This paper describes a cyber-forensics course that integrates important public policy and legal issues as well as relevant forensic techniques. Cyber-forensics refers to the amalgam of multi-disciplinary activities involved in the identification, gathering, handling, custody, use and security of electronic files and records, involving expertise from the forensic domain, and which produces evidence useful in the proof of facts for both commercial and legal activities. The Size Of Cartel Overcharges: Implications For U.S. And Ec Fining Policies, John M. Connor, Robert H. Lande

The purpose of this article is to examine whether the current cartel fine levels of the European Union (EU) and the United States are at the optimal levels. We collected and analyzed the available information concerning the size of the overcharges caused by hard-core pricing fixing, bid rigging, and market allocation agreements. Data sets of United States cartels were assembled and examined. These cartels overcharged an average of 18% to 37%, depending upon the data set and methodology employed in the analysis and whether mean or median figures are used. What's The Hold-Up? Making The Case For Lifetime Orders Of Protection In New York State, Jennifer Rios

The note advocates for the implementation of lifetime or extended orders of protection in New York State to better safeguard domestic violence victims. It highlights the limitations of the current legal framework, which requires victims to repeatedly seek renewals of protective orders, and argues that longer or indefinite orders would reduce trauma and enhance safety. The analysis draws on comparative examples from states like New Jersey and California to support its proposal for stronger legal measures.

Female offenders often have had increased financial difficulties post-release because of lower levels of educational achievement and less job experience. Career programming may prove useful to female offenders by providing guidance with career decisions and strengthening career decision-making skills. The aims of this study were to investigate career decision-making skills and self-efficacy in the context of vocational programming for a group of female offenders. A pretest-posttest quasi-experimental design was used to examine scale scores for a group who participated in programming and a control group at the same correctional facility. Poverty, Inequality & Terrorism Relationship in TurkeyUsing empirical evidence criminological studies have identified a relationship between poverty and crime and many studies have concluded that a high crime rate is associated with a higher poverty rate. Other studies indicate that inequalities are a better determinant of crime than absolute poverty. Social disorganization theory, anomie strain theory and Marxist theory have been used to explain the phenomenon. Guided by the aforementioned theories and previous literature on crime, this study looks at the terrorism issue and explores whether a relationship exists between poverty, inequality and terrorist incidents. This dissertation focuses on student learning outcomes assessment in criminal justice programs in American colleges and universities. Particularly, this research sought to establish a baseline understanding about how criminal justice programs are measuring student achievement toward learning outcomes. The baseline does not include what students should be learning or how that learning should be assessed; it includes only what is actually happening in criminal justice programs in terms of how student learning is being assessed. Transforming Growth Factor-Β1 (Tgf-Β1) Induces Mast Cell Apoptosis, Farnaz Norozian

Mast cells are potent effectors of the inflammatory response, playing an important role in atopy, bacterial immunity, and animal models of arthritis, multiple sclerosis, and heart disease. Hence controlling mast cell numbers and responsiveness is essential for preventing inflammatory disease. This work demonstrated that the cytokine TGF-β1 is a potent inducer of mast cell apoptosis, a finding that was consistent for cultured mouse bone marrow-derived mast cells, peritoneal mast cells, and human mast cells. Cell death appeared to be the result of TGF-mediated repression of IL-3 receptor expression and function, leading to mitochondria1 damage and activation of an apoptotic cascade …

Understanding How African-American Middle School Students Cope With Peer Victimization: A Mixed-Methods Approach, Suzanne C. Linkroum

A mixed-methods approach was used to determine how African-American middle school students cope with peer victimization and to identify factors that inhibit and promote the use of prosocial coping strategies. In a previous study, participants had been categorized into four social clusters: well-adjusted, rejected, passively-victimized, or aggressively-victimized based on a cluster analysis of self-reported psychosocial variables. Interviews with a sub sample of 80 students focusing on identifying both how students thought they would respond and how they thought they should respond to hypothetical situations involving peer victimization were analyzed. The overall intent of this study is to illustrate how GIS and crime mapping methods can be applied to forensic evidence to better understand and comprehend spatial patterns that exist in these data. This study bridges common crime mapping principles such as hot spot mapping, exploratory data analysis, and spatial statistics to spatial forensic evidence investigation. In particular, forensic shoeprint evidence is examined and spatial relationships are analyzed using both exploratory and confirmatory statistical analysis. This study examines state domestic violence policies and their affect on state domestic homicide rates. This research builds on the literature in the area of policy strength and its impact on policy implementers, specifically examining seven of the domestic violence policies recommended by the 1994 and 2000 Violence against Women Acts. Policies were categorized as "coercive," "hortatory," or "catalytic" and data were collected from all fifty states and the District of Columbia. Survey research is a popular methodology used to gather data on a myriad of phenomena. Self-report victim surveys administered by the Federal government are used to substantially broaden our understanding of the nature and extent of crime. A potential source of nonsampling error, respondent fatigue is thought to manifest in contemporary victim surveys, as respondents become "test wise" after repeated exposure to survey instruments. Using a special longitudinal data file, the presence and influence of respondent fatigue in national self-report victim surveys is examined from three perspectives. On August 1, 2002, then Assistant Attorney General Jay S. Bybee signed for President Bush a memorandum of law concluding that some torture was not necessarily illegal if the President ordered it. This Essay examines how Bybee could arrive at a conclusion that is fundamentally at odds with both our national moral spirit and our law. In doing so, it cautions American lawyers to recognize the difference between what is "legal" and what is "arguably legal, " and to be aware of their own extra-legal biases when interpreting the law.

This correlational study investigates the incremental validity of the Reactive (R) composite scale of the Psychological Inventory of Criminal Thinking Styles (PICTS) relative to Psychopathy Checklist: Screening Version (PCL:SV) total score for predicting medium security federal adult male inmate adjustment over a 12 month period. Adjustment, the criterion variable, was operationalized as the number of incident reports received over 12 months. Archival data for 146 offenders were obtained for incident reports and categorized as aggressive or non-aggressive. Scores for the PICTS P and R composite scales were obtained from archival electronic files. Data for rating the PCL:SV were gathered from …

This article examines the possibilities and implications of employing virtual environments (VEs), immersive virtual environments (IVEs), and collaborative virtual environments (CVEs) in the courtroom. We argue that the immersive and interactive reality created by these tools adds significant value as a simulation of experience to enhance courtroom practice. The obvious boundaries between real and virtual enhance the attractiveness of these tools as technologies of rhetorical persuasion that can be used to demonstrate subjective perspective, strengthen or impeach the credibility of witnesses, and provide the trier of fact with a better understanding of each side's perception of the facts at issue. …

In this article the author explores whether the rule of forfeiture by wrongdoing is the post-Crawford panacea for victimless domestic violence prosecutions. Section II briefly discusses the Crawford decision and the revitalization of the Confrontation Clause. The author highlights Crawford's recognition of the rule of forfeiture by wrongdoing and the traditional concept of forfeiture by wrongdoing. Section III presents difficulties with the rule of forfeiture by wrongdoing in the domestic violence context. Application of the doctrine of entity criminal liability, which had only a thin tort-like rationale at inception, now sometimes instantiates a social practice of blaming institutions. Examining that social practice can ameliorate persistent controversy over entity liability's place in the criminal law. An organization's role in its agent's bad act is often evaluated with a moral slant characteristic of judgments of criminality and with inquiry into whether the institution qua institution contributed to the agent's wrong. Legal process, by lending clarity and authority, enhances the communicative impact, in the form of reputational effects, of blaming an institution for a wrong. …
