A Technological Theory Of The Arms Race, Lee Kovarsky

Although the "technological arms race" has recently emerged as a vogue-ish piece of legal terminology, scholarship has quite conspicuously failed to explore the phenomenon systematically. What are "technological" arms races? Why do they happen? Does the recent spike in scholarly attention actually reflect their novelty? Are they always inefficient? How do they differ from military ones? What role can legal institutions play in slowing them down?
In this Article I seek to answer these questions. I argue that copyright enforcement and self-help represent substitutable tactics for regulating access to expressive assets, and that the efficacy of each tactic depends on …

Unnatural Rights: Hegel And Intellectual Property, Jeanne L. Schroeder

The article challenges the common misconception that Hegel's legal philosophy supports the romantic view of intellectual property as an extension of personality or natural right. Instead, it argues that Hegel's framework, rooted in the concept of "abstract right," views property, including intellectual property, as a legal construct created to facilitate freedom and legal subjectivity. The analysis emphasizes the pragmatic and utilitarian aspects of adopting intellectual property regimes within a modern constitutional republic, while rejecting the notion of natural law and highlighting the realization of property rights through alienation and contract.

Science education reform initiatives emphasize 1) the value of concepts over facts; 2) the benefits of open-ended, inquiry-based problem-solving rather than protocols leading to a single correct answer; and 3) the importance of a multidisciplinary approach to teaching that is not confined by departmental boundaries. Neuroscientists should be at the forefront of this movement by the very nature of the discipline we study. Neuroscience is a relatively new field that integrates diverse subjects (anatomy, physiology, pharmacology, molecular biology, computer science, and psychology) and experimental advances are constantly changing and expanding our understanding of brain function. To date, global protection of biodiversity has been largely dominated by governmental actors. Ecosystems transcending state boundaries find themselves at the mercy of international agreements, for better or for worse. Steven Sanderson of the Wildlife Conservation Society (WCS) suggested for worse in The Future of Conservation, but he gave hope for more effective environmental conservation, if the private sector could gain more standing globally. The plan that Sanderson created for self-assertion of nongovernmental environmental groups describes approaches typically endorsed not by NGOs but by governments: global alliances, political strategy, human-centered conservation, and economic development. In this action research study I examined the relationship between the teacher, the students and the types of motivation used in mathematics. I specifically studied the mathematic teachers at my school and my seventh grade mathematics students. Motivating middle school students is difficult and the types of motivation can be as numerous as the number of students studied. I discovered that the teachers used multiple motivating tactics from praise, to extra time spent with a student, to extra fun activities for the class. The focus of my action research is to study the impact of student self-assessment and reflection on my 6th grade math students’ abilities to solve deep-thinking math problems, herein referred to as habits-of-mind, or HOM, problems. I investigated the way informal self-assessments and self-reflections impact student learning and motivation. I discovered that students are seldom stimulated to think about their own learning. When they are encouraged to do so, student self-assessments give students ownership of their own learning and provide them with a means for evaluating their growth. Students’ assessments of their work also gives teachers a meaningful indication of …

A decade ago the Advanced Placement (AP) program was introduced into the Canadian province of Newfoundland and Labrador. Initially, schools embraced this opportunity to provide their students with opportunities that were previously unavailable. However, within a few years the AP program was relegated to urban and large regional high schools. Few smaller, and particularly rural schools, were able to offer AP courses only to the brightest one or two students taking it as an independent study. In 1997-98, schools began to delivery AP courses in a web-based method. The purpose of the study is to examine the retention rates and …

This survey year saw the continuation of what has become a clear trend in Eleventh Circuit evidence decisions. In stark contrast to the days when the Eleventh Circuit rigorously examined district court evidentiary decisions and freely reversed those decisions, the Eleventh Circuit now studiously defers to district judges. The reason for this trend can be debated. Perhaps because most evidentiary issues addressed by the Eleventh Circuit arise in the context of criminal cases, and because Eleventh Circuit judges are more conservative today, the Eleventh Circuit is less likely to reverse criminal convictions, particularly on evidentiary grounds. By holding in State v. Herendeen that a patient could invoke the mental health privilege ("privilege") when the patient either received mental health treatment ("treatment") or such treatment was contemplated during the course of the psychotherapeutic relationship, the Georgia Supreme Court eliminated any remaining vestige of a "voluntariness" requirement for patients seeking to invoke the privilege. In doing so, the court overruled Georgia case law that had required a patient to demonstrate, in addition to a showing that treatment was received or contemplated, that the patient voluntarily sought the treatment. Carbonate in its various forms is an important component in blood and the cytosol. Since, under conditions that simulate therapy, carbonate reacts with cisplatin to form carbonato complexes, one of which is taken up and/or modified by the cell [C.R. Centerwall, J. Goodisman, D.J. Kerwood, J. Am. Chem. Soc., 127 (2005) 12768–12769], cisplatin-carbonato complexes may be important in the mechanism of action of cisplatin. In this report we study the binding of cisplatin to pBR322 DNA in two different buffers, using gel electrophoresis. In 23.8 mM HEPES, N-(2-hydroxyethyl)-piperazine-N′-2-ethanesulfonic acid, 5 mM NaCl, pH 7.4 buffer, cisplatin produces …

Geospatial ontology development and semantic knowledge discovery addresses the need for modeling, analyzing and visualizing multimodal information, and is unique in offering integrated analytics that encompasses spatial, temporal and thematic dimensions of information and knowledge. The comprehensive ability to provide integrated analysis from multiple forms of information and use of explicit knowledge make this approach unique. This also involves specification of spatiotemporal thematic ontologies and populating such ontologies with high quality knowledge. Seasonal modulation of the adrenocortical response appears to be ubiquitous in mid- to high- latitude vertebrates but has not been investigated in tropical vertebrates. Previous studies demonstrate that temperate passerines show seasonality in corticosterone secretion and corticosteroid binding globulin capacities. We examined seasonal and sex differences in the stress response in an equatorial population of Zonotrichia capensis, the only Zonotrichia that breeds in the tropics, and compared the results with those of northern Zonotrichia. Seasonal differences in tropical Zonotrichia would presumably be independent of photoperiod and thus directly related to such activities as reproduction and feather molt. In addition, we …

Global maps of land cover and leaf area index (LAI) derived from the Moderate Resolution Imaging Spectrometer (MODIS) reflectance data are an important resource in studies of global change, but errors in these must be characterized and well understood. Product validation requires careful scaling from ground and related measurements to a grain commensurate with MODIS products. We present an updated BigFoot project protocol for developing 25-m validation data layers over 49-km2 study areas. The hierarchical structure of natural systems can be useful in designing ecological studies that are informative at multiple spatial scales. Although stream systems have long been recognized as having a hierarchical spatial structure, there is a need for more empirical research that exploits this structure to generate an understanding of population biology, community ecology, and species-ecosystem linkages across spatial scales. We review studies that link pattern and process across multiple scales of stream-habitat organization, highlighting the insight derived from this multiscale approach and the role that mechanistic hypotheses play in its successful application. Studies of facilitation have primarily been limited to single mechanisms, species, or environments. We examined interacting mechanisms governing the facilitative effects of Pinus flexilis on two later successional understory species, Pseudotsuga menziesii and Ribes cereum, in different microhabitats and seasons at the ecotone between the Rocky Mountain forests and Great Plains grasslands in Montana, USA. In field surveys, 69% of Pseudotsuga and 91% of Ribes were located beneath P. flexilis even though P. flexilis subcrowns accounted for a small proportion of available habitat. For three years, we monitored the survival of Pseudotsuga and Ribes seedlings experimentally planted beneath …

We describe a method for surveying birds in river habitats that allows for rapid assessment across broad spatial scales and estimation of detection probabilities. Our river survey approach incorporates a double-survey technique, whereby observers in two canoes simultaneously survey birds along a river reach. Data are in the form of a two-sample mark-recapture history, and covariates suspected of influencing detection probabilities can be included in the modeling process and evaluated using information-theoretic approaches. We provide an example using the method along the Madison and upper Missouri rivers in Montana. Overall, detection probabilities for each observer ranged from 57% to 89%, …

A condensation sensing and control system was designed to detect condensation using a commercially available leaf wetness sensor (LWS). The leaf wetness sensor was a variable resistance grid-type that responded to moisture on the surface. A circuit was developed to compare the LWS voltage output to a user specified reference voltage, and operate a relay for possible switching of a humidity control device (for example a fan and/or heater). The condensation detection system operation was validated in an environmental chamber in the laboratory using a heat exchanger and water bath. Worldwide, freshwater is becoming scarce as the Earth's population increases, the effects of pollution and global warming shrink available resources, and agriculture demands rise. As theological communities offer distinctive contributions to the dialogue, theologians need to address the crisis and provide appropriate analysis and solutions from the perspective of "Blue Theology". This paper formulates such an approach, offering some of the first efforts made towards addressing the global water crisis through a theological lens.
