenges including …

Unequal Rights: The Fourteenth Amendment And De Facto Parentage, Adam K. Ake Nov 2006

Unequal Rights: The Fourteenth Amendment And De Facto Parentage, Adam K. Ake

Washington Law Review

Faced with an unprecedented number of children born into non-traditional family arrangements, courts across the country are struggling to preserve relationships between same-sex partners and their partners' biological children after those non-marital relationships end. This Comment argues that the Fourteenth Amendment limits the extent to which courts can intrude on the parental rights of a natural or adoptive parent in an attempt to provide remedies for non-parent partners, who are usually legal strangers to the children under applicable statutory schemes. U.S. Supreme Court jurisprudence implicitly recognizes hierarchical tiers of parental rights. Under this framework natural and adoptive parents have superior …

Insurers, Illusions Of Judgment & Litigation, Chris Guthrie, Jeffrey J. Rachlinski Nov 2006

Insurers, Illusions Of Judgment & Litigation, Chris Guthrie, Jeffrey J. Rachlinski

Vanderbilt Law Review

Insurers play a critical role in the civil justice system. By providing liability insurance to parties who would otherwise be untenable as defendants, insurers make litigation possible. Once litigation materializes, insurers provide representation, pay legal fees, and often play a central role in resolving disputes through settlement or adjudication. In this paper, we explore empirically how these key litigation players make important decisions in the litigation process, like evaluating a case, deciding whether to settle, and if so, on what terms. We find that insurers, though not entirely immune to the effects of cognitive illusions that have been shown to …

Long-Run Risk-Adjusted Performance Of Ipos In The Life Insurance Industry, Lal Chugh, Joseph W. Meador Nov 2006

Long-Run Risk-Adjusted Performance Of Ipos In The Life Insurance Industry, Lal Chugh, Joseph W. Meador

Financial Services Forum Publications

The pace of demutualization among major U.S. life insurance companies increased sharply after the mid-1990s. Five of the fifteen largest U.S. life insurers demutualized between 1997 and 2001, and the largest, Metropolitan Life Insurance Company, demutualized in 2000. Ten other major life insurance companies, with total assets in 2003 of $775 billion, demutualized over the same time period. The regulatory and competitive environment in the life insurance industry has changed dramatically in recent years. These changes include: (1) the fact that consumers have shown declining interest in the traditional life insurance products of risk bearing and transfer, while revenues from …

Auditing Executive Discretion, Mariano-Florentino Cuellar Nov 2006

Auditing Executive Discretion, Mariano-Florentino Cuellar

Notre Dame Law Review

Executive branch officials routinely make thousands of decisions affecting public security and welfare. While it is rare that such discretionary decisions are entirely immune from some kind of judicial review, the courts' role is often so circumscribed or deferential that in some domains the probability of uncovering problems through such review almost certainly falls close to zero. The resulting amount of executive discretion carries considerable risks along with rewards. Some discretionary decisions undoubtedly benefit from the speed and flexibility associated with limits on judicial review. Yet judicial review's evisceration as a tool to restrain certain forms of discretion also makes …

The Role Of Child Emotional Responsiveness And Maternal Negative Emotion Expression In Children’S Coping Strategy Use, Rebecca Goodvin, Gustavo Carlo, Julia C. Torquati

Department of Psychology: Faculty Publications

This study examined the additive and interactive effects of children’s trait vicarious emotional responsiveness and maternal negative emotion expression on children’s use of coping strategies. Ninety-five children (mean age = 5.87 years) and their mothers and teachers participated in the study. The mothers reported on their own negative emotion expression and the children’s empathic concern and personal distress tendencies. The mothers and teachers reported on the children’s use of avoidant, support-seeking, and aggressive-venting coping strategies. Empathic concern was positively associated with the children’s use of support seeking and negatively associated with the children’s use of aggressive venting, whereas personal distress …

Beholding The Beauty Of Self: The Psychological Integration Of The Afrocentric-Self Among African-American Females Socialized In A Eurocentric Aesthetic, Donna Lynn Cook Phd Nov 2006

Beholding The Beauty Of Self: The Psychological Integration Of The Afrocentric-Self Among African-American Females Socialized In A Eurocentric Aesthetic, Donna Lynn Cook Phd

Dissertations

Self-esteem and body image disturbances prominently figure into many physical and psychological health disorders such as depression, eating disorders, anxiety disorders, and chemical dependency. In Euro-American culture, media images of femininity and physical attractiveness reinforce generally held perceptions of the idealized female beauty as tall, white, slender, and often blond and blue eyed. The physical morphology of African-American women does not genetically "fit" this westernized standard of beauty with implications for their mental health. The socialization of African-American women in a culture that embraces a different ethnic standard of beauty influences their perceptions of how physically attractive they see themselves. …

What Are They Saying: Voices From The Inner City? Lived Experience Of Inner City African American Adolescents With Asthma, Othello Childress Phd

Dissertations

The purpose of this study was to investigate the lived experience of African-American adolescents with asthma who reside in an inner city community. The research in this area of interest is sparse, yet the morbidity and mortality rates related to asthma within the African-American population are greater than the general population. This study offers the experience of living with asthma from the perspective of the young African-American adolescent. Using phenomenological methodology, the nurse researcher selected 13 African-American adolescents; aged 12 to 15, who reside and attend middle school in the inner city. All of the participants had a confirmed medical …

Security In Pervasive Computing: Current Status And Open Issues, Munirul Haque, Sheikh Iqbal Ahamed

Mathematics, Statistics and Computer Science Faculty Research and Publications

Million of wireless device users are ever on the move, becoming more dependent on their PDAs, smart phones, and other handheld devices. With the advancement of pervasive computing, new and unique capabilities are available to aid mobile societies. The wireless nature of these devices has fostered a new era of mobility. Thousands of pervasive devices are able to arbitrarily join and leave a network, creating a nomadic environment known as a pervasive ad hoc network. However, mobile devices have vulnerabilities, and some are proving to be challenging. Security in pervasive computing is the most critical challenge. Security is needed to …

Authority With The Force Of Law: Statutory Interpretation As Policymaking In Gonzales V. Oregon, Alfred J. Ludwig Nov 2006

Authority With The Force Of Law: Statutory Interpretation As Policymaking In Gonzales V. Oregon, Alfred J. Ludwig

Missouri Law Review

The Oregon Death with Dignity Act was enacted in 1994 by the State of Oregon to allow physicians to aid terminally ill patients who wished to end their lives in a controlled manner. In 2001, Attorney General John Ashcroft issued an Interpretive Rule stating that prescribing a controlled substance for the purpose of physician-assisted suicide would not qualify as a requisite "legitimate medical purpose" under the federal Controlled Substances Act, and that any physician who prescribed a controlled substance for the purpose of ending a patient's life faced deregistration. In Gonzales v. Oregon, the Supreme Court of the United States …

Psychology And Bapcpa: Enhanced Disclosure And Emotion, Richard L. Wiener, Michael Holtje, Ryan J. Winter, Jason A. Cantone

Missouri Law Review

This article describes a program of research that applies social analytic jurisprudence to test some of the assumptions in consumer bankruptcy law and policy.4 Our work first seeks to describe selected provisions from the newly enacted bankruptcy amendments that pertain to enhanced disclosure requirements, and then to locate some of the behavioral assumptions implicit in these provisions. 5 Next, we assess the accuracy of these assumptions based on an experiment that we conducted looking at a simulated online shopping trip that we constructed specifically to test the effects of enhanced disclosure

Foreword, Michelle Arnopol Cecil Nov 2006

Foreword, Michelle Arnopol Cecil

Missouri Law Review

With the tumultuous period after the enactment of BAPCPA as our backdrop, hundreds of academics, practitioners, and judges gathered together for a two-day symposium to explore the positive and negative aspects of bankruptcy reform from a variety of interdisciplinary perspectives. This volume of the Missouri Law Review is devoted almost exclusively to that symposium. Not only does it include the ten participants' written scholarship that emerged from that extraordinary setting, during which we all benefitted tremendously from the input of others who had thought about, written about, and worked with the provisions of BAPCPA, but it also contains a fascinating …

Self-Exclusion And The Compulsive Gambler: The House Shouldn't Always Win, Justin E. Bauer Nov 2006

Self-Exclusion And The Compulsive Gambler: The House Shouldn't Always Win, Justin E. Bauer

Northern Illinois University Law Review

This Comment examines the law revolving around a compulsive gambler's ability to exclude himself from a casino. While the current state of the law in many jurisdictions properly allows a person to place himself on a self-exclusion list," in an effort to be barred from entering into a casino, the law provides no remedy for the self-excluded gambler in the event that the casino negligently, deliberately, or even recklessly allows the self-excluded person to gamble. This comment calls for a change to that jurisprudence and invites the judiciary to allow a self-excluded gambler to receive redress from the casino that …

Proportional Process Conflict In Undergraduate Cooperative Learning Groups, Glenna K. Dunn Nov 2006

Proportional Process Conflict In Undergraduate Cooperative Learning Groups, Glenna K. Dunn

Doctoral Dissertations and Projects

The first purpose of this research was to determine if minimal training on the concepts and effects of relational, task, and process conflict would have an effect on proportional process conflict (Jehn, 2000) in undergraduate cooperative learning groups. Proportional process conflict is explained as the amount of process conflict in proportion to relational and task conflict and to the overall amount of conflict within the group. The second purpose was to increase knowledge about the cultural patterns and perspectives of undergraduate cooperative learning groups. The sample consisted of 68 undergraduate students from four classes of the same course at a …
