The Role Of Legal Uncertainty, Risk, Institutional Size, And Mission In Presidential Selection: Is The Trend To Lawyer-Presidents An Unmitigated Good?, Nora V. Demleitner
Touro Law Review
This Article builds on Patricia Salkin’s May It Please the Campus which documents the extent to which legally trained persons have led U.S. institutions of higher education since colonial times. It explains the perennial attraction of lawyer-presidents despite substantial changes in legal training, in the professional formation of attorneys, and the transformation of higher education, especially with the rise of the modern research university, governmental investment, and heightened regulation of colleges and universities. Governing boards are increasingly attracted to the skills ascribed to lawyers and their personal characteristics, including the common law appreciation for slow change. This Article highlights how …
Access Denied: The Injustice Of Plra Exhaustion, Rachel Kincaid
Access Denied: The Injustice Of Plra Exhaustion, Rachel Kincaid
Marquette Law Review
Law students learn to “think like a lawyer” by studying appellate decisions that contain extensive reasoning and result from vigorous advocacy by lawyers on both sides. These well-reasoned decisions allow students to learn how to distill legal rules from judicial opinions: to focus on the rationale behind a court’s decision so that they might be able to predict how the court would deal with a different factual scenario. But this focus on extensively reasoned and argued appellate court opinions obscures the access-to-justice crisis plaguing our legal systems; most people cannot even afford to pay a lawyer to represent them, let …

Decoding The Path Of Constitutional Exclusion In Wisconsin Digital Evidence Cases, Amelia Boruch
Decoding The Path Of Constitutional Exclusion In Wisconsin Digital Evidence Cases, Amelia Boruch
Marquette Law Review
Criminal cases involving novel digital evidence warrants often raise constitutional and suppression issues. As these constitutional issues become harder to resolve, resolution of the suppression issues becomes easier to predict. Where officers obtain warrants to use cutting-edge investigative techniques in the absence of any legal authority, it is unlikely that evidence obtained pursuant to those warrants will be suppressed under the exclusionary rule. Even if the exclusionary rule were “triggered,” the good faith exception would likely apply to preclude suppression. Either way, the outcome is clear: suppression is unlikely.
Confidence in the outcome of these suppression issues has seemingly taken …
Creating And Analyzing Topic Sentences With Chat Gpt, Raymond Rosas
Creating And Analyzing Topic Sentences With Chat Gpt, Raymond Rosas
Open Educational Resources
This assignment engages students in creating and analyzing AI-generated topic sentences using ChatGPT. By working with a shared textual dataset—in this case, the Comments & Discussion section of the article “If Hispanics Hate the Term ‘Latinx,’ Why Is It Still Used?”—students practice distilling key ideas into concise, coherent sentences that preview and structure content. In groups, students generate topic sentences with ChatGPT, then evaluate them for keyword inclusion, main topic, emphasis, and omissions. This exercise develops skills in clarity, coherence, stance-taking, and rhetorical analysis, while encouraging critical reflection on how AI summarizes and interprets text. The activity concludes with group …

Designing A Research Study: Controlling For A Variable And Using Chatgpt, Fritz Umbach
Open Educational Resources
This assignment uses a hypothetical society to help students understand the idea of “controlling for a variable” and practice applying it to a real-world research question. Students design a research approach to examine whether income differences are better explained by family background or by systemic prejudice, working within clear data limits. ChatGPT is used as a research guide to help students brainstorm, test, and revise their methods, while encouraging them to critically evaluate the usefulness and limits of AI-generated suggestions. The assignment emphasizes careful reasoning, clear research design, and thoughtful use of AI as a support for learning rather than …
Free Speech On The Web And Its Limits, Moris Stern
Free Speech On The Web And Its Limits, Moris Stern
Open Educational Resources
This assignment uses ChatGPT as a learning tool to examine the democratic justification and limits of free speech on the web. Students analyze arguments for and against online free expression through Kantian respect for persons and Utilitarian maximization of overall well-being. Using AI-generated historical and controversial cases, students evaluate whether specific instances of free speech are morally justifiable, challenge their own conclusions with AI-constructed counterarguments, and critically assess AI-generated summaries. The assignment emphasizes philosophical reasoning, ethical analysis, and reflective engagement with AI as an academic tool.

Introduction: The initiation of buprenorphine for patients with opioid use disorder (OUD) in the emergency department (ED) has been associated with improved outcomes including reduced ED visits and increased treatment engagement. Though both standard-dose (8 mg buprenorphine equivalent) and high-dose (24 mg buprenorphine equivalent) strategies to initiate buprenorphine have been used in the ED, no prospective trials comparing outcomes among patients receiving these treatments have been reported.
Methods and analysis: This multisite randomised clinical trial is a multisite double-blind, double-dummy, randomised clinical trial enrolling 360 emergency department patients with moderate-to-severe OUD. Enrolled patients will be randomised to one of two …

Experiential Spillover In Public Views Of Police And Courts, Emma Henderson, Matthew Mettler, Jeffery J. Mondak, Mark Peffley
Political Science Faculty Publications
Personal experiences with public officials influence how those officials are perceived. We question whether these experiential effects extend to other officials. If people draw on what they know to make inferences about unfamiliar evaluative targets, then interactions with one actor may shape evaluations of other independent actors. Focusing on police and courts, analyses of data from two surveys reveal that personal interactions with public officials produce spillover effects on appraisals of officials in different sectors. The findings indicate that experiential spillover constitutes an underappreciated force in public opinion, one that operates outside the control of the actors being evaluated.

The Covid-19 Pandemic: Predictors Of Inpatient Admission For People With Severe Mental Illnesses, Ashley Killoren
PCOM Psychology Dissertations
The purpose of the study was to identify differences in patterns of demographic and psychiatric symptoms among individuals with severe mental illnesses admitted to an inpatient psychiatric hospital 1 year before the quarantine shelter-in-place restriction order issued by a governor in the Northeastern United States, during the restriction order, and 1 year starting when all COVID-19 restrictions were lifted. A second goal of the study was to determine whether psychiatric admission rates changed by comparing admission rates before and during the quarantine order, and 1 year after all COVID-19 restrictions were lifted. This quantitative, retrospective, observational study was achieved by …

The Hidden Cost: Vicarious Trauma And Burnout In Professional Sex Offender Treatment Providers, Diazia Hughes
PCOM Psychology Dissertations
Professionals who provide treatment to individuals who have commuted sexual offenses are routine exposed to traumatic material, placing them at increased risk for both vicarious trauma (VT) and burnout. Despite growing recognition of these occupational hazards, limited research has examined the relationship between VT and burnout within this specialized population. The present study investigated the association between VT and the three dimensions of burnout (i.e. Emotional Exhaustion (EE), Depersonalization (DP), and personal Accomplishment (PA)) among licensed treatment providers working directly with individuals who have commuted sexual offenses. A cross-sectional correlational design was employed with a sample of 107 licensed providers …

A First Amendment Right To Know, David S. Ardia
A First Amendment Right To Know, David S. Ardia
Faculty Publications
This Article tackles an increasingly important question: Can police round up people on American streets and keep secret the names of those they detain without violating the First Amendment? Alarmingly, the government made this very argument in the summer of 2020 when it sought to break up Black Lives Matter protests occurring in cities across the country. Based in part on a Supreme Court decision from the 1970s involving access to prisons, the government argued that the First Amendment imposes no constraints on government secrecy. If it is true that the government can shield its exercise of police power from …
Roll The Dice: Do Fostered Youth Stand A Chance In Juvenile Justice?, Marina Rios
Roll The Dice: Do Fostered Youth Stand A Chance In Juvenile Justice?, Marina Rios
Capstone Showcase
Foster youth remain dramatically overrepresented in the juvenile justice system, accounting for up to almost a quarter of system-involved youth despite comprising less than 5% of the general population. Prior research on this subject indicates that foster youth tend to face disproportionately punitive responses, systemic challenges linked to trauma, placement, and instability, as well as limited access to diversion programs. This project aims to examine the disparities that foster youth face that result in juvenile justice involvement, as well as focusing on how structural barriers influence detention rates, sentencing outcomes, and opportunities for rehabilitation. Through an analysis of current literature, …

Kentucky Is Working: An Examination Of Higher-Than-Expected Labor Force Participation Rates In Kentucky, Grace E. Coleman, Gabriel M. Kalla, Joseph S. Matthews
MPA/MPP/MPFM Capstone Projects
This client-based capstone examines the drivers of higher-than-expected labor force participation rates across five counties in Kentucky, i.e., Kenton, Pendleton, Owen, Taylor, and Monroe counties. Our client, the Kentucky Chamber of Commerce, requested a qualitative analysis of semi-structured interviews with local stakeholders to identify and contextualize factors contributing to the five counties’ overperformance. Our findings suggest that factors such as collaboration and partnership; education and career pathway initiatives; and community champions all play important roles in supporting strong labor force participation. These insights can be used by other counties seeking to strengthen their local workforce.

Substance Abuse: Causes, Effects, And Treatment Approaches, Ambrea A. Watkins
Integrated Studies
Abstract
Substance abuse continues to be one of the most significant public health and social challenges facing the United States. Substance use disorders affect millions of individuals each year and have serious consequences for families, communities, and public systems such as healthcare and criminal justice. Addiction is widely recognized as a chronic brain disease that can alter behavior, decision making, and impulse control. Many individuals who struggle with substance abuse also experience related issues such as mental illness, homelessness, poverty, and involvement in the criminal justice system.
This research paper examines the causes, impacts, and treatment approaches related to substance …

Abstract
Kentucky’s Department of Probation and Parole needs additional officers. While officers are being added, caseloads continue to rise and officers in Kentucky are feeling exhausted. This research project focuses on examining some of the main issues behind the cause and effects that probation and parole officers are facing in Kentucky. The research lists the different aspects of both probation and parole and the dissentions between state and federal probation, since parole was abolished by the federal system 1987. The project includes new legislative reform movements taking place in attempts to reduce the high populations of Kentucky’s jails and prisons …
Legal Stories Without Villains, Alison Peck
Legal Stories Without Villains, Alison Peck
Law Faculty Scholarship
Lawyers have always been storytellers, and cognitive science is increasingly demonstrating that human beings are wired to learn through story. But legal stories may have a dark side if, as theorists have recently suggested, stories motivate pro-social action by reinforcing in-group identification and out-group hatred. In an increasingly divided polity, are we doomed to stories that drive us toward social disintegration? A solution to the legal storyteller’s dilemma may be found in an ancient source: Aristotle’s Poetics. By crafting legal stories that track the elements of the Tragedy as described by Aristotle and adapted by modern storytellers from Broadway …

Lost, Never Found: Syria's National Commission For The Missing, Sara Jordan
Loyola University Chicago International Law Review
This article discusses the enactment of Presidential Decree No. 19, enacted by interim Syrian President Ahmed al-Sharaa, which established the National Commission for the Missing. This body was created in May 2025 and is tasked with researching missing and forcibly disappeared persons, including creating a national database, providing legal and humanitarian support to victims’ families, and documenting cases. The Commission’s findings, however, cannot be used in criminal trials, and the international community, including groups such as Amnesty International, has voiced concerns about its potential ineffectiveness. Following a brief history of conflict under the Assad regime, this article offers an analysis …
The Intertemporal Law Doctrine’S Application To The Acquisition Of Colonies In The Americas, Kent Mcneil
The Intertemporal Law Doctrine’S Application To The Acquisition Of Colonies In The Americas, Kent Mcneil
All Papers
The intertemporal doctrine provides that international disputes have to be resolved in accordance with the international law that existed at the time the events giving rise to the dispute took place, not at the time the matter is adjudicated.1 It is thought to be impermissible to apply current standards to events that occurred in the past when different legal principles and rules were the norm. This doctrine applies as much to acquisition of colonies as to other international issues.2 So in order to determine whether a European nation acquired sovereignty over an overseas territory, it is necessary to determine and …

A Child On Stand: The Impact Of Experiencing Trauma On Children’S Testimonial Efficacy In Legal Proceedings, Morgan Sweger
Williams Honors College, Honors Research Projects
Children who are victims of physical, sexual, emotional, or verbal abuse are nearly always left deeply traumatized by such events. In extreme cases, abused children may be asked to testify against their abuser(s) in legal proceedings, recounting their trauma in front of a room full of strangers. For some, the trauma of abuse may influence a child’s ability to effectively recall and describe their experiences and for others, the process of participating in legal proceedings creates deeper wounds. Research has aimed to understand whether children lack the ability to contribute sufficient testimonies during investigations of abuse and how these investigations …

Neurobiological Determinants Of Psychopathy And Their Ethical Implications In Capital Punishment Cases, Brooklyn Lewis
Neurobiological Determinants Of Psychopathy And Their Ethical Implications In Capital Punishment Cases, Brooklyn Lewis
Williams Honors College, Honors Research Projects
This literature review examines the relationship between the neurobiological determinants of psychopathy and the ethical implications of applying capital punishment to violent offenders. Drawing on research from neuroscience, psychology, and criminal justice, the paper explores how structural and functional differences in brain regions associated with emotional processing, impulse control, and moral reasoning are linked to psychopathic traits. The review synthesizes findings on how these neurobiological factors may contribute to an increased risk of violent behavior while emphasizing that such influences are not deterministic. The paper further analyzes how neuroscientific evidence is interpreted within legal contexts, particularly in relation to assessments …
