Women, Drugs, And Crime, Angela M. Moe Jan 2006

Women, Drugs, And Crime, Angela M. Moe

Sociology Faculty Publications

Throughout feminist criminological scholarship, a concerted effort has been focused on understanding the backgrounds, criminal contexts, and programming needs of criminalized women. It is clear that criminalized women enter the justice system with a host of interconnected experiences and issues, ranging from childhood victimization, sexual assault, and intimate partner abuse, to homelessness, poverty, and illness. While these contribute to the motivations and rationales of women’s criminality, they are often aggravated by drug addiction. In a variety of ways, drug use is interlaced with women’s efforts to survive on a daily basis. This article examines the role drugs play in criminalized …

Mothers Who Kill: Number Of Victims, Sexism, And A Just World, Kelly Cook, Nicole Feldman, Rebecca Martin Jan 2006

Mothers Who Kill: Number Of Victims, Sexism, And A Just World, Kelly Cook, Nicole Feldman, Rebecca Martin

All Volumes (2001-2008)

High profile cases, such as those of Susan Smith and Andrea Yates, have drawn the attention of the public and scholars to the act of filicide, the killing of a child by his/her parent. Although relatively rare, filicide has occurred throughout history. Most experts agree mental illness is frequently an underlying factor when mothers kill their children. After giving birth women are at greater risk for psychiatric illness, specifically postpartum depression. Symptoms of postpartum depression include abrupt mood swings, suicidal thoughts, and thinking about hurting their new born child (Davidson, 2000). Postpartum depression occurs in only one woman out of …

Federal Criminal Law And Tribal Self-Determination, Kevin Washburn Jan 2006

Federal Criminal Law And Tribal Self-Determination, Kevin Washburn

Faculty Scholarship

Under the rubric of "tribal self-determination," federal policymakers have shifted federal governmental power and control to tribal governments in nearly all areas of Indian policy. Normatively, this shift reflects an enlightened view about the role of Indian tribes in Indian policy. As a practical matter, it has also improved services to Indians on reservations by placing functions with tribal service providers who are more knowledgeable and more accountable than their federal counterparts. Despite broad adoption of self-determination as the dominant federal policy, felony criminal justice on Indian reservations has remained an exclusive federal function, and a highly ineffective enterprise, according …

The Fundamental Law That Shapes The United States Health Care System: Is Universal Health Care Realistic Within The Established Paradigm?, William P. Gunnar

Annals of Health Law and Life Sciences

In this article, the author draws from his own experience as a doctor in describing the issues the uninsured patient population faces. Pointing out that neither the U.S. Constitution nor case law provides a positive right to health care, the author describes the parameters of federal health care funding and ultimately concludes that universal health care cannot be fully achieved in the U.S.

Reconceptualizing Elder Abuse: Treating The Disease Of Senior Community Exclusion, Donna Schuyler, Bryan A. Liang Jan 2006

Reconceptualizing Elder Abuse: Treating The Disease Of Senior Community Exclusion, Donna Schuyler, Bryan A. Liang

Annals of Health Law and Life Sciences

This article focuses on the phenomenon of elder abuse, which is one of the paramount symptoms of the larger community's failure to address the social, medical, and legal needs of the senior populace. Although there have been multidisciplinary efforts to address this problem, they are not responsive to the needs of the senior population itself. In response, the authors propose a model that takes into account the specific concerns of local senior communities and provides seniors and their stakeholder providers a stable infrastructure to ensure open, consistent, and effective participation and delivery of services.

Reformulating The Miranda Warnings In Light Of Contemporary Law And Understandings, Mark A. Godsey Jan 2006

Reformulating The Miranda Warnings In Light Of Contemporary Law And Understandings, Mark A. Godsey

Faculty Articles and Other Publications

Since Miranda v. Arizona was decided in 1966, much scholarly attention has been devoted to both the theoretical underpinnings and the real world impact of that decision. Little attention, however, has been paid to the substance or content of the warnings. The Supreme Court has often stated that the Miranda warnings requirement is a prophylactic rule that can change and evolve. However, in spite of 40 years of legal developments and practical experience, the content of these famous four warnings has never been modified or even been subjected to systematic scrutiny.

This Article proposes that the substance of the Miranda …

Interprofessional Collaboration Between Criminal Justice And Mental Health Practitioners Regarding Mentally Ill Offenders: Perception Of Collaboration, Christopher Sharp Jan 2006

Interprofessional Collaboration Between Criminal Justice And Mental Health Practitioners Regarding Mentally Ill Offenders: Perception Of Collaboration, Christopher Sharp

Electronic Theses and Dissertations

The federal program of deinstitutionalizing psychiatric facilities has resulted in a well documented, ever-increasing mentally ill population in the nation's prisons and jails. Historically, the criminal justice system has maintained a laissez-faire attitude toward the mentally ill, and only became involved with the mentally ill when a crime had been committed. As such, the President's Mental Health and Criminal Justice Consensus Project was developed to explore ways that the two systems could work together to address the growing problem of the mentally ill offender. However, challenges arise because the criminal justice system has typically been viewed as a loosely coupled, …

Exploring Demographic, Structural, And Behavioral Overlap Among Homicide Offenders And Victims, Lisa M. Broidy, Jerry K. Daday, Cameron S. Crandall, David P. Sklar, Peter F. Jost

Sociology Faculty Publications

Criminologists tend to focus their attention on the dynamics of offending, paying limited theoretical and empirical attention to the well-established relation between offending and victimization. However, a number of criminological theories predict similarities in the correlates and etiology of victimization and offending, suggesting substantial overlap across offender and victim populations. Empirical research confirms this overlap across offender and victim populations, at least among those involved in nonlethal incidents. This research explores whether similarities between offender and victim populations extends to homicide, using criminal justice, health care, and U.S. Census data linked to homicide offenders and victims in Bernalillo County, New …
