Genderless Marriage, Institutional Realities, And Judicial Elision, Monte Neil Stewart

Duke Journal of Constitutional Law & Public Policy

The stuff of the marriage debate is not static. That is particularly true in the courts, where the legal definition of marriage is debated most thoroughly and most consequentially. This article addresses one of the new arguments advanced in support of man/woman marriage now drawing judicial attention, the argument from social institutional studies. The social institutional argument is a sufficient answer to the variety of constitutional challenges leveled against man/woman marriage. Yet to date, the courts holding for genderless marriage have chosen (consciously it appears) to elude rather than engage argument.

Wildland Fire Effects On Visits And Visitors To The Bob Marshal Wilderness Complex, William T. Borrie, Stephen Mccool, Joshua G. Whitmore

Wildland fire can affect wilderness visits and scientific efforts to understand visitor relationships with wilderness places. Large-scale and long-lasting fires occurred in the Bob Marshall Wilderness Complex, Montana, in 2003. A study of visitors that year to monitor long-term trends in visit and visitor characteristics was repeated in 2004 to fully understand how the 2003 fires affected trend analysis. This article considers the question of how wildland fire changes the relationship people have with wilderness, particularly related to their visits and visitor attitudes toward fire management.

Antiestrogens Inhibit Xenoestrogen-Induced Brain Aromatase Activity But Do Not Prevent Xenoestrogen-Induced Feminization In Japanese Medaka (Oryzias Latipes), Adam J. Kuhl, Marius Brouwer

In fish, exposure to estrogen or estrogen-mimicking chemicals (xenoestrogeus)during a critical period of development can irreversibly invert sex differentiation. In medaka, a male-to-female reversal upon exposure to a xenoestrogen is accompanied by an increase in brain aromatase expression and activity. However, whether this increase is the direct cause of sex reversal is unknown. In this study we further examined the role brain aromatase plays in genesis of developmental abnormalities in response to endocrine-disrupting chemicals (EDCs). Further, the effects of a mixture of apparent antagonistic environmentally relevant EDCs on development were examined to determine if their combined actions could lessen each …

A large body of research has shown that a disproportionate number of elite youth male soccer players competing in age-segmented competition are born early in the selection year. The advantage of being born early in a cohort has been termed the "relative age effect''. Although there has been an exponential growth in women's soccer, few studies have examined the relative age effect in female youth soccer. The traditional social scientific method undervalues the role that cognitive processes play in human behavior and instead focuses on posited external causal forces, the most common of which is 'culture.' Normative models of rationality, on the other hand, often do suggest and emphasize cognitive reasoning strategies. What is lacking is a familiarity and understanding of what human beings actually do which is, ironically, something social scientists do know something about. Synthetic Studies Of 1,10-Phenanthroline Derivatives As Novel Catalysis Ligands And Their Application In Transition Metals Catalyzed Reactions, Son Duc Tran

The preparation of 1,10-phenanthroline derivatives entailed ring opening reactions of 1,10-phenanthroline epoxide as a key transformation, affording novelbidentate nitrogen ligands with new stereogenic centers in the 5- and 6-position. This research was concerned with (i) the epoxidation of 1,10-phen, (ii) epoxide ring opening reactions, (iii) the formation of trans -5,6-disubstituted-1,10-phenanthroline metal complexes, and (iv) application of 1,10-phenanthroline derivatives in metal-catalyze reactions such as palladium-catalyzed allylic substitution and aminohalogenation reactions; Zinc-catalyzed direct aldolreaction, and acetophenone reduction; Nickel-catalyzed Michael addition reaction.

The humanities have been defined as a group of academic subjects united by a commitment to studying aspects of the human condition and a qualitative approach that generally prevents a single paradigm from coming to define any discipline. OBJECTIVE: The study was designed to examine whether the gene expression profiles of fibroblast cell lines, established from the tumor and the normal tissue from the same breast, exhibit any similarities with the profiles of the original tissues. METHODS: Fibroblast cell lines were established from invasive ductal carcinoma (IDC) and ductal carcinoma in situ (DCIS) of the breast and the adjacent normal tissues. Isolated total RNA from the cell lines and tissues were used to prepare labeled cDNA which was hybridized to Becton Dickinson Atlas microarrays for obtaining profiles of expressed genes. The zebrafish is becoming an increasingly popular model for studies involving olfactory function, yet there is still much to be learned about the anatomy and circuitry of different cell types in the olfactory bulb. This study focuses on identifying the morphology and distribution of output neurons and interneurons in the olfactory bulb of adult zebrafish, Danio rerio . Furthermore, this investigation examines the cellular interactions of the primary output neuron, the mitral cell, and addresses the issue of neuronal plasticity by considering the structural stability of this cell type following loss of afferent innervation.

The specific properties of probability distributions on a circle require different definitions of several statistical concepts. For example, a median that can always be found for linear data not always exists on the circle. Several estimators of a circular median were proposed, lately by Otieno (2002), Otieno and Anderson - Cook (2003). Their work is, however, focused on the "preferred direction" which coincides with the median, mean and mode in the case of symmetric, unimodal distributions. This document outlines the creation of a searchable information system. The information system is comprised of a database that is searchable through a web interface. The database includes brief descriptions of patents and projects, associated with South Dakota universities, and their appropriate contact information. The web interface gives users an easy search venue to the data. The information system is intended to aid entrepreneurs and companies in the develop collaborative relationships with South Dakota universities. The design, development and populating of this database is the subject of this graduate project.

The dispersal of anthrax spores in October 2001 showed Americans that they are vulnerable to bioterrorism. The ineffective response to bioterrorism demonstrates that public health agencies do not have plans or training exercises in place to deal with this emerging threat. Although the CDC asked that the Model State Emergency Health Powers Act (MSEHPA or Model Act) be drafted to prepare the states for these emerging risks, critics like George Annas assert that the acts are “blatantly unconstitutional” (MSEHPA,2005,p.1). The Ecology Of The Peaks Of Otter Salamander (Plethodon Hubrichti) In The Contact Zone With The Redback Salamander (P. Cinereus), Andrew B. Kniowski

The Peaks of Otter Salamander Plethodon hubrichti is found only in the Peaks of Otter area in the Blue Ridge Mountains of Virginia where its range is completely surrounded by the Redback Salamander P. cinereus. In 2005 we conducted a mark-recapture study in the contact zone of P. hubrichti and P. cinereus. From a 10 × 10 m site a total of 349 (including 131 recaps) P. hubrichti and 229 (including 63 recaps) P. cinereus were collected. The number of salamanders collected at the surface correlated with the number of days without rainfall prior to a collection event which was …
