The Effects Of The Kyoto Protocol On Taiwan, Yi-Yuan William Su Jan 2006

The Effects Of The Kyoto Protocol On Taiwan, Yi-Yuan William Su

PEEL Alumni Scholarship

Both the UNFCCC and the Kyoto Protocol, like many international agreements, limit participation in negotiations and ratification to “States.” After the General Assembly of the United Nations recognized the People’s Republic of China (“PRC”) as the only representative of China in 1971, most States severed diplomatic relations with Taiwan. As it is not recognized as a “State” pursuant to international treaty definitions, Taiwan faces a tremendous obstacle to participating in international organizations. For instance, it is typically excluded from negotiations and discussion in all meetings concerning multilateral environmental agreements.

Regulating Inheritable Genetic Modification Or Policing The Fertile Imagination?: A Feminist Response, Roxanne Mykitiuk, Isabel Karpin

Articles & Book Chapters

The past few years have seen an explosion of legislative activity around developments in genetics and assisted reproduction. In this chapter we examine recently passed legislation in Australia and Canada in the area of genetic modification technologies and reproductive genetics. We demonstrate that legislative control in this area has a twofold purpose. Less controversially it is aimed at providing limits to scientific innovation for the purpose of ensuring safe and ethical research and experimentation. More controversially it is concerned with what should be the proper "nature of reproduction' namely, how it happens (sexually), between whom (a man and a woman, …

E(Raced) Bodies In And Out Of Sight/Cite/Site, Wanda B. Knight Jan 2006

E(Raced) Bodies In And Out Of Sight/Cite/Site, Wanda B. Knight

Journal of Social Theory in Art Education

In the social sphere there are numerous unmarked and unexamined categories. Heterosexuality, maleness, and middle classness are some of the apparent ones. However, Whiteness is perhaps the foremost unmarked and thus unexamined category in art education. And like other unmarked categories, White is assumed to be the human norm. Moreover, when Whiteness goes unexamined, racial privilege associated with Whiteness goes unacknowledged. In this article, I use the metaphor of sight or vision to examine race through a framework of bodies. My focus is, specifically, on the preparation of the authoritative White body of the art teacher to teach in classrooms …

Infants’ Perception Of Rhythmic Patterns, Tonya R. Bergeson, Sandra E. Trehub Jan 2006

Infants’ Perception Of Rhythmic Patterns, Tonya R. Bergeson, Sandra E. Trehub

Scholarship and Professional Work - Communication

We explored 9-month-old infants perception of auditory temporal sequences in a series of three experiments. In Experiment 1, we presented some infants with tone sequences that were expected to induce a strongly metric framework and others with a sequence that was expected to induce a weakly metric framework or no such framework. Infants detected a change in the context of the former sequences but not in the latter sequence. In Experiment 2, infants listened to a tone sequence with temporal cues to duple or triple meter. Infants detected a change in the pattern with duple meter but not in the …

Cross-Examining The Brain: A Legal Analysis Of Neural Imaging For Credibility Impeachment, Charles N. W. Keckler Jan 2006

Cross-Examining The Brain: A Legal Analysis Of Neural Imaging For Credibility Impeachment, Charles N. W. Keckler

UC Law Journal

The last decade has seen remarkable progress in understanding ongoing psychological processes at the neurobiological level, progress that has been driven technologically by the spread of functional neuroimaging devices, especially magnetic resonance imaging, which have become the research tools of a theoretically sophisticated cognitive neuroscience. As this research turns to specification of the mental processes involved in interpersonal deception, the potential evidentiary use of material produced by devices for detecting deception, long stymied by the conceptual and legal limitations of the polygraph, must be reexamined. Although studies in this area are preliminary, they have not yet satisfied the foundational requirements …

Reconstructing Family Privacy, Suzanne A. Kim Jan 2006

Reconstructing Family Privacy, Suzanne A. Kim

UC Law Journal

Feminist legal theorists have long debated the proper role of privacy in women's lives. They have generally discredited the formalist division of society into "public" and "private" spheres to the extent that this model has historically permitted male abuse of women under the mantle of "domestic privacy." Indeed, the critique of the public-private dichotomy has been a central concern of feminist legal theory and the domestic violence movement. The critique has given rise to disputes among feminist legal scholars, however, about the utility and desirability of asserting women's rights claims on privacy grounds. While radical feminists reject privacy-based claims because …

The Experimental Use Exception To Patent Infringement: Do Universities Deserve Special Treatment?, Elizabeth A. Rowe Jan 2006

The Experimental Use Exception To Patent Infringement: Do Universities Deserve Special Treatment?, Elizabeth A. Rowe

UC Law Journal

The experimental use exception has recently come under attack by many who consider it too narrow. Much of this discontent with the doctrine has been spurred by a relatively recent Federal Circuit opinion, Madey v. Duke University, which makes clear that a research university does not receive immunity under the experimental use exception when its researchers engage in research or conduct experiments using patented inventions. To determine whether such a narrowing is proper, one must consider the overarching theoretical question about the tradeoff between protecting patentees' rights and maintaining incentives to innovate. In the context of the experimental use exception, …

Yuba River Accord: Lessons Learned In Moving From Controversy To Consensus, Hastings Law Journal Jan 2006

Yuba River Accord: Lessons Learned In Moving From Controversy To Consensus, Hastings Law Journal

UC Law Journal

Working with a broad coalition of seventeen agricultural, environmental, and fishery interests, including state and federal agencies, the Yuba County Water Agency has developed an innovative set of agreements with respect to instream flow requirements for the lower Yuba River. The proposed Yuba River Accord will resolve nearly fifteen years of controversy and litigation on this matter.

The challenges presented in Yuba County are similar to those presented in other California water districts. The agreement reached by the seventeen parties, all representing unique interests, exemplifies the communication, compromise, and leadership necessary to resolve longstanding water disputes in California. Representatives of …

Desalination In California: Should Ocean Waters Be Utilized To Produce Freshwater?, Hastings Law Journal Jan 2006

Desalination In California: Should Ocean Waters Be Utilized To Produce Freshwater?, Hastings Law Journal

UC Law Journal

According to the California Coastal Commission, more than twenty proposed desalination plants along the coast are in various stages of planning and permitting. Several desalination plants, including an experimental plant in Marin and a plant in Carlsbad, are coming online in the very near future. In addition, desalination is receiving substantial subsidies from the Department of Water Resources to encourage the development of new water supplies through desalination. This Panel discussed these issues, potential regulatory and legislative proposals, and the costs and benefits of desalination in California.

The Cardiomyocyte Cell Cycle, Pascal J. Lafontant Jan 2006

The Cardiomyocyte Cell Cycle, Pascal J. Lafontant

Biology Faculty publications

Many forms of cardiac disease are characterized by cardiomyocyte death due to necrosis, apoptosis and/or oncosis. Recently, the notion of promoting cardiac regeneration as a means to replace damaged heart tissue has engendered considerable interest. One approach to accomplish heart muscle regeneration entails promoting cardiomyocyte cell cycle activity in the surviving myocardium. Genetically modified mice have provided useful model systems to test the efficacy of specific pathways to promote cardiomyocyte proliferation in normal and diseased hearts. For example, expression of a heart-restricted dominant interfering version of p193 (an E3 ubiquitin ligase also known as Cul7) resulted in an induction of …

Mapping The Road From Childhood Trauma To Adult Somatization: The Role Of Attachment, Robert J. Waldinger, Marc S. Schulz, Arthur J. Barsky, David K. Ahern

Psychology Faculty Research and Scholarship

Objective: This study tested whether insecure attachment mediates the link between childhood trauma and adult somatization. Methods: A community sample of 101 couples completed self-report measures including the Relationship Scales Questionnaire, the Childhood Trauma Questionnaire, the Somatic Symptom Inventory, the Beck Depression Inventory, and the Conflict Tactics Scale. Results: Childhood trauma was associated with higher levels of somatization and insecure attachment. Insecure attachment style was also associated with higher levels of somatization. Controlling for age, income, and recent intimate partner violence, analyses showed that fearful attachment fully mediated the link between childhood trauma and somatization for women. …
