Genocide On The Airwaves: An Analysis Of The International Law Concerning Radio Jamming, Meghna Rajadhyaksha
Journal of Hate Studies
Using the Rwandan genocide as an example, this article makes a case for allowing the jamming of radios that are broadcasting hate speech in situations in which such hate speech would incite genocide. To this end, it discusses the law relating to freedom of speech and communication in international law and its relative position when applied to genocide. Further, it analyzes the traditional notions of state sovereignty to make a case for humanitarian intervention by radio jamming. Finally, it recommends the establishment of a body under the aegis of the UN with the mandate and equipment to jam incendiary broadcasts …

Self, Other And The Sociopolitical In Politically Active Women Survivors Of Domestic Violence, Molly Ann Hedrick

This research examined experiences with interpersonal, intrapersonal, and structural violence in politically active women survivors of domestic violence. This study also explored how (if at all) these women described processes which Freire (2003) called critical consciousness and liberating action, and what these women can tell us about the processes of change. Participants were 16 survivors of domestic violence recruited from Sisters Overcoming Abusive Relationships (SOAR) in Rhode Island. SOAR is an organization run entirely by survivors of domestic violence and provides political activism with the goal of ending domestic violence. I utilized a mixed-methods, transformative and social constructivist concurrent design. …

Workplace violence has always existed in the U.S.---indeed, during some periods of our history, fear, intimidation, and physical violence were commonplace in work settings. Contemporary expectations in industrialized democracies, however, are that all workers are entitled to a workplace free from recognized hazards. During the time period from the mid 1980s to the present, a range of actors from local, state, and Federal government, industry, labor, academic, as well as professional societies and organizations became active in the area of workplace violence. Government efforts have stopped short of regulatory efforts with an emphasis instead on symbolic and learning tools. The …

While steps have been undertaken in the last five years to better understand the problem of identity theft, there has been little research done in the areas of high tech crime victim profiling and prevention. Most studies focus on victim demographics without examining ways in which the victimization may have been facilitated technologically. Attempts to look at precipitating behaviors in the context of victimization are limited. As such, a weak empirical base exists on which to generate additional research and potential solutions to identity theft victimization. This dissertation shows how organizations, including local government and police, and residents within Seattle, Washingtons East Precinct define and police the contours of community, neighborhoods and public space. Under the rubric of public safety, these players create territorial geographies that seek to include only those who fit the narrowly conceived idea of a neighbor. Territoriality is exercised against the social Other in an attempt to build a cohesive community while at the same time excluding those who are seen as different or as non-conformant to acceptable behaviors in the neighborhood. I am delighted to be a part of this Symposium on Law and Adolescence. My talk today is about adolescent development and juvenile justice policy. Specifically, I will focus on why a legal regime that is grounded in scientific knowledge about adolescence and the role of criminal activity during this developmental period is better for young offenders and for society than the contemporary policy, which often pays little attention to differences between adolescents and adults.

In a recent speech to the American Bar Association, Justice John Paul Stevens "issued an unusually stinging criticism of capital punishment." Although he "stopped short of calling for an end to the death penalty," Justice Stevens catalogued a number of its "'serious flaws,'" including several procedures that the full Court has reviewed and upheld over his dissent – selecting capital jurors in a manner that excludes those with qualms about the death penalty, permitting elected state judges to second-guess jurors when they decline to impose the death penalty, permitting states to premise death verdicts on "victim impact statements," tolerating sub-par …

The modem debate on deterrence and capital punishment, now in its fourth decade, was launched by two closely timed events. The first was the 1976 United States Supreme Court decision in Gregg v. Georgia, which restored capital punishment after its brief constitutional ban following Furman v. Georgia in 1972. In 1975, Professor Isaac Ehrlich published an influential article saying that during the 1950s and 1960s, each execution averted eight murders. Although Ehrlich's article was a highly technical study prepared for an audience of economists, its influence went well beyond the economics profession. Ehrlich's work was cited favorably in Gregg …

The essay shows that the new deterrence studies are fraught with numerous technical and conceptual errors: inappropriate methods of statistical analysis, failures to consider several relevant factors that drive murder rates such as drug epidemics, missing data on key variables in key states, the tyranny of a few outlier states and years, weak to non-existent tests of concurrent effects of incarceration, statistical confounding of murder rates with death sentences, failure to consider the general performance of the criminal justice system, artifactual results from truncated time frames, and the absence of any direct test of the components of contemporary theoretical constructions …

Since the modern era, the discourse of punishment has cycled through three sets of questions. The first, born of the Enlightenment itself, asked: On what ground does the sovereign have the right to punish? Nietzsche most forcefully, but others as well, argued that the question itself begged its own answer. The right to punish, they suggested, is what defines sovereignty, and as such, can never serve to limit sovereign power. With the birth of the social sciences, this skepticism gave rise to a second set of questions: What then is the true function of punishment? What is it that we …

Conventional wisdom holds that the public supports harsh punishment of juvenile offenders, and politicians often argue that the public demands tough policies. But public opinion is usually gauged through simplistic polls, often conducted in the wake of highly publicized violent crimes by juveniles. This study seeks to probe public opinion about the culpability of young offenders as compared to adult counterparts through more nuanced and comprehensive measures in a neutral setting (i.e. not in response to a high profile crime or during a political campaign when the media focuses on the issue). Racial profiling as a defensive counterterrorism measure necessarily implicates a rights trade-off: if effective, racial profiling limits the right of young Muslim men to be free from discrimination in order to promote the security and well-being of others. Proponents of racial profiling argue that it is based on simple statistical fact and represents just smart law enforcement. Opponents of racial profiling, like New York City police commissioner Raymond Kelly, say that it is dangerous and just nuts.

Recent law and scholarship has claimed that the developmental limitations of adolescents affect their capacity for control and decision making with respect to crime, diminishing their culpability and reducing their exposure to punishment. Social science has focused on two concurrent adolescent developmental influence: the internalization of legal rules and norms that regulate social and antisocial behaviors, and the development of rational thought to frame behavioral choices and decisions. The political pursuit of global justice is not a worthy goal, and our aims in establishing international legal and political institutions should be more modest. The pursuit of justice in the international order is dangerous to the extent that it requires the establishment of powerful supranational agencies, or legitimizes greater and more frequent exercise of political, economic, and military power by strong states or coalitions. The primary concern in the establishment and design of all legal and political institutions should be not to secure justice but to limit power. It is a mistake to think that a distinction can be …

This article examines whether the use of the criminal penalty as a 'default' sanction for regulating directors' core duties in Singapore is excessive, and if so, whether civil pecuniary penalties ought to be introduced in the reform of the existing sanctions regime. Mental Disorders, Comorbidity, And Postrunaway Arrests Among Homeless And Runaway Adolescents, Xiaojin Chen, Lisa Thrane, Les B. Whitbeck, Kurt Johnson

This study examined the associations between lifetime mental disorder, comorbidity, and self-reported postrunaway arrests among 428 (187 males, 241 females) homeless and runaway youth. The analysis examined the pattern of arrests across five lifetime mental disorders (alcohol abuse, drug abuse, conduct disorder, major depressive episode, and posttraumatic stress disorder). The adolescents, ranging from 16 to 19 years old, were interviewed directly on the streets and in shelters in four Midwestern states using computer-assisted personal interviewing. Extensive self-reports of early life history, behaviors since running away from home, and diagnostic interviewing (UM-CIDI and DISC-R) were used to estimate possible disorders. There …

Engaging citizens in the deliberative process is essential to overcoming participatory apathy, cynicism toward government, and the apparent disconnect between citizens and decision-makers. AmericaSpeaks developed an electronic town meeting (ETM) designed to reconnect citizens and government. Ideally, the ETM affords citizens a means by which they can impact the policy-making discourse. This paper examines the extent to which AmericaSpeaks’ ETM enhances the prospect for deliberative democracy. Thirty minute structured interviews were conducted with twenty participants from Citizen Summit III, an ETM held in the District of Columbia in November 2003. How much of what we do is the result of our will, and how much the result of chance or luck or fortune? This is a decidedly un-decidable question, but one that needs to be asked. The general assumption seems to be that a person's "lot" in life is physically, morally, politically, even romantically linked to choice. But the use of the term "lot" betrays the underlying uncertainty of what "causes" our "lot", laying bare questions of responsibility, burden, and even explanation. Researchers have established that individual religiosity influences sexual behavior and that religious support can increase consistency between personal religiosity and behavior. Researchers are less certain, however, of the effect that religious friendship networks have on sexual behavior. In addition, the effects of network characteristics such as density and one’s position in a social network have not been established. This paper uses a network subsample of the National Longitudinal Study of Adolescent Health (Add Health) to examine the effect of friends’ religiosity on the probability of first sex. Citation analyses were carried out on master’s thesis in three disciplines, forensic psychology, forensic science and criminal justice, completed and deposited in John Jay library from 1991 to 2004. The aim was to determine the effect of availability of electronic journals on students’ choice of references. The number of journal citations and the ratio of journal articles to all citations was assessed. Criminal justice theses listed more citations that either science of psychology theses, but relatively fewer journal articles. An increase over time was seen in the number of journal articles cited and in the ratio of journal articles to …
