Still, At The Margins, Emily Houh

Faculty Articles and Other Publications

An anthology by Austin Sarat is reviewed from a critical race perspective. The book's agenda is to show how the law seeks to work in the world, particularly when, why, and how legal decisions respond to social characteristics of those making them as well as those who are subject to them. Also emphasized are the complex relations among the law's various parts (e.g., judges and jurors, police and prosecutors, appellate and trial courts). The book is organized around the law's paradoxes, purposes of the law which can be somewhat mutually exclusive. Many of the leading voices in the law and …

Murder, Denunciation And Criminal Policing In Weimar Berlin, Sace E. Elder Jan 2006

Murder, Denunciation And Criminal Policing In Weimar Berlin, Sace E. Elder

Faculty Research & Creative Activity

In the years since 1989, there has been a wealth of scholarly research into role of denunciation in supporting Germany’s two twentieth-century authoritarian regimes. The shocking revelation after the collapse of East German communism and the opening of the Stasi archives that hundreds of thousands of GDR citizens had served as ‘informal collaborators’ with the secret police seemed to help explain how a relatively small police organization managed to create a culture of terror and conformity. By focusing on the cooperation of ordinary citizens with policing institutions in the surveillance of public and private behaviors, scholars of Nazi Germany have …

How Just Is The Union's Area Of Freedom, Security And Justice?:An Assessment Of The Normative Status Of International Fundamental Rights In The Union's Legal Order., Stephen Carruthers

Other resources

This thesis argues that international fundamental rights provide the most appropriate measure of justice for the Union’s area of ‘freedom, security and justice’ (AFSJ). However, it is argued that the normative status of international fundamental rights in Union law is undermined by the pursuit of the objective of autonomy of Union law and deficiencies in the legal mechanisms for giving effect to those rights.

This research analyses the sources and normative status of international fundamental rights in Union law, and in particular the AFSJ, both as currently constituted and under the Constitution, and assesses the robustness and effectiveness of the …

Prisons Of The Mind: Social Value And Economic Inefficiency In The Criminal Justice Response To Mental Illness, Amanda C. Pustilnik Jan 2006

Prisons Of The Mind: Social Value And Economic Inefficiency In The Criminal Justice Response To Mental Illness, Amanda C. Pustilnik

Faculty Scholarship

Can constructs of social meaning lead to actual criminal confinement? Can the intangible value ascribed to the maintenance of certain social norms lead to radically inefficient choices about resource allocation? The disproportionate criminal confinement of people with severe mental illnesses relative to non-mentally ill individuals suggests that social meanings related to mental illness can create legal and physical walls around this disfavored group. Responding to the non-violent mentally ill principally through the criminal system imposes at least 6 billion dollars in costs annually on the public, above any offsetting public safety and deterrence benefits, and imposes terrible human costs on …

Intimate Partner Violence And Rural Women, Amanda S. Adams Jan 2006

Intimate Partner Violence And Rural Women, Amanda S. Adams

Theses, Dissertations and Capstones

Over the past twenty years, awareness of the significant issue of intimate partner violence (IPV) has steadily increased. The deleterious consequences of IPV on physical and psychological health are well documented. However, much of our understanding of IPV is based on urban models, while little is known about the phenomena of IPV among rural women. In an attempt to address this deficiency within the literature, the present study explored the impact of IPV on rural women. Fifty-six women, between the ages of 18 to 69 comprised three distinct groups: the rural IPV victims recruited from the community (R-IPV group, n=13), …

Black And White And Read All Over: An Analysis Of Narratives In The O.J. Simpson Murder Trial, Martin Larry Lastrapes Jan 2006

Black And White And Read All Over: An Analysis Of Narratives In The O.J. Simpson Murder Trial, Martin Larry Lastrapes

Theses Digitization Project

The thesis examines the O.J. Simpson murder trial and analyzes the racial narratives that affected its outcome and the way it is perceived by the American public. By examining four books about the trial written by lawyers who served on the case, the analysis focuses on how race functions within each of the reconstructed narratives, as well as within the framework of the U.S. criminal justice system. The author argues that racial narratives affect how and why people can see the same event differently, a prime example of which is the O.J. Simpson murder trial. Representations of Mark Fuhrman, his …

The Illegality Of Resentencing, Quin M. Sorenson Jan 2006

The Illegality Of Resentencing, Quin M. Sorenson

Duquesne Law Review

The Supreme Court in United States v. Booker held that mandatory application of the United States Sentencing Guidelines is inherently unconstitutional, and, to preserve the federal sentencing structure, it excised several provisions of the United States Code that required district courts to adhere to the Guidelines in sentencing criminal defendants. Yet, the Court did not address one provision of the Code, 18 U.S.C § 3742(g)(2), that still requires district courts to adhere to the Guidelines in resentencing criminal defendants. This article explores this provision and concludes that it renders all resentencing in the federal system illegal, in violation …

Defense Counsel Rendered Ineffective Assistance At The Sentencing Phase Of A Capital Trial By Failing To Find Mitigating Evidence Contained In The Defendant's Prior Conviction Record: Rompilla V. Beard, April Trimble Jan 2006

Defense Counsel Rendered Ineffective Assistance At The Sentencing Phase Of A Capital Trial By Failing To Find Mitigating Evidence Contained In The Defendant's Prior Conviction Record: Rompilla V. Beard, April Trimble

Duquesne Law Review

The Supreme Court found that the assistance rendered during the sentencing phase of the defendant's capital trial fell below the standard of reasonable competence required by the Sixth Amendment when defense counsel failed to find mitigating evidence contained in the defendant's prior conviction record.

Rompilla v. Beard, 125 S. Ct. 2456 (2005).

Social Worker Qualifies As A Criminal Justice Expert For The Purposes Of Classifying A Sex Offender As A Sexually Violent Predator: Commonwealth V. Conklin, Jarrod T. Takah

Duquesne Law Review

To carry its burden of proving that a sex offender is a sexually violent predator, the Commonwealth need not provide a clinical diagnosis by a licensed psychiatrist or psychologist; the opinion of a qualified criminal justice expert suffices.

Commonwealth v. Conklin, 897 A.2d 1168 (Pa. 2006).
